The Quartz Corp USA applied for NPDES permit renewal for their TFC facility, and submitted a renewal application dated July 13, 2015. This facility processes local mineral ore for quartz, feldspar, and mica using Page 1 of 9 acid extraction and froth flotation processes. Residuals from processing and treatment are placed as `tailings' back into the worked mines as part of the mine reclamation process. There is concern that stormwater runoff from the mines are contributing additional pollutants to the watershed. Stormwater is currently permitted through NC DEQ DEMLR under the stormwater general permit NCG02000 which expires September 30, 2020. EPA visited several of these sites in 2015 and expressed concerns over potential pollutants in the stormwater. DEMLR has issued several of these stormwater general permits with additional monitoring requirements and will reassess whether these mines should continue receiving general permit coverage. If it is determined that the mines do not qualify for general permit coverage, then those mines will be directed to apply for individual NPDES wastewater coverage. If fluoride is detected in stormwater runoff, then that fluoride loading will need to be accounted for in the fluoride WLA for the respective facilities. Several mines (NC0000353, NC0000175, NC0000361, NC0000400, and NC0084620) share a wasteload allocation (WLA) for fluoride to maintain the water quality standard of 1.8 mg/L. The WLA is addressed in Appendix A. TSS limits were originally assigned using draft Effluent Limitation Guidelines in EPA's 1975 Development Document for Interim Final Effluent Limitations Guidelines and New Source Performance Standards for the CLAY, CERAMIC, REFRACTORYAND MISCELLANEOUS MINERALS VOL. III MINERAL MINING AND PROCESSING IND USTR Y Point Source Category. These draft guidelines, which set TSS limits at 0.6 lb/10001b of ore processed, were never finalized. Subsequent expansions and new facilities redistributed or added new TSS loading. Since the receiving stream is impaired for turbidity, TSS is frozen at current loading. 2. Instream Data Summary Instream monitoring may be required in certain situations, for example: 1) to verify model predictions when model results for instream DO are within 1 mg/l of instream standard at full permitted flow; 2) to verify model predictions for outfall diffuser; 3) to provide data for future TMDL; 4) based on other instream concerns. Instream monitoring may be conducted by the Permittee, and there are also Monitoring Coalitions established in several basins that conduct instream sampling for the Permittee (in which case instream monitoring is waived in the permit as long as coalition membership is maintained). If applicable, summarize any instream data and what instream monitoring will be proposed for this permit action: The current permit requires instream monitoring for fluoride, TSS, turbidity, and pH. Compliance Summary Summarize the compliance record with permit effluent limits (past S years): The facility reported no limit violations 2014-2018, however, DMR data for July 2018 has yet to be reported and the facility suffered a HF bypass resulting in a fish kill in the receiving stream that same month. Summarize the compliance record with aquatic toxicity test limits and any second species test results (past S years): The facility passed 18 of 18 quarterly chronic toxicity tests January 2014 to present. Summarize the results from the most recent compliance inspection: The last facility inspection conducted in February 2018 indicated corrosion and solids build-up in clarifiers, weirs, and discharge troughs. ARO is currently monitoring repairs and maintenance. 6. Water Quality -Based Effluent Limitations (WQBELs) Dilution and MixingZones ones In accordance with 15A NCAC 2B.0206, the following streamflows are used for dilution considerations for development of WQBELs: 1Q10 streamflow (acute Aquatic Life); 7Q10 streamflow (chronic Aquatic Life; non -carcinogen HH); 30Q2 streamflow (aesthetics); annual average flow (carcinogen, HH). If applicable, describe any other dilution factors considered (e.g., based on CORMIX model results): NA If applicable, describe any mixing zones established in accordance with I5A NCAC 2B.0204(b): NA Oxygen -Consuming Waste Limitations Limitations for oxygen -consuming waste (e.g., BOD) are generally based on water quality modeling to ensure protection of the instream dissolved oxygen (DO) water quality standard. Secondary TBEL limits (e.g., BOD= 30 mg/1 for Municipals) may be appropriate if deemed more stringent based on dilution and model results. If permit limits are more stringent