On December 12, 2023 a site inspection was conducted for the Greenway Waste facility located at 5940
Old Smithfield Road, Wake County, North Carolina. A copy of the Compliance Inspection Reports are
enclosed for your review. The site visit and file review revealed that the subject facility is covered by
NPDES Stormwater General Perm it-NCG120000, Certificate of Coverage-NCG120102 and NPDES
Stormwater General Permit-NCG240000, Certificate of Coverage-NCG240024. Permit coverage
authorizes the discharge of stormwater from the facility to receiving waters designated as Little Branch
Creek, a Class C waterbody in the Cape Fear River Basin.
As a result of the inspection, the facility was found to be not in compliance with the conditions of the
NCG120000 & NCG240000 permits. Please refer to the enclosed Compliance Inspection Reports for
additional comments and observations made during the inspection. Please provide a copy of the revised
stormwater pollution prevention plan for both the NCG120102 & NCG240024 permits to me in the Raleigh
Regional Office by no later than 90 days from the receipt of this letter or April 15, 2023, whichever comes
first.
Please be advised that violations of the NPDES Stormwater General Permit are subject to a civil
penalty assessment of up to $25,000 per day for each violation. If you or your staff has any
