The Wilmington Regional Office received a complete, modified Express State Stormwater Management
Permit Application for The Thistle Golf Club on April 29, 2014. Staff review of the modified plans and
specifications has determined that the project, as proposed, will comply with the Stormwater
Regulations set forth in Session Law 2008-211 and Title 15A NCAC 2H.1000. We are forwarding
Permit No. SW8 980820 dated May 30, 2014, for the construction, operation and maintenance of the
BMP's and built -upon area associated with the subject project.
This permit shall be effective from the date of issuance until March 27, 2015, and shall be subject to the
conditions and limitations as specified therein. Please pay special attention to the conditions fisted in
this permit regarding the Operation and Maintenance of the BMP(s), recordation of deed restrictions,
procedures for changing ownership, transferring the permit, and renewing the permit. Failure to
establish an adequate system for operation and maintenance of the stormwater management system,
to record deed restrictions, to transfer the permit, or to renew the permit, will result in future compliance
problems.
The following modifications are included and covered by this permit:
1. The pond systems have been modified from a no -discharge system to a discharging pond
system via the addition of a drawdown orifice. Golf course irrigation from the pond system is still
allowed, but is no longer the only means -of drawing down the pond.
2. The drainage areas were revised to include the area of the BMP.
3. Phase II development is shown on the plans. The total number of lots in Phase I is now 68 and
the total number of lots in Phase II is 91.
4. The maximum BUA per lot increased from 6,000 sf to 8,000 sf.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings
(OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes, and
must be filed with the OAH within thirty (30) days of receipt of this permit. You should contact the OAH
with all questions regarding the filing fee (if a filing fee is required) and/or the details of the filing

Carolina as amended, and other applicable Laws, Rules, and Regulations

construction, operation and maintenance of two (2) wet detention ponds in compliance
with the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules')
and the approved stormwater management plans and specifications and other supporting
data as attached and on file with and approved by the Division of Energy, Mineral and
Land Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until March 27, 2015 and shall be
subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.6 of this permit. The wet ponds designated as DA-1
and DA-2 have been designed to treat the runoff from 1,219,339 square feet and
1,269,522 square feet of impervious area, respectively.
3. Each of the 68 single family subdivision lots in Phase I and the 91 single family lots
in Phase II is limited to a maximum of 8,000 ftz of built -upon area.
4. Approved plans and specifications for this project are incorporated by reference and
are enforceable parts of the permit.
5. The runoff from all built -upon area within each of the permitted drainage areas of
this project must be directed into the appropriate permitted stormwater control
system.

II. SCHEDULE OF COMPLIANCE
1. No homeowner/lot owner/developer shall fill in, alter, or pipe any drainage feature
(such as swales) shown on the approved plans as part of the stormwater
management system without submitting a revision to the permit and receiving
approval from the Division.
2. The permittee shall routinely monitor the project to assure that the proposed built -
upon area for the project and for each lot, does not exceed the maximum allowed
built -upon area assigned by this permit.
3. The permittee shall review all proposed lot plans and subsequent modifications and
additions thereto, for compliance with the permitted BUA limit. The permittee shall
not approve any lot plans that propose to exceed the maximum allowed BUA limit
assigned by the permit.
4. The permittee shall have submitted a permit modification and received approval
prior to the construction of any changes to the approved plans. A permit
modification is required for, and not limited to, any of the following occurrences:
a. Any revision to the approved plans, number of lots, layout, drainage, ponds,
streets, details, etc., regardless of size.
b. Redesign of or changes to the permitted amount of built -upon area for the
project or for the individual lots covered by the permit.
c. Further subdivision, acquisition, or sale of the project area. The project area is
defined as all property owned by the permittee, for which Sedimentation and
Erosion Control Plan approval was sought.
d. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
e. The development of the multi -family future tract in Phase II.

