Staff review of the plans and specifications has determined that the project,as proposed,will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 970521 dated October 22, 1997,for the construction of Mill Creek Apartments Phase II. This permit shall be effective from the date of issuance until October 22,2007, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty(30)days following receipt of this permit. This request must be in the form of a written petition,conforming to Chapter 150B of the North Carolina General Statutes,and filed with the Office of Administrative Hearings,P.O.Drawer 27447,Raleigh,NC 27611-7447. The permittee is responsible for verifying that the proposed built-upon area does not exceed the allowable built-upon area. 6. The following items will require a modification to the permit: a. Any revision to the approved plans,regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built-upon area. e. Further subdivision of the project area. f. Filling in,altering,or piping of any vegetative conveyance shown on the approved plan. In addition,the Director may determine that other revisions to the project should require a modification to the permit. 7. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit.Within the time frame specified in the notice,the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. H.SCHEDULE OF COMPLIANCE 1. The permittee will comply with the following schedule for construction and maintenance of the stormwater management system: a. The stormwater management system shall be constructed in it's entirety,vegetated and operational for it's intended use prior to the construction of any built-upon surface except roads. b. During construction,erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. C. All connections into the stormwater system from future areas/outparcels shall be made such that short- circuiting of the system does not occur. 2. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections(every 6 months). b. Sediment removal. C. Mowing and revegetation of side slopes. d.- Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. g. Access to the outlet structure must be available at all times. 3. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date,activity,name of person performing the work and what actions were taken. 4. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit,the approved plans and specifications, and other supporting data. 4 State Stormwater Management Systems Permit No. SW8 970521 Mill Creek Apartments Phase II Stormwater Permit No. SW8 970521 New Hanover County Engineer's Certification 1, ,as a duly registered Professional Engineer in the State of North Carolina, having been authorized to observe(periodically/weekly/full time)the construction of the project, (Project) for (Project Owner)hereby state that, to the best of my abilities, due care and diligence was used in the observation of the project construction such that the construction was observed to be built within substantial compliance and intent of the approved plans and specifications. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit,the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 6. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 7. Prior to the sale of any portion of the property,an access/maintenance easement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale of any portion of the property. M.GENERAL CONDITIONS 1. This permit is not transferable. In the event there is a desire for the facilities to change ownership,or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee,documentation from the parties involved,and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143- 215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations,or ordinances which may be imposed by other government agencies(local,state,and federal)which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DHNR Staff permission to enter the property for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. Permit issued this the 22nd day of October, 1997. Monthly, or after every runoff producing rainfall event, whichever comes first: A. Inspect the trash rack; remove accumulated debris, repair/replace if it is not functioning. B. Inspect and clear the orifice of any obstructions. If a pump is used as the drawdown mechanism, pump operation will be checked. A log of test runs of the pump will be kept on site and made available to DWQ personnel upon request. C. Inspect the pond side slopes and grassed inlet swales; remove trash, and repair eroded areas before the next rainfall event. D. If the pond is operated with a vegetated filter, the filter will be checked for sediment accumulation, trash accumulation, erosion and proper operation of the flow spreader mechanism. Repairs/cleaning