We are forwarding Permit No. SW8 950519 dated November 2, 1995 to Ammons-NorthChase Corporation. This permit shall be effective from the date of issuance until November 2, 2005 and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in fuiure compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an ajudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding. No homeowner/lot owner/developer shall be allowed to fill in, alter, or pipe any vegetative practices (such as swales) shown on the approved plans as part of the stormwater management system without submitting a revision to the permit and receiving approval from the Division. 5. Each of the lots in the subdivision will be limited to the amount of built -upon area indicated in the supporting calculations and per approved plans. 6. The permittee is responsible for verifying that the proposed home plans do not exceed the allowable built -upon area. Once the lot transfer is complete, the home plan may not be revised without approval from the permittee, and responsibility for meeting the built -upon area limit is transferred to the individual homeowner. 7. The following items will require a modification to the permit: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area. e. Further subdivision of the project area. In addition, the Director may determine that other revisions to the project should require a modification to the permit. 8. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. IL SCHEDULE OF COMPLIANCE 1. The permittee will comply with the following schedule for construction and maintenance of the stormwater management system: a. The stormwater management system shall be constructed in it's entirety, vegetated and operational for it's intended use prior to the construction of any built -upon surfaces except roads. b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 2. The facilities must be properly maintained and operated at all times. The approved Operation and Maintenance Plan must be followed in it's entirety and maintenance must occur at the scheduled intervals. E State Stormwater Management Systems Permit No. SW8 950519 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency including, but not limited to:. a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DEM. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. Deed restrictions must be recorded which limit the built -upon area per lot to the amount as shown on the Project Data Sheet, per Part I #2. The recorded statements must follow the form: a. "The allowable built -upon area per lot is 3,000 square feet, inclusive of that portion of the right- of-way between the lot line and the edge of pavement, structures, pavement, walkways of brick, stone, or slate, but not including open wood decking." b. "The covenants pertaining to stormwater regulations may not be changed or deleted without concurrence of the State." C. "Alteration of the drainage as shown on the approved plan may not take place without the concurrence of the State." 6. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Mail the Certification to the Wilmington Regional Office, 127 Cardinal Drive Extension, Wilmington, North Carolina, 28405, attention Water Quality Section. 8. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of five years from the date of the completion of construction. Ci State Stormwater Management Systems Permit No. SWS 950519 III. GENERAL CONDITIONS 1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Environmental Management accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Environmental Management, in accordance with North Carolina General Statute 143-215.6(a) to 143-215.6(c). 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. Permit issued this the 2nd day of November, 1995. The use of these swales allow the use of curbing for roadway areas and is a permitted method for stormwater treatment in compliance with the State of North Carolina Administrative code Section 15 NCAC 2H.1000, Stormwater Runoff Disposal. b. DETENTION POND The detention pond is intended to provide some measure of sediment and nutrient filtration within the vegetation along the pond perimeter as well as promoting infiltration of runoff into the subsurface groundwater. The use of a pond allows a more intensive built -upon area to be developed and is a permitted method for stormwater treatment in compliance with the State of North Carolina Administrative code Section 15 NCAC 2H.1000, Stormwater Runoff Disposal. 