REGAN Secretary TRACY DAVIS Dimaor On August 22, 2017, Mr. Thom Edgerton, staff member from the Division of Energy, Mineral and Land Resources (DEMLR) from our Washington Regional Office (WaRO), along with Mr. Jeff Welti, staff member from the Underground Storage Tank Section (UST), also from WaRO, visited the subject site following a fire department report of site conditions. The inspectors met with Mr. William Conner, Site Manager and observed an active scrap metal recycling operation. Also observed was potential for surface water impacts associated with the activities of this facility. The site visit and file review revealed that Dump and Cash Inc. has neither applied for, nor obtained coverage under an NPDES Permit for stormwater (SW) discharges from Milestone Metals, which is located at 2346 US Hwy 13 S, Ahoskie, NC 27910, Hertford County, just south of Ahoskie. Accordingly, the inspection and DEMLR file review revealed that your site is in violation of North Carolina General Statute and North Carolina Administrative Codes. North Carolina General Statute (hereby known as G.S.) 143-215.1(a) (1) requires that no person shall make any outlets into the waters of the State unless that person has received a permit. Permit requirements are outlines in North Carolina Administrative Code 02H .0100 — Point Source Discharges to Surface Waters. Required Response Accordingly, you are directed to respond to this letter in writing within 15 calendar days of receipt of this Notice. Please explain your efforts to abate the impacts identified above. 2. Please address your efforts to resolve unpermitted discharges by seeking coverage under NPDES General Permit NCG20000 for Scrap Metal Recycling Operations (see the attached permit application, NOI. Send a copy of the completed application package to this office, as well as submit the original application with fee to the Raleigh Central Office as directed on the last page of the permit application). Thank you for your attention to this matter. This office requires that the violations, as detailed above, be abated immediately and properly resolved. Environmental damage and/or failure to secure proper authorizations have been documented on the subject tract as stated above. Your efforts to undertake activities to bring the subject site into compliance is not an admission, rather it is an action that must be taken in order to begin to resolve ongoing environmental issues. Pursuant to G.S. 143-215.6A, these violations and any future violations are subject to a civil penalty assessment of up to a maximum of $25,000.00 per day for each violation. Your above- mentioned response to this correspondence, the degree and extent of harm to the environment and the duration and gravity of the violation(s) will be considered in any civil penalty assessment process that may occur.