will be done as necessary. II. Quarterly (Four times a year): A. Inspect the collection system (ie. catch basins, piping, grassed swales) for proper functioning. Accumulated trash will be cleared from basin grates, basin bottoms, and piping will be checked for obstructions and cleared as required. B. Pond inlet pipes will be checked for undercutting. Riprap or other energy dissipation structures will be replaced, and broken pipes will be repaired. III. Semi-annually (twice a year): A. Accumulated sediment from the bottom of the outlet structure will be removed. B. The forebay depth will be checked at various points. Sediment removal is required when the depth is reduced to 75% of the original forebay design depth of_ -_'. C. Grassed swales, including the vegetated filter if applicable, will be reseeded twice a year as necessary. POND MAINTENANCE REQUIREMENTS PAGE 2 IV. Annually (Once a year): A. The pond depth will be checked at various points. Sediment removal is required when the depth is reduced to 75% of the original design depth or Y, whichever is greater. Design depth is'K 175', measured vertically from the orifice down to the pond's bottom. Sediment must be removed to at least the original design depth. �K K,p k_ m2X. V. General: d0h is A. Mowing of the side slopes will be accomplished according to the season. Maximum grass t height will be 6". B. Cattails are encouraged along the pond perimeter, however they will be removed when they cover more than 1/2 the surface area of the pond. The best time to cut them is at the end of the growing season, in November. Environmentally sensitive chemicals for use in killing cattails can also be used. Contact your nearest Agricultural Extension Agent. C. The'orifice/pump is designed to draw down the pond in 2-5 days. If drawdown is not accomplished in that time, the orifice will be replaced with a larger or smaller orifice. Slow drawdown may be attributed to a clogged system. The source of the clogging will be found and eliminated. D. All components of the detention pond system will be kept in good working order. Repair or replacement components will meet the original design specifications as per the approved stormwater plan. If previously approved components are determined to be ineffective, the component must be redesigned and/or replaced. VI. Special Requirements: I Gregory M. Duggan,Asst. Pond A has the berm top reduced to 5 feet wide. The surface area at the permanent pond elevation of 25 feet is 2,022 square feet as taken off by ACAD. The required calculated surface area is 2,086 square feet, which is a difference of 64 square feet. Since the volume for a 1-inch storm event is much in excess of that required, the system should be adequate for treatment of the runoff. To cut down on waste of paper, we have included only the changed sheets (C--1, C-2, and C-2A). It was our impression that you wanted the scaled pond layouts so that you could more easily determine the overall dimensions. It is still best to use the site map to see where the location of the weir is located. 2. The section has been deleted. 3. The terminology can be changed. We will change the upper elevation to the terminology indicated in your October 17 fax. 4. The drawing was used for a take-off of the forebay for Pond B and the area was 1,681 square feet. The calculations were based on this data. Later, it was found that the vegetative filter slope of 1:6 was used in the forebay. This was changed back to the 1:3 slope, which gave more volume in the pond. The surface area at Elevation 25 is 4,485 square feet instead of 1,681 square feet. 5. We will refrain from listing the "greenspace acreage" on the form. We use it to assist us in total acreage calculations. We have never counted greenspace as impervious acreage in our calculations. 6. Does the 22' road section on Sheet C-4A apply to the parking lot aisle? 4. The typical building footprint you provided is not completely dimensioned.. 5. Please delineate and label the permanent pool and design pool contours. This means that you must show on sheet C-1 or C-3A the pond's contours in correct relationship to each other based on the section provided, ie., the whole contours below 25 are 2' apart, the distance from 25 to 26.67 is 10' (6:1 shelf) and the whole contours from 26.67 to 28 are 3 feet apart. Using the pond section to provide dimension information does not adequately convey the requirements. Many engineers find it easy and less confusing to provide a to scale detail on the plans of the pond with just the bottom, permanent pool, end of shelf, and design pool contours drawn. Dimensions for the permanent pool are also provided on the detail. Remember to include the forebay as part of the permanent pool. It isn't necessary to treat the forebay a separate dimension. ✓ 7. Please list the surface area provided at elevation 26.67, the end of vegetated shelf, for both ponds. Due to the methodology the State uses to calculate volume, it is necessary to have the area at that elevation where the slope changes from 6:1 to 3:1. I am unable to duplicate the volumes you come up with based on the areas shown in contour on the plans. The following information/explanation are provided. 