HomeMy WebLinkAboutSW8031059_Historical File_20031008 State Stormwater Management Systems Permit No. SW8 881201 Modification STATE OF NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES DIVISION OF WATER QUALITY STATE STORMWATER MANAGEMENT PERMIT LOW DENSITY DEVELOPMENT In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules and Regulations PERMISSION IS HEREBY GRANTED TO DeCarol Williamson The Pearl Brunswick County FOR THE construction, operation and maintenance of a 25% low density subdivision with a curb outlet system in compliance with the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "storrrmwater rules") and the approved stormwater management plans and specifications, and other supporting data as attached and on file with and approved by the Division of Water Quality and considered a part of this permit. The Permit shall be effective from the date of issuance until rescinded and shall be subject to the following specific conditions and limitations: I. DESIGN STANDARDS 1. The project is a golf course with condominium/apartment-style buildings, parking, roads, and cartpaths. The tract is limited to a maximum of 201.53 acres of built- upon area, as defined by the stormwater rules, and as indicated in the approved plans. There is 16.24 acres of built-upon area currently existing, leaving 185.29 acres available for future development. CAMA regulations may reduce the built- upon area for those areas within CAMA's AEC. 2. The overall tract built-upon area percentage for the project must be maintained at 25%, per the requirements of Section .1005 of the stormwater rules. 3. This project proposes a curb outlet system. Each designated curb outlet swale or vegetated area to be used for treatment of the runoff must be maintained at a minimum of 100' long, have 5:1 (H:V) side slopes or flatter, a longitudinal slope no steeper than 5%, carry the flow from a 10 year storm in a non-erosive manner, maintain a dense vegetated cover, and be located in either a dedicated common area or a recorded drainage easement. 4. No piping shall be allowed except those minimum amounts necessary to direct runoff beneath an impervious surface such as a road, or under the fairways, as shown on the approved plan. 5. Runoff conveyances other than the curb outlet system swales, such as perimeter ditches, must be vegetated with side slopes no steeper than 3:1 (H:V). 2 State Stormwater Management Systems Permit No. SW8 881201 Modification 6. Approved plans and specifications for projects covered by this permit are incorporated by reference and are enforceable parts of the permit. II. SCHEDULE OF COMPLIANCE 1. Curb outlet swales, vegetated areas and other vegetated conveyances shall be constructed in their entirety, vegetated, and be operational for their intended use prior to the construction of any built-upon surface, per the approved plans 2. During construction, erosion shall be kept to a minimum and any eroded areas of the swales or other vegetated conveyances will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to operate the permitted stormwater management systems at optimum efficiency to include: a. Inspections b. Sediment removal. c. Mowing, and revegetating of the swale side slopes. d. Immediate repair of eroded areas. e. Maintenance of swale side slopes in accordance with approved plans and specifications. f. Cleaning and repair of catch basin grates, flumes, and piping. 4. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to the approved plans, regardless of size. b. Project name change. c. Transfer of ownership. d. Redesign or addition to the approved amount of built-upon area or to the drainage area. e. Further subdivision, acquisition or sale of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval was sought. f. Filling in, piping, or altering any vegetative conveyance shown on the approved plan. 5. The Director may determine that other revisions to the project should require a modification to the permit. 6. The permittee is responsible for verifying that the proposed built-upon area does not exceed the allowable built-upon area. Additions to the permitted amount of built-upon area must be approved through a permit modification. 7. The permittee must certify in writing that the project's stormwater controls, and impervious surfaces have been constructed within substantial intent of the approved plans and specifications. Any deviation from the approved plans must be noted on the Certification. The permittee shall submit the Certification to the Division within 30 days of completion of the project. 8. The permittee shall submit ail information requested by the Director or his representative within the time frame specified in the written information request. 9. The built-upon area covered by this permit must be located a minimum of 30 feet from the Mean High Water line of surface waters. 10. All roof drains must terminate at least 30' from the Mean High Water mark. 3 State Stormwater Management Systems Permit No. SW8 881201 Modification 11. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 12. Prior to transfer of ownership, any permitted stormwater treatment devices such as swales must be inspected and determined to be in compliance with the permit. Any deficiencies will be repaired or replaced prior to the transfer. 13. The final plats for the project will be recorded showing all required swale easements and common areas, in accordance with the approved plans. 14. Certain areas of the Master Plan are subject to be designated as pockets of high density, where the built-upon area is clustered and/or sheet flow of the runoff cannot be achieved. The Division will make this determination based on the detailed site plans to be submitted as each phase is developed. These areas will, at the request of the DWQ, either provide an infiltration system to treat the runoff, or redesign the area so that adequate sheetflow of the runoff across a minimum of 30' of open grassed area is provided. 15. Detailed site plans for each phase must be submitted and approved prior to development. If the site plans are in substantial conformance with the Master Plan, a plan revision will be issued. If the site plans indicate substantial deviations from the Master Plan, a modification will be required. III. GENERAL CONDITIONS 1. