(CSXI) Charlotte Terminal located at 5430 Hovis Road in Charlotte, North Carolina. Included below is a brief discussion of the CEI findings. Storm Water Pollution Prevention Plan (1) The permittee did not provide the latitude and longitude coordinates of the point of discharge on the USGS map. (2) The permittee did not include the location of the storm water outfall on the site map. (3) The permittee has not fully implemented the Storm Water Pollution Prevention Plan (SPPP). (4) The permittee did not provide a complete feasibility study. Response: (1) There are no point source discharges associated with industrial activities located at the facility as defined under the General Permit (NCG080000). The General Permit is applicable to owners or operators of storm water point source discharges associated with vehicle maintenance activities. All storm water associated with industrial activities at the facility, including vehicle maintenance and material storage, are collected by a trench drain from the maintenance pad and directed to an aboveground oil/water separator unit. The oil/water separator discharges to the municipal sanitary sewer system. Therefore no coordinates were located on the USGS or facility map included in the SPPP since there are no industrial storm water discharges from this facility. (2) Pursuant to 40 CFR 122.26(a)(1)(ii), a storm water outfall that requires coverage under the permit includes discharges from industrial activities. Industrial activities, as applicable to transportation facilities, include only those portions of the facility that are either involved in vehicle maintenance or equipment cleaning operations (as defined in 40 CFR 122.26(b)(14)(viii)). The maintenance pad at the facility (identified as Drainage Area 04 on the SPPP facility map) includes industrial activities as defined above; however, storm water discharges are routed to the oil/water separator and to the municipal sanitary sewer system. A storm water outfall associated with industrial activities does not exist at the facility. Additionally, the facility utilizes catch basins, underground piping, and a storm water detention basin to convey storm water discharges not associated with industrial activities. CSXI will update the SPPP facility drawing to include storm water conveyances and non -regulated discharge points from the facility to provide clarification. (3) The SPPP was last updated in December 2008. Inspections are performed semi-annually and documentation is maintained in the environmental filing system located at the facility office. The documentation includes information regarding the industrial activity area (Industrial Area 02) and the oil/water separator. Best management practices have been implemented at the facility as outlined in the SPPP. CSXI has implemented and met the requirements of the SPPP. (4) Section 5.4 of the SPPP was last updated 12/09/08 and includes a feasibility study which states the following: "Storm water collection devices are evaluated, installed, and removed as facility operations evolve. As feasible methods to reduce the volume of storm water collected from exposed materials and industrial activities are identified, they are implemented." The facility was evaluated in 2006 and it was determined that current operations needed to be rearranged to meet permit and regulatory requirements. Construction of the maintenance pad and installation of the oil/water separator was completed in mid-2008 to eliminate storm water discharges from industrial activities. Qualitative Monitoring The permittee did not provide qualitative monitoring documentation for review during the storm water inspection. During the inspection, an outfall was observed from the detention pond on site. Ms. T. Grumbly, environmental consultant for the permittee, stated the detention pond rarely discharges. The permittee should recognize the discharge point from the detention pond as an outfall and conduct semi- annual qualitative monitoring (even if "no flow" is recorded on the qualitative monitoring forms during the 6-month monitoring period). Response: The detention pond does not receive storm water runoff associated with industrial activities. The discharge point includes storm water collected from a chassis staging area. Chassis are pieces of equipment specifically designed for movement of containers by highway. No industrial activities occur in this area. We will update the SPPP drawing to show this as a non -regulated discharge point. Analvtical Monitorin The permittee should recognize the discharge point from the detention pond as an outfall. The permittee is only required to conduct analytical monitoring at vehicle maintenance areas if the facility uses more than 55 gallons of new motor oil per month when averaged over a calendar year. According to facility personnel, the facility does not use more than 55 gallons of new motor oil per month when averaged over a calendar year. Response: As indicated, analytical monitoring is not required for this vehicle maintenance area. As discussed above, the detention pond does not receive industrial storm water as defined in 40 CFR 122.26(b)(14)(viii) and should not be considered an "outfall" but as a non -regulated discharge point. The SPPP drawing will be updated to show the detention pond outfall as a non -regulated discharge point. Permits and Outfalls During the inspection, an outfall was observed from the detention pond on site. Ms. T. The permittee should recognize the discharge point from the detention pond as an outfall. 2 Response: The detention pond non -regulated discharge point does not receive industrial storm water and therefore is not subject to requirements under the General Permit (associated with activities that have vehicle maintenance areas). This inspection was conducted as part of a cooperative working agreement between Mecklenburg County and the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in compliance with the City's NPDES Permit, NCS000240, Part lI Section H. Thank you for your assistance and cooperation during the inspection. The inspection found that CSX Intermodal facility has developed and implemented a Stormwater program and this Office commends the permittee's efforts to ensure compliance with - your NPDES permit. However, deficiencies were noted as detailed in the Stormwater Pollution Prevention Plan and Qualitative Monitoring sections of the attached report. It is requested that a written response be submitted to this Office by May 15, 2009, addressing the above -noted deficiencies as detailed in the enclosed report. In responding to the violations, please address your comments to the attention of Ms. Marcia Allocco at the letterhead address. In addition, elevated concentrations of zinc, copper, and turbidity were also detected as compared with the Division's benchmarks developed for individual stormwater permits (copper - 7 µg/L; zinc - 67 µg/L; and turbidity — 50 NTU). These values also exceed the applicable stream standards (copper - 7 µg/L and zinc - 50 µg/l_ [toxic substances], and turbidity 50 NTU). Since the stormwater sample was not collected in -stream, the stream standards do not apply; however, these standards can be used to indicate the potential of your runoff to impact the receiving stream.
