Skvada, III Secretary The Wilmington Regional Office received a complete, Stormwater Management Permit Application for Cottage Grove on August 28, 2014. Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000 and Session Law 2008-211. We are forwarding Permit No. SW8 140814, dated September 3, 2014, for the construction, operation and maintenance of the BMP's and built -upon areas associated with the subject project. This permit shall be effective from the date of issuance until September 9, 2022, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), recordation of deed restrictions, procedures for changes of ownership, transferring the permit, and renewing the permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system, to record deed restrictions, to transfer the permit, or to renew the permit, will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of this permit. Cottage Grove Middle Sound Loop Road, Wilmington, New Hanover County FOR THE construction, operation and maintenance of an infiltration basin in compliance with the provisions of Session Law 2008-211 and 15A NCAC 2H .1000 (hereafter jointly and individually referred to as the "stormwater rules') and the approved stormwater management plans and specifications and other supporting data as attached and on file with and approved by the Division and considered a part of this permit. This permit shall be effective from the date of issuance until September 3, 2014 and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.8 of this permit. The subdivision is permitted for 24 lots, each allowed a maximum of 5,500 square feet of built -upon area. 3. The total maximum amount of built -upon allowed for this project is 175,635 square feet, as listed in the application documents. 4. The system can store at least 2.5 times the minimum design storm, therefore neither an LSNFS nor an offline bypass are required. 5. All stormwater collection and treatment systems must be located in either public rights -of -way or dedicated common areas or recorded drainage easements. The final plats for the project will be recorded showing all such required rights -of -way, common areas and easements, in accordance with the approved plans. 6. The project shall provide and maintain a 50-foot-wide buffer adjacent all surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the top of bank of both sides of streams and rivers, and the mean high water line of tidal waters. 7. The runoff from all built -upon area within the permitted drainage area of this project must be directed into the permitted stormwater control system. Additionally, the permittee shall not allow any homeowner, lot owner, builder or developer to alter any aspect or any component of the approved stormwater collection system or to pipe any ditches or swales shown on the approved plans, except for minimum driveway crossings, unless and until the permittee shall have submitted a revision to the permit and received approval from the Division. The permittee shall routinely monitor the project to ensure that the proposed built -upon area for the entire project including lot BUA, streets, recreation facilities and sidewalks, does not exceed the permitted maximum allowable built - upon area. Where the permittee finds a noncompliance with the permit on an individual lot, the permittee shall notify the lot owner in writing, requiring remediation of the noncompliance within a reasonable time frame, and shall follow-up to ensure that the noncompliance has been resolved. 3. The permittee is responsible for approving and monitoring all driveway pipe installation on individual lots. The permittee shall assure that all piping shall be that minimum amount and diameter necessary to adequately pass the drainage underneath the driveway, while maintaining a 3:1 side slope. 4. The permittee shall not approve any lot plan where the permitted maximum BUA limit is exceeded, or where piping of ditches or swales is proposed, or where excessive driveway piping is proposed, without first submitting a permit modification and receiving approval from the Division. 5. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Page 3 of 8 State Stormwater Management Systems Permit No. SW8 140814 Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 6. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to the approved plans, regardless of size. b. Redesign or addition to the approved amount of built -upon area. C. Further subdivision, acquisition, or sale of all or part of the project area. d. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. e. The construction of any future BUA listed on the application. 7. The Director may determine that other revisions to the project should require a modification to the permit. 8. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 9. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. Infiltration systems should not be used as erosion control devices, due to the potential clogging. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 10. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, the permittee shall cause a certification from an appropriate designer for the system installed, to be submitted, certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 11. The permittee shall at all times provide the operation and maintenance necessary to assure that all components of the permitted stormwater system function as designed. The approved Operation and Maintenance Agreement must be followed in its entirety and maintenance must occur at the scheduled intervals listed in the O&M Agreement. 