Skvada, III Secretary On May 19, 2014, the Wilmington Regional Office received a request to revise the approved plans for Stormwater Management Permit Number SW8 060226 in order to correct an overlap with Stormwater Management Permit Number SW8 050927. Plan Revision and Correction: The revisions include documenting reallocated impervious area and correcting the number of lots to alleviate concerns of overlapping project area between SW8 060226 and SW8 050927 raised in the Division's letter from June 27, 2009. The enclosed table details a summary of all of the impervious area permitted to the three permits and shows that each pond permitted under each permit can accommodate the impervious area draining to it. The previous permit approved 123 single family lots and 53 townhome units. This plan revision and correction corrects the numbers to 125 single family lots and 40 townhome units. A master plan showing all three permits documents the layout of the three permits. It has been determined that a formal permit modification is not required for the proposed changes. We are forwarding you an approved copy of the revised plans for your files. Please add the attached master plan to the previously approved plan set. Permit Extension: On August 5, 2009, the Governor signed Session Law 2009406. This law impacts any development approval issued by the Division of Energy, Mineral and Land Resources under Article 21 of Chapter 143 of the General Statutes, which is current and valid at any point between January 1, 2008, and December 31, 2010. The law extends the effective period of any stormwater permit that was set to expire during this time frame up to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177, which granted an extra year for an extension of up to four (4) years. The Division is hereby notifying you that permit SW8 050927 has been revised on June 3, 2014 and shall be effective until April 25, 2020, which includes the extensions. Please be aware that all terms and conditions of the permit issued on April 22, 2010, remain in full force and effect. Please also understand that the approval of this revision to the approved plans for the subject State Stormwater Permit is done on a case -by -case basis. Any other changes to this project must be approved through this Office prior to construction. The issuance of this plan revision does not preclude the permittee from complying with all other applicable statutes, rules, regulations or ordinances which may have jurisdiction over the proposed activity, and obtaining a permit or approval prior to construction. Skvarla, III Secretary The Wilmington Regional Office received a complete, State Stormwater Management Permit Application for Brunswick Forest Phase I Section 4 on May 19, 2014. Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Session Law 2008.211 and Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8140305 dated June 3, 2014, for the construction, operation and maintenance of the BMP's and built -upon area associated with the subject project. This permit shall be effective from the date of issuance until June 3, 2022, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), recordation of deed restrictions, procedures for changing ownership, transferring the permit, and renewing the permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system, to record deed restrictions, to transfer the permit, or to renew the permit, will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of this permit. This permit shall be effective from the date of issuance until June 3, 2022 and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system, Pond 34, has been approved for the management of stormwater runoff as described in Section 1.6 of this permit. The stormwater control has been designed to handle the runoff from 437,840 square feet (sf) of impervious area of which 421,406sf has been allocated and 16,434sf is available for future allocation. The subdivision is permitted for 96 lots, each limited to a maximum of 6,000 square feet of impervious area per lot. The project shall provide and maintain a 50' wide vegetative buffer adjacent surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the top of bank of each side of streams and rivers and the mean high water line of tidal waters. 5. The discharge from the wet ponds is designed to flow overland through a level spreader and 30 foot vegetative filter strip, designed per NCAC 2H.1008 (I) to pass the peak flow from the 10 year storm in a non - erosive manner. The level spreader has been provided to protect the wetlands near the pond's outlet. Classification of Water Body: "C: Sw" II. SCHEDULE OF COMPLIANCE 1. No person or entity, including the permittee, shall alter any component of the approved stormwater drainage system shown on the approved plans, unless and until the Division has approved of the revised plan. 2. The permittee is responsible for the routine monitoring of the project for compliance with the built -upon area. limits, grading, and the stone drainage system established by this permit, the permit documents, the approved plans, and the recorded deed restrictions. The permittee shall notify any lot owner that is found to be in noncompliance with the conditions of this permit in writing, and shall require timely resolution. 