than TBELs, describe how limits were developed: The facility does not discharge oxygen consuming waste. Ammonia and Total Residual Chlorine Limitations Limitations for ammonia are based on protection of aquatic life utilizing an ammonia chronic criterion of 1.0 mg/1(summer) and 1.8 mg/l (winter). Acute ammonia limits are derived from chronic criteria, utilizing a multiplication factor of 3 for Municipals and a multiplication factor of 5 for Non -Municipals. Limitations for Total Residual Chlorine (TRC) are based on the NC water quality standard for protection of aquatic life (17 ug/1) and capped at 28 ug/1(acute impacts). Due to analytical issues, all TRC values reported below 50 ug/1 are considered compliant with their permit limit. Describe any proposed changes to ammonia and/or TRC limits for this permit renewal: The facility does not discharge ammonia or TRC. Reasonable Potential Analysis (RPA) for Toxicants No RPA has been conducted because there are no effluent data for toxicants. The main pollutant of concern, fluoride, has a shared wasteload allocation and will be addressed in Appendix A. Page 5 of 9 Toxicity Testing Limitations Permit limits and monitoring requirements for Whole Effluent Toxicity (WET) have been established in accordance with Division guidance (per WET Memo, 8/2/1999). Per WET guidance, all NPDES permits issued to Major facilities or any facility discharging "complex" wastewater (contains anything other than domestic waste) will contain appropriate WET limits and monitoring requirements,, with several exceptions. The State has received prior EPA approval to use an Alternative WET Test Procedure in NPDES permits, using single concentration screening tests, with multiple dilution follow-up upon a test failure. Describe proposed toxicity test requirement: This is a Minor industrial mine, and a chronic WET limit at 11% effluent will continue at a quarterly frequency. Mercury Statewide TMDL Evaluation There is a statewide TMDL for mercury approved by EPA in 2012. The TMDL target was to comply with EPA's mercury fish tissue criteria (0.3 mg/kg) for human health protection. The TMDL established a wasteload allocation for point sources of 37 kg/year (81 lb/year), and is applicable to municipals and industrial facilities with known mercury discharges. Given the small contribution of mercury from point sources (-2% of total load), the TMDL emphasizes mercury minimization plans (MMPs) for point source control. Municipal facilities > 2 MGD and discharging quantifiable levels of mercury (>1 ng/1) will receive an MMP requirement. Industrials are evaluated on a case -by -case basis, depending if mercury is a pollutant of concern. Effluent limits may also be added if annual average effluent concentrations exceed the WQBEL value (based on the NC WQS of 12 ng/1) and/or if any individual value exceeds a TBEL value of 47 ng/l. This facility is not known to discharge mercury. Other TMDL/Nutrient Management Strategy Considerations If applicable, describe any other TMDLs/Nutrient Management Strategies and their implementation within this permit: NA. Technology -Based Effluent Limitations (TBELs) This facility is not subject to any Effluent Limitation Guidelines 8. Antidegradation Review (New/Expanding Discharge): The objective of an antidegradation review is to ensure that a new or increased pollutant loading will not degrade water quality. Permitting actions for new or expanding discharges require an antidegradation Page 6 of 9 review in accordance with 15A NCAC 2B.0201. Each applicant for a new/expanding NPDES permit must document an effort to consider non -discharge alternatives per 15A NCAC 2H.0105(c)(2). In all cases, existing instream water uses and the level of water quality necessary. to protect the existing use is maintained and protected. If applicable, describe the results of the antidegradation review, including the Engineering Alternatives Analysis (EAA) and any water quality modeling results: NA 9. Antibacksliding Review: Sections 402(o)(2) and 303(d)(4) of the CWA and federal regulations at 40 CFR 122.44(1) prohibit backsliding of effluent limitations in NPDES permits. These provisions require effluent limitations in a reissued permit to be as stringent as those in the previous permit, with some exceptions where limitations may be relaxed (e.g., based on new information, increases in production may warrant less stringent TBEL limits, or WQBELs may be less stringent based on updated RPA or dilution). Monitoring Requirements Monitoring frequencies for NPDES permitting are established in accordance with the following regulations and guidance: 1) State Regulation for Surface Water Monitoring, 15A NCAC 2B.0500; 2) NPDES Guidance, Monitoring Frequency for Toxic Substances (7/ 15/2010 Memo); 3) NPDES Guidance, Reduced Monitoring Frequencies for Facilities with Superior Compliance (10/22/2012 Memo); 4) Best Professional Judgement (BPJ). Per US EPA (Interim Guidance, 1996), monitoring requirements are not considered effluent limitations under Section 402(o) of the Clean Water Act, and therefore anti - backsliding prohibitions would not be triggered by reductions in monitoring frequencies. For instream monitoring, refer to Section 4. 