Main Street Fuquay Varina, NC 27526-2613 SUBJECT: Notice of Violation (NOV) Dry Clean Spot (920071C) Fuquay Varina, Wake County, North Carolina DSCA MMP -- Violation of 15A NCAC 02S .0202(b) Dear Mr. Patel: On September 22, 2016, Pam Moore, Compliance Inspector with the North Carolina Department of Environmental Quality (DEQ), Division of Waste Management (DWM), Dry-Cleaning Solvent Cleanup Act (DSCA) Compliance Program, conducted a compliance inspection at Dry Clean Spot. During this inspection, violations of the following state environmental regulation was documented: DSCA Minimum Management Practice (MMP) rules 15A NCAC 02S .0202(b) 1. Failure to maintain and/or make available to the Department required records pertaining to the wastewater treatment unit (atomizer, evaporator, carbon filter, or other equipment for the treatment of wastewater containing solvents) [15A NCAC 02S.0202(b)(1)]. Wastewater treatment unit filters must be changed according to the manufacturer’s recommendations and wastewater treatment unit maintenance and filter changes must be documented. Records shall be kept for a period of three years. The above listed violation and any future violations of any of the applicable DSCA MMP regulations are subject to the assessment of civil penalties of up to ten thousand dollars ($10,000) per day in accordance with North Carolina General Statute §143-215.104P.
