Please note that our permit expired on December 31, 2016 and we submitted a permit renewal application to your office on June 1, 2016 prior to the renewal application deadline. It is our understanding that the NCDEQ-DEMLR requires Mallinckrodt to continue monitoring our stormwater outfalls under the same "semi-annual" frequency specified in our current permit if we have not received a new permit by the expiration date. If the Division disagrees with our understanding, please let us know in writing of any ongoing stormwater monitoring requirements after expiration of our current permit. Therefore, the next semi-annual storm water sample will be collected between December 1, 2018 and May 30, 2019 unless we hear otherwise from your office. The release occurred at approximately 8:00 PM on April 3, 2013 and wastewater overflowed from a wastewater wet well (sump) into a nearby pond, known as the Flush Water Pond. During the call, I reported that 6,500 gallons were released but an estimate of 6,750 gallons is now believed to be more accurate. This letter serves as a follow-up response to that verbal notification as requested by Mr. Wiggins. At about 7:55 PM, power was lost at our wastewater treatment plant and the emergency generator immediately cut on to power the pumps in the wet well. Unfortunately, the switch on the generator malfunctioned and did not transfer the power to the pumps and wastewater effluent was thereby released from this wet well into the 2-acre Flushwater Pond where it was fully contained. Within 45 minutes of the release, power was restored at the wastewater treatment plant and the pumps were manually re -set and operational. We are still investigating the cause of the malfunctioning switch and will either repair or replace the switch. Our wastewater effluent is a combination of treated production -related wastewaters, untreated sanitary wastewaters, and untreated utility -related wastewaters (e.g., steam condensate, cooling tower blowdown, etc.) and we discharge our wastewater effluent in accordance with City of Raleigh Industrial Discharge Permit #CHEM. This subject wet well is a concrete sump used for pumping Mallinckrodt's combined wastewater effluent to the City of Raleigh sewer system. The water in the Flushwater Pond is used to flush the lines used for the application of treated wastewater residuals onto 29 on -site hayfields pursuant to Residuals Application Permit #WQ0005537 issued by NCDENR. The Flushwater Pond has no direct discharge outlet but is designed to discharge through a vertical overflow pipe and into our on -site 23-acre Stormwater Retention Pond near the Neuse River. The Stormwater Retention Pond is covered by the site's NPDES Stormwater Discharge Permit #NCS000136 issued by, NCDENR. The Stormwater Retention Pond does not have an overflow and must be routinely pumped for discharge to the Neuse River. According to our permit and in response to this exceedence, we are required to evaluate the effectiveness of any site best management practices (BMPs) associated with this exceedence plus review and/or update the Stormwater Pollution Prevention Plan and document any efforts to address stormwater contamination. However, because the benchmark value was recently increased to 19 mg/L in site's new permit (effective December 1, 2011), we do not believe further evaluation of this particular monitoring result is required at this time nor is there a need to update the Stormwater Pollution Prevention Plan (SWPPP). Structural BMPs: This storage area has a divided concrete dike which allows for segregation of incompatible materials should a Hill Tank Farm spill occur. There is a sump located in each of the diked (S-10) areas. The tanks in this area are also equipped with overflow detection devices. Procedural BMPs: Filling Tanks 384 and 385 is controiled by a level gauge. Any accumulated stormwater is pumped to the hazardous wastewater tanker (Table 5, W-17). Location: East of building 205 in Drainage Zone 3 Materials: I lazardous waste, empty drums, plastic totes of aqua ammonia, fuel, and plastic totes of hydrogen peroxide Structural BMPs: The hazardous waste storage pad has a full roof and walls on the north, east, and south sides. This area also has a concrete pad that has epoxy coating and is sealed with "Waterstop". The base is sloped to collection trenches in the rear of the storage area. There is also a speed bump on the western side that is open for roadway access and prevents rainwater from running onto the pad. Hazardous Waste Storage Pad Procedural BMPs: Hazardous waste materials are stored in appropriate new (5-20) drums depending on the nature of the hazardous waste or hazardous material to ensure no incompatible materials stored in the same bay. The drums that are sealed are then placed four to a pallet (maximum) with all drums touching to prevent tipping. Provisions are made to stack drums at safe heights and adequate aisle space is maintained between the pallets. Stonnwater accumulation in the drainage trenches at the base of the pad is typically evaporates. Should excess stormwater accumulate in this trench, a vac truck collects the stormwater and transports to the W WTP for disposal. This area also has dikes on all sides of the pad. Procedural BMPs: Fire training is conducted annually, typically in October of each year. Upon completion of fire training, an environmental contractor manually pumps liquids in the sump into a vacuum truck for disposal. Residual liquids contained in the sump are typically a mixture of rainwater, #2 fuel oil, and fire righting foam. The sump is then power -washed and emptied into the vacuum truck.