5. The Director may determine that other revisions to the project should require a
modification to the permit.
6. The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of the permit. Within the time frame specified in
the notice, the permittee shall submit a written time schedule to the Director for
modifying the site to meet minimum requirements. The permittee shall provide
copies of revised plans and certification in writing to the Director that the changes
have been made.
7. The stormwater management systems shall be constructed in their entirety,
vegetated and operational for their intended use prior to the construction of any
built -upon surface.
8. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately. If the stormwater system was used as an
Erosion Control device, it must be restored to design condition prior to operation as
a stormwater treatment device, and prior to occupancy of the facility.
9. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received from
an appropriate designer for the system installed certifying that the permitted facility
has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification.
10. If the permanent pool volume is greater than 30,000 cubic feet, a decorative spray
fountain will be allowed in the stormwater treatment system, subject to the following
criteria:
a. The fountain must draw its water from less than 2' below the permanent pool
surface.
b. Separated units, where the nozzle, pump and intake are connected by tubing,
may be used only if they draw water from the surface in the deepest part of the
pond.
C. The falling water from the fountain must be centered in the pond, away from the
shoreline.
d. The maximum horsepower for the fountain's pump is based on the permanent
pool volume. The maximum pump power for a fountain in either pond is 3 HP.
11. Unless specified elsewhere, permanent seeding requirements for the stormwater
pond systems must follow the guidelines established in the North Carolina Erosion
and Sediment Control Planning and Design Manual.
12. The facilities shall be constructed in accordance with the conditions of this permit,
the approved plans and specifications, and other supporting data.
13. The permittee shall maintain a copy of the approved plans and specifications on
site at all times.

14. The permittee shall at all times provide the operation and maintenance necessary
to assure the permitted stormwater system functions at optimum efficiency. The
approved Operation and Maintenance Plan must be followed in its entirety and
maintenance must occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
c. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch
basins and piping.
g. Access to the outlet structure must be available at all times.
15. Records of maintenance activities must be kept and made available upon request
to authorized personnel of DEMLR. The records will indicate the date, activity,
name of person performing the work and what actions were taken.
16. Prior to the sale of any lot, deed restrictions must be recorded which limit the built -
upon area per lot to the amount as shown on the Project Data Sheet, per Section I,
Part 2. The recorded statements must follow the form:
a. "The maximum built -upon area per single family lot is 8,000 ft2 square feet. This
allotted amount includes any built -upon area constructed within the lot property
boundaries, and that portion of the right-of-way between the front lot line and
the edge of the pavement. Built upon area includes, but is not limited to,
structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking
areas, but does not include raised, open wood decking, or the water surface of
swimming pools."
b. "The covenants pertaining to stormwater regulations may not be changed or
deleted without concurrence of the State."
c. "Alteration of the drainage as shown on the approved plan may not take place
without the concurrence of the State."
17. A copy of the recorded deed restrictions must be submitted to the Division within 30
days of the date of recording the plat, and prior to selling lots. The recorded copy
must bear the signature of the Permittee, the deed book number and page, and
stamp/signature of the Register of Deeds.
18. Built upon area includes, but is not limited to, structures, asphalt, concrete, brick,
stone, slate, coquina and parking areas, but does not include raised, open decking,
or the water surface of swimming pools.
III. GENERAL CONDITIONS
1. Any individual or entity found to be in noncompliance with the terms, conditions and
limitations contained in a stormwater management permit or the stormwater rules,
is subject to enforcement action in accordance with North Carolina General Statute
143 Article 21.
2. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances which may be imposed by
other government agencies (local, state, and federal) which have jurisdiction.

