Based on the information provided and a June 27, 2017 site inspection, we are approving this request. In accordance with 40 CFR § 122.21(g)(7), you are authorized to sample outfalls number 003 and 005 as representative for the entire site. This approval is effective with the next sampling event. Please append this letter to your Stormwater Pollution Prevention Plan (SPPP) or permit to document that representative outfall status has been approved. if changes in drainage areas, structures, 'processes, storage practices, or other activities occur that significantly alter the basis of this approval, representative outfall status may no longer be valid. You should either resume sampling at all SDOs, or reapply to this office for representative outfall status based on updated information. HMTC received written notification by NCDEQ dated August 2nd, 2016 stating that NCDEQ will conduct a site evaluation for consideration of the requirements mentioned in Tier Three. HMTC has conducted in-depth analysis of copper and zinc levels in the stormwater run-off from its facility. The site has implemented corrective actions in an effort to reduce the amount of copper and zinc released to the stormwater discharge. Additionally, HMTC has contracted Amec Foster Wheeler (AFW) to evaluate the collected data and perform a site inspection to determine if additional feasible improvements can be implemented. AFW's report is included with this letter. It is HMTC's belief that most copper and zinc present in the stormwater run-off is due to factors outside of its control. For example, dust generated by the nearby rock quarry, brake dust from vehicles, and zinc from service vehicle's tires are impacting both copper and zinc levels. HMTC has exhausted all possibilities within the site's control to achieve compliance. HMTC is an ISO 14001 certified facility and recognized by the North Carolina Department of Environmental Quality as an Environmental Steward. The purpose of this letter is to follow-up on information contained within the Stormwater Compliance Inspection Report for Corning Optical Communications — Hickory Manufacturing and Technology Center (HMTC) dated 3/17/15. Per our earlier discussion regarding the report, I am enclosing information applicable to Stormwater Discharge Outfall (SDO) 4. The Compliance Report states that representative outfall status for SDO 5 is not valid at this time since the site condition has changed. Please note that SDO 5 has been included in the stormwater monitoring requirements by HMTC. The SDO that was exempt from sampling requirements is SDO 4. HMTC was provided information in an e-mail dated 8/5/2008 where DENR stated - If there are no emissions from industrial activity happening inside or any other industrial activity exposure to the stormwater running off this roof -- or between where those drains and where the runoff leaves at the outfall(s) -- the outfalls that drain the roof runoff are exempt from the NPDES permitting requirements all together. Details related to the exemption are listed below: SDO 4 only captures water from the east warehouse roof drains and warehouse office roof. Attached is a site drawing of HMTC's stormwater conveyance system, an expanded view of SDO 4, photos of the warehouse roof with slope to the east drains, and the downspouts leading underground to SDO 4. There are no industrial activities that impact stormwater run-off at SDO 4. Please note that HMTC has not claimed representative status for this outfall. Sampling at the outfall has not been performed based solely on the exemption statement provided by Mrs. Polly Lespinasse. • In 2008, HMTC did complete a construction project that combined two outfalls on the east side of the facility. At that time the SDO's were renumbered and SDO 5 was © 2015 Corning Incorporated. All Rights Reserved. CORNING changed to SDO 4. A letter and drawing was provided to NCDENR communicating the change. HMTC is requesting DENR provide confirmation that SDO 4 is still exempt from quantitative monitoring based on the exemption provided by DENR in 2008. The revised drawing depicts actual discharge points for HCF's seven stormwater outfalls. The drawing is being submitted as a continual improvement of HCF's Environmental Management System. In addition, HCF is requesting that outfall 4 be exempted from future sampling requirements. This outfall receives run-off water from the warehouse operations building. HCF's warehouse is a non manufacturing structure. Previous assessments of this outfall, for non- stormwater discharges, have proven to be consistently dry. HCF also requests that outfalls 6 and 7 be combined as one sampling point. As reflected by the site map, outfall 6 is connected in its entirety to outfall 7. Due to this reason, outfall 7 is a true representation of both outfalls and should therefore be identified as one sampling point. Rex Gleason, Supervisor WQ-MRO r PREPARED BY: Pete Colwell, WQ-MRO SUBJECT: Enforcement Package and Recommendation Stream Standard Violations SS Corning Cable Systems LLC Catawba