12. Records of maintenance activities must be kept and made available upon request to authorized personnel of DENR. The records will indicate the date, activity, name of person performing the work and what actions were taken. Page 4 of 8 State Stormwater Management Systems Permit No. SW8 140814 13. Prior to the sale of any lot, the following deed restrictions must be recorded: a. The following covenants are intended to ensure ongoing compliance with State Stormwater Management Permit Number SW8 140814, as issued by the Division under NCAC 2H.1000. b. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to maintain compliance with the Stormwater Management Permit. C. These covenants are to run with the land and be binding on all persons and parties claiming under them. d. The covenants pertaining to stormwater may not be altered or rescinded without the express written consent of the State of North Carolina. e. Alteration of the drainage as shown on the approved plans may not take place without the concurrence of the Division. f. The maximum built -upon area per lot is 5,500 square feet. This allotted amount includes any built -upon area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas, but does not include raised, open wood decking, or the water surface of swimming pools. g. All affected lots shall provide a 50-foot-wide buffer adjacent surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the top of bank of both sides of streams and rivers, and the mean high water line of tidal waters. h. Lots within CAMA's Area of Environmental Concern may be subject to a reduction in their allowable built -upon area due to CAMA regulations. i. All runoff on the lot must drain into the permitted system. This may be accomplished through providing roof drain gutters which drain to the street, grading the lot to drain toward the street, or grading perimeter swales and directing them into the pond or street. Lots that will naturally drain into the system are not required to provide these measures. j. Built -upon area in excess of the permitted amount will require a permit modification. k. Any individual or entity found to be in noncompliance with the provisions of a storrmwater management permit or the requirements of the stormwater rules is subject to enforcement procedures as set forth in G.S. 143 Article 21. 14. A copy of the recorded deed restrictions must be submitted to the Division within 30 days of the date of recording the plat, and prior to selling lots. The recorded copy must contain all of the statements above, the signature of the Permittee, the deed book number and page, and the stamp/signature of the Register of Deeds. 15. Prior transfer of the permit, the stormwater facilities must be inspected by the Division and must be in compliance with all permit conditions. Any items not in compliance must be repaired or replaced to design condition prior to the transfer. Records of maintenance activities performed to date will be required. 16. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. GENERAL CONDITIONS This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed Name/Ownership Change Form, accompanied by the supporting documentation as listed on the form, to the Division at least 60 days prior to any one or more of the following events: a. An ownership change including the sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions; b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association, subject to the requirements of Session Law 2011-256; c. Bankruptcy; d. Foreclosure; e. Dissolution of the partnership or corporate entity; f. A name change of the current permittee; g. A name change of the project; h. A mailing address change of the permittee; 2. The permittee is responsible for compliance with all of the terms and conditions of this permit until such time as the Director approves the transfer request. 3. Any individual or entity found to be in noncompliance with the provisions of this storrmwater management permit or the requirements of the Stormwater Rules is subject to enforcement procedures as set forth in G.S. 143 Article 21. 4. Permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 5. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. In the event that the facilities fail to perform satisfactorily the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 8. The Permittee grants permission to staff of the DENR to access the property for the purposes of inspecting the stormwater facilities during normal business hours. 9. Approved plans, supplement forms, O&M Agreements and specifications for this project are incorporated by reference and are enforceable parts of the permit. A copy of this permit, the supplement forms, the Operation and Maintenance Agreements, and the approved plans and specifications shall be maintained on file by the Permittee at all times. 