3. This permit is not transferable to any person or entity except after notice to and
approval by the Director. The permittee shall submit a completed and signed
Name/Ownership Change Form, accompanied by the supporting documentation as
listed on the form, to the Division of Energy, Mineral and Land Resources at least
60 days prior to any one or more of the following events:
a. An ownership change including the sale or conveyance of the project area in
whole or in part, except in the case of an individual lot sale that is made subject
to the recorded deed restrictions;
b. The sale or conveyance of the common areas to a Homeowner's or Property
Owner's Association, subject to the requirements of Session Law 2011-256;
c. Bankruptcy;
d. Foreclosure;
e. Dissolution of the partnership or corporate entity;
f. A name change of the current permittee;
g. A name change of the project;
h. A mailing address change of the permittee;
4. Prior to transfer of the permit, the project must be inspected by the Division and
determined to be in compliance with all permit conditions. Any items not in
compliance must be repaired or replaced to design condition prior to the transfer.
Required documentation including recorded deed restrictions, Designer
Certifications, records of lot approvals and/or copies of tax records and BMP
maintenance activities performed to date will be required as proof of compliance.
5. In the event that the facilities fail to perform satisfactorily, the Permittee shall take
immediate corrective action, including those as may be required by this Division,
such as the construction of additional or replacement stormwater management
systems.
6. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition.
7. Permittee grants permission to staff of the DEMLR to access the property for the
purposes of inspecting the stormwater facilities during normal business hours.
8. The permittee shall submit a permit renewal application and fee to the Division at
least 180 days prior to the expiration date of this permit. The renewal application is
due by September 27, 2014.

11. Required drawdown devices are correctly sized and are installed at the
correct elevation per the approved plans.

13. All required parts of the system are provided, such as a vegetated shelf, a
forebay, and a vegetated filter, if applicable.

Stormwater runoff during and post construction will be collected and treated by two, distinct Rond systems
constructed on the adjoining golf course. The pond systems are each interconnected in series through weirs
and piping, and each has a controlled discharge thorugh an orifice and broad -crested weir installed on the
last pond in each series. The pond systems were previously permitted and constructed during develoRment
activities associated with Phase I of the project.

VI. SUBMITTAL REQUIREMENTS
Only complete application packages will be accepted and reviewed by the Division of Energy, Mineral and
Land Resources (DEMLR). A complete package includes all of the items listed below. A detailed application
instruction sheet and BMP checklists are available from

6. A USGS map identifying the site location. If the receiving stream is reported as class SA or the
receiving stream drains to class S.A. waters within 1/2 mile of the site boundary, include the 1/2
mile radius on the map.
7. Sealed, signed and dated calculations (one copy).
8. Two sets of plans folded to 8.5" x 14" (sealed, signed, & dated), including:
a. Development/Project name.
b. Engineer and firm.
c. Location map with named streets and NCSR numbers.
d. Legend.
e. North arrow.
f. Scale.
g. Revision number and dates.
h. Identify all surface waters on the plans by delineating the normal pool elevation of
impounded structures, the banks of streams and rivers, the MHW or NHW line of tidal
waters, and any coastal wetlands landward of the MHW or NHW lines.

VII. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
For all subdivisions, outparcels, and future development, the appropriate property restrictions and protective
covenants are required to be recorded prior to the sale of any lot. If lot sizes vary significantly or the proposed
BUA allocations vary, a table listing each lot number, lot size, and the allowable built -upon area must be provided
as an attachment to the completed and notarized deed restriction form. The appropriate ridkieds restd

In the instances where the applicant is different than the property owner, it is the responsibility of the property

