Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 970847 dated January 28, 1998, for the construction of Tactical Support Van Pad. This permit shall be effective from the date of issuance until January 28, 2008, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described on page 3 of this permit, the Project Data Sheet. The stormwater control has been designed to handle the runoff from 307,534 square feet of impervious area. 3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 4. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per approved plans. 5. To ensure continued compliance with the NC Division of Water Quality Stormwater Management Permit Regulations, 15A NCAC 2H.1000, the future area as shown on the approved plans is limited to a maximum of 69,696 square feet of built -upon area. All runoff from the future built -upon area must be directed into the permitted stormwater control system. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built - upon area. 8. The following items will require a modification to the permit: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area. e. Further subdivision of the project area. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. g. Change in the project area boundaries. In addition, the Director may determine that other revisions to the project should require a modification to the permit. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. H. SCHEDULE OF COMPLIANCE The permittee will comply with the following schedule for construction and maintenance of the stormwater management system: The stormwater management system shall be constructed in it's entirety, vegetated and operational for it's intended use prior to the construction of any built -upon surface except roads. b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. C. All connections into the stormwater system from future areas/outparcels shall be made such that short- circuiting of the system does not occur. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. g. Access to the outlet structure must be available at all times. ll State Stormwater Management Systems Permit No SW8 970847 Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 4. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. Upon completion of construction, prior to ocupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 6. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. III. GENERAL CONDITIONS This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143- 215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. Permit issued this the 28th day of January, 1998. The forebay has been enlarged to exceed the minimum 20% of the total first I" volume of runoff as follows; Total first 1" runoff volume = 31,468 cu. ft. (from original calculations) Revised forebay volume = 8,000 cu. ft. % of first 1" runoff volume = (8,000/31,468) X 100% = 25% 2. The 0.9 acre drainage area along the Access Rd. adjacent to the van pad will be allowed to drain into the existing canal with the inclusion of the 2.2 acres from the existing off -site parking lot into the pond. This arrangement is described<in the previously submitted Stormwater Management Pond paragraph of the Narrative accompanying the calculations. There is no change to the plans. 3. Future development must include considerations for stormwater management for the southern portion of the access road as well as the remaining tract. The drainage system shown on sheet C4 is reconfigured to accommodate this requirement. 4. Two copies each of sheets C4, C7, and C 13 are attached with a copy of this memo and forwarded to Ms. Lewis at the NCDENR Division of Water Quality office in Wilmington. It is our understanding that the stormwater management plans will be approved upon successful review of this submittal. It was intended that 3 sets of plans, accompany the initial application package. Since this did not occur, two new sets of plans are attached for DEHNR use. Several minor changes and corrections have been made as a result of the Water Quality Section comments and in-house reviews. None of these changes impact the erosion/sedimentation control permit application submittal. Several changes have been made to the narrative page (paragraphs I, II, and III) and to the stormwater management summary sheet of the original application. Replace the old pages with the attached copies. Item 2. The 10.08 acres of drainage breaks down as follows: A. Current Site= 5.58 acres B. Existing (off -site) = 2.2 acres C. Future Development (also off -site) = 2.3 acres Two copies of the revised stormwater design work sheet, sheet SDO1, are attached. This sheet delineates the indicated areas. Item 3. The orifice size has been reduced to 3" (75 mm-nominal) (schedule 40 pvc). Two copies of the revised Stormwater Management Calculations (page 2(continued)) are attached. Plan sheet C13 has been revised accordingly. Item 4. A note indicating no wetlands has been added to sheet SDO1 (2 revised copies attached) as requested. Replace the old sheet SDO1 with an attached copy. Item 5. The information requested is shown on plan sheets C4, C5, C6, and C7 of the attached drawings. Item 6. In addition, a small head (restroom), open storage shelter, parking area, and access roads are provided. Total site area is approximately 8.85 acres including the proposed impervious areas and a 1.85 acre stormwater management pond. The proposed site is located on a largely undeveloped 15 acre (+-) tract of land bounded by Canal St. on the west, Campbell St. on the north, White St. on the east, and Douglas St. on the south. This project is one of several planned for this area. The access road, canal crossings, and stormwater management pond are designed to facilitate future development. Access to the site will be provided by two canal crossings whose location is dictated by existing elevated sections of a steam line parallel to the existing canal. The southernmost portion of the access road is for future development. SITE DESCRIPTION The site is relatively flat with incidental runoff to the existing canal along the west side of the project. The overland flow will be collected into 375mm through 900mm diameter storm drain pipes and routed into the new detention pond. The storm water will flow from the pond approximately 46 meters into the existing canal. A concrete headwall with rip rap is provided to stabilize the existing canal bank. Two canal crossings are.provided. Twin 1500mm culverts with headwalls are provided at each crossing. STORMWATER MANAGEMENT POND A 1.85 acre wet detention pond is provided to treat runoff