We are in receipt of your Request for Additional Information dated February 14, 2019 for the
referenced project. We provide the following information to allow you to continue processing the
stormwater application (item numbers correspond to your original letter):
1. The Bearing/Distances of Project Boundary have been added to the Stormwater Plan.
2. Attached are Engineering Calculations for the conveyances demonstrating non-erosivity.
3. Swale lengths have been minimized (minimal grades) to the maximum extent practical such
that proposed homes sites are not affected by runoff from the streets. Grading at end of
proposed swales is such that Sheet Flow will be provided and infiltration promoted.
4. Supplement Form emailed per your request.
We are hopeful that this response addresses your concerns and allows you to proceed with review
and issuance of the Permit Modification.

Dear Ms. Bullock:
The Wilmington Regional Office received and accepted a State Stormwater Management Permit
Application for the subject project on October 29, 2018. A request for additional information was mailed
on November 5,2018, and a response was received on January 31,2019. A preliminary in-depth review
of that information has determined that the application is not complete and that additional information is
needed. To continue the review,please provide the following additional information:
1. Project Area[15A NCAC 02H.1042(2)(g)(ii)]: Please provide dimensioned project or project
phase boundary with bearings and distances.
2. 10yr Storm [15A NCAC 02H.1003(2)(c)(ii)]: Please provide engineering calculations supporting
the information presented in the low density supplement to demonstrate that the conveyances
have been designed to not erode during the peak flow from the 10-year storm event.
3. Swales [15A NCAC 02H.1003(2)(b)]: The grading plan shows swales are proposed. Please
provide justification that the stormwater cannot be dispersed and that conveyances are needed.
4. Supplement[15A NCAC 02H.1042(2)]: Please email the supplement form to the email address
provided below so that it can be preserved electronically per the regulatory requirements.
Please remember to confirm that any revised information is presented consistently throughout the
application documents including calculations, supplements,narrative, and plans. Please also remember to
provide two hard copies of any updated documents per 15A NCAC 02H.1042(2).
The requested information should be received in this Office by March 1,2019,or the application will be
returned as incomplete. If the project is returned and you wish to re-submit later,you will need to
resubmit all required items at that time,including the application fee.
If additional time is needed to submit the requested information please e-mail,mail, or fax your extension
request,prior to the original due date,to the Division using the contact information available in this letter.
The extension request must include a justification and a date of when the requested information will be
submitted to the Division.Please remember that extension requests delay the issuance of the final
permit. The Division is allowed 90 days from the receipt of a complete application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement
action pursuant to NCGS 143-215.6A.

David,
There has been no change in rule, policy or guidance on this issue. Applicable rule citations are listed below.
Your project drains to an UT of Turkey Creek(SA; ORW). DWR has identified a point on that UT where it transitions from
saltwater to freshwater. That point is within a half-mile of your project. Landward of this point,the UT is "freshwater
tributary to tidal saltwaters" with a classification of"C" [.0301(i)(1)(B)]. Downstream of the point(and within a half-mile
of your project),the saltwater portion of the UT carries the, "same classification as that assigned to the stream segment
to which it is tributary"which is "SA; ORW" [.0301(i)(1)]. Since the receiving stream transitions from freshwater to
saltwater within a half-mile of your project you are within a half mile of and drain to SA; ORW waters.
In order to potentially minimize the impact, I recommend that you consider measuring the SA boundary landward from
NHW per.1019(5)(a)(i). If the line crosses through your tract,then you may have two drainage areas. One would be an
SA drainage area (inside half-mile to the point),and the other a non-SA drainage area (outside the half-mile) per§ 143-
214.7(b2)(3). I hope that helps.