THIS SECOND AMENDMENT TO DECLARATION OF PROTECTIVE COVENANTS
RESTRICTIONS AND EASEMENTS FOR THISTLE DOWNS AT THISTLE GOLF CLUB (the
"Amendment") is made and entered into as of February 7, 2014, by DGH THISTLE, LLC, a Florida
limited liability company ("Declarant").
RECITALS:
A. Thistle Downs Limited Partnership, a Florida limited partnership ("Thistle Downs")
entered into that certain Declaration of Protective Covenants, Restrictions and Easements for Thistle
Downs at Thistle Golf Club dated as of September 5, 2001, recorded in Book 1529, Page 572, as
amended by a First Amendment recorded in Book 3353, Page 782, in the Brunswick County, North
Carolina Register of Deeds, (the aforesaid Declaration, as amended by the aforesaid First Amendment is
hereafter referred to as the "Declaration").
B. Declarant is the successor to the rights of Thistle Downs as "Declarant" under the
Declaration by virtue of that certain Assignment of Declarant Rights recorded in Book 3454, Page 462,
in the Brunswick County, North Carolina Register of Deeds.
C. Pursuant to Article XVII, Section 15 of the Declaration, the "Declarant" thereunder has
the unilateral right to amend the Declaration prior to the Turnover Date (as defined in the Declaration,
which Turnover Date, as of the date of this Amendment, has not yet occurred).
D. As "Declarant" under the Declaration, Declarant desires to amend this Declaration in
accordance with the terms and provisions set forth in this Amendment.
AGREEMENT:
NOW, THEREFORE, for an in consideration of Ten Dollars ($10.00) paid in hand and other
food and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the
parties hereby agree as follows:

1. Recitals. The recitals set forth above are incorporated herein by reference. The use of
any capitalized term not otherwise defined herein shall have the meaning ascribed thereto in the
Declaration.
2. Turnover Date. Article IV, Section 2 of the Declaration is hereby amended by deleting
the phrase "December 31, 2014" and replacing said phrase with the phrase "December 31, 2017."
3. A new Section 39 to Article V of the Declaration is added as follows:
Section 39. Side Setback Lines for Lots Recorded in Map Cabinet 65, Page 34. With respect to
Lots 55-61, 63-64, 66,68 and 69, Phase II, Thistle Downs Subdivision, as recorded in Map Cabinet 65,
Page 34, Brunswick County, North Carolina, Public Registry, the side Setback Lines shall be five (5)
feet from the property line.
4. A new Section 40 to Article IV of the Declaration is added as follows:
Section 40, Minimum Impervious Area. Subsequent to January 1, 2014, with respect.to new
construction on any previously vacant lot, the maximum impervious surface area shall not exceed 6,000
square feet. The term "Impervious Area" shall mean any built upon area constructed within a Lot and
for such Lot shall include any built upon area between the front Lot line and that portion of the right-of-
way between the front Lot line and the edge of the pavement. "Built upon area" includes, but is not
limited to structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas, but does
not include raised open wood decking or the water surface of swim„ting pools.
5. Section 1 to Article XI of the Declaration is deleted in its entirety and amended and
restated as follows:
Section 1. General. The Golf Club Property is not Common Area. The Golf Club Property is
private property owned and operated by the' Golf Club Property Owner or- its assigns and administered
according to membership policies and rules and regulations adopted by the Golf Club Owner from time
to time. The Golf Club Property Owner has the exclusive right to determine from time to time, in its
sole discretion and without notice or approval of any change, how and by whom facilities on the Golf
Club Property shall be used, if at all. Ownership of a Lot or any other portion of the Property or
membership in the Association does not give any vested right or easement, prescriptive or otherwise, to
use the Golf Club Property, and does not grant any ownership or membership interest therein.
6. Conflict. To the extent of any conflict between the provisions of the Declaration and the
provisions of this Amendment, this Amendment shall supersede and control.
7. Final Agreement: Ratification. Except as specifically set forth herein, the Declaration
remains unchanged and in full force and effect and Declarant, as "Declarant" under the Declaration, by
its execution of this Amendment, hereby ratifies, affirms and approves the Declaration, as amended
hereby.