10. The permittee shall submit a permit renewal application at least 180 days prior to the expiration date of this permit. The renewal application shall include the required application, appropriate application fee and documentation. Permit issued this the 3rd day of September, 2014. As a result, please find this design narrative, plans, and supporting calculations. The address of the property is 234 Middle Sound Loop Road, Wilmington, NC with a latitude and longitude of 34°16'06"N, 77°49'02"W (Deed Book 1713, page 910). In the calculations, the total onsite stormwater boundary is 8.06 acres. The property drains to Howe Creek (SA) but is greater than 1/2 mile therefore we will designing to the LY storage volume standard. For this site based on configuration, the stormwater will be treating using an infiltration basin. Enclosed is the soils report that depicts the seasonal high water table and infiltration rate used for the sizing of the infiltration basin. All stormwater runoff will be directed by way of a storm sewer system to an adequately designed stormwater BMP. The stormwater BMP on the site include an infiltration basin. The BMP has been designed to meet the State's stormwater quality requirements, as well as, New Hanover County quantity (pre/post) demands. Please find all supported calculations within the following pages of the report. MAINTENANCE Contractors shall be responsible for periodic inspection and maintenance of all indicated erosion control devices in accordance with the plans and specifications. In addition, inspection and any necessary maintenance will be required immediately following any significant storm event. Sediment will need to be removed from behind silt fencing as described on the Erosion Control Plan. Vegetative cover will be fertilized and reapplied as necessary to promote a vigorous stand. Contractor shall be responsible for prevention of damage to properties outside the construction limits from siltation due to construction of the project. The Contractor will assume all responsibilities to the affected property owners for correction of damages that may occur. Erosion control measures shall be performed by the Contractor, conforming to the requirements of, and in accordance with plans approved by applicable state and local agencies and as per the erosion control portion of the construction drawings and these specifications. The Contractor shall not allow mud and debris to accumulate in the streets. Should the Contractor pump water from trenches during construction, appropriate siltation preventative measures shall be taken prior to discharge of pumped water into any storm drain or stream. Page 1 , PART 2-PRODUCTS 2.1 Open mesh biodegradable mulching cloth. 2.2 Fertilizer shall be 10-10-10 grade or equivalent. 2.3 Lime shall be dolomitic agriculWral ground 1 limestone containing not less than 10 percent magnesium oxide. 2.4 Phosphate shall be 20 percent super phosphate or equivalent. 2.5 Provide grass seed mixture as shown on the plans. 2.6 Silt fence shall consist of non -biodegradable filter fabric (Trevira, Mirafi, etc.) wired to galvanized wire mesh fencing and supported by wood or metal posts. 2.7 NCDOT Class B stone for erosion control. PART 3 - EXECUTION 3.1 CLEARING A. Clearing and grubbing shall be scheduled and performed in such a manner that subsequent grading operation and erosion control practices can follow immediately thereafter. Excavation, borrow, and embankment operations will be conducted such that continuous operation. All construction areas not otherwise protected shall be planted with permanent vegetative cover within 15 working days after completion of active construction. All slopes shall be planted within 21 calendar days after completion of such activity. 3.2 STABILIZING A. The angle for graded slopes and fills shall be no greater than the angle that can be retained by vegetative cover or other adequate erosion control devices or structures. All disturbed areas not to be paved and left exposed will, within 21 calendar days of completion of any phase of grading, be planted or otherwise provided with either temporary or permanent ground cover, devices, or structures sufficient to restrain erosion. All slopes steeper than 3:1 shall be planted or otherwise provided with either temporary or permanent ground cover, devices, or structures sufficient to restrain erosion within 21 calendar days. 3.3 REGULATORY REQUIREMENTS A. Whenever land disturbing activity is undertaken on a tract, a ground cover sufficient to restrain erosion must be planted or otherwise provided within 15 calendar days on that portion of the tract upon which further active construction is to being undertaken. B. If any earthwork is to be suspended for any reason whatsoever for longer than 15 calendar days, the areas involved shall be seeded with vegetative cover or otherwise protected against excessive erosion during the suspension period. Suspension of work in any area of operation does not relieve the Contractor of the responsibility for the control of erosion in that area. Page _ PART 4 - CONSTRUCTION PHASE 4.1 PRACTICES A. Avoid dumping soil or sediment into any streambed or watercourse. Backfill for stream crossings shall be placed dry and compacted to minimize siltation of the watercourse, where applicable. B. Maintain an undisturbed vegetative buffer where possible between a natural watercourse and trenching and grading operations. C. Avoid equipment crossings of streams, creeks, and ditches where practicable. PART 5 - SEDIMENT CONTROL FEATURES 5.1 GENERAL A. All devices (silt fences, retention areas, etc.), for sediment control shall be constructed at the locations indicated prior to beginning excavation on the site. All devices shall be properly maintained in place until a structure or paving makes the device unnecessary or until directed to permanently remove the device. 