3. The permittee shall review all individual proposed and modified lot plans for compliance with the conditions of this permit. The permittee shall not approve any lot plans where the maximum allowed built -upon area has been exceeded, or where revisions to the grading or to the storm drainage system are proposed unless and until a permit modification has been approved by the Division. 4. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 5. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. Page 3 of 8 State Stormwater Management Systems Permit No. SW8140305 6. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to the approved plans, regardless of size. b. Redesign or addition to the approved amount of built -upon area. C. Further development, subdivision, acquisition, or sale of any, all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. d. Alteration of any aspect of the approved stormwater drainage system and/or the approved stormwater BMPs. e. The construction of any permitted future development areas shown on the approved plans. 7. All stormwater collection and treatment systems must be located in public rights -of -way, dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required rights -of -way, common areas and easements, in accordance with the approved plans. 8. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. If the stormwater system is used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 9. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 10. The facilities shall be constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 11. The permittee shall follow the approved Operation and Maintenance (0&M) Agreement in its entirety, and shall provide and perform the listed operation and maintenance at the scheduled intervals to assure that all components of the permitted stormwater system function at design condition. 12. Records of maintenance activities must be kept by the permittee. The records will indicate the date, activity, name of person performing the work and what actions were taken. III. SCHEDULE OF COMPLIANCE Prior to the sale of any lot, the following deed restrictions must be recorded: a. The following covenants are intended to ensure ongoing compliance with State Stormwater Management Permit Number SW8140305, as issued by the Division of Energy, Mineral and Land Resources under NCAC 2H.1000. b. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to maintain compliance with the Stormwater Management Permit. C. These covenants are to run with the land and be binding on all persons and parties claiming under them. d. The covenants pertaining to stormwater may not be altered or rescinded without the express written consent of the State of North Carolina, Division of Energy, Mineral and Land Resources. e. Alteration of the drainage as shown on the approved plans may not take place without the concurrence of the Division of Energy, Mineral and Land Resources. f. The maximum built -upon area per lot is 6,000 square feet. This allotted amount includes any built - upon area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas, but does not include raised, open wood decking, or the water surface of swimming pools. Page 4 of 8 State Stormwater Management Systems Permit No. SW8 140305 g. All runoff from the built -upon areas on the lot must drain into the permitted system. This may be accomplished through providing roof drain gutters, which drain to the pond or street, grading the lot to drain toward the street or directly into the pond, or grading perimeter swales and directing them into the pond or street. h. Built -upon area in excess of the permitted amount will require a permit modification. i. All affected lots shall maintain a 50' wide vegetative buffer adjacent to surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the top of bank of each side of streams and rivers and the mean high water line of tidal waters. j. Any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or the requirements of the Stormwater Rules is subject to enforcement procedures as set forth in G.S.143, Article 21. 2. A copy of the recorded deed restrictions must be submitted to the Division within 30 days of the date of recording the plat, and prior to selling lots. The recorded copy must contain all of the statements above, the signature of the Permittee, the deed book number and page, and the stamp/signature of the Register of Deeds. 