Narrative of Stormwater Best Management Practices
The Thistle Golf Club and Estates -Phase II
Calabash, Brunswick County, North Carolina
The subject site is Phase II of The Thistle Golf Club (formerly Hansen Tract), located in southeastern
Brunswick County in the Town of Calabash. The tract is located in the southeast quadrant formed by the
intersection of NCSR 1163 and NCSR 1164, and comprises approximately 401.26 acres. The project is
located adjacent to/or within the headwater wetlands of Shingletree Swamp and Little Cawcaw Swamp.
The current use of the property is residential/recreational, with 14 developed single-family lots, a 27-hole
public golf course, a clubhouse and maintenance building. The site is currently undergoing development
of an area permitted as Phase I, with Phase II development planned in the future.
The project area is relatively flat; topographic relief ranges from approximately 52 feet above mean sea
level (MSL) to approximately 46 feet MSL. Soil at the site is predominantly of the Murville, Mandarin
and Leon Series (Soil Survey of Brunswick County). These soils are typically poorly drained, fine sands
in upland areas.
A pocket of wetlands was delineated in the northeast portion of the Phase I project area during the
stormwater permitting phase. Wetlands were not identified in the Phase II section of the development.
Phase I of the tract is composed of approximately 252 acres, of which construction of the roadways was
permitted under NCDENR low density stormwater permit SW8 970135 in March 1997. In November
1998, the permit was modified to include the roadways in Phase 11 of the tract. In September 1999, a
permit application was submitted by WK Dickson for a 32-acre, non -discharging pond system for
collection of post -construction stormwater runoff from both phases of development.
In May 2000, NCDENR issued a modified stormwater permit, SW8 980820, for a high -density
development of the tract, to include 1,208 multi -family units limited to 30% impervious area, with post -
construction stormwater runoff to be treated by the pond collection system. The permit was modified in
September 2000 from a multi -family residential layout to single family units. In March 2001, the permit
was again modified to combine the development of both Phase I and Phase II into a high density permit
covering a total drainage area of 362.41 acres (218.91 acres in Phase I and 143.5 acres in Phase II), with
construction of 57 single-family lots in Phase I, with a Built Upon Area restriction of 6,000 square feet
per lot.
Post construction stormwater runoff is collected and treated by two distinct, non -discharge,
interconnected pond systems comprised of a total of 13 ponds and providing a total 60 acres of storage
area.