5.2 DESIGN APPLICATIONS A. Mulch shall be used for temporary stabilization of areas subject to excessive erosion, and for protection of seed beds after planting where required. 1. - Jute, mesh, etc. should be installed as per manufacturer's instructions. B. Silt fences shall be used at the base of slopes and in drainage swales to restrict movement of sediment from the site. Straw bales may be required for reinforcement. C. Riprap shall be used at the proposed outfall pipes as indicated on plans. D. Establish vegetative cover on all unpaved areas disturbed by the work. 1. Preparation of Seedbed. Areas to be seeded shall be scarified a depth of 6 inches until a firm, well -pulverized, uniform seedbed is prepared. Lime, phosphorous, and fertilizer shall be applied during the scarification process in accordance with the following rates. a. Lime — 2 ton per acre b. Nitrogen —100 pounds per acre C. P2O5 — 200 pounds per acre 2. Seeding. Disturbed areas along roads and ditches shall be permanently seeded with 10- 20 pounds per acre of centipede during the period from March through September. Seeding performed during the period from April to August shall be temporarily seeded with 40 pounds per acre of German Millet. The permanent vegetative cover will be over seeded at the earliest possible time as specified above. 3. Mulch all areas immediately after seeding. Mulch shall be applied and anchored as specified hereinbefore. Page 3 - _ - 5.3 MAINTENANCE A. The Contractor shall be responsible for maintaining all temporary and permanent erosion control measures in functioning order. Temporary structures shall be maintained until such time as vegetation is firmly established and grassed areas shall be maintained until completion of the project. Areas which fail to show a suitable stand of grass or which are damaged by erosion shall be immediately repaired. 5.4 REMOVAL OF SEDIMENT CONTROL DEVICES A. Near completion of the project, when directed by the Owner's agent, the Contractor shall dismantle and remove the temporary devices used for sediment control during construction. All erosion control devices in seeded areas shall be left in place until the grass is established. Seed areas around devices and mulch after removing or filling temporary control devices. This letter describes our field work, presents our findings, and offers conclusions and preliminary recommendations relating to the suitability of near -surface soil conditions for pavement subgrade. We were also requested to estimate the seasonal high watertable at two locations identified by you and conducted infiltration testing at each location. PROJECT INFORMATION The project site is located at 234 Middle Sound Loop Road and is currently the K & M Trailer Park in New Hanover County, North Carolina. Proposed development consists of a single-flimily residential subdivision. As we understand from our conversations with you, Paramounte Engineering is in need of Some limited information as to groundwater and near -surface soil conditions within the aroa of proposed new subdivision roads within this tract of land. This information is desired for the purpose of optimizing design grades with regard to: (a) the type of soils exposed in cat as roadway subgrade, and (b) the vertical separation of the roadway pavement section from groundwater or perched water occurring in the subgrade. The purpose of the seasonal high watertable estimates and the infiltration testing is to provide soil parameters for stormwater infiltration design. DESCRIPTION OF FIELD ACTIVITIES As requested, our staff visited the site on July 12 and 16, 2014, and advanced hand auger borings to depths ranging from approximately 7 to 10 feet below existing grade at 4 locations (Locations I, 2, 3, and 6 shown in the sketch attached hereto as Figure 1). These locations were selecte.11 by you and occur within the proposed roadway area. At each hand auger boring location, the RPTS. July 28, 2014 RFTS Job No. 1026-14 Page Two encountered soils were visually classified and logged by depth, zones of cementation were noted, and the depth to standing water in the boreholes were recorded at the completion of augcring. The logs of these hand auger borings are attached hereto as Table 1. At Locations 4 and 5 (also shown in Figure 1), we advanced hand auger borings to depths of 117 and 122 inches, respectively. The soils encountered in these borings were visually classified and logged by depth, soil coloration was compared to a Munsell soil color chart, and the depth to any standing water in the boreholes was recorded. The logs of these hand auger borings are attached hereto as Table 2. Infiltration testing was performed at Locations 4 and 5 using a model 2800 Guelph Permeameter which is a constant -head device that operates on the Marione siphon principle and is referenced in ASTM D-5126. The permeameter is used to determine field saturated hydraulic conddctivity in centimeters per second for soil at a specified depth. This testing involves advancing a borehole to the desired infiltration depth and introducing water at a constant head to determine the steady state flow rate from which the hydraulic conductivity can be calculated. The results of this testing are attached hereto as Table 3. FINDINGS