3. Prior to transfer of the permit, the stormwater facilities will be inspected by DEMLR personnel. The project and the stormwater facility must be in compliance with all permit conditions. Any items not in compliance must be repaired, replaced or restored to design condition prior to the transfer. Records of maintenance activities performed to date will be required. 4. If the permanent pool volume is greater than 30,000 cubic feet, a decorative spray fountain will be allowed in the stormwater treatment system, subject to the following criteria: a. The fountain must draw its water from less than 2' below the permanent pool surface. b. Separated units, where the nozzle, pump and intake are connected by tubing, may be used only if they draw water from the surface in the deepest part of the pond. C. The falling water from the fountain must be centered in the pond, away from the shoreline. d. The maximum horsepower for the fountain's pump is based on the permanent pool volume. The maximum pump power for a fountain in Pond 34 is 3/4. If permeable pavement BUA credit is desired, the permittee must submit a request to modify this permit to incorporate such language as required by the Division of Energy, Mineral and Land Resources. The request to modify must include a proposed amendment to the deed restrictions and protective covenants for the subdivision, and a soils report identifying the type of soil, the Seasonal High Water Table elevation and the infiltration rate. Upon the successful completion of a permit modification, the individual lot owners that request to utilize permeable pavements shall submit the necessary forms and documentation to the permittee, or a designated agent, and receive approval prior to construction of the permeable pavement. IV. GENERAL CONDITIONS This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed Name/Ownership Change Form, accompanied by the supporting documentation as listed on the form, to the Division of Energy, Mineral and Land Resources at least 60 days prior to any one or more of the following events: a. An ownership change including the sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions; b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association, subject to the requirements of Session Law 2011-256; c. Bankruptcy; d. Foreclosure; e. Dissolution of the partnership or corporate entity; f. A name change of the current permittee; g. A name change of the project; h. A mailing address change of the permittee; 2. The permittee is responsible for compliance with all permit conditions until such time as the Division approves a request to transfer the permit. Neither the sale of the project in whole or in part, nor the conveyance of common area to a third party constitutes an approved transfer of the permit. Any person or entity found to be in noncompliance with the terms and conditions of a stormwater management permit or the stormwater rules is subject to enforcement action as outlined in NCGS 143, Article 21. 4. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 5. In the event that the facilities fail to perform satisfactorily the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 6. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting the permitted stormwater management facility. The permit issued shall continue in force and effect until revoked or terminated. The permit may be modified, revoked and reissued or terminated for cause. The fling of a request for a permit modification, revocation and re -issuance or termination does not stay any permit condition. 8. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 9. Approved plans, specifications, supplement forms, 0&M Agreements and calculations for this project are incorporated by reference and are enforceable parts of the permit. The permittee shall maintain a copy of these documents on file at all times. 10. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules and regulations contained in Session Law 2006-246, Title 15A NCAC 2H.1000, and NCGS 143-215.1 et.al. 11. The permittee shall submit a permit renewal application at least 180 days prior to the expiration date of this permit. The renewal request must include the appropriate documentation and the processing fee. Permit issued this the 3rtl day of June 2014. The drainage area to the system contains approximately the permitted acreage. _2. The drainage area to the system contains no more than the permitted amount of built -upon area. _3. All the built -upon area associated with the project is graded such that the runoff drains to the system. All roof drains are located such that the runoff is directed into the system. 