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Water Quality, in accordance with North Carolina General Statutes 143-215.6A to 143-215.6C. 2. The permit issued shall continue in force and effect until revoked or terminated. 3. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance, or termination does not stay any permit condition. 4. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules, and regulations contained in Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General Statute 143-215.1 et. al. 5. The permit is not transferable to any person or entity except after notice to and approval by the Director. The Director may require modification or revocation and reissuance of the permit to change the name and incorporate such other requirements as may be necessary. A formal permit transfer request must be submitted to the Division of Water Quality accompanied by the appropriate fee, documentation from both parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits, and may or may not be approved. The permittee is responsible for compliance with all the terms and conditions of this permit until the transfer is approved by the Division. 6. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances imposed by other government agencies (local, state and federal) which have jurisdiction. If any of those permits or approvals result in revisions to the plans, a permit modification must be submitted. 4 State Stormwater Management Systems Permit No. SW8 881201 Modification 7. The permittee grants permission to DENR Staff to enter the property during business hours for the purposes of inspecting the stormwater control system and its components. 8. The permittee shall notify the Division of Water Quality of any name, ownership or mailing address changes within 30 days, via the "Name/Ownership Change Form". Please recall that Mr. Bowman previously faxed you a copy of the May 20, 2003 letter from the South Brunswick Water and Sewer Authority (SBWSA) Engineering Committee to their Board of Directors in regards to this project. Enclosed is another copy of this letter for your ease of reference. As you are aware, the proposed wet ponds being used in this project are being provided only to meet SBWSA's post vs pre-development runoff requirements (water quantity issues). These ponds are not being proposed as a form of treatment and no discrete stormwater collection systems will be constructed. Grassed swales will be used within this low density project that collect runoff and discharge to these ponds. Therefore, the water quality issues will have already been met by the time any runoff reaches these ponds. Enclosed is a copy of information we have obtained from the Brunswick County Tax Office which documents that The Pearl maintenance building was constructed in 1986. The same information is also enclosed documenting that The Pearl clubhouse and pro shop building was constructed in 1987. Hopefully, this will suffice to show that the existing built-upon areas (including the golf cart paths and existing roads), as shown on our Master Stormwater Plan, pre-date the current Stormwater Regulations which went into effect January 1, 1988. We will request additional information from Dr. DeCarol. Williamson documenting that the existing impervious surfaces within The Pearl pre-date 1988. Ms. Lewis Page Two The Pearl June 12, 2003 Brunswick County, NC The low density stormwater plan for The Pearl that your department received in late 1988 from others did not accurately reflect the conditions in existence at that time. That plan did not show the clubhouse and pro shop in their correct locations, nor did the plan reflect the streets and golf cart paths which were in existence at that time. Please note that the current design approach for this project has not changed from that mentioned in our February 28, 2003 submittal letter to you. This design approach is to handle storm drainage within The Pearl through extensive use of vegetative swales and filters. The roadway sections will have curb and gutter with curb cuts draining to such swales and filters as required. Subsequent individual site specific designs and submittals of each phase will show the precise locations of all proposed storm drainage features and will include the appropriate hydraulic and hydrologic calculations. It is our understanding that the provision of the enclosed information and the letter from SBWSA will allow you to continue your review. As you will note in SBWSA's May 20, 2003 letter, they encourage the completion of your review of this project, particularly since you possess the expertise to understand projects of this type. The 1999 amendment to the SBWSA Stormwater Ordinance clearly states that the requirements of our ordinance are to be "consistent with the 15A NCAC 2H.1000 State Stormwater Management rules." In most places the words and/or definitions are copied word for word from the state ordinance,but sometimes SBWSA's amended ordinance stops short of encompassing the entire state ordinance. The conflict comes when we attempt to be"consistent"with state regulations,but at the same time, some practices are not expressly"allowed"in the SBWSA ordinance. The Engineering Committee is working to overcome these inconsistencies, and suggest verifying points of conflict within the ordinance. By copy of this letter we encourage the State's review of The Pearl's application, in particular,the review by Linda Lewis with the N.C.Division of Water Quality,we encourage the State to complete its review-particularly since they possess the expertise to understand projects of this magnitude.As the local stormwater regulation entity, we offer our opinion as to two points of confusion between our two agencies' ordinances. We are referring to the use of curb outlet system and wet detention ponds in low-density projects. The Engineering Committee is of the opinion that: 1) Consistent with the 15A NCAC 2H.1000 State Stormwater Management rules, curb outlet systems are allowed in a low-density project.The N.C.Code addresses curb outlet systems in 15A NCAC 2H.1008(g) by stating "projects that meet the low density provisions of Rules .1005 through .1007 of this section may use curb and gutter with outlets to convey the stormwater to grassed swales or vegetated area prior to the runoff discharges to vegetable filters or wetlands." Also consistent with 15A NCAC 2H .1000 State Stormwater Management rules SBWSA should allow pipes to be used to carry drainage underneath built-upon surfaces that are associated with low-density development. 