Detention Basin Systems
The two detention basin systems provide treatment of stormwater runoff from the developed areas of
Phase I and Il. The two p and systems are not connected to each other. Seven ponds are interconnected in
the Phase I system, and six ponds are interconnected in the Phase II system.
The Phase I pond system provides a total surface area of 1,393, 570 ft (32 acres) at the permanent pool
elevation of 44.5 feet mean sea level (fmsl). The provided surface area exceeds the required surface area
of 43,879 fl calculated using a Surface Area/Drainage area (SA/DA) ratio of 0.4 (Table 10-4, North
Carolina Division of Water Quality Stormwatar BMp 11fanual), a design suspended solids removal
efficiency of 90%, an 11% impervious cover and six foot permanent pool average depth. The permanent
pool elevation of the interconnected ponds is controlled by a designated outlet structure in Pond "C"
comprised on an outlet weir installed with a discharge elevation of 45.82 finsl. As part of the modified
stormwater permit, an 8" circular orifice will be installed on this outlet structure to provide release of the
1.5" storm volume of 204,310 ft . Additionally, Ponds "D" and "E" in the Phase I system have outlet
weirs set at elevations 47.12 and 47.72 finsl, respectively, to control upstream levels in the interconnected
ponds. The upstream weirs are set at elevations to provide 1.32 feet of storage depth in the temporary
pool of each pond. The total provided temporary pool surface area is 1,433,759 W (32.9 acres) with a
provided storage capacity of 1,244,025 ft . This is more than enough capacity to capture the stormwater
runoff volume from the Phase I drainage area based on a rainfall depth of 1.5 inches. The bottom
elevations of the ponds in the Phase I system range from 38.4 ft asl to 40.4 ft asl, and are designed with a
sediment storage depth of 1.5 ft. There are no vegetated shelves in the Phase I pond system, and all pond
slopes are a maximum 3:1. Calculations and the Wet Detention Supplement form are provided in the
stormwater permit modification application.
The Phase II pond system provides a total surface area of 1,026,411 W (23.56 acres) at the permanent
pool elevation of 45.65 feet mean sea level (finsl). The provided surface area exceeds the required
surface area of 58,501 ftz calculated using a Surface Area/Drainage area (SA/DA) ratio of 0.79 (Table 10-
4, North Carolina Division of .Water Quality Stormwater BMP Manual), a design suspended solids
removal efficiency of 90%, a 17% impervious cover and 6.5 permanent pool average depth. The
permanent pool elevation of the interconnected ponds in Phase II is controlled by a designated outlet
structure in Pond "Z" comprised on a 12-ft wide broad -crested weir to control the water levels in the
interconnected ponds. The top of the outlet weir is set at an elevation of 47.2 feet above mean sea level
(asl) to provide an emergency spillway. The outlet structure is equipped with five, 12-inch diameter
orifices set with an invert elevation of 45.65 ft asl. The center orifice will be capped/plugged, and an 8"
orifice and pipe will be installed through the cap for release of the 1.5-inch storm volume of 189,104 W.
The other four orifices will each be covered with an 8" steel rectangular weir plate that will be bolted and
sealed to the concrete wall of the outlet structure. Additionally, Ponds "U" and "V" in the Phase II
system have outlet weirs set at top elevations 47.2, and 46.9 ft asl, respectively, to control upstream levels
in the interconnected ponds, and Pond "T" is connected to Pond "Z" through a 36" underwater pipe with a
top elevation of 44.40 ft asl. The upstream weirs are set at elevations to provide 2.09 feet of storage depth
in the temporary pool of each pond. The total provided temporary pool surface area is 1,154,329 ftz (26.5
acres) with a provided storage capacity of 710,435 W at an average depth of 6.5 feet. This is more than
enough capacity to capture the stormwater runoff volume from the Phase II drainage area based on a
rainfall depth of 1.5 inches. The bottom elevations of the ponds in the Phase II system range from 39.5
ft asl to 40.2 ft asl, and are designed with a sediment storage depth of 1.5 ft. There are no vegetated
shelves in the Phase II pond system, and all pond slopes are a maximum 3:1. Calculations and the Wet
Detention Supplement form are provided in the stormwater permit modification application.

The Wilmington Regional Office received an Express Stormwater Management Permit
Application for The Thistle Golf Club and Estates on April 29, 2014. A preliminary review of
that information has determined that the application is not complete. The following
information is needed to continue the stormwater review:
1. The impervious area reported on the Phase I pond supplement does not match the
impervious area reported on the application..
2. The pond area is generally counted as part of the drainage area and is considered
pervious. Please revise the drainage areas for each pond.
3. Since the deed restrictions allow all of the lots to have 8,000 square feet of BUA, you
should use 8,000 sf for each lot for purposes of totaling up the BUA. You do not
need to separate the lots by existing and undeveloped, or account for partial lots. In
the Phase I pond, just use 68 x 8000 for the lot BUA, then add in the other buildings.
In the Phase II pond, use 91 x 8000 and eliminate the 4745 "existing".
4. The wet pond supplement has an area to report volumes for SA waters and non -SA
waters. Since Shingletree Swamp is non -SA waters, you should not have any
numbers in the five blanks under the heading "Storage Volume: SA Waters" on the
supplements. You only need to fill in the two blanks under the heading "Storage
Volume: Non -SA Waters" on the supplements.
5. The Pond C weir details on Figure 4 need to be revised as follows:
a. The orifice invert is currently shown as 44.7, however the permanent pool
elevation for the Phase 1 pond is proposed at 44.5, therefore the orifice
invert should also be set at 44.5.
b. The weir throat elevation is currently shown as 45.78, however, the
temporary pool elevation is proposed at 45.82. Please either raise the
throat elevation to 45.82, or lower the proposed temporary pool elevation
to 45.78. If you lower the temporary pool to 45:78, please update the
supplement form, recalculate the volume provided between 44.5 and
45.78, and recalculate the orifice size.

