This inspection was conducted as part of a cooperative working agreement between. Mecklenburg County and the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in compliance with the City's NPDES Permit, NCS000240, Part [I Section H. Thank you for your assistance and cooperation during the inspection. The follow-up inspection found that Norfolk Southern Railway Company has implemented the corrective actions as stated in the permittee's response letter dated September 19, 2008. The corrected actions included: Re-routed Equipment Wash Bay condensate line to the wastewater treatment plant drainage system. • Relocated used batteries to watertight containers in the hazardous waste storage area. • Clarified that the empty barrels stored outside near the wastewater treatment plant are used for metal scrap and not for chemical storage. • Oil spills and impacted soils in the Material Storage Areas have been removed and disposed of properly. These areas are inspected on a weekly basis with prompt removal of spills. • Boiler room vent lines that may discharge blow down were removed with the installation of a new boiler. • Clarified that the line plumbed to storm drain at Scale House is a sump pump discharge pipe. • Documented feasible alternatives in the Stormwater Pollution Prevention Plan. Equipment washing, painting, and paint removal from equipment also occurs on site. Hydraulic fluid is drained from maintenance equipment on site. The facility is a small quantity generator of hazardous waste, primarily mineral spirits. This facility covers Norfolk Southern's Piedmont Division and operates 24 hours a day, 7 days a week. The on -site wastewater pretreatment plant (including the oil/water separator) is permitted to discharge to Charlotte Mecklenburg Utilities sanitary sewer system, Haz-Mat Transportation and Disposal collects and disposes of used oil and antifreeze. Compliance History: A MCWQP file review revealed that on January 2, 2004 MCWQP investigated a 5000-gallon wastewater spill at the facility. The wastewater reached an unnamed tributary of Little Sugar Creek. A Compliance Evaluation Stormwater Inspection was conducted on April 16, 2008, by Mecklenburg County Water Quality Program and a Notice of Violation was issued by the Division of Water Quality for the inspection. Industrial Operations/City of Charlotte Stormwater Ordinance Review: Material Storage Area — Immediail to the west and north of the detention basin is a large material storage area that is located outside on bath concrete and gravel surfaces. Large and small equipment, including engines and engine parts, are stored outside and exposed to stcrmwater in this area Minor areas of standing oil and absorbent material was observed on the concrete beneath three stored engines. Stormwater in this area flows across the storage area and into the detention basin by sheet flow. The permitteelfacility personnel should continue to ensure regular inspections of the Material Storage Area and immediately remove and remediate all spills (as required by Part ll, Section A, Item #4 of the permit). Material Storage — South of the Storehouse Building, large and small equipment parts are stored outside and exposed to stormwater. Items stored included alternators and starters. Minor spills were observed on the pavement beneath the stored materials. The permitteelfacility personnel should continue to ensure regular inspections of the Material Storage Area and immediately remove all spills (as required by Part II, Section A, Item #4 of the permit). During the inspection, standing water was observed in the storm drain pipe that discharges into the detention basin. Heavy erosion and sedimentation was observed along the slopes of the detention basin. The permitteelfacility personnel should conduct proper maintenance of the on -site stormwater detention basin (as required by Part III, Section C, Item #1 of the permit) . The following responses correspond to comments presented in the Notice. Comment: Equipment Wash Bay (condensate line connected to storm water down spout) —Norfolk Southern shall remove all illicit connections and immediately discontinue discharges to the storm drain system, Response: NSRC will re-route the line to the wastewater treatment plant drainage system in the near future. NSRC is currently in the process of hiring a contractor to complete this work. Comment: Battery Storage (behind the Heavy Repair Shop) — Norfolk Southern should consider storing used batteries in a location not exposed to storm water. Response: NSRC stores batteries in watertight containers in the hazardous waste storage area. The batteries from behind the Heavy Repair Shop have been re -located to these containers. Comment: Empty Barrels (near the wastewater treatment plant and open) — Norfolk Southern should implement procedures for proper storage of empty barrels to prevent pollution