HomeMy WebLinkAboutNCS000532_Inspection_20230928 ROY COOPER i / Governor MICHAEL S.REGAN ,�, , fir, Secretary s�v BRIAN WRENN NORTH CAROLINA Director Environmental Quality September 28, 2023 Oak-Bark Corporation Attn: William Oakley 514 Wayne Drive Wilmington, NC 28403 Subject: Compliance Evaluation Inspection, Permit Rescission Request NPDES Individual Stormwater Permit Certificate of Coverage NCS000532 Oak-Bark Corporation Riegelwood Columbus County Dear Mr. Oakley: On September 27, 2023, Brian Lambe from the Wilmington Regional Office of the Division of Energy, Mineral, and Land Resources (DEMLR), conducted a compliance evaluation inspection for Bakelite Synthetics located in 333 Neils Eddy Road, Columbus County, North Carolina. The site drains to UT to Mill Creek,which is currently classified as Class C,Sw Waters in the Cape Fear River Basin. A permit rescission request was received by this office September 19, 2023. At this time,this office rejects the rescission request. The following observations were noted during the DEMLR inspection (please see the attached addendum for additional information about your permit): 1)Stormwater Pollution Prevention Plan(SPPP) A Stormwater Pollution Prevention Plan (SPPP) NOT has been developed, recorded, and properly implemented. A SPPP should be prepared according to current site conditions. 2) Qualitative Monitoring Qualitative monitoring has NOT been conducted and recorded in accordance with permit requirements. 3)Analytical Monitoring Analytical monitoring has NOT been conducted and recorded in accordance with permit requirements. Sampling is required for the monofill discharge. Other Observations: Oak Bark has not conducted any manufacturing since 2011.The 55 gallon drums need to be removed or stored under cover.The large liquid storage tanks near the wester warehouse are labeled as"Not in service", but documentation of decommissioning of the tanks is needed.The monofill area has a report by Shield Engineering circa 2020.The upper layer of the liner is in disrepair.The stormwater is discharged by a pump.This discharge must be sampled regularly. Please be advised that violations of the NPDES Stormwater General Permit may be subject to a civil penalty assessment of up to $25,000.00 per day for each violation. The western warehouse is empty at this time. There are about twenty 55 gallon drums filled with hazardous material. Recommend removal of the drums or store under cover. Inspected 6 large liquid storage tanks adjacent to the western warehouse. The Columbus county tax gis indicates only one is within the Oak Bark property, the other five may be within the Bakelite/Hexion property. The tanks all were labeled as not in service. Clarification of ownership is needed. Documentation of tank decommissioning is needed. The monofill area was observed during Bakelite inspection. The inspection confirmed a 2020 Shield Engineering report that the upper liner is in disrepair. The report recommends permanently capping the monofill. The surface rainwater is allegedly pumped offsite at this time. 2020 report documents some contamination in the rain water. Could not locate documentation for allowing this discharge. Please provide documentation of this.