15A NCAC 02H .1019(5)
(a) SA WATER. SA Water requirements shall apply to projects located within one-half mile of and draining to waters
classified as SA-HQW or SA-ORW per 15A NCAC 02B.0301.
(i)The SA boundary shall be measured from either the landward limit of the top of bank or the normal high
water level. In cases where a water is listed on the Schedule of Classifications, but the applicant provides
documentation from the Division of Water Resources or the U.S.Army Corps of Engineers that the water is not
present on the ground,the applicant shall not be subject to the SA requirements of this Rule.
15A NCAC 02B .0301(i) Unnamed Streams.
(1)Any stream which is not named in the schedule of stream classifications carries the same classification as that
assigned to the stream segment to which it is tributary except:
(A)unnamed streams specifically described in the schedule of classifications;or
(B) unnamed freshwaters tributary to tidal saltwaters will be classified "C"; or
(C)after November 1, 1986, any newly created areas of tidal saltwater which are connected to Class SA waters
by approved dredging project
§ 143-214.7(b2)(3) The requirements that apply to development activities within one-half mile of and draining to Class
SA waters or within one-half mile of Class SA waters and draining to unnamed freshwater tributaries shall not apply to
development activities and associated stormwater discharges that do not occur within one-half mile of and draining to
Class SA waters or are not within one-half mile of Class SA waters and draining to unnamed freshwater tributaries.

In that response you stated, "even though a UT all waters have a classification"
Yes, I agree it is a UT(freshwater unnamed stream)....
And yes I agree that 15A NCAC 02B .0301 provides a methodology to assign a classification to an "unnamed stream"
In this case, 2H.1019 and 2B.0301 clearly state for the purposes of"DETERMINATION OF WHICH COASTAL
STORMWATER PROGRAM APPLIES unnamed freshwater tributary(s) to tidal saltwaters will be classified "C"'
The Rules appear quite straightforward, unambiguous and definitive.
If there are additional definitive and current RULES (as opposed to internal policy)that suggest otherwise I would be
more than willing to read and learn.
But in the meantime, I remain convinced that, BASED ON THE CURRENT RULES, and BASED UPON PREVIOUSLY ISSUED
GUIDANCES FROM DEQ,that this particular unnamed freshwater tributary, for the purposes of determination of which
coastal program is applicable, should be classified "C" (12%).

Hey David,
This follows my previous email below. Our Division is often asked to locate the extent of SA-waters to assist our
environmental engineers with state stormwater project applications they receive. In this case, I determined the
approximate extent of saltwater influence on the vegetation within this un-named tributary(UT)to Turkey Creek (SA;
ORW),through our Non-Discharge GIS aerial photography and LIDAR Mapping. Even though this is a UT, all waters have
a classification, and in this case it is SA-Waters to the point of tidal influence. As stated before, I would be happy to
meet with you on-site as well to locate the extent of tidally influenced waters.

We do follow the rules that you name below when it comes to unnamed UTs. However, not all unnamed UTs have had
the point of origin for saltwater identified for the stream. When that is the case,we have to have water resources field
check the stream and make a call on freshwater vs saltwater. Your project drains to a UT that has not had the point of
origin identified. The map in yesterday's letter showed the tali made by Water Resources and the location of your
project.
Since this shows it is a 1/2 mile from SA it has to meet the 12%requirement for Stormwater,

I reviewed the Additional Info letter Kelly Johnson sent yesterday. In that letter you state "application
indicated that the project was over a half-mile from the site (?receiving water?). But, I did not see the USGS
Map with the site and the half mile line drawn to SA waters"
If we inadvertently failed to include those map(s) in the package, I do apologize. That said, I have attached
them to this email (attachment 1 and 2). As you can see from those attachments the closest portion of the
project is 0.65 miles to the closest "named surface waters", that being Turkey Creek per NC Surface Water
Classifications

Current rules (15A NCAC 02H .1019 COASTAL COUNTIES) state,
(5) DETERMINATION OF WHICH COASTAL STORM WATER PROGRAM APPLIES. (a)SA WATER. SA Water
requirements shall apply to projects located within one-half mile of and draining to waters classified as SA-
HQW or SA-ORW per 15A NCAC 02B .0301. (i)