5. The outlet/bypass structure elevations are per the approved plan. _6. The outlet structure is located per the approved plans. _7. Trash rack is provided on the outlet/bypass structure. _8. All slopes are grassed with permanent vegetation. _9. Vegetated slopes are no steeper than 3:1. _10. The inlets are located per the approved plans and do not cause short-circuiting of the system. _11. The permitted amounts of surface area and/or volume have been provided. _12. Required drawdown devices are correctly sized per the approved plans. _13. All required design depths are provided. 14. All required parts of the system are provided, such as a vegetated shelf, a forebay, and the vegetated filter. _15. SW8 050927 (Brunswick Forest Phase 1 modification) a) To the best of my knowledge, ALL of the drainage area is "onsite", as per the original permit by Malpass Engineering, and subsequent modifications, the last one being approved, noted as such on June 15, 2006, which lists 9,001,674 sf onsite and "none" offsite. The additional area we are appending is also fully "onsite". b) Wow. Yes, those numbers were entered incorrectly. I entered the correct values and checked and revised all the other values that were entered on the supplement, attached. c) When we increased the drainage area and redesigned the existing pond, we added the second forebay, increased surface area and depth, and increased storage by raising the weir elevation, and re -ran all the numbers and routing calculation, based upon the current standards of 1.5". d) We are providing bearings and distances and a clearer delineation of the project and drainage areas as requested. The outlet structure pond IS included in surface area and storage calculations, as it was previously, but we are proposing no modifications to that portion of the pond as such, except raising the weir elevation in the structure itself. The existing heavy rip -rap outlet protection apron extends over 50' farther than the pipe discharge and is more than adequate; I calculate the 10-year outlet velocity at 3.7 fps. A level spreader is not required. All ponds are located within a drainage easement or common area, as in all of Brunswick Forest recorded plats, and I noted again as such on the plan. All required buffers have been provided. e) I believe that the correction as you have noted should be sufficient. 2.) SW8 14305 (Brunswick Forest Phase 1 Section 4) a) The permanent pool was intended to go down to 8.0, not 7.0 (172,800 + 43,200 = 216,000), and I changed the plan and supplement to reflect the correct depth and added level spreader details and sizing, although the spreader is not strictly required in this application. b) As in 1)d) above, we are providing you with a clearer delineation map. And also as above, level spreader information, drainage easement note and buffers are now accounted for. c) I'm working on providing you with a notarized statement that the proffered restrictive covenants will be recorded; has this been required in the past? d) There should be no offsite supplement required. All ponds, all drainage areas, and all maintenance agreements in Brunswick Forest are with Funston Land 8 Timber, LLC. A preliminary in-depth review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1) General: Brunswick Forest Phase I Section 4 is a new section to be built. A portion of this section will be treated onsite (on the SW8140305 permit) and a portion of it will drain offsite to be treated in the wet pond permitted under SW8 050927. It appears from the file that SW8 050927 overlaps SW8 060226. The Division requested a Plan Revision to address this issue in 2009, but it does not appear from the file that the Plan Revision has been received. In order to process the two applications in-house (SW8 050927 and SW8140305) the overlap between SW8 060226 will have to be addressed simultaneously. Please submit a Plan Revision for SW8 060226. a) SW8 050927 (Brunswick Forest Phase 1): A modification package has been received. A history of the file is as follows. i) 7/27/09: Plan Revision approving the pond as -built with PE Certification. This Plan Revision says that SW8 050927 and SW8 060226 have overlapping lots and drainage areas and that there are discrepancies between the recorded deed restrictions for each permit. The letter asked for another plan revision to correct the lot numbers, permit numbers, and impervious area allocations for each permit. A plan revision request has not been received. ii) 6/15/06: Permit issued iii) 12/13/05: Permit issued b) SW8140305 (Brunswick Forest Phase I, Section 4): This will be a new permit. c) SW8 060226 (Brunswick Forest Phase I, Jefferson Landing): A Plan Revision has not been received for this permit. i) 4/22/10: Plan Revision to add the existing Robinson's Landing Boat Launch to Parcel E on the Conceptual Master Plan that was originally approved with Phase I of Brunswick Forest. It does not appear that this Plan Revision addressed the concerns in the 6/27/09 letter. ii) 