6. The Pond Z weir details on Figure 4 indicate that the existing 12" orifices have
been covered by a steel plate. As we discussed at our meeting, the temporary
pool elevation in the Phase 2 pond is going to be governed by the top elevation
of that steel plate, which is currently set at elevation 46.3. If you want to keep the
temporary pool at 47.2, then you need to completely cover or plug the 12" orifices
such that the water level is allowed to stage up to 47.2 and then flow over the
broad -crested weir. If you want to keep the steel covers over the existing orifices
at 46.3, then please update the supplement and recalculate the temporary pool
volume provided between elevations 45.65 and 46.3, and recalculate the orifice
size.
7. Each of the orifice sizing calculations uses a CD of 0.65 and an average head of
3.7 (feet/inches??). The standard coefficient of discharge for a sharp -edged
orifice is 0.6. The use of a larger CD and an incorrect average head results in the
4" orifice being much too small to drain off the 1.5" volume in 2-5 days. Average
head in the Phase 1 pond is (45.82 — 44.5) / 3 = 0.44 feet and average head in
the Phase 2 pond is (47.2 — 45.65) / 3 = 0.52 feet. These are the current
numbers — if you change the temporary pool elevations as described in previous
comments, the average head will be different.
8. For the Phase 2 pond, there are several inconsistencies between the numbers
reported on the supplement, application and calculations that must be resolved:
a. Please clarify what is the permanent pool surface area provided — the
calculations indicate 2 different numbers: 1,026,410 and 1,017,508.
The number reported on the supplement is 1,019,096.
b. The required minimum permanent pool surface area in the calculations
is 55,772, but the number reported on the supplement is 71,260.
c. The temporary pool volume provided in the calculations is 1,752,489,
but the number reported on the supplement is 256,371. The temporary
pool volume is that volume located between the permanent pool
elevation and the specified temporary pool elevation.
d. Please round the average depth to the nearest half -foot (6") before
calculating the SA/DA ratio. For this pond the average depth to use is
6.5 feet, not 6.6 feet.
Please revise the application documents accordingly and provide 2 new
copies. Due to the increases in drainage area and built -upon area, these
numbers will change.
9. Due to the significant additional review time that will be needed, please submit a
reapplication fee of $500.
Please note that this request for additional information is in response to a preliminary
review. The requested information should be received in this Office prior to May 15,
2014, or the application will be returned as incomplete. The return of a project will
necessitate resubmittal of all required items, including the application fee.
If you need additional time to submit the information, please mail, email or fax your
request for a time extension to the Division at the address and fax number at the bottom
of this letter. Please note that a second significant request for additional information
may result in the return of the project. If that occurs, you will need to reschedule the
project through the Express coordinator for the next available review date, and resubmit

