Good afternoon,

The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater Management Permit Application
for the subject project on May 15, 2018. After a cursory review we have identified information that is missing from the
application.

Documentation was submitted with the application that shows that Cypress Creek Holdings, LLC is an active corporation
in good standing with the NC Secretary of State. However, the individual signing the application must be listed on the
documentation as a company official or must submit documentation signed by a company official authorizing that
individual to apply for the permit. For these purposes, a letter signed by any of the four individuals listed in the
document stating that the applicant is authorized is sufficient.

The application lists FBS Land Hold Co., LLC as the owner of the property. However, the deed that was submitted with
the application shows Richard E. Fox as the owner of the property. Please explain the discrepancy and provide legal
proof of ownership of the property or a lease to develop the site.