4/25/06: Permit issued 2) All Three Permits' Data: Please tabulate the impervious area associated with the buildings/lots, streets, parking, sidewalks, and other uses as being either onsite or offsite impervious area for each pond. Land Surveyors, Engineers, Land Planners Brunswick Forest Phase 1 Section 4 — SHWT determination - POND No. 34 Field visit: 12-20-13 References: Soils at the pond site are mapped as Foreston Series loamy fine sands (USDA NRCS National Cooperative Soil Survey map and Official Series Description attached), moderately well drained soils with moderately rapid permeability and relatively flat slopes of 0-2%, abutting the delineated wetlands soils which are mapped as predominantly Dorovan and Pantego Series mucky loamy, poorly drained with moderately poor permeability and flat slopes. Observations: One soil boring was observed as follows (location map and aerial photo attached): The seasonal high water table is normally evident by observation of redoximorphic features suggesting past conditions of saturation and reduction, indicated by colors of chroma 2 or less (Munsell) at greater than 2% of soil volume in mottles or a distinct horizon subdivision. There was evidence of redoximorphic features at about 1.95' in the bore at the pond (No.34) with a distinct chroma and evidence of wetness at that depth. This observation was in line with the expected depth to seasonal high water in the soil profile of 2.0 to 3.5' for Foreston Series soils. Elevation read at the boring for Pond 34 was 18.16 MSL, resulting in a SHWT elevation of 16.21 MSL (18.16 — 1.95 = 16.21), field notes report and photos in file). TYPE LOCATION: Williamsburg County, South Carolina; 4.6 miles southeast on South Carolina Highway 512 from the intersection of U.S. Highway 52 in Cordes, South Carolina; 0.1 mile southwest on South Carolina Secondary Highway 159; 0.2 mile south on field road; 33 feet northeast of road. RANGE IN CHARACTERISTICS: Reaction is very strongly acid to slightly acid in the A and E horizon and very strongly acid or strongly acid in the Bt horizon. The A or Ap horizon has hue of 1 OYR or 2.5Y, value of 3 or 4, and chroma of 1 or 2. It is sand, fine sand, loamy sand or loamy fine sand. The E and E' horizons have hue of 1 OYR or 2.5Y, value of 5 to 7, and chroma of 1 to 4. Redox features of higher chroma are present in some pedons. In some pedons the E' horizon is discontinuous and is mottled. It is sand, fine sand, loamy sand, or loamy fine sand. The upper Bt horizon has hue of 7.5YR to 2.5Y, value of 5 or 6, and chroma of 4 to 6. Redox features in shades of red, yellow, and brown are present in some pedons and gray iron depletions are within 30 inches of the surface. It is sandy loam or fine sandy loam with less than 20 percent silt. Some pedons have a thin subhorizon that is sandy clay loam. Many pedons contain lenses and pockets of clean sand. Some pedons have a few nodules of plinthite. The B't horizon has hue of 7.5YR to 2.5Y, value of 4 to 7, and chroma of 1 to 8. It has few to many redox features in shades of red, yellow, brown, and gray or it is mottled. It is sandy loam, fine sandy loam or sandy clay loam. The C horizon has hue of 7.5YR to 2.5Y, value of 4 through 8, and chroma of 1 through 8 or it is mottled without a dominant matrix color. It is fine sand, sand, loamy fine sandy, fine sandy loam, sandy clay loam, sandy loam, or sandy clay and in some pedons it is stratified with these textures. Pactolus soils are sandy throughout. GEOGRAPHIC SETTING: Foreston soils are on nearly level slopes in the Coastal Plain. The soil formed in loamy marine sediments. Near the type location the mean annual temperature is 64 degrees F., the average annual rainfall is 48 inches, and the frost -free season is about 228 days. GEOGRAPHICALLY ASSOCIATED SO1LS:'Ihese are the Autrvville, Bonneau, Chisolm, Dothan, FuQuay Goldsboro, Kalmia, Leon, Lynchburg, Lvtm Haven, Norfolk, Ocilla, Paxville, Rains, Rutlege, and Wagrain soils. The Autryville, Bonneau, Chisolm, Dothan, Fuquay, Norfolk, and Wagram soils are in slightly higher positions on the landscape and are better drained. In addition, these soils, except for Dothan and Norfolk, are arenic. They all have fine-loamy,Bt horizons. The Goldsboro soils are in a similar position on the landscape, but they are fine -loamy. Lynchburg, Ocilla, Paxville and Rains soils are in slightly lower positions on the landscape and are more poorly drained and have fmc-loamy Bt horizons. Leon, Lynn Haven and Rutlege soils are in the lowest position on the landscape, are more poorly drained, and are sandy throughout. DRAINAGE AND PERMEABILITY: Moderately well drained. Surface runoff is slow. Permeability is moderately rapid. USE AND VEGETATION: Most areas of these soils have been cleared and are cropped to com, cotton, tobacco, soybeans, and hay crops.
