We are in receipt of your review comments for The Cottages at Wingate—Phase 1 and 2 located on
Maye Street in Wingate,NC.Please find below the edited responses to the requested information.
DEMLR COMMENTS
Contact:Jim Farkas
The Division of Energy,Mineral and Land Resources (DEMLR),received a Stormwater
Management Permit Application for the subject project on April 21,2023.A review of that
information has determined that the application is not complete. The following information is
needed to continue the stormwater review:
1) Prior Comment l.a.—"Off-site Drainage Any off-site drainage area that is not bypassed around the
SCM must be accounted for at its full build-out potential(per 15A NCAC 02H .1003(3)(b)). The full
build-out potential of the off-site area can be limited by having the property owners enter into a legal
agreement limiting the amount of BUA and drainage area directed from the off-site area to the SCM
or by assuming that the off-site area is 100%BUA(its full build out potential). It is recommended to
bypass off-site drainage areas around the SCMs (please see note following the comments for more
information). Please revise as needed."Please either divert the off-site drainage area around the
SCM or account for the off-site area at its full build-out potential. It is noted that the off-site area is
currently developed as a residential area,however the full build-out potential of a site is determined
by having the property owners enter into a legal agreement limiting the amount of BUA and
drainage area directed from the off-site area to the SCM or by assuming that the off-site area is
100%BUA(its full build out potential). The provided response of analyzing the off-site areas at
their current level of build-out is unsatisfactory as the current level of development can change in the
future(unless there is a legal agreement in place to limit the amount of off-site drainage area and
BUA directed to the SCM). We recommend that the off-site areas be diverted around the SCMs,but
if this is not practicable,we require the off-site areas to be accounted for in this manner since the
permittee has no control over property that they do not own.Please revise as needed.
i) The offsite areas that drain to the stormwater ponds onsite have been adjusted to account for the
full build-out conditions. All offsite areas that drain to Pond Al and Pond B are zoned R-20
(there is no offsite drainage for Ponds A2 or A3).Per Union County's Development Ordinance,
property zoned R-20 has a maximum impervious coverage of 40%. Therefore, all offsite areas
have been accounted for in the stormwater calculations with the assumption that 40%of this
offsite area would be impervious if ever developed to the full build-out potential.All
computations have been updated accordingly.

2) Prior Comment 6.a.—"Application: Please have the other property owner, Shelby Cattle Farm,LLC
sign Section IX...and provide their contact information in Section III,2."Please provide an original,
hard copy of the signature page for Shelby Cattle Farms,LLC.
i) An original hard copy of the application signed by Shelby Cattle Farms,LLC.has been included
with this submittal.
3) Prior Comment 6.b.—"Application, Section IV, 10—Please refer to later comments with regard to
BUA accounting. The information in this table should reflect the drainage area columns of the
Drainage Areas Page of the Supplement-EZ Form. Please revise as needed."Please correct the
discrepancies between the Application and Supplement-EZ Form. Below is a comparison of the
values entered for SCM Al (there appear to be similar issues with the other drainage areas). Please
revise as needed.

NOTE: Buildings/Lot(Application)refers to the BUA allocated to the individual lots for subdivision