11. Electronic Reporting Requirements The US EPA NPDES Electronic Reporting Rule was finalized on December 21, 2015. Effective December 21, 2016, NPDES regulated facilities are required to submit Discharge Monitoring Reports (DMRs) electronically. Effective December 21, 2020, NPDES regulated facilities will be required to submit additional NPDES reports electronically. NCG020000 coverage authorizes: • Stormwater discharges associated with mining and quarrying of non-metallic minerals (except fuels), mine excavation, processing, and vehicle maintenance activities (VMA) at mine sites. • Wastewater discharges (dewatering, process wastewater, wastewater recycle system overflows). • Operation of wastewater treatment systems (Authorization to Construct no longer required). NCG020000 coverage is NOT APPLICABLE to: • Borrow Pits covered by the NC DOT statewide stormwater permit. • Peat mining, coal mining, metal mining, or oil 8, gas extraction operations. • Wastewater not specifically identified by the general permit. What are key stormwater requirements? NCG020000 requires periodic discharge monitoring and a Stormwater Pollution Prevention Plan (SPPP): • Develop and implement an SPPP, and update it at least annually. • Inspect Stormwater Best Management Practices (BMPs) once every seven (7) calendar days. • Semi-annual analytical monitoring and qualitative (visual) monitoring. • Report stormwater monitoring data once a year by March 1 st to DEQ Central Office. • Report benchmark exceedances or Tier 2 monitoring to the DEMUR Regional Office within 30 days. • Respond to benchmark exceedances according to Tier response requirements. What are key wastewater requirements? NCG020000 stipulates wastewater treatment facility operational requirements and periodic discharge monitoring: • Notify DEQ if facility fails to perform satisfactorily or creates nuisance conditions. • Only DEQ-evaluated flocculants may be used, if administered according to maximum application doses. • Quarterly analytical monitoring for first year, or until four consecutive samples comply with all limits (then semi-annual monitoring allowed). Quarterly monitoring schedule resumes upon any limit violation. • Settleable solids (SS) monitoring applies to discharges to HQW, ORW, SA, SB, PNA, or Tr designated waters. • Total Suspended Solids (TSS) limits specific to industrial sand mines, and to any mine discharging to HQW. • Report wastewater effluent monitoring data once a year (by March 1st) to DEQ Central Office. • Report effluent limitation violations to the DEMUR Regional Office within 30 days. • Effluent turbidity levels above the water quality standard prompt upstream and downstream monitoring. The permit makes allowances for Inactive mines that have sus- pended all industrial activities and that certify to DEMUR that the site has been stabilized. If approved for "dormant status," these operations qualify for re- duced BMP inspections and may be exempted from outfall moni- toring by the Regional Engineer. Do I have to monitor all outfalls? Yes. However, you may request Representative Outfoll Status (ROS). If approved, ROS allows monitoring at fewer outfalls. To request ROS, submit an ROS Re- quest Form to the DEMUR Region- al Office. The form is available on our website (below). Also, the Regional Office may exempt mines with "dormant sta- tus" from analytical and/or quali- tative monitoring. What if 1 sell my business, or the name changes? You are required to notify DEMLR of those changes in writing, and continuation of permit coverage is subject to the Director's ap proval. Please submit the Name/ Ownership Change form located on our Program website. What do I do when my permit expires? Permitees are not required to sub- mit an application for renewal un- less directed by the Division. The permiteee should continue to abide by this general permit if it expires and renewed coverage has not yet been issued. What is wastewater, and what is stormwater at a mine site? Any water contacting an actively mined area, water used to