Dear Mr. Murrell:
The Wilmington Regional Office received the Stormwater Management Permit Application for Hanover Towing on April
30, 1997, with final information on July 15, 1997. Staff review of the plans and specifications has determined that the
project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 214.1000. We are
forwarding Permit No. SW8 970428 dated July 28, 1997, for the construction of Hanover Towing.
This permit shall be effective from the date of issuance until July 28, 2007, and shall be subject to the conditions and
limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit.
Failure to establish an adequate system for operation and maintenance of the stormwater management system will result
in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be
in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the
Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this
permit shall be final and binding.

This permit shall be effective from the date of issuance until July 28, 2007 and shall be subject to the following specified
conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater described in the application and
other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as described on page 3 of this
permit, the Project Data Sheet. The stormwater control has been designed to handle the runoff from 109,163 square
feet of impervious area.
3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the
permit.

4. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per approved
plans.
The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -
upon area.
6. The following items will require -a modification to the permit:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of'ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision of the project area.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan.
In addition, the Director may determine that other revisions to the project should require a modification to the
permit.
The Director may notify the permittee when the permitted site does not meet one or more of the minimum
requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time
schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies
of revised plans and certification in writing to the Director that the changes have been made.
H. SCHEDULE OF COMPLIANCE
The permittee will comply with the following schedule for construction and maintenance of the stormwater
management system:
a. The stormwater management system shall be constructed in it's entirety, vegetated and operational for it's
intended use prior to the construction of any built -upon surface except roads.
b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be
repaired immediately.
2. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater
system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its
entirety and maintenance must occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping.
g. Access to the outlet structure must be available at all times.
3. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ.
The records will indicate the date, activity, name of person performing the work and what actions were taken.
4. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this
permit, the approved plans and specifications, and other supporting data.

5. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this
permitted facility, a certification must be received from an appropriate designer for the system installed certifying
that the permitted facility has been installed in accordance with this permit, the approved plans and specifications,
and other supporting documentation. Any deviations from the approved plans and specifications must be noted on
the Certification.
6. A copy of the recorded deed restrictions must be submitted to the DWQ within 30 days of the date of the recording.
The recorded copy must be signed by the permittee, dated, stamped with the deed book number and page, and bear
the stamp of the Register of Deeds.
A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten
years from the date of the completion of construction.
IM GENERAL CONDITIONS
1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a
name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality
accompanied by an application fee, documentation from the parties involved, and other supporting materials as may
be appropriate. The approval of this request will be considered on its merits and may or may not be approved.
2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement
action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-
215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules,
regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which
have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the
Permittee shall take immediate corrective action, including those as may be required by this Division, such as the
construction of additional or replacement stormwater management systems.
5. The permittee grants DEHNR Staff permission to enter the property for the purpose of inspecting all components
of the permitted stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit
modification, revocation and reissuance or termination does not stay any permit condition.

Dear Mr. Shiver:
This letter is being faxed to you so that you can review all the pertinent information before
discussing these matters by phone. 1 realms that your time is just as limited as mine and wish to
complete our application as soon as possible.
I have received your letter dated 19 May.1997 and Ms. Linda Lewis' letter to Mr. Jim Honeycutt,
P.E. about our Stormwater Management Application dated 30 April 1997. After my telephone
conversation with Ms. Lewis I would like to formally protest several requirements and requests
contained within her letter.
First I would like to assure you that we are not in the habit of violating any requirements or
regulations of the great State of North Carolina. However, as we attempt to expand, allowing the
employment of more North Carolinians it is quite evident that the State of North Carolina
Department of Environment, Health, and Natural Resources has other plans for our state.
Ms. Lewis has asked several valid questions about the application submitted for a Stornwater
Management Permit Application. However, after reviewing all her requests, I question whether
the application and plan were reviewed at all.
First, if you are not familiar with the location of our site, it is exactly five (5) miles north of the
western foot of the Isabel Holmes Bridge in Wilmington. The topography of our land is extremely
sandy and elevated with irrigation being the main concern if you wish to have any vegetative cover
to survive. Ms. Lewis has asked for a more detailed vicinity map. On the drawing attached to our
application it clearly shows that our facility is exactly 1306.14 feet south of the New I lanover
County Landfill entrance on Highway 421 North our cast property line is the New Hanover
County Landfill. We have a sign measuring 10 feet high and 10 feet wide (permitted) on the
highway showing our location. Also, according to your letter our site "vas krisited on 16 May 1997
by a member of your office. Undoubtedly he had no problem funding the site.

runoff from our property is channeled to this basin for infiltration back into groundwater.

and best maintained you will find. We have spent literally thousands of dollars trying t im rove