15A NCAC 02B .0301(i) further clarifies as follows,
"Any stream which is not named in the schedule of classifications carries the same classification as that
assigned to the stream segment to which it is tributary; EXCEPT:
B) unnamed freshwaters tributary to tidal saltwaters will be classified C"
The un-named tributary to which this project is tributary is NOT named in the State's Schedule of
Classifications.
The un-named tributary to which this project is tributary is indeed a freshwater tributary.
Therefore.....according to the above language it would seem that un-named tributary should be classified
C waters (24%).
The State provided the Design Community the attached guidance document (attachment 3) to assist us in
determining which rules would apply to a specific project location. We have been routinely relying on that
guidance to provide developers "guidance" as to what rules might apply to a prospective development
project. In this instance, that document indicates this project is "Not Subject to SA Requirements" In fact, in
this instance, the Developer relied on our recommendation before purchasing the tract in question, and
certainly would NOT have purchased if he believed a 12% density requirement would be imposed.
I guess my question is this I am not the only Engineer relying on that document to make "calls" on what
rules would apply to projects tributary to un-named (un-classified) waters Many, many Engineers and
Developers similarly do. Is that document no longer applicable? If not, perhaps we need to issue some new
clarification (guidance) so everybody is "on the same page". Otherwise, It seems the entire process is rather
arbitrary and subject to differing interpretations when it seems the Rules themselves are quite clear.

looked through the documents to become familiar with the project before filing it for my future review.
I noticed that the application indicated that the project drains to SA; ORW and that the application
indicated that the project was over a half-mile from the site. But, I did not see the USGS Map with the
site and the half-mile line drawn to SA waters included with the package. As we discussed over email
beginning on Friday,November 2,2018,I reached out to your engineer to get a copy of that USGS map
in order to expedite the future review. I then learned that Robb Mairs of DWR had not yet been asked
to confirm the shellfish(SA)location for this project. As indicated in this email chain,he provided the
following map showing that the project is 0.44 miles from SA waters. He has offered to meet onsite to
locate this point of tidally influenced wetlands if needed. I have not reviewed any other aspect of
this application.

02B.0301(i)(1)(B) (inserted below),an UT carries the classification of its main stem. This project is
within a half-mile of the tidal saltwater portion of its receiving UT and is therefore subject to SA
requirements. Please ensure that the appropriate changes are made to the design.

We have been relying on the NC Surface Water Classifications website
(httos://ncdenr.maps.arceis.com/apps/webappviewer/index.html?id=6e125ad7628f494694e259c80dd64265) and the
attached Guidance Document provided to us by your office to determine whether prospective projects are subject to
the SA requirements(i.e. 12%).
Based on those resources....it appears that the drainway on the southerly boundary of the tract is a UT to Turkey Creek
(which is SA)...however is greater than 0.50 miles.
Based on the attached guidance document provide to us by NCDENR such a project is"not subject to SA
requirements".
Please consider and advise.

The main thing is 12%Ws 24%. It looks like you all drain to an UT of SA,and the UT carries the main stem's classification
except for three caveats per NCAC 02B.0301(i). Paraphrasing,the UT doesn't carry the main stem's classification 1.) If it
has its own classification,2.) If it isn't a "source" but instead a freshwater tributary(which is complicated), or 3.) If it
drains to a dredged area. Numbers#1 are fairly straightforward but if it is#2 then Robb will make the call and we
will measure the half-mile from the spot he sets.

Stormwater Narrative
Project Description
Beaver Creek Investors, Inc. is proposing to construct a subdivision in Stump Sound Township,
NC. The project is located off Tar Landing Road (NCSR 1531). Construction activities shall
include, but are not limited to, clearing and grubbing, grading, landscaping, installation of
asphalt drives, storm drainage piping, skimmer basins and stormwater swales. Approximately
20 acres are to be disturbed by construction activity.
Site Conditions
The project site is located in Stump Sound Township in Onslow County, North Carolina. The
existing site is currently undeveloped with open grassed and wooded area. The site is, in
general, mostly flat in the upland areas with moderate slopes in twlands. The proposed
project is located in the White Oak River Basin. Th roject dr ,to UT Turkey Creek
(NCDEQ Index Number 18-87-1), however, is grea r than 0.50 mil from this receiving
stream. The stream has a NCDEQ Stream Classifica on of SA;ORW.
Design Standards
Project is designed as a Low Density subdivision in accordan a with the current Stormwater
Rules for Coastal Counties (15A NCAC 02H.1019. As stated bove, project is located in a
watershed classified as SA:ORW, therefore the project is designe for maximum BUA of 12%