pro- cess mined materials, and mine dewatering water are all consid- ered "wastewater." For some mines, "mine dewatering" also means wet pit overflows, and not just pumped -out water. Any stormwater that commingles with these waters is "wastewater." "Stormwoter" includes runoff from areas related to mining, pro- cessing, or raw material storage areas, such as haul roads or pro- cessing plant areas at the mine. Sometimes the answer is not clear because of how broad the defini- tions are. For example, N.C. con- siders runoff from areas that con- tain overburden only (no mined or processed material), and that does not commingle with wastewater (including runoff from the mine), to be stormwater. If you are unsure about discharges, please contact the DEMUR Re- gional Office for assistance. Does a certified lab need to analyze my samples? Monitoring under NPDES permits must be conducted in accord- ance with test procedures ap- proved in federal regulations in 40 CFR § 136. All labs certified by North Carolina perform analysis in accordance with those proce- dures. While N.C. certification re- quirements do not apply to testing stormwater-only discharges, data gathered under an NPDES permit _must OR conform to federal re- quirements. Using a North Caroli- na certified lab is one way to en- sure compliance. If this happens, please sample for the missing parameter during the next measureable storm event or wastewater discharge. If I sample my discharge, do 1 have to do visual monitoring at the same time? You may, but it is not necessary under NCG02. Some other gen- eral permits require it, however. What if there is no flow for a period between two samples that exceed a benchmark? Are those consecutive exceedances? Yes. This scenario still puts you in Tier 2. The new permit is more clear about how the Tier 2 trigger omits periods of no discharge. I was waiting on their sampling data and finally received it. I didn't realize that their WW permit did not include Chloride or Flouride like Red Hill. Their sampling results only include parameters already in the general permit. They do have some samples over TSS benchmark so that could be an issue. I have attached the NOI. Let me know if you would like to see the DMRs they send me. Does the Asheville Regional Office have any concerns about issuing this facility a COC for this general permit, and are there any potential impacts to wetlands? If the turbidity exceeds 10 NTU due to natural conditions, the discharge shall not cause any increase in turbidity. 3. The pH shall not be less than 6.0 standard units nor greater than 10.0 standard units. 4. Chloride shall be monitored quarterly during the same months as toxicity testing. 5. Chronic Toxicity (Ceriodaphnia) Pass/Fail at 10%: February, May, August and November. See Special Condition A (2). There shall be no discharge of floating solids or visible foam in other than trace amounts. NC0000361 . A. (2). CHRONIC TOXICITY PERMIT LIMIT (QRTRLY) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 10.0%. The permittee shall notify the Director in writing, not later than ninety (90) days prior to instituting use of any additional biocide used in cooling systems, which may be toxic to aquatic life other than those previously reported to the Division of Water Quality. Such notification shall include completion of Biocide Worksheet Form 101 and a map locating the discharge point and receiving stream. No chromium, zinc, or copper shall be added to the treatment system except as pre -approved additives to biocidal compounds. A. (4). WASTEWATER DIVERSION Diversion or bypassing of untreated wastewater from the treatment facility is prohibited. A. (5). SOLIDS DISPOSAL Solids removed or resulting from the wastewater treatment process shall be contained and disposed of in such a manner as to prevent any contamination of the surface waters of the State. A. (6). FLUORIDE REOPENER This permit shall be modified, or revoked and reissued to incorporate new fluoride effluent limitations in the event that acute or chronic bioassay testing or other studies results in a change in the North Carolina Water Quality Standard for fluoride. A. (7). TURBIDITY In the event that violations of the turbidity standard of the North Carolina Water Quality Standards occur as a result of this discharge, this permit shall be modified, or alternately, revoked and reissued to incorporate limitations sufficient to protect the receiving waters. A. (8). PERMIT MODIFICATIONS This permit shall be modified, or revoked and reissued to incorporate new limitations in the event that production changes are requested or should any new fluoride