County This enforcement recommendation is a result of the following investigation findings: Corning Cable Systems LLC filled and culverted approximately 2360 linear feet of unnamed tributaries to Clark Creek, Class "C" waters. Catawba River Basin. This impact occurred prior to securing the appropriate 404 permits from the U.S. Army Corps of Engineers and a 401 Water Quality Certification from the Division of Water Quality. Site inspections by DWQ staff on February 6, 2001, March 14, 2001, May 10, 2001, July 26, 2001, and December 11, 2001 confirmed that unnamed tributaries to Clark Creek had been filled without benefit of the appropriate 401 Water Quality certification. Accordingly, best usage, which includes aquatic life propagation and biological integrity, wildlife, and secondary recreation, had been removed because the streams have been illegally removed. It is therefore the recommendation of the Mooresville Regional Office that Corning Cable Systems LLC be assessed civil penalties in accordance with NCGS 143-215.6A. It is also recommended that enforcement costs ($568.39) incurred during the investigation be recovered. If you have any questions concerning this report, please advise. The geomorphology of streams includes riffle -pool complexes, channel sinuosity, and many different types of stream floor substrate (cobble, gravel etc.) The trophic structure of a stream (including primary producers, periphyton, and heterotrophic decomposers) is coincident to and dependent upon the above mentioned stream traits. French drain systems, culverts, and back -filling of a stream removes all of the diverse habitat necessary for the propagation of aquatic life. Also, a culverted stream is devoid of biological integrity due to the destruction of the above mentioned stream characters. In addition, a stream provides wildlife benefits. The canopy cover and the many different aquatic habitats including root -wads, pools, riffles, submerged rocks and logs, and leaf beds, all provide home -range and foraging habitat for wildlife, including both aquatic and terrestrial fauna. A filled stream has no such usage. 4. The cost of rectifying the damage: DWQ personnel have investigated the site to determine if the channels housed significant biotic function. The two stream channels exiting the fill were determined to be perennial with aquatic life below the impact. All upstream waters have been filled. Staff estimates from topography maps that as much as 500 linear feet of perennial stream has been impacted and would require compensatory mitigation. Payment into the Wetland Restoration Program for 500 feet of stream would be $62,500. The cost of installing appropriate stormwater treatment is unknown. 5. The amount of money saved by noncompliance: Since it was determined that mitigation would be required for some of the impacts, the cost of paying into the Wetland Restoration Program would be $62,500.00 for 500 linear feet of impact. The cost of submitting a 401 Water Quality Certification application to DWQ is $475.00. Corning Cable Systems LLC developed the site without the stormwater treatment that would have been required had they gone through the 401 Water Quality Certification process. Corning Cable Systems LLC was able to develop the site for the purpose of a large manufacturing facility in less time than if they would have applied for a 401 Water Quality Certification and been subject to DWQ review. Accordingly, money was saved by not complying with requirements that other developers (their competitors) are required to follow. 6. Whether the violations were committed willfully or intentionally: Corning Cable Systems LLC was made aware of the potential need for authorization in the July 25, 2001 letter from the Mooresville Regional Office. 7. The prior record of the violator in complying or failing to comply with programs over which the Environmental Management Commission has regulatory authority: Another meeting was held on December 11, 2001 to try to resolve the violations. Mr. Robert Whitlock, Plant Manager for the new Corning Cable Systems building, Mr. Steve Chapin with the US Army Corps of Engineers, Mr. Danny Smith from the Division's Wetlands / 401 Unit, and Mr. Pete Colwell with the Mooresville Regional Office were at the meeting. An effort was made to reach a compromise in which Corning would assume some responsibility for the stream impact to "important channels", pay mitigation, and install the appropriate stormwater treatment. Mr. Whitlock insisted that Corning had done nothing wrong, and Corning would stand by the environmental assessment that was done. The new building is now occupied and in operation. 