Soil Conditions in Roadway Areas The soil profiles encountered at Locations 1, 2, and 3, consist entirely of clean fine sands (USCS Soil Group `SP'). At Location 6, most of the profile also consists of clean fine sand, with the exception of the soils from a depth of 56 inches to the completed boring depth of 80. inches, which consist of silty fine sands (Group `SM'). The soils encountered from a depth of 16 inches to 56 inches at Location 6 were observed to be cemented. No groundwater was encountered at any of the borings advanced within the roadway areas. Seasonal High Water Table Estimates Location 4. The soils encountered in this hand auger boring consisted of relatively r'ean fine sands (USCS Soil Groups "SP" and `SP-SM") through the boring termination depth of 122 inches below the existing ground surface. No distinct zones of soil cementation were encountered in the profile at this location. Based on our experience with similar soils and comparisons of the soil coloration to the Munsell Chart, it is our opinion that the seasonal high water table level occurs approximately 77 inches below the existing the ground surface. No water was encountered a the completion of our auger at this location. Our soil logs are presented in Table 2. Location 5. The soils encountered in this hand auger boring consisted of interbedded relatively clean fine sands (USCS Soil Group "SP") in the upper 31 inches below the ground surface. Below the depth of 31 inches and.extending 38 inches clay with sand (USCS Soil Group "CL") was encountered. From 38 to the boring termination depth of 117 inches, interbedded relatively clean sands and sands with varying amounts of silt were encountered (USCS Soils Groups "SP", "SP-SM" and "SM") were encountered. No zones of soil cementation were encountered in the profile at this location. Based on our experience with similar soils and comparisons of the scil Paramounte Engineering, Inc. RFTS Job No. 1026-14 July 28, 2014 Page Three coloration to the Munsell Chart, it is our opinion that seasonal high water table level occurs approximately 66 inches below the existing the ground surface. Standing water level at this location 30 minutes after auger was approximately 114 inches below the ground surface. Our soil logs are presented in Table 2. Infiltration Testing Our infiltration testing at Locations 4 and 5 was performed approximately 18 and 2` inches below the existing ground surface, respectively. The results of our permeameter testing, as presented in Table 3, indicates saturated field hydraulic conductivity values of 1.2 and 0.81 inches per hour, respectively. CONCLUSIONS AND RECOMMENDATIONS Based on the results of our soil classifications, measurements of the depth to ground water, and our previous experience with similar soils, we offer the following recommendations for roadway grading within the areas represented by these borings. Suitability of Soils as Pavement Subgrade With the exception of topsoil, the soils encountered in our hand auger borings are all suitable as to type for use as pavement subgrade. A pavement section consisting of I''/a inches ofNCDOT SF9.5A bituminous surface course over 6 inches of crushed aggregate base course (ABC) is considered adequate for subdivision roads under the NCDOT Minimum Construction Standards for Subdivision Roads for roadways exhibiting these soil types when they are properly c,ompacted in place and provided with adequate subgrade drainage. Subgrade Drainage It is generally desirable to permanently maintain a vertical separation of at least 2 feet between the level of any groundwater or perched water in the soils and the bottom of the stone in the pavement section. On this basis, we would expect the subgrade in areas exhibiting the subsurface conditions of Locations 1-3 to perform adequately with respect to subgrade drainage for roadways occurring in fill or in cuts up to five feet below grade without implementing special subgrade drainage measures. However, in areas exhibiting the conditions encountered at Location 6, there is a potential for shallow perched water to occur after periods of prolonged or heavy rainfall above the cemented sands encountered at 16 inches below site grade. In areas where these cemented soils will occur within the upper two feet below the bottom of the pavement section, they should be removed and replaced with clean sands. Infiltration Testing Based on the results of our field testing and soil classifications at the test location, -we offer the following recommendations for stormwater infiltration design: At the test locations 4 and 5 it is our opinion that in order to achieve the steady state flow rate obtained during our testing; the areas of infiltration galleries or other infiltration structures should Paramounte Engineering, Inc. For purposes of sizing the structures we recommend an ultimate application rate of 1.2 and 0.81 inches per hour, respectively. These recommendations should be reviewed by appropriate regulatory authorities before finalizing the details of any civil design. The site investigation found that no areas met the required three parameters in order to be called a jurisdictional wetland, therefore, no wetlands are present. The only area of jurisdiction as Waters of the US is the ditch along the southwest properly line shown in Figure One. These findings are under review by the USACE for their concurrence.