using discharge request to locate on the North Toe River. NC0000361 STORMWATER MONITORING, CONTROLS AND LIMITATIONS FOR PERMITTED DISCHARGES SECTION B. STORMWATER BEST MANAGEMENT PRACTICES (BMPS) PLAN 1. The permittee shall implement stormwater BMPs to ensure that contaminants do not enter surface waters via stormwater that comes in contact with any unstabilized overburden, raw materials, intermediate products, finished products, byproducts or waste products located on the site covered by this permit. A BMP Plan shall be developed in accordance with the requirements of this section. The BMP Plan requirement, or portions of the plan requirement, may be met by utilizing appropriate requirements in other documented plans specific to the permitted facility. 2. Management of Stormwater Runoff and Runon. The permittee shall maintain stormwater BMPs for land disturbance areas and outside process areas. In addition, controls should be used to limit or isolate selected land disturbance and process areas and limit the amount of off site stormwater runon to those areas. Appropriate Best Management Practices (BMPs) should be used to divert, infiltrate, reuse or otherwise manage stormwater runoff and runon in a manner that reduces pollutants in stormwater discharges leaving the site. Appropriate BMPs may include but are not limited to: vegetative swales, berms, use of reclaimed mine areas, and reuse of collected stormwater (such as for an industrial process or as an irrigation source). 3. BMP Controls Inspection and Maintenance. All stormwater BMPs shall be inspected by or under the direction of the permittee at least once every seven calendar days and within 24 hours after any storm event that results in a discharge. The BMPs implemented shall be operated and maintained so that they are cleaned out when the sediment storage capacity has been reduced by 50%. If any visible sedimentation is leaving the property, corrective action shall be taken to reduce the discharge of sediments. Visible sedimentation found offsite shall be recorded with a brief explanation as to the measures taken to prevent future releases as well as any measures taken to remove the sediment that left the site. All other stormwater specific controls (e.g. oil /water separators) shall be inspected and qualitatively monitored on a semiannual schedule, once in the fall (September -November) and once during the spring (April-june). A log of sampling data and of activities taken to implement BMPs associated with the vehicle maintenance activities shall be maintained and incorporated into the BMP Plan and kept onsite for the duration of the permit term and made available to the Director upon request. 4. Erosion and Sedimentation Control. The permittee shall implement the management practices and the erosion and sedimentation control measures that are included in the mining permit or erosion and sedimentation control permit issued by the Division of Land NC0000361 Resources. Compliance with the issued permit is considered a requirement of this permit. Any deviation from the issued permit, or amendments to the issued permit, that impacts water quality shall constitute a violation of the terms and conditions of this permit. A signed copy of the issued permit including the approved erosion and sedimentation control measures and the reclamation plan shall be maintained on the site at all times. Once an area is released by the Division of Land Resources in accordance with NCGS Chapter 74, Article 7, it shall no longer be subject to this permit. 5. Preventive Maintenance Inspections and Good Housekeeping Practices. Equipment utilized during mining activity on a site must be operated and maintained in such a manner as to prevent potential or actual pollution of the surface water or ground waters of the state. Fuels, lubricants, coolants, and hydraulic fluids, or any other petroleum products, shall not be discharged on the ground or into surface waters. Spent fluids shall be disposed of in a manner so as not to enter the surface waters or ground waters of the state and in accordance with applicable federal disposal regulations. Any spilled fluids shall be cleaned up to the maximum extent practicable and disposed of in a manner that does not allow their entry into the surface waters or ground waters of the state. 