1 The finished floor elevations and spot elevations in the parking area are shown. 2. Inverts to the catch basins and pipe schedule have been added. They were taken from the data calculated for the County erosion control permit. 3. A signed Operation&Maintenance Plan is enclosed. 4. Sheet C-0 has the wetlands delineated. We are keeping construction out of those areas. 5. The site plan contains the dimensions of the drives and parking areas. The detail sheet has dimensions for the roads and sidewalks. 6. Enclosed is a typical building footprint. No outside patios (wood or concrete) are proposed. Our original calculations had a typical unit at 0.27 acre, whereas the average unit is 0.29 acre. Revisions in the calculations have been made. 7. Roof downspouts are being determined by the Architect and have not been completed. The slope of the permanent pond is now 3:1. 11. The forebay has been made shallower and contains 20 percent of the flow plus some for sediment accumulation. 12. The labeling of the permanent pool and other elevations can best be seen in the sections on Sheet C-2. 13. The dimension on the permanent pool contour is provided for Elevation 30.0. 14. The bottom elevation on the sections are shown on C-2. 15. A plan of the revised collection system areas with the building surface areas are enclosed. We have added the ponds to the collection systems. The composite "C" factor for Area 1 and Pond 1 is 0.62. The combined Areas B and C with Pond B is 0.64. We could decrease the C factor by adding the stormwater recharge areas between Areas B and C and include the wetland areas, but prefer to consider only the areas flowing to the ponds. Basically, the "disturbed area" used for erosion control is the same area used for stormwater. The City wants to review this project after you complete your review. GENERAL REOUIREMENTS: This section covers the furnishing of all labor, materials, equipment and services required for clearing and grubbing within the clearing limits shown on the drawings as specified herein. Within established public rights of way (roads and streets) only such growth and trees will be cleared as is required to construct the pipeline. Where monumental trees are located and designated, no cutting of any part of the tree or principal roots will be allowed and the pipe will be installed by tunneling under the tree. Trees which are 24" diameter B.H. will be considered as monumental trees unless designated for removal by the Engineer. Where new rights of way are acquired to construct the pipeline, the entire width of the right of way will be cleared except for monumental trees. Within the clearing limits of the pumping station sites, the area will be cleared and grubbed. 2. CLEARING: Clearing shall consist of the felling and cutting of trees into sections and the satisfactcny disposal of the trees and other vegetation designated for removal, including down timber, snags, brush, and rubbish occurring within the areas to be cleared. Trees, stumps, roots, brush, and other vegetation in areas to be cleared shall be cut off, flush with or below the original ground surface, except such trees and vegetation as may be indicated or directed to be left standing. Clearing shall so include the removal and disposal of structures that obtrude, encroach upon, or otherwise obstruct the work. In areas designated as selective clearing limits, all trees 6 inches and larger shall remain. All other vegetation shall be removed as specified hereinbefore. 3. GRUBBING: Grubbing shall consist of the removal and disposal of stumps and roots larger than 3 inches in diameter, and matted roots within the clearing limits shown on the drawings. This material, together with logs and other organics or metallic debris not suitable for foundation purposes, shall be excavated and removed to a depth of not less than 18 inches below the original surface level of the ground in areas indicated. Depressions made by grubbing shall be filled with suitable material and compacted to make the surface with the original.adjacent surface of the ground. 4. DISPOSAL OF CLEARED AND GRUBBED MATERIAL: All trees, branches, snags, brush, stumps, etc., resulting from the clearing and by grubbing shall become the property of the Contractor and shall be disposed of by burning, removal from the property or a combination of both. All burning done, if any, shall comply with applicable State and local ordinances. The value of merchantable timber, if any, shall be reflected in the bid price for clearing and grubbing. 