The subject site is Phase H of The Thistle Golf Club (formerly Hansen Tract), located in southeastern
Brunswick County in the Town of Calabash. The tract is located in the southeast quadrant formed by the
intersection of NCSR 1163 and NCSR 1164, and comprises approximately 401.26 acres. The project is
located adjacent to/or within the headwater wetlands of Shingletree Swamp and Little Cawcaw Swamp.
The current use of the property is residential/recreational, with 14 developed single-family lots, a 27-hole
public golf course, a clubhouse and maintenance building. The site is currently undergoing development
of an area permitted as Phase I, with Phase H development planned in the future.
The project area is relatively flat; topographic relief ranges from approximately 52 feet above mean sea
level (MSL) to approximately 46 feet MSL. Soil at the site is predominantly of the Murville, Mandarin
and Leon Series (Soil Survey of Brunswick County). These soils are typically poorly drained, fine sands
in upland areas.
A pocket of wetlands was delineated in the northeast portion of the Phase I project area during the
stormwater permitting phase. Wetlands were not identified in the Phase H section of the development.
Phase I of the tract is composed of approximately 253 acres, of which construction of the roadways was
permitted under NCDENR low density stormwater permit SW8 970135 in March 1997. In November
1998, the permit was modified to include the roadways in Phase H of the tract. In September 1999, a
permit application was submitted by WK Dickson for a 32-acre, non -discharging pond system for
collection of post -construction stormwater runoff from both phases of development.
In May 2000, NCDENR issued a modified stormwater permit, SW8 980820, for a high -density
development of the tract, to include 1,208 multi -family units limited to 301/6 impervious area, with post -
construction stormwater runoff to be treated by the pond collection system. The permit was modified in
September 2000 from a multi -family residential layout to single family units. In March 2001, the permit
was again modified to combine the development of both Phase I and Phase II into a high density permit
covering a total drainage area of 362.41 acres (218.91 acres in Phase I and 143.5 acres in Phase Il), with
construction of 57 single-family lots in Phase I, with a Built Upon Area restriction of 6,000 square feet
per lot.
Post construction stormwater runoff is collected and treated by -two distinct, non -discharge,
interconnected pond systems comprised of a total of 13 ponds and providing a total 49 acres of storage
area.

The two detention basin systems provide treatment of stormwater runoff from the developed areas of
Phase I and H. The two pond systems are not connected to each other. Seven ponds are interconnected in
the Phase I system, and six ponds are interconnected in the Phase II system.
The Phase I pond system provides a total surface area of 1,393, 570 f' (32 acres) at the permanent pool
elevation of 44.5 feet mean sea level (finsl). The provided surface area exceeds the required surface area
of 38,144 ft' calculated using a Surface ArealDrainage area (SA/DA) ratio of 0.4 (Table 104, North
Carolina Division of Water Quality Stormwater BMP Manual), a design suspended solids removal
efficiency of 90%, a 12% impervious cover and six foot permanent pool average depth. The permanent
pool elevation of the interconnected ponds is controlled by a designated outlet structure in Pond "C"
comprised on an outlet weir installed with a discharge elevation of 45.82 finsl. As part of the modified
stormwater permit, a 4" circular orifice will be installed on this outlet structure to provide release of the
1.5" storm volume of 188,334 W. Additionally, Ponds "D" and "E" in the Phase I system have outlet
weirs set at elevations 47.12 and 47.72 finsl, respectively, to control upstream levels in the interconnected
ponds. The upstream weirs are set at elevations to provide 1.32 feet of storage depth in the temporary
pool of each pond. The total provided temporary pool surface area is 1,749,329 ft' (40.15 acres) with a
provided storage capacity of 2,074,313 W. This is more than enough capacity to capture the stormwater
runoff volume from the Phase I drainage area based on a rainfall depth of 8.37 inches (25-yr, 24-hr storm
event). The bottom elevations of the ponds in the Phase I system range from 38.4 ft asl to 40.4 ft asl, and
are designed with a sediment storage depth of 1.5 ft. There are no vegetated shelves in the Phase I pond
system, and all pond slopes are a maximum 3:1. Calculations and the Wet Detention Supplement form
are provided in the stormwater permit modification application.

permanent pool elevation of the interconnected ponds in Phase II is controlled by a designated outlet
structure in Pond "Z" comprised on a 12-ft wide broad -crested weir to control the water levels in the
interconnected ponds. The top of the outlet weir is set at an elevation of 47.2 feet above mean sea level
(asl) to provide an emergency spillway. The outlet structure is equipped with five, 12-inch diameter
orifices set with an invert elevation of 45.65 ft asl. The center orifice will be capped/plugged, and a 4"

top elevations 47.2, and 46.9 ft asl, respectively, to control upstream levels in the interconnected ponds,
and Pond "T" is connected to Pond "Z" through a 36" underwater pipe with a top elevation of 44.40 ft asl