6. Secondary Containment. The permittee shall provide secondary containment for bulk storage of liquid materials, storage of Section 313 of Title III of the Superfund Amendments and Reauthorization Act (SARA) water priority chemicals, or storage of hazardous liquids substances to prevent leaks and spills from contaminating stormwater runoff. If the secondary containment devices are connected directly to stormwater conveyance systems, the connection shall be controlled by manually activated valves or other similar devices (which shall be secured with a locking mechanism) and any stormwater that accumulates in the containment area shall be at a minimum visually observed for color, foam, outfall staining, visible sheens and dry weather flow, prior to release of the accumulated stormwater. Accumulated stormwater shall be released if found to be uncontaminated by the material stored within the containment area. SECTION C: ANALYTICAL AND QUALITATIVE MONITORING REQUIREMENTS FOR DISCHARGES COMPOSED ENTIRELY OF STORMWATER Analytical monitoring for stormwater discharges shall be performed for parameters as specified in Tables 1 through 3. All analytical monitoring shall be performed during a representative storm event as defined in Section E. Definitions. In situations where stormwater runoff is controlled by some type basin or retention/detention pond, the following provisions are applicable for sample collection for analytical monitoring: ooAnalytical monitoring for stormwater discharges from a basin or other similar control NC0000361 structures must be performed within the first 30 minutes of discharge. • Analytical monitoring for a basin /pond designed to contain the 10-year design storm (see Section E. Qualitative monitoring requires a visual inspection of all stormwater outfalls with stormwater runoff from land disturbance, process or vehicle maintenance areas regardless of representative outfall status or cut-off concentrations and shall be performed as specified below in Table 2. No analytical tests are required. The first qualitative monitoring event during the term of the permit must coincide with the initial analytical monitoring event (regardless of the season). Mine Dewatering Wastewater (including Borrow Pits) During the period beginning on the effective date of the permit and lasting until expiration, the permittee is authorized to discharge mine dewatering wastewater controlled in accordance with the conditions of this permit. Mine dewatering activities that have the potential to drain wetlands must have secured and implemented an Operation and Monitoring Plan approved by the Division. Operation and Monitoring Plans shall include, but are not limited to: ■ Groundwater monitoring strategies to demonstrate the effect of pumping and, as necessary, establish the pumping regime necessary to reduce impacts. ■ Detailed plans to maintain the surrounding hydrology and the respective monitoring to demonstrate compliance. Alternative site specific pumping and monitoring regimes may be approved by the Division on a case -by -case basis. The discharge of Mine dewatering wastewater that is directly pumped from the pit through an erosion and sedimentation control structure prior to discharging to surface waters is not required to receive an authorization to construct. Mine dewatering wastewater discharges, which require additional treatment other than erosion and sedimentation control structures, are subject to the authorization to construct requirement. Analytical monitoring of mine dewatering wastewater shall be performed as specified below in Table 3. An exceedence of any of these limitations is a violation of the permit conditions and may be subject to enforcement action. NC0000361 Table 3. The permittee shall comply with Final Limitations and Controls specified for stormwater discharges in accordance with the following schedule: For the land disturbance activities: a. Implement BMP's and stormwater controls, as appropriate on the effective date of permit coverage, at existing operations. b. Develop and implement BMP's and stormwater controls, as appropriate, prior to beginning land disturbance activity at new operations. 2. Permittee shall at all times provide the operation and maintenance necessary to operate the permitted stormwater controls at optimum efficiency. SECTION E: DEFINITIONS 1. Representative Storm Event A storm event that measures greater than 0.1 inches of rainfall and that is preceded by at least 72 hours in which no storm event measuring greater than 0.1 inches has occurred. A single storm event may contain up to 10 consecutive hours of no precipitation. For example, if it rains for 2 hours without producing any collectable discharge, and then stops, a sample may be collected if a rain producing a discharge begins again within the next 10 hours. 