Evergreen Packaging, as an entity regulated by the North Carolina Department of Environmental Quality, is
providing notification we are converting from Evergreen Packaging Inc. to Evergreen Packaging LLC. The
change will be fully implemented by January 1, 2018.
Please accept this letter and attached Permit Name/ Owner Change form as written notification of a change in
company structure and request of Director approval concerning the Evergreen Packaging — Raleigh Plant's
coverage by General Permit No.NCG05000. While there is not truly a Buyer and Seller who can sign this
paper due to this just being a conversion to an LLC, 1, as the Raleigh Plant's Responsible Official, am signing
this letter to document the written agreement that permit responsibility, coverage, and liability will remain
with the facility as Evergreen Packaging LLC.
There will be no changes to the facility or facility's management, nor changes in the operations or
discharges as a result of the changes indicated with this notification.
We are asking for written response, at your earliest convenience, of concurrence with this notification and

Evergreen Packaging, as an entity regulated by the North Carolina Department of Environment
and Natural Resources, is providing notification they are converting from a Delaware C
Corporation (as Evergreen Packaging, Inc.) into a LLC (Evergreen Packaging LLC).
Please accept this letter and attached Permit Name Owner Change Form as written notification
of a change in company structure and request for Director approval concerning the Evergreen
Packaging — Raleigh Plant's coverage by General Permit No. NCG05000. While there is not
truly a Buyer and Seller who can sign this paper due to this just being a conversion to an LLC, 1,
as the Raleigh Plant's Responsible Official, am signing this letter to document the written
agreement that permit responsibility, coverage, and liability will remain with the facility as
Evergreen Packaging LLC.
There will be no changes to the facility or facility's management, nor changes in operations or
discharges as a result of the changes indicated with this notification.
Further, we are notifying there will be nominal changes in the corporate control of Evergreen
Packaging. Evergreen Packaging LLC's immediate parent company will be RenPac Holding
Inc. RenPac Holding Inc's parent company will be Reynolds Group Holding Inc.
This change is being coordinated as needed with the Secretary of State. This change is
expected to be completed and in effect by February 28, 2013. Should there

On December 9, 2011, a Compliance Evaluation Inspection (CEI) was conducted at the subject facility
by Mandy Hall of the Raleigh Regional Office. The assistance of Mr. Jason Williams was helpful and
appreciated. This inspection was conducted to determine your compliance with the subject stormwater
general permit. The following observations were noted during the inspection:
SITE DESCRIPTION
Evergreen Packaging is located on S. Wilmington Street in Raleigh, Wake County, North Carolina.
Stormwater generated at the facility is conveyed to Walnut Creek, Class C-Nutrient Sensitive Waters in
the Neuse River Basin.
INSPECTION SUMMARY
The subject permit expires May 31, 2013. Review of the records for the general permit indicated the
facility and stormwater discharge outfalls (SDOs) are maintained and the facility is in compliance will all
requirements of the permit. All outfalls were observed during the inspection and no problems were
noted. Mr. Williams indicated employee training is conducted annually and a test is administered to
employees at the end of the training. Under the NCG05 permit series, no analytical monitoring is
required; the facility is conducting qualitative monitoring as required.

on March 31, 2003. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by early spring of 2003. Once the permit is reissued. your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier. we are informing you in
advance that your permit coverage will be expiring. Enclosed you will find a Permit Coverage Renewal
Application Form. The application must be completed and returned by October 2, 2002 in order• to assure
continued coverage under the general permit. Due to staff and budget constraints, letters confirming our receipt of
the completed application will not be sent.
Failure to request renewal within the time period specified. may result in a civil assessment of at least $250.00.
Larger penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your
facility without coverage under a valid stormwater NPDES permit would constitute a violation of,NCGS 143-215.1
and could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to :dl operators of industrial
facilities in anv of the I I categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify -a condition of "no exposure", i.e. the facility, industrial
materials and operations are not exposed tostormwater, you can apply for the no exposure exclusion. For additional

If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed

Your facility is currently covered for stormwater discharge under General Permit NCG050000.
This permit expires on August 31, 1997. The Division is currently reviewing a number of
alternatives for continuing the stormwater coverage given under this permit. These alternatives
include:
• Revising and reissuing the existing stormwater general permit.
• Developing new stormwater general permits to better handle these facilities.
• Developing rules that would allow your stormwater discharge to be permitted by rule
rather than requiring a permit. (Even if permitted by rule, your facility would still need
to maintain a Stormwater Pollution Prevention Plan and perform visual monitoring as
required by your current permit.)
It is anticipated that this process could take up to two years to fully implement. During this time
your current General Permit will continue in force and effect, even though the expiration date has
past, in accordance with 15A NCAC 211 .127(e) and Part II, Section B. # 8 of your permit. It
will not be necessary for you to apply for a permit renewal or pay any permit fees at this time.
We have attached a "Permit Information Update" form which includes the information we
