HomeMy WebLinkAboutSW3231103_Deed Restriction/Protective Covenant Form_20231121 High Density Residential Subdivisions Deed Restrictions & Protective Covenances In accordance with Title 15 NCAC 2H.1000 and S.L. 2006-246, the Stormwater Management Regulations, deed restrictions and protective covenants are required for High Density Residential Subdivisions where lots will be subdivided and sold and runoff will be treated in an engineered stormwater control facility. Deed restrictions and protective covenants are necessary to ensure that the development maintains a "built-upon" area consistent with the design criteria used to size the stormwater control facility. I, Scott Stearns , acknowledge, affirm and agree by my signature below, that I will cause the following deed restrictions and covenants to be recorded prior to the sale of any lot: 1. The following covenants are intended to ensure ongoing compliance with State Stormwater Management Permit Number , as issued by the Division of Energy, Mineral and Land Resources under the Storm water Management Regulations. 2. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to maintain compliance with the storm water management permit. 3. These covenants are to run with the land and be binding on all persons and parties claiming under them. 4. The covenants pertaining to storm water may not be altered or rescinded without the express written consent of the State of North Carolina, Division of Energy, Mineral and Land Resources. 5. Alteration of the drainage as shown on the approved plan may not take place without the concurrence of the Division of Energy, Mineral and Land Resources. 6. The maximum built-upon area per lot, in square feet, is as listed below: Lot# BUA Lot# BUA Lot# BUA Lot# BUA LOT NUMBER LOT AREA(SQ FT) MAX BUA(SQ FT) 1 10888 6800 2 10425 6800 3 10135 6800 4 12193 6800 5 13177 6800 6 12460 6800 7 12057 6800 8 13890 6800 9 30926 6800 10 17804 6800 11 16640 6800 12 10080 6800 13 10607 6800 14 14187 6800 15 17867 6800 16 13060 6800 17 10080 6800 18 11130 6800 19 11130 6800 20 10080 6800 Form DRPC-3 Rev.2 05Nov2009 Page 1 of 4 High Density Residential Subdivisions Deed Restrictions & Protective Covenances 21 10080 6800 22 10080 6800 23 11745 6800 24 17297 6800 25 10500 6800 26 10500 6800 27 10500 6800 28 11200 6800 29 11200 6800 30 10044 6800 31 10050 6800 32 10501 6800 33 12580 6800 34 14691 6800 35 11544 6800 36 10080 6800 37 10080 6800 38 10080 6800 39 11015 6800 40 12234 6800 41 12000 6800 42 12000 6800 43 12000 6800 44 14100 6800 45 15941 6800 46 14877 6800 47 14471 6800 48 13868 6800 49 13065 6800 50 11345 6800 51 11382 6800 52 13252 6800 53 11232 6800 54 12433 6800 55 12425 6800 56 11209 6800 57 11200 6800 58 11200 6800 59 13821 6800 60 15302 6800 61 14517 6800 62 12777 6800 63 10010 6800 Form DRPC-3 Rev.2 05Nov2009 Page 2 of 4 High Density Residential Subdivisions Deed Restrictions & Protective Covenances 64 10010 6800 65 10528 6800 66 12213 6800 67 12205 6800 68 17992 6800 This allotted amount includes any built-upon area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas, but does not include raised, open wood decking, or the water surface of swimming pools. 7. Each lot will maintain a 30**foot wide vegetated buffer between all impervious areas and surface waters. **50 foot for projects located in the 20 coastal counties. 8. All runoff from the built-upon areas on the lot must drain into the permitted system. This may be accomplished through a variety of means including roof drain gutters which drain to the street, grading the lot to drain toward the street, or grading perimeter swales to collect the lot runoff and directing them into a component of the stormwater collection system. Lots that will naturally drain into the system are not required to provide these additional measures.