11. Mitigating circumstances: None. 12. Corning Cable Systems LLC is a "person" within the meaning of G.S. 143- 215.6A pursuant to G.S.143-212(4). B. The unnamed tributaries to Clark Creek are located on the site known as Corning Cable Systems LLC and constitute waters of the State within the meaning of G.S. 143-212(6). C. Corning Cable Systems LLC violated 15A NCAC 213 .0211(2) by placement of earthen fill in approximately 2360 linear feet of stream channels such that usage of the surface waters was removed. D. Coming Cable Systems LLC may be assessed civil penalties pursuant to G.S. 143-215.6(A)(a)(1) which provides that a civil penalty of not more than twenty- five thousand dollars per violation may be assessed against a person who violates any classification standard, limitation, or management practice established pursuant to G.S. 143-214.1, 143-214.2, or 143-215. E. The State's enforcement costs in this matter may be assessed against Corning Cable Systems LLC pursuant to G.S. 143-215.3(a)(9) and G.S. 14313-282.1(b)(8). F. The Director, Division of Water Quality, pursuant to delegation provided by the Secretary of the Department of Environment and Natural Resources, has the authority to assess civil penalties in this matter. That letter also explained the requirements for Division of Water Quality (Division) authorization and the 401 Water Quality Certification application process. Since, that time no correspondence about this site was received and there is no record of authorization for impacts at this site. On February 6, 2001, Mr. Pete Colwell with this office made a site inspection of the project and found that stream channels had been filled, the site filled, and building construction was well underway. Two stream channels were found flowing out from under the fill at the southwestern part of the project. Mr. Colwell documented fish in the stream channels below the fill. Mr. Jim Chastain with H & M construction indicated that there were springs or seeps in the hill slope that were filled with rock to carry water under the construction site. From the grading plans it appears that as much as 2,360 linear feet of stream channel may have been impacted_ The above activities require a 401 Water Quality Certification from the North Carolina Division of Water Quality (DWQ) in accordance with 15A NCAC 2H .0500. Authorization for these impacts has not been issued by the DWQ. In addition, the impacts to the unnamed tributary to Clark Creek, a Class C waters, constitutes a violation of 15A NCAC 2B .0211(2) which states: "Conditions Related to Best Usage. The waters will be suitable for aquatic life propagation and maintenance of biological integrity, wildlife, secondary recreation, and agriculture; sources of water pollution which preclude any of these uses on even a short- term basis will be considered to be violating a water quality standard:" This office requires that you respond in writing within 15 days of this notice. Mr. Pete Colwell from this office estimated from grading plans that as much as 2.360 linear feet of stream channel may have been impacted. In your response to the Notice of Violation you indicated that an environmental report was prepared for Coming in April 2000, that only 120 linear feet of pipe was placed in a drainage ditch, and that the USGS Quadrangle does not indicate a creek on this property. The environmental report mentions "a drainage ditch" and no wetlands were found on the property but that the area was depicted as "an intermittent Dow water body" on the USGS maps. It must be noted that Division research has shown that USGS Quadrangle maps greatly under map the extent of small streams in the Piedmont. The grading and drainage plans clearly show three drainage ways on the property, and the streams ieaving the property are perennial. A qualified environmental consultant should have found these channels and Corning should have had the delineation of these channels confirmed by the regulatory agencies. You state that 120 linear feet of pipe was used, but the remainder of the channels were filled with rock in order to continue drainage. Mr. Jim Chastain with H & M construction indicated that there were springs or seeps in the hill siope that were filled with rock to carry water under the construction site. A meeting has been set up with Mr. Steve Chapin of the US Army Corps of Engineers on March 14, 2001 at 10:00 at Corning to determine the extent of stream impacts on the property. This time was the earliest date that Mr. Chapin could meet. The Division hopes to begin resolution of this matter at that time. Your immediate attention to this matter is appreciated. Statute 143-215,1, other lawful standards and regulations promulgated and adopted by the North Carolina Environmental Management Commission, and the Federal Water Pollution Control Act, as amended, Siecor Corporation is hereby authorized to discharge stormwater from a facility located at Siecor Corporation - Telecommunications Cable Plant SR 2308 Hickory Catawba County to receiving waters designated as an unnamed tributary to Clark Creek in the Catawba River Basin in accordance with the effluent limitations, monitoring requirements, and other conditions set forth in Parts 1, II, III and IV of General Permit No. NCG030000 as attached. This Certificate of Coverage shall become effective January 14, 1994. This Certificate of Coverage shall remain in effect for the duration of the General Permit.