from the proposed development and a future 2.3 acre site north of this project in accordance with 15A NCAC 2H.1000. A piped stormwater collection system will route the site runoff to the pond for treatment. Outflow from the pond will flow into the existing canal along Canal Street on the west side of the project. The pond is designed to comply with the requirements of 15A NCAC 2H.1000. Four small adjacent drainage areas along the access road (0.9 acre total) cannot be configured to drain to the pond. They are instead drained into the existing canal. To compensate for this limitation the pond will treat runoff from the existing 2.2 acre parking lot upstream. Future development will include considerations for stormwater management for the southern portion of the access road as well as the remaining tract area. In addition, a small head (restroom), open storage shelter, parking area, and access roads are provided. Total site area is approximately 8.85 acres including the proposed impervious areas and a 1.85 acre stormwater management pond. The proposed site is located on a largely undeveloped 15 acre (+-) tract of land bounded by Canal St. on the west, Campbell St. on the north, White St. on the east, and Douglas St. on the south. This project is one of several planned for this area. The access road, canal crossings, and stormwater management pond are designed to facilitate future development. Access to the site will be provided by two canal crossings whose location is dictated by existing elevated sections of a steam line parallel to the existing canal. The southernmost portion of the access road is for future development. SITE DESCRIPTION The site is about 75% covered with small pine trees except for the existing dirt road along the western side adjacent to the canal. The ground is relatively flat with incidental runoff to the existing canal along the west side of the project. The overland flow will be collected into 375mm through 900mm diameter storm drain pipes and routed into the new detention pond. The storm water will flow from the pond approximately 46 meters into the existing canal. A concrete headwall with rip rap is provided to stabilize the existing canal bank. Two canal crossings are provided. Twin 1500mm culverts with headwalls are provided at each crossing. STORMWATER MANAGEMENT POND A 1.85 acre wet detention pond is provided to treat runoff from the proposed development and a future 2.2 acre site north of this project in accordance with 15A NCAC 2H.1000. A piped stormwater collection system will route the site runoff to the pond for treatment. Outflow from the pond will flow into the existing canal along Canal Street on the west side of the project. The pond is designed to comply with the requirements of 15A NCAC 2H.1000. Four small adjacent drainage areas along the access road (0.9 acre total) cannot be configured to drain to the pond. They are instead drained into the existing canal. To compensate for this limitation the pond will treat runoff from the existing 2.4 acre parking lot upstream as well as include the 0.9 acre in the pond sizing calculations. Future development will include considerations for stormwater management for the southern portion of the access road as well as the remaining tract area. SOILS The soils existing on the site are generally in three groups as follows- 1)The surface is covered by a 6" thick layer of soft dark brown organic fine sandy silt with roots. This layer was soft and wet at the time of drilling. The thickness vanes, extending to a depth of 3' in some locations. 2)Beneath these soils and extending to depths of 6' to 9' are layers of brown and orange fine sandy clay. Present within this area are layers or lenses of fine sand. 3)A soft highly plastic clay extends below the group 2 soils to termination of our borings. This clay is replaced by fine sand along the southern edge of the Van Pad site. The clay sand interface appears to dip down to the north, with a slight rise or peak in the vicinity of borings B6 and B8. Groundwater elevations vaned considerably during exploration, from being encountered at the ground surface to dry at 10.5'. Much of the groundwater encountered is thought to be perched, as the nearby ditch is approximately 10' deep and water was not standing in it. The uppermost soils are considered to be of moderate erosion hazard and of low permeability, except moderate to high permeability where the sand layers or lenses are exposed. PLANNED EROSION AND SEDIMENT CONTROL PRACTICES 1. Temporary Gravel Construction Entrances; 4 are provided to allow ample site access. 2. Inlet Protection; is provided for all affected inlet structures. 3. Temporary Sediment Fences; are provided around the entire construction site. 4. Temporary Sediment Containment; The wet detention pond may be used for temporary sediment containment during construction. The pond will be cleaned of all eroded materials, trash, and sediment at the completion of the project. 5. Declarations; prohibitions. -In order to safeguard life, health, and property, and to promote the public welfare, the practice of engineering and the practice of land surveying in this State are hereby declared to be subject to regulation in the public interest. It shall be unlawful for any person to practice or to offer to practice engineering or land surveying in this State, as defined in the provisions of this Chapter, or to use in connection with his name or otherwise assume or advertise any title or description tending to convey the impression that he is either a professional engineer or a registered land surveyor, unless such person has been duly registered as such. The right to engage in the practice of engineering or land surveying shall be deemed a personal right, based on the qualifications of the individual as evidenced by his certificate of registration, which shall not be transferable. Definitions. -When used in this Chapter, unless the context otherwise requires: (1) 'Board' shall mean the North Carolina State' Board of Registration for Professional Engineers and Land Surveyors provided for by this Chapter. (2) "Engineer'. - The term 'engineer,' within the intent of this Chapter, shall mean a person who, by reason of his special knowledge and use of the mathematical, physical and engineering sciences and the principles and methods of engineering analysis and design, acquired by engineering education and engineering experience, is qualified to practice engineering. (5) "Person' means any natural person, firm, partnership, corporation or other legal entity. (6) "Practice of Engineering", - a.