4465.02 (041697) SITE CLEARING 02110-1 5. PAYMENT: No separate payment will be made for clearing of trees less than 8" diameter B.H. or smaller brush. Payment for clearing trees larger and for clearing of rights of way and clearing and grubbing of station sites will be at the unit price schedule in the Proposal. END OF SECTION 02110 4465.02 (041697) SITE CLEARING 02110-2 DIVISION 2 - SITE WORK SECTION 02270 - EROSION AND SEDIMENTATION CONTROL 1. GENERAL REQUIREMENTS: The work includes all measures necessary to effectively control erosion on the construction site and prevent sediment-laden run-off from leaving the construction site. 2. CONTRACTOR'S RESPONSIBILITY: The Owner has submitted an erosion control plan to the proper authority and received a permit which is included in these specifications following this section. The Contractor agrees to all of-the conditions of the permit and the Contractor shall be responsible for prevention of damage to properties outside the construction limits from siltation due to construction of the project. The Contractor will assume all responsibilities to the affected property owners for correction of damages which may occur. The Contractor further agrees to assume all responsibilities for all fines or damages accessed against the Owner by any regulatory agency or individual due to lack of proper erosion and sediment control during construction. The Owner reserves the right to withhold a portion of the Contractor's payment requests sufficient to pay the assessments. 3. MINIMUM AREAS TO BE DISTURBED: A. Only those areas necessary for timely and proper completion of the project shall be stripped of native vegetation. B. No land disturbing activity shall be permitted in proximity to a natural watercourse without a buffer zone along the margin of the watercourse of sufficient width to confine visible siltation within the 25 percent of the buffer zone nearer the land disturbing activity. C. The angle for graded slopes and fills shall be no greater than the angle which can-be retained by vegetative cover or other adequate erosion control devices or structures. Slopes left exposed will, within 30 working days of completion of any phase of grading, be planted or otherwise provided with ground cover, devices, or structures sufficient to restrain erosion. D. Whenever land disturbing activity is undertaken on a tract comprising more than one acre, if more than one contiguous acre is uncovered, a ground cover sufficient to restrain erosion must be planted or otherwise provided within 30 working days on that portion of the tract upon which further active construction is not being undertaken. 4465.02 (041697) EROSION AND SEDMIENTATION CONTROL 02270-1 4. METHODS TO BE USED - EROSION CONTROL SCHEDULE REQUIRED: Any accepted erosion sedimentation control measures may be used, at the Contractor's option, including and in addition to specific measures prescribed in the project plans and elsewhere in these specifications. Methods which may be used include, but are not limited to, vegetation, berms, silt fences or silt basins. The Contractor shall program and submit to the Engineer prior to beginning construction an erosion control schedule outlining measures to be taken for positive control of erosion and sedimentation during construction. 5. PLACEMENT OF SEDIMENT CONTROL DEVICES: All devices (silt fences, silt basins, etc.) for sediment control shall be constructed prior to beginning clearing and grubbing on the site. 6. MOINTENAN E OF SEDIMENT CONTROL DEVICES: All devices for sediment control shall be maintained in proper working order for the duration of the project. 7. SCHEDULING OF WORK: Clearing and grubbing shall be scheduled and performed in such a manner that subsequent grading operation and erosion control practices can follow immediately thereafter. Excavation, borrow, and embankment operations will be conducted such that cuts and fills will be completed to final grades in a continuous operation. All construction areas not otherwise protected shall be planted with permanent vegetative cover in accordance with Section 02930 (Establishing Vegetation) of the Specifications within 30 working days after completion of active construction. 8. TEMPORARY SUSPENSION OF WORK: If any earthwork is to be suspended for any reason whatsoever for longer than 30 calendar days, the areas involved shall be seeded with temporary vegetative cover or otherwise protected against excessive erosion during the suspension period. Suspension of work in any area of operation does not relieve the Contractor of the responsibility for the control of erosion in that area. 9. REMOVAL OF SEDIMENT CONTROL DEVICES: Near the completion of the project or upon instruction by the Engineer, the Contractor shall dismantle and remove silt fences and fill silt basins used for sediment control during construction and dress up and seed the area to give a pleasing appearance. 