3. MAINTENANCE RESPONSIBILITIES Routine maintenance as detailed below is required for both the vegetative swales and detention ponds. To provide for this, a HOMEOWNER'S ASSOCIATION shall be formed which shall be responsible for all required maintenance. In lieu of performing the direct maintenance, the HOMEOWNER'S ASSOCIATION may contract this service to an independent maintenance entity; however, all responsibilities for enforcing these restrictive covenants shall reside with the HOMEOWNER'S ASSOCIATION. STORM WATER MANAGEMENT SYSTEM MAINTENANCE a. VEGETATIVE SWALES As a minimum, the following maintenance procedures shall be followed: (1) Grass shall be mowed at a sufficient interval so that the maximum grass height shall not exceed six (6) inches. (2) Vegetative swales shall be inspected for erosion or blockage after every runoff producing event but not less than monthly. (3) Areas exhibiting erosion or loss of vegetation shall be stabilized and reseeded as necessary to restore proper operation. b. DETENTION POND As a minimum, the following maintenance procedures shall be followed: (1) Upon Completion of Construction: (a) Any sediment deposited in detention pond shall be removed to obtain design depth, slopes and specifications. (b) The wetted perimeter shall be planted with water resilient vegetation appropriate to soil and site characteristics; the remaining pond slopes shall also be vegetated and planted with vegetation appropriate to soil and site characteristics. All slopes shall be maintained to ensure growth of such vegetations. (c) All drainage features shall be inspected and cleaned of sand, silt or foreign materials. These features include, but not limited to, the pond outlet structure trash screen, outlet orifice and site drop inlet and catch basin grates. (d) Any component which is determined to be not performing satisfactory in its intended usage shall be repaired or replaced to original design specifications. (2) After Each Runoff Producing Rain: (a) Any sloughing, erosion or vegetative wash -out of the pond slopes shall be repaired immediately. U. MAINTENANCE RESPONSIBILITIES Routine maintenance as detailed below is required for both the vegetative swales and detention ponds. To provide for this, a HOMEOWNER'S ASSOCIATION shall be formed which shall be responsible for all required maintenance. In lieu of performing the direct maintenance, the HOMEOWNER'S ASSOCIATION may contract this service to an independent maintenance entity; however, all responsibilities for enforcing these restrictive covenants shall reside with the HOMEOWNER'S ASSOCIATION. STORM WATER MANAGEMENT SYSTEM MAINTENANCE a. (2) Vegetative swales shall be inspected for erosion or blockage after every runoff producing event but not less than monthly. SW8 q so SI 9 DESIGN NARRATIVE GENERAL: The project site is located within the confines of the NorthChase Development on North Carolina Highway 132 within New Hanover County. Comprising a total of 32.12 acres and consisting of 83 single-family residential lots, the project area is an extension to prior phases of development (Phases I, II and III). The Owners will be responsible for construction of the roadway and utility systems with the intention to market lot sales. Individual home construction will be handled by the purchasers of the individual lots. The intent of this submittal is to provide design of the grading and drainage of the roadway system. Design of water and sewer utilities is handled under separate drawings and is indicated on the overall plan for reference purposes only. EXISTING SITE: Site topography in the area of construction is relatively flat with slopes less than one (1) percent. Existing drainage patterns are virtually non-existent except for areas which may drain into the man-made swales located through -out the project area. Subsurface soils typically range from organics to clayey -sands with no obvious pattern to soil type. Prior construction in the vicinity has found similar variabilities and is expected to continue within the project area. Drainage for the project site as well as the majority of the NorthChase Development is toward the north into Prince George Creek, a C-Sw classified tributary to the Northeast Cape Fear River. 3. PROPOSED IMPROVEMENTS: Grading and drainage improvements include grading and paving of the roadways and construction of the roadway drainage collection systems, detention ponds and pond outlet piping. To permit possible phasing of the project, the site has been divided into two (2) areas each served by a detention pond. For design, these areas have been designated as Northern and Southern drainage areas. All roads are to be public with assumption by the NCDOT upon completion. STORM DRAINAGE CALCULATIONS: As the site is flat with no predominant drainage pattern, assumptions were made to assist in calculating drainage flows. These assumptions include the following: a. Home construction will result in the house being the highest elevation on the lot. b. Homes are located near the middle of the lot with driveways and sidewalks along the front. c. Approximately two-thirds (2/3) of the built -upon and one-third (1/3) of the turf areas will drain toward the roadway. d. Lots located along the project perimeter shall drain the remaining areas away from the roadway and thus not directed into the detention ponds. Using these assumptions, lots along the perimeter of the project area were handled -differently from the remaining lots. Runoff was determined using the Rational Method with a rainfall intensity of 5.8 inches per hour. As the ponds are capable of handling the 10-year flow, outlets were sized for the increase in flow between the ten and