This development will require modifications to the four subject permits because access roads/driveways will need to be constructed inside these permits to accommodate the new development. Additionally,these permits need to be transferred to their new owner(s)and two of them need to be renewed. DECft) North Carolina Department of Environmental Quality(Division of Energy,Mineral and.l d Resources Vlliltnington Regional Office 1727 Cardinal Drive Extension I Wilmington.North Carolina 28405 NMI a [n.uw�w I. °+." ^"^' "0.01, ' 910.796.7215 State Stormwater Permit No. SW8 980801,SW8 030724,SW8 020221,and SW8 960822 Page 2 of 3 Request for Permit Transfers: Post-construction state stormwater permits do not automatically transfer when property ownership changes and permit holders are required to continue to comply with the terms,conditions and limitations of any Stormwater Management Permit issued under Title 15A NCAC 2H.1000 and North Carolina General Statute 143-214.7 until the Division approves the transfer of the permit. The transfer requirements for post-construction stormwater permits outlined in GS 143-214.7(c5)were rewritten by Session Law 2021-158 which became law on September le 2021.. This amended section of the General Statutes allows the Division to require the submission of an application to transfer a post-construction stormwater permit within 180 days when the following conditions were met prior to July 1,2021: a. The permit holder is one of the following: 1. A natural person who is deceased. 2. A partnership,limited liability corporation,corporation, or any other business association that has been dissolved,has completed the winding up of the business as required by law or equity, and does not have a successor-in-interest to the permit. 3. A person or entity who has been lawfully and finally divested of title to the.property on which the permitted activity is occurring or will occur through foreclosure,bankruptcy,or other legal proceeding. 4. A person or entity who has sold the property on which the permitted activity is occurring or will occur. b. The successor-owner is one of the following: 1. A person or entity holding title to the property on which the permitted activity is occurring or will occur. 2. The claimant of the right to engage in the permitted activity. 3. An association, as defined in G.S.47C-1-103 or G S.47F-1-103. 4. Any other natural person, group of persons, or entity deemed appropriate by the Department to operate and maintain the permit. c. There will be no substantial change in the permitted activity. The Division has been made aware that the current permit holders have sold the properties on which the permitted activity is occurring or will occur as summarized in.Attachment A. County records show that new owners now hold the titles to the property on which the permitted activity is occurring or will occur. A review of aerial photography and county records for these sites also found that there appears to be no substantial change in permitted activity. Since the conditions of G.S. 143-214.7(c5),as amended by Session Law 2021-158 appear to have been met prior to July 1,2021,jointly completed,and signed permit transfer application forms along with the necessary documentation and the required$505.00 processing fees must be submitted within 180 days of the receipt of this letter. The permit transfer application is available on the Post-Construction Stormwater Program section of the Division's website:deq.nc.gov/SW. Upon receipt of the signed transfer applications and the required documentation,site inspections will be scheduled to confirm compliance with the permit. Prior to submitting the transfer application packages,please evaluate the project for compliance. If the project does not conform to the approved plans and permit conditions,then in accordance with G.S. 143-214.7(c5X1d)either submit modification(s)within 180 days of the receipt of this letter or prepare and submit schedule(s)of actions that will be taken to bring the project(s)into compliance with the approved plans and permit conditions within 1 calendar year. If the permit holder can demonstrate that the property was in substantial compliance in the 12 months either before or after the conditions were met,resulting in this notice,then the compliance requirements shall be the sole responsibility of the successor-owner. Request for Permit Renewals: Please submit complete permit renewal forms signed by the current permittee along with a$505.00 fee per permit for SW8 980801 and SW8 030724 and other submittal requirements within 30 days. Hi all, In review of these requests, in addition to the impacts to SW8 030724 and 5W8 020221,the proposed entrance drive connecting to Cadbury Lane and Dartmoor Way appears to impact SW8 960822 and SW8 980801 as well.These two additional impacted permits have outstanding compliance issues. As noted in the Express fee schedule (which can be found on this website or the express website),the express program is for projects that do not have compliance issues or do not impact,overlap,or cause other permits to become out of compliance. Projects that do have compliances issues that will not be resolved by the proposed permitting action are not eligible for express.Additionally,the express program is intended for projects that can be reviewed within the established timelines and projects are carefully scheduled to ensure those timelines can be met. The number of permits impacted by the proposed project and the associated review timelines are incompatible with the express program. Therefore, due to the impacts to other permits and the outstanding compliance issues of those impacted permits,the proposed permitting actions are not eligible for the express program and would need to be submitted to the regular program.