4465.02 (041697) EROSION AND SEDIMENTATION CONTROL 02270-2 10. ADDITIONAL MEASURES: If the Engineer determines that significant sedimentation is occurring as a result of activity on the construction site despite the application and maintenance of prescribed protective measures, the Engineer may require the Contractor to take additional protective measures. 11. DUST CONTROL: A. The Contractor shall control dust throughout the life of the project within the project area and at all other areas affected by the construction of the project, including, but not specifically limited to,unpaved secondary roads, haul roads, access roads, disposal sites, borrow and material sources, and production sites. Dust control shall not be considered effective where the amount of dust creates a potential or actual unsafe condition, public nuisance, or condition endangering the value, utility, or appearance of any property. B. The Contractor will not be directly compensated for any dust control measures necessary, as this work will be considered incidental to the work covered by the various contract items. 12. PAYMENT: All work included under this section shall be considered incidental to other work being paid for by the various items in the contract. No special payment shall be made for erosion and sedimentation control measures during construction. END OF SECTION 02270 4465.02 (041697) EROSION AND SEDIMENTATION CONTROL 02270-3 DIVISION 2 - SITE WORK SECTION 02274 - RIP RAP 1. GENERAL: This section includes furnishing all labor, equipment, plant and materials required to install the rip rap work shown. 2. MATERIALS: A. Rip Rap: Rip rap - Type 1 shall comply with the requirements of Class 1 rip rap as specified by the Standard Specifications for Roads and Structures by the North Carolina Department of Transportation (DOT). Stone shall be coastal limestone pieces and vary in weight from 5 to 200 pounds. At least 30 percent of the total weight shall be in individual pieces weighing a minimum of 60 pounds. Not more than 10 percent of the total weight may be in individual pieces weighing less than 15 pounds each. B. Filter Fabric: Filter fabric shall be woven fabric of polyvinylidene chloride mona-filament yarn consisting of at least 85 percent vinylidene chloride and yarn count of at lest 20 x 20 per inch with equivalent opening size to U.S. Standard Sieve No. 100. Cloth shall be furnished in 6-foot widths and selvaged edges. Lap all edges 8 inches minimum. 3. RIP RAP PLACEMENT: Excavate the bedding to firm soil and install a continuous layer of filter fabric prior to placing the rip rap stone. Hand place stone pieces as necessary to provide an interlocked surface preventing pieces from rolling downhill. Remove any debris or trash from the stone or voids to allow filling the stone as densely as is practically possible. 4. PAYMENT: Payment for all work in this section shall be included in the lump sum contract amount. END OF SECTION 02274 4465.02 (041697) RIP RAP 02274-1 DIVISION 2- SITE WORK SECTION 02724 - DRAINAGE PIPE 1. GENERAL REQ1.METy1E TS: The work includes all materials, labor, equipment and plant necessary to reconstruct or relay all storm drain lines, structures and appurtenances where shown on the plans or as may be disturbed during construction. 2. MATERIAL. : Concrete pipe for use as storm drain pipe shall conform to the requirements of ASTM C-76, latest edition, Class III. with resilient prefabricated "push" joints. Where existing lines are disturbed, those materials which are reusable may be used in restoration. Where pipe is reusable,joints will be made with bituminous joint material or by use of cement mortar diaper joint. 3. LAYING DRAIN PIPE: A. Drain lines shall be laid to line and grade as established by the Engineer, where shown on the plans, or as directed. All pipe lines and structures will be constructed by the use of competent workmen under the supervision of experienced foremen to the end that a satisfactory workmanlike job can be accomplished. Great care shall be taken to obtain well aligned and tight pipe lines so as to assure good flow and the exclusion, insofar as is possible of all infiltration by ground water. B. Layjng}Pipe Drains: Only proper and suitable tools and appliances for the safe and convenient handling and laying of pipes and fittings shall be used. Pipe and fittings shall be carefully handled and lowered into the trench. The ends of pipe shall abut against each other in such manner that there shall be no shoulder or unevenness of any kind along the inside of the bottom half of the pipeline. C. Special care shall be taken to insure that the pipes are well bedded on a solid foundation, and no pipe shall be brought into position until the preceding length has been thoroughly embedded and secured in place. D. Whenever a pipe requires cutting to fit into the line or to bring it to the required location, the work shall be done in a satisfactory manner, so as to leave a smooth end, and without extra compensation. 