twenty-five year storm events. Length of rip -rap aprons were calculated using the widths of the flared end sections, slopes and flow rates and are included within the Calculations. EROSION CONTROL CONSIDERATIONS: Land disturbance is to be confined within the right-of-way areas, drainage easements and pond areas. As a precaution for minor areas outside these limits, the total acreage for disturbance was increased ten (10) percent. The site is served by two (2) DEM detention ponds which will be used as sediment basins during construction until satisfactory stabilization has occurred. As removal of sediment may be both costly and time consuming from the ponds, additional individual inlet protection measures are indicated until final paving. Individual inlet protection should minimize solids accumulation within the ponds during construction and prevent soil migration across the project site. 0 Page Three Design Narrative Berkleigh Subdivision, Phase 4 Additional measures include the following: a. use of temporary seeding should construction be halted for the specified time limit (see plan) b. use of flared -end sections with rip -rap at the end of all new piping C. use of end -of -day piping protection during construction of storm drainage piping d. use of silt fencing is recommended for areas which exhibit additional erosion problems e. use of construction entrances at each connection to existing developed areas. 6. MAINTENANCE CONSIDERATIONS: During construction, the Contractor shall be required to inspect and repair as needed all erosion control devices after any significant rain event. Any measure found not performing it's intended function, shall be repaired immediately. Upon completion of construction and establishment of permanent ground cover, the Owner shall be responsible for maintenance on the project site. The project area will contain improvements which will require perpetual maintenance and include a storm water management system which relies on the treatment of surface runoff through one of the following methods: a. network of vegetative swales b. detention pond facility OPERATION OF STORM WATER MANAGEMENT SYSTEMS a. VEGETATIVE SWALE The vegetative swales are intended to provide some measure of sediment and nutrient filtration within the vegetation as well as promoting infiltration of runoff into the subsurface groundwater. The use of these swales allow the use of curbing for roadway areas and is a permitted method for stormwater treatment in compliance with the State of North Carolina Administrative code Section 15 NCAC 2H.1000, Stormwater Runoff Disposal. b. DETENTION POND The detention pond is intended to provide some measure of sediment and nutrient filtration within the vegetation along the pond perimeter as well as promoting infiltration of runoff into the subsurface groundwater. The use of a pond allows a more intensive built -upon area to be developed and is a permitted method for stormwater treatment in compliance with the State of North Carolina Administrative code Section 15 NCAC 2H.1000, Stormwater Runoff Disposal. MAINTENANCE RESPONSIBILITIES Routine maintenance as detailed below is required for both the vegetative swales and detention ponds. In lieu of performing the direct maintenance, the HOMEOWNER'S ASSOCIATION may contract this service to an independent maintenance entity; however, all responsibilities for enforcing these restrictive covenants shall reside with the HOMEOWNER'S ASSOCIATION. STORM WATER MANAGEMENT SYSTEM MAINTENANCE a. VEGETATIVE SWALES As a minimum, the following maintenance procedures shall be followed: (1) Grass shall be mowed at a sufficient interval so that the maximum grass height shall not exceed six (6) inches. (2) Vegetative swales shall be inspected for erosion or blockage after every runoff producing event but not less than monthly. (3) Areas exhibiting erosion or loss of vegetation shall be stabilized and reseeded as necessary to restore proper operation. b. DETENTION POND Prior to construction of any impervious surfaces, the wetted perimeter shall be planted with water resilient vegetation appropriate to soil and site characteristics; the remaining pond slopes shall also be vegetated and planted with vegetation appropriate to soil and site characteristics. All slopes shall be maintained to ensure growth of such vegetations. As a minimum, the following maintenance procedures shall be followed: (1) Upon Completion of Construction: (a) Any sediment deposited in detention pond shall be removed to obtain design depth, slopes and specifications. (b) All drainage features shall be inspected and cleaned of sand, silt or foreign materials. These features include, but not limited to, the pond outlet structure trash screen, outlet orifice and site drop inlet and catch basin grates. (c) Any component which is determined to be not performing satisfactory in its intended usage shall be repaired or replaced to original design specifications. (2) After Each Runoff Producing Rain: (a) Any sloughing, erosion or vegetative wash -out of the pond slopes shall be repaired immediately.