Originally we wished to use this basin as a landscape enhancement until we were informed that it
would not hold water unless it was lined with a synthetic material or clay to stop the water from
being absorbed into the ground. If you cannot build a basin on site that will hold water why do
we need all this additional wasted expense? Is not the purpose of the basin to hold stormwater for

Aker the two hurricanes we experienced last fall our property had no accumulation of water at
all. I would assume that the occurance of two hurricanes within a 45 day period would out weigh
your requirement. for a 2.5 year, 24 hour storm however as a nonprofessional 1 have not attempted
any computations. Before pouring the foundation for our present facility we hauled water onto
the property fit 7,500 gallon tank trailers to compact the sand to make a better foundation. The
ground is so porous that allowing 7,500 gallons of water to run out of a tank through a 3" hose
would not make a nmd puddle.
Ms. Lewis has requested that the concrete walks' widths be noted on the drawing. Since they are
contained inside the area of impermeable surfaces and included in Mr. Honeycutt's calculations
what purposes will be served by revising the drawing.

When I asked Ms. Lewis about the amount of new clearing and construction on the 421 corridor
not having basins, she explained that I should take this up with ew Hanover Couu�. If this is
a State requirement according to your letter, why should I contact New Hanover County to find
out why other companies and individuals do not, have, to comply with your requirements?
I would like to document as best I can the costs associated with compliance for construction of the
basin and Ms. Lewis' additional requests.

Mr. Honeycutt does not have an idea of what s. Lewis reggiremen fora spreadernechanism
will be. Therefore, lie cannot give us an estimate of what it will cost to design one much less
construct. it.
$11,200.00 could purchase equipment for an employee to use deriving wages. The same amount
used to comply with a requirement applied without common sense will derive $ 0.00.
The title of your office suggests that its purpose is to protect the Natural Resources of the Great
State of North Carolina. One of the greatest natural resources we have is the citizens of North
Carolina. Eliminating or stifling the growth of companies providing employment and additional
tax revenue is not protecting the citizens of the state.
Hanover Towing has been proactive in improving the Natural Resources of the State of North
Carolina. We have made many donations to the North Carolina Department of Environment,
Health, and Natural Resources Division of Marine Fisheries. To date we have donated three (3)
tugs and five (5) barges to be used in artificial reef development. The last barge donated was
C donated prepared, delivered and sunken on the reef at the expense of Hanover Towing with no
expense to the State. We could have scrapped all of this equipment and realized revenues from
the sale.
My wife and I are regular participants at the Area Contingency Plan Meetings. Local Emergency
Planning Committee Meetings and have donated hundreds of hours of volunteer service to New
Hanover County. Hanover Towing was the first privately owned corporation to voluntarily
participate in the Preparedness for Response Program enacted by the Oil Pollution Act of 1990.
Cost for our participation was more than $40,000.00. Our actions indicate our concern for the
environment and New Hanover County.

I respectfully request that you review Ms. Lewis' requests with a measure of common sense and
call me at your earliest convenience to discuss this matter.

This correspondence wit serve to Present findings and calculations to be utilized in
designing of the on -site storm water infiltration Pond. Two test Pits were excavated
utilising a baWw. Each pit was excavated dawn to aPProximately nine to ten feet deep.
Peet Pit P-1, IMM" new the southeastern comer of the proposed infiltration pond, was
found to be represented by SOW* foamy send grading Into a fine to medium grained sand.
No evidence of seasonal high water table conditions or colors were identified; however,
soll wetness conditions were identified at epprorimetety ten feet deep. Test Pit P-2,
located near the northieasteM Property oarwr, was also found to be represented by slightly
loamy sand grading into a fire to medium grained sand. No evidence of seasonal high
water table conditions or colors were identified in P-2. Soil wetness Conditions were also
Mentified at apMwimately ten feet deep in P-2.
A soil sample was taken from each test pit at appzoxkrwtely ens feet deep. Each sample
VMS tested in general accordance with the Amencoi Society for Testing end Materials
(ASTM) test procedure 0-422, entitled'Swxuw Test Method for Particle -Sim Analysis
of Soils.° As presented in the attached laboratory report, both samples vw(e found to be
fine to medium sand. Grain size sieve analyses of both samples were famd to
apprailmately corefa6e *0 each other (+1-10%), suggesting consistent conditions under
the proposed pond location.
Hydraulic eonduuCovify was determined by first establishing a mean value for the fine and
medium grained sand sizes. The hydraulic conductivity value was catmdm* utllizkg'
know values for specific grain sizes. The hydraulic conduct" for the area of the
rmrthsestsm property comer was determined to bo approximately 11.88 inches per hour.