4. INLETS AND MANHOLES: A. All lines entering structures shall be placed upon the concrete slab prior to beginning any brick work. The masonry work shall be brought up snugly around such lines and a tight connection rnadc so.as to preclude any washout and cavities at the basin. 4465.02 (041697) DRAINAGE PIPE 02724-1 B. The brick walls shall be constructed of concrete block or good hard burned common brick in the manner as shown on the plans, furring in as necessary to meet the casing specified. Brick and mortar shall be specified under Section 04200, Masonry. C. Prefabricated manhole structures must receive prior approval before installation. 5. REPAIR OF EXISTING MANHOLES: Whenever a pipe is passed through an existing manhole, entrance and exit area shall be sealed with a cement compound similar to Embeco 153 Grout by Master Builders, Protoborid ET-180 by Protex or equal. 6. EXCAVATION AND BACKFILL: Excavation and backfill shall be in accordance with Section 02200, Earthwork. 7. PAYMENT: No separate payment will be made for items in this section and all costs shall be included in the pipe line unit,prices or lump sum as shown in the Proposal. END OF SECTION 02724 4465.02 (041697) DRAINAGE PIPE 02724-2 DIVISION 2- SITE WORK SECTION 02930 - ESTABLISHING VEGETATION 1. GENERAL REQUIREMENTS: The work includes the seeding and grassing of the site where indicated and any other grassed area which is disturbed by the Contractor's actions. 2. ORDER OF WORK: Upon completion of any phase of grading, the Contractor shall seed for and begin establishment of a vegetative cover within 30 days for all disturbed areas. If the grading is completed during months when permanent vegetative covers cannot be established, a temporary vegetative cover shall be provided until the conditions are proper for establishment of the permanent cover. 3. ROADWAY SHOULDERS: Where existing grassed roadway shoulders and lawns are disturbed by installation of pipelines or other operations of the Contractor, they shall be repaired and reseeded. Mulch shall be used where required for stabilization of repaired areas. Where topsoil has previously been hauled in, it shall be restored by removal, stockpiling, and replacing, or by hauling in new topsoil. 4. MATERIALS: All materials shall be furnished by the Contractor from sources off the property. A. Tempos Vegetative Cover: (1) Sew: Seeding shall consist of one or more of the following: Late Winter- Spring Per Acre Oats 501bs. Winter Rye (Grain) 50 lbs. Oats and 251bs. Winter Rye(Grain) 251bs. Weeping Lovegrass 4 - 6 lbs. 4465.02 (041697) ESTABLISHING VEGETATION 02930-1 Tate Summer/Early Winter Per Acre Winter Rye (Grain) 50 lbs. Oats 501bs. Barley 30 40 lbs. Wheat 30 - 40 lbs. All seed used shall have been tested not more than six(6) months prior to seeding. The specifications provided with each container shall state the percent purity, germination and number of noxious weed seed per pound. (2) Fertilize r: Fertilizer shall be 8-8-8 grade, uniform in composition, free flowing and suitable for application with approved equipment, delivered to the site in bags or other convenient containers each fully labeled, conforming to the applicable State fertilizer laws, and bearing the name and warranty of the producer. If no soils test is taken, apply fertilizer at a rate of 20 lbs./1,000 sf. (3) Lime: Lime shall be ground limestone containing not less than 85% of total carbonates and shall be grounded to such fineness that at least 50% will pass through a 100 mesh sieve and at least 90%will pass through a 20 mesh sieve. If no soils test is taken, apply lime at a rate of 100 lbs./1,000 sf. (4) Mulch: Mulch shall be dry,unchopped, unweathered small grain straw or hay free of seeds of competing plants. Apply 1 to 2 tons/acre on all seeded areas. All slopes with straw mulch exceeding 3:1 slopes shall have an asphalt tack applied at the rate of 225 gallons/acre. In areas of high pedestrian traffic, a rapid setting tack shall be applied.Mulches other than straw, such as bark, burlap,jute matting, wood fiber or others shall be installed as indicated on the drawings. The Contractor may use alternate mulches upon approval of the Engineer. (5) Maintenance: The Contractor shall maintain the temporary vegetative cover by mowing, irrigation, repair of planting failures, or other necessary methods for the duration of the temporary cover. B. Permanent Vegetative Cover: (1) Seeding: Seeding shall consist of one or more of the following: September - April 15 Per Acre Winter Rye (Grain) and 40 lbs. Bermuda Grass (unhulled) 40 lbs. INSPECTION AND TESTS: The Engineer and Owner will be furnished with duplicate copies of invoices for all seed, fertilizer and lime used on the project. The Contractor shall provide tests and/or test results at his expense if required by the Engineer. 