discharges. Response: These 55-gallon drums have been removed. NSRC keeps empty drums sealed and stored in designated areas pending proper disposal. Comment: Used Oil Tank (rust spot observed on supply line) -- Norfolk Southern should conduct proper maintenance on storage tanks to prevent potential pollution discharges. Response: NSRC will have the rust spot removed and the supply line painted within two weeks. Comment: Material Storage Areas (staining and product leaks observed around some stored equipment) — Norfolk Southern should conduct regular inspections of the Material Storage Area and immediately remove all spills. Norfolk Southern shall properly remove all spills and impacted soils as per the Oil Pollution and Hazardous Substances Control Act of 1978 (NC G.S. 143-215.75). The facility should consider covered storage with spill containment for oil or greasy materials. Response: NSRC has cleaned up the staining and product leaks. Stained soils were removed for proper disposal by a contractor per NCGS 143-215.84(a), It is not economically feasible to cover the material storage areas. Spill containment structures such as curbing or dikes in the material storage areas would create safety hazards and impede operations. Material storage areas are observed daily and inspected on a weekly basis. Any spills that are observed will be cleaned up immediately. Comment: Boiler Room and Scale House (boiler vent lines discharge to storm drain system) — Norfolk Southern shall remove all illicit connections and discontinue all illegal discharges to the storm drain system. Response: NSRC will remove the boiler system by the end of the year. 2 Comment: The permittee has not documented an evaluation of feasible alternatives to current practices in the SPPP. Response: The SPPP will be updated to include a more comprehensive evaluation of feasible alternatives to current practices within two weeks. Comment: The stormwater outfalls were last evaluated for the presence non-stormwater flow on April 28, 2006. NOTE: The new general permit requires that this certification be conducted annually. Response: NSRC will conduct a non -storm water evaluation as soon as possible. Comment: Heavy erosion and sedimentation was observed along the slopes of the detention basin. The facility should conduct proper maintenance of the on -site stormwater detention basin. Response: NSRC will remove sediment from the basin, re -contour its slopes, place rip rap and then seed it with grass to prevent future erosion. NSRC is currently in the process of hiring a contractor to complete this work. The samples analyzed were grab samples collected during the sampling investigation performed on June 20, 2008, by Ms. Heather Sorensen and Mr. Chris Elmore of Charlotte- Mecklenburg Storm Water Services (CMSWS). This sampling investigation was conducted as part of a cooperative working agreement between Mecklenburg County and the Division of Water Quality. In addition, the sampling investigation was conducted on behalf of the City of Charlotte in compliance with the City's NPDES Permit, NCS000240, Part II Section H. The enclosed monitoring results indicate that the stormwater discharged on June 20, 2008, contained an elevated concentration of total suspended solids compared with the benchmark concentration contained in Stormwater General Permit NCG080000 and your Certificate of Coverage under this permit. Please review the requirements of your stormwater permit and take the required steps/actions to reduce the concentration of total suspended solids leaving your site. Through the development and implementation of stormwater management programs it is the Division of Water Quality's expectation that stormwater discharges are not impacted by the industrial activities of the NPDES permit holders. In addition, through discussions with the CMSWS inspectors it is the understanding of this Office that the primary industrial activity that occurs at the Liddell Street facility is the manufacturing of railroad track maintenance equipment. This industrial activity (manufacturing of industrial and commercial machinery) is covered by Stormwater General Permit NCG030000 - Metal Fabrication and would not be covered as an approved activity under the current stormwater permit at the site, NCG080000 — Transit and Transportation. The hazardous materials generated by the subject facilities consist primarily of paint waste and spent cleaning solvents. The material is collected and stored in 55 gallon drums. Each facility has a dedicated hazardous material storage area. Two contractors are used for the transport and disposal of the facilities hazardous waste, Safety - Kleen (Laidlaw Environmental) of Columbia, S.C. and A&D Environmental of High Point, N.C. The Intermodal facility (NCG080619) averages 2 shipments per year and the Roadway Shop (NCG080620) averages 12 shipments per year.