2. Ten Year Design Storm The maximum 24 hour precipitation event expected to be equaled or exceeded on the average once in ten years. All mining activities, including the installation and maintenance of all erosion and sedimentation control measures, shall be conducted as indicated on Map 2 last revised August 7, 2003 and Map 3 last revised January 2004. G. All mining activities associated with the expansion of the waste area, including the construction and maintenance of all associated erosion and sediment control measures, shall be conducted as indicated on the mine maps last revised April 141 2005 and supplemental information submitted by Pinnacle Engineering dated March 3, 2004 and April 21, 2005. H. Additional erosion and sediment control measures and/or devices shall be utilized as necessary during the construction phase and throughout the lifetime of the six acre expansion of the waste area to prevent sediment from entering natural watercourses or other properties. I. The additional disposal of tailings at the site to increase the height/elevation of the tailings disposal area must be constructed per the maps and details last revised on April 14, 2005 and supplemental information submitted by Pinnacle Engineering dated March 3, 2004, and April 21, 2005. The additional tailings disposed of in this area must be constructed in lifts to insure geotechnical stability. J. During the construction and installation of the rock buttress, adjacent to the North Toe River, a qualified professional Geotechnical Engineer who is familiar with the project and construction plans shall be present during all phases of said buttress construction. The construction and installation of the rock buttress shall be in accordance with the approved plans and details outlined on the Sheets 2 through 4 last revised April 14, 2005. K. Mining related activities associated with expansion of the Central Product Warehouse shall be conducted as indicated on the Central Product Warehouse General Site Layout Map last revised April 21, 2008 and the supplemental information received by the Land Quality Section on April 23, 2008. L. Mining related activities associated with the reduction of the rock toe stability berm from 40 feet to 25 feet, elimination of the rock toe stability berm along the northern tailings disposal area (Section B-B), and reduction of the tailings disposal height in this area from 125 to 100 feet shall be conducted as indicated on the Unimin Tailings Disposal Grading Plan with Rock Buttress (Sheet 2 of 4) last revised September 1, 2009, the Unimin Schoolhouse Mine Phase II Tailing Disposal Plan dated September 4, 2009 and supplemental information received by the Land Quality Section on May 12, 2010, with the following stipulations: 1. The horizontal rock toe stability berm width of 55 feet or more shall be maintained; Page 7 2. Controlled compaction of the outer 300 feet zone and proper surface water drainage shall continue in order to maintain the structural integrity of the tailings disposal area; 3. Interim benches along the outer slope and along the tailings disposal area crest shall be constructed and maintained in order to maintain the structural integrity of the tailings disposal area; and 4. The soft tailings material in the ponded area near the rock toe stability berm on the south side of the existing tailings disposal shall be removed and replaced with competent material. M. An erosion and sediment control plan(s) shall be submitted to the Department for approval prior to any land disturbing activities not indicated on the revised erosion control plan or mine maps submitted with the approved application for a mining permit and any approved revisions to it. ' Such areas include, but are not limited to, expansion outside of the approved pit area, creek crossings, or expansion of overburden or waste disposal areas. 5. Groundwater Protection Groundwater monitoring wells shall be installed and monitored as deemed appropriate by the Department. 6. Graded Slopes and Fills A. The angle for graded slopes and fills shall be no greater than the angle which can be retained by vegetative cover or other adequate erosion control measure, structure, or device. In any event, exposed slopes or any excavated channels, the erosion of which may cause off -site damage because of siltation, shall be planted or otherwise provided with groundcover, devices or structures sufficient to restrain such erosion. B. Overburden cut slopes along the perimeter of any pit expansion conducted after November 12, 1993, shall be graded to a minimum 2 horizontal to 1 vertical or flatter and shall be stabilized within 60 days of completion. Furthermore, a minimum ten (10) foot wide horizontal safety bench shall be provided at the top of the rock and at the toe of any overburden slope constructed after November 12, 1993. 