2) Wet detention ponds,though not an acceptable means of providing quality treatment of stormwater within one-half mile of SA waters,we do not believe are prohibited in a low- density project under both SBWSA and State rules. We concede to Ms. Lewis' letter of April 14, 2003, to The Pearl Development where she states "...golf course ponds can exist within a low-density project as long as they are not being proposed as a form of treatment,and a discrete collection system is not constructed.Grass swales,within a low- density project that collect runoff and discharge to a golf course pond, are considered to meet the intent of low-density development. As far as we are aware, only the discharge from a detention pond being used as a stormwater treatment system or from a sanitary sewer treatment system is prohibited in SA waters." The Engineering Committee recommends the development of necessary amendments to the stormwater ordinance and presenting them to the public for comments while at the same time submitting them to the proper state agencies for approval. The 100' vegetated swales will not be located in wetlands. The detail on the master plan is not sufficient to provide the exact location of swales. Because the South Brunswick Water and Sewer Authority (SBWSA) would not accept a Master Stormwater Plan for this project, detailed site and grading plans for the entire project have been prepared. The detailed plans will show the exact location and length of all swales. We have already submitted the detailed site and grading plans to SBWSA and will forward them to you under a separate application within the next few days (we are currently preparing the application for our Client's signature). 2. A minimum 100' vegetated swale will be maintained on each curb outlet prior to discharge into any golf course pond. 3. The proposed areas in question are designed such that treatment of the stormwater runoff will be consistent with the other areas of the project,namely vegetated swales, and run-off dispersal by sheet flow. The two areas are similar to the existing clubhouse area. However, if these areas are deemed pockets of high density by NCDENR, treatment will be revised in conformance with state regulations. Since the overall project is still within the low-density limits, the approval of the MASTER PLAN is requested with these areas included as submitted. 4. The runoff from the proposed built-upon area will not drain through the existing pipes prior to treatment. Some of the existing piping is located in the natural drainage ways of the property and will unavoidably drain the runoff after treatment. 5. Page 2 of the application is revised and is enclosed for replacement of the previous submittal. Also enclosed is a revised Sheet 3 of 4. Please note that the BUA in the data summary is revised. The new total BUA is 201.53 acres, which is exactly 25% of the overall project area. The application and the data summary both reflect this new total. In the course of performing the detailed site and grading plans for this project, several buildings have been eliminated and several more relocated due to conflicts with wetlands and surface waters. The enclosed revised Master Stormwater Plan is depictive of the adjusted site layout. 6. The Data Summary Table on Sheet 3 of 4 is revised and two copies are enclosed for replacement of the previous submitted sheet. 7. The enclosed Sheet 3 of 4 shows the new location of all the buildings that may have had some conflict with surface waters. The detailed plans that will be submitted within the next few days will show the exact location of all buildings in relation to the MHW line. The detailed plans are also at a much larger scale, so the distance between objects can be accurately determined. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. The grading plan indicates that several of the swales might be located in wetlands. Curb outlet swales may not be located in wetlands. Please relocate any swales off of parking areas that are adjacent wetlands so that the entire 100' of swale is provided prior to discharge into the wetland. 2. The grading plan also indicates several areas where swales appear to be draining directly into golf course ponds. Please remember that the entire 100' of the curb outlet swale must be provided prior to discharge in any pond. The pond itself may not act as the treatement device because wet detention ponds are not allowed within '/2 mile of SA waters. 3. There are two areas shown on the Master plan that could be considered pockets of high density- one is between Fairways 15W and 16W and the other is just across the causeway over Lake Osprey to the right. Both areas show two bays of double-loaded parking lots, and one has a very large building. 4. There is a lot of existing piping which serves no purpose other than to transport runoff. .1 understand why there are pipes under the fairway and under the road. In some cases, though, small pipes under the cart path are extended for several hundred feet into a pond. In other cases, the pond's outlet appears to be piped for several hundred feet to a wetland. None of the runoff from the proposed built-upon area can be allowed to drain through these pipes. 5. Please revise page 2 of the application to reflect the proposed built-upon area of 199.15 acres. Please note that this request for additional information is in response to a preliminary review. The requested information should be received in this Office prior to September 1, 2003, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee.