i) The application has been updated to match the Supplement-EZ Form for all line items
concerning the BUA of the project.
4) Prior Comment 7.a.i.—"Supplement-EZ Form, Cover Page,Line 2—Please use the project area,
118.64 ac, instead of the total property area."The provided value, 136.07 ac, does not correspond to
the project area as shown in the Application(118.64 ac). Please revise.
i) The project area on the cover page of the Supplement-EZ Form has been updated to reflect the
correct project area of 118.64 acres.
5) Prior Comment 7.a.ii.—"Supplement-EZ Form, Cover Page,Line 7—Please include this item(refer
to 15A NCAC 02H .1003(4) & .1017(10) for more information)."The minimum required vegetated
setback from surface waters is 30 ft in this part of the State. Please revise.
i) The minimum required vegetated setback from surface waters has been updated to 30 feet.
6) Prior Comment 7.b.i.—"Supplement-EZ Form, Drainage Area Page: Please complete the entire site
column. The entire site column is an accounting of the entire project area(similar to how the
drainage area columns are an accounting of the areas draining to the SCMs).When the items for this
column ask for the"drainage area"please enter the project area.NOTE: Any BUA that does not
drain to an SCM should be accounted for in this column."No information was entered for the entire
site column.Please provide this information for the entire project area.NOTE: The sum of the
values in the drainage area columns may not add up to the value in the entire site column(this is the
case when there is BUA located within the project area that does not drain to the SCM).
i) The `Entire Site' column of the Drainage Area Information has been completed.
7) Prior Comment 7.b.v.—"Supplement-EZ Form, Drainage Area Page,Line 11 —See earlier
comment." See earlier comment,please revise as needed.
i) The Offsite BUA on the Supplement-EZ Form has been updated to include 40%of the offsite
area as impervious per comment#1 since not all offsite area is being routed around the ponds.
8) Prior Comment 7.c.viii.—"Supplement-EZ Form,Wet Pond Page,Line... 36..."The provided
value, "weir"does not correspond to the drawdown device shown in the plans(orifice). Please
revise.
i) The drawdown device for all ponds has been changed to `orifice'.

9) Please revise the drainage area maps for Phase 2. The maps indicate that the drainage area to SCM
Al is 34.66 ac(other submittal items indicate 1,496,875 sf=34.36 ac)and indicate that the drainage
area to SCM B is 23.53 ac(other submittal items indicate1,019,236 sf=23.40 ac).Please revise for
consistency.
i) The Drainage Area Map for Phase 2 has been updated to accurately reflect the drainage area for
SCM Al and SCM B. Additionally,the RCN for SCM Al has been updated per the offsite BUA
adjustments.
10) Please correct the following items with the Wet Pond Page of the Supplement-EZ Form:
a) Line 21, SCM A3—The provided value, 528.0', does not correspond to the plans(showing
the top of the sediment storage zone at elevation 526.0').
ii) Supplement-EZ Form has been updated with the correct value per the plans.
a) Line 24, SCM B—The provided value,499.5',does not correspond to the plans (showing
the top of the vegetated shelf at elevation 499.0').
iii) Supplement-EZ Form has been updated with the correct value per the plans.
a) Line 42, SCMs Al,A2, &B—These SCMs appear to utilize berms to increase the flow path
through the SCMs.
iv) Supplement-EZ Form has been updated with the correct value per the plans.
11) Provide PDFs of all revisions,2 hardcopies of revised plan sheets, 1 hardcopy of other documents,
and a response to comments letter briefly describing how the comments have been addressed.

Please reach out to me prior to hand delivering a submission to make sure that I(or someone else in
my group)will be able to receive the submission. Do not leave the package in the foyer with the
security guard.

NOTE: Hard copies should not be sent to a Regional Office. Doing so will delay the review process and
the submission package may be lost while being sent from the Regional Office to me in the Central
Office.
While it is not required, it is recommended that the off-site drainage from upstream properties be
diverted around the SCM since the Applicant cannot maintain control over the development of property
that they do not own. If the Applicant elects to account for off-site drainage, it must either be accounted
for as 100%BUA(its full build out potential, or there must be a recorded legal agreement in place
between the Applicant and the Owner of the upstream property in which the Owner of the upstream
property agrees to record a deed restriction limiting the minimum/maximum amount of BUA on the
upstream property that will be treated in the Applicant's SCM,the locations and sizes of access and
drainage easements,how construction and/or ongoing maintenance costs will be handled,maintenance

responsibility, a list of legal recourses available to each party should one party fail to hold up their end of
the agreement, and any other related legal issues.
Please note that this request for additional information is in response to a preliminary review.
The requested information should be received by this Office prior to August 20,2023, or the application
will be returned as incomplete. The return of a project will necessitate resubmittal of all required items,
including the application fee. Please reference the State assigned project number SW3221006 on all
correspondence.
NOTE: Per Division policy,the next review of this application will be the final review. Failure to
provide the requested information will result in the project being returned as incomplete. The return of a

If you need additional time to submit the information,please submit your request for a time extension to
the Division at the contact below. The request must indicate the date by which you expect to submit the
required information. The Division is allowed 90 days from the receipt of a completed application to
issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement
action pursuant to NCGS 143-215.6A.