7. Surface Drainage The affected land shall be graded so as to prevent collection of pools of water that are, or likely to become, noxious or foul. Necessary structures such as drainage ditches or conduits shall be constructed or installed when required to prevent such conditions. "y 46 Page 8 8. Blasting The operator shall monitor each blast with a seismograph located at a distance no farther than the closest off site regularly occupied structure not owned or leased by the operator. A seismographic record including peak particle velocity, air overpressure, and vibration frequency levels shall be kept for each blast (except as provided under Operating Condition Nos. 8B and 8D of this permit). The following blasting conditions shall be observed by the mine operator to prevent hazard to persons and adjacent property from surface blasting: A. Record Keeping: The operator shall maintain records on each individual blast describing: the total number of holes; pattern of holes and delay of intervals; depth and size of holes; type and total pounds of explosives; maximum pounds per delay interval; amount of stemming and burden for each hole; blast location; distance from blast to closest offsite regularly occupied structure; and weather conditions at the time of the blast. Records shall be maintained at the permittee's mine office and copies shall be provided to the Department upon request. F. Excessive Ground Vibration/Air blast Reporting: If ground vibration or Air blast limits are exceeded, the operator will immediately report the event with causes and corrective actions to the Department. Use of explosives at the blast site that produced the excessive reading shall cease until corrective actions approved by the Department are taken. However, blasting may occur in other approved areas within the permitted boundary. Authorization to blast at the blast site may be granted at the time of the verbal reporting of the high ground vibration or high air blast reading if the circumstances justify verbal approval. Failure to report will constitute a permit violation. G. Flvrock Prevention: The operator shall take all reasonable precautions to ensure that flyrock is not thrown beyond areas where the access is temporarily or permanently guarded by the operator. Failure to take corrective measures to prevent flyrock and repeated instances of flyrock shall be considered a violation of the Mining Permit. H. Flvrock Reporting: Should flyrock occur beyond the permitted and guarded areas, the operator shall immediately report the incident to the Department. Further use of explosives on the mine site shall be suspended until the following actions have been taken: 1. A thorough investigation as to the cause(s) of the incident shall be conducted. 2. A report detailing the investigation shall be provided to the Department within 10 days of the incident. Refuse Disposal A. No on -site disposal of refuse or other solid waste that is generated outside of the mining permit area shall be allowed within the boundaries of the mining permit area unless authorization to conduct said disposal has first been obtained from both the Division of Waste Management and the Land Quality Section, Department of Environment and Natural Resources. The method of disposal shall be consistent with the approved reclamation plan. B. Mining refuse as defined by G.S. 74-49 (14) of The Mining Act of 1971 generated on -site and directly associated with the mining activity may be disposed of in a designated refuse area. All other waste products must be disposed of in a disposal facility approved by the Division of Waste Management. No petroleum products, acids, solvents or their storage containers or any other material that may be considered hazardous shall be disposed of within the permitted area. C. For the purposes of this permit, the Division of Land Resources considers the following materials to be "mining refuse" (in addition to those specifically listed under G.S. 74-49 (14) of the N.C. All areas of unconsolidated material such as overburden or waste piles shall be graded to a 2 horizontal to 1 vertical or flatter slope and terraced as necessary to insure slope stability. B. Any settling ponds and sediment control basins shall be backfilled, graded, and stabilized or cleaned out and made into acceptable lake areas. C. The processing, stockpile, and other disturbed areas neighboring the mine excavation shall be leveled and smoothed. D. Reclamation Plan: Reclamation shall be conducted simultaneously with mining to the extent feasible.