4465.02 (041697) ESTABLISHING VEGETATION 02930-3 6. PREPARATION OF PLANTING BED: A. Equipment necessary for the proper preparation of the ground surface and for handling all required materials shall be on hand, in good condition, and shall be approved by the Engineer before the work is started. B. Clearing: Prior to grading and tillage operations, the ground surface shall be cleared of all heavy vegetation, stumps, stones, roots, cable wire, grade stakes, and any other material which might hinder proper grading, tillage, or subsequent maintenance operations. C. Grading: Grades on the areas to be seeded shall be maintained in a true and even condition, preventing the formation of depressions where water will stand. The finished grades on the road shoulders shall conform to the slopes as required by the North Carolina Department of Transportation. D. Tillage: After the areas required to be seeded have been brought to the grades shown on the drawings, the areas shall be thoroughly tilled to a depth of at least 6 inches by plowing, disking, harrowing, or other approved operations until the condition of the soil is acceptable to the Owner. The work shall be performed only during periods when beneficial results are likely to be obtained. E. Application of Fertilizer: Fertilizer shall be distributed uniformly at the specified rate on areas indicated to be seeded and shall be incorporated into the soil to a depth of at least 3 inches by disking, harrowing, or other acceptable methods. The incorporation of fertilizer may be a part of the tillage operation specified above. F. Application of Lime: Immediately following and simultaneously with the incorporation of the fertilizer, lime shall be distributed uniformly at the specified rate and shall be incorporated into the soil to a depth of at least 2 inches by disking, harrowing, or other acceptable methods. The incorporation of the lime with the fertilizer may form a part of the tillage operation specified above. G. Application of SupeWhosph_ ate: Immediately following and simultaneously with-the incorporation of the lime, superphosphate shall be distributed uniformly at a rate of 12 pounds per 1,000 square feet (unless soil tests indicate otherwise) and shall be incorporated into the soil to a depth of at least 2 to 3 inches by disking, harrowing, or other acceptable methods. The incorporation of the superphosphate with the lime may form a part of the tillage operation specified above. H. Leveling: Any undulation or irregularities in the surface resulting from tillage, fertilizing, liming or other operations shall be leveled out before seeding operations are begun. 4465.02 (041697) ESTABLISHING VEGETATION 02930-4 7. SEEDING: Seeding shall be in accordance with the seeding requirements specified herein and shown on the plans. No seeding shall be done during windy weather or when the ground is wet or otherwise non-tillable. The grass seed shall then be covered, using a flexible toothed weeder or other suitable equipment, by stirring the ground not deeper than 1/4 inch. 8. COMPACTION: Immediately after the seed has been planted, the planted areas shall be leveled and rolled with a culti-packer, roller, or other approved equipment weighing 60 to 90 pounds per linear foot of roller. 9. WATER_TNG: Immediately following seeding, when necessary to maintain growth of grass and in any case when planting is permitted in dry weather, planted areas shall be watered. Each watering shall be in sufficient quantities to obviate rapid drying out, and at a rate of which will not cause erosion. 10. PROTECTION: The seeded areas shall be protected against traffic or other use by erecting barricades immediately after seeding is completed and by placing warning signs on the various areas. The seeded areas shall be protected from erosion by placing mulches and other necessary methods. 11. ACCEPTANCE: Seeded areas will be accepted when a healthy growth of vegetation is achieved and maintained to a height of 4 inches. 12. PAYMENT: Payment for work in this section will be at the unit price shown in the Proposal or included in the lump sum item as described in the Proposal.
