On May 7, 2015, the Wilmington Regional Office received a complete request to revise the approved
plans for Stormwater Management Permit Number SW8 890414. The revision includes revising the
future section to Section 4A and renumbering of lots 1-5 as follows:

The maximum built -upon area (BUA) allocated to the lots is not changing. It has been determined that
a formal permit modification is not required for the proposed changes. We are forwarding you an
approved copy of the revised plans for your files. Please replace the old approved plan sheet with the
new one
Please be aware that all terms and conditions of the permit issued on March 4, 2015, remain in full
force and effect. Please also understand that the approval of this revision to the approved plans for
the subject State Stormwater project is done on a case -by -case basis. Any other changes to this
project must be approved through this Office prior to construction. The issuance of this plan revision
does not preclude the permittee from complying with all other applicable statutes, rules, regulations
or ordinances which may have jurisdiction over the proposed activity, and obtaining a permit or
approval prior to construction.

Kingsbridge II, Section 4A
Dear Mrs. Hall:
Please find attached the Stormwater Management Permit Plan Revision Application
Form for the above referenced project, which is signed by the President of Kingsbridge
II HOA, Inc. (Permittee/Applicant). The purpose of the Plan Revision is to change the
"Future" Section to Section 4A and to change "Future" Lots 1 through 5 to Lots 36A,
37A, 38A, 39A and 40A. This information is reflected on the attached Plan Sheet C-1,
last Revised February 14, 2015. We have also attached a table that shows the Lot
Numbers and their allocated BUA. Please note that the BUA allocation amounts have
not changed. Only the lot and section number has changed. We are submitting this
application under the Regular Stormwater Program.

Please give me a call to discuss at your convenience. Lots 36A (formerly 5), 37A (formerly 4) and 38A (formerly 3) are
actually bigger because there used to be a strip of coastal wetlands between the lots and the creek that was owned by
Robert Youngblood. He had owned a buffer between individual Owners and their riparian rights to the creek (imagine
that). When he went into bankruptcy, my understanding is the courts ordered that piece of property to be deeded back
to the individual property Owners who should have had creek frontage. This happened over time. The piece of property
that was added is not shown on the map you are looking at.
The impervious areas for the lots is already established in the permit for lots 36A-40A. The property that was added
cannot cannot be used to increase the impervious area because it is mainly coastal wetlands and creek. Therefore the
project area should stay the same. We are not trying to increase the impervious areas.
Attached is a map that shows this added piece of property to lots 36A-38A. I made this map for the Erosion Control
permit, which we already have. If I add it to the sheet you are looking at then it would run off the page and I would need
two pages. If you need a sealed copy of the attached, let me know
This is literally a case were the lots grew. It is unique I am sure. I handled it the best way I knew how.

Kyle and Bill;
In lieu of having Bill, the applicant, at the meeting today, we agreed that a summary of the meeting would be provided
in order to keep Bill in the loop. Please note for future Stormwater submittals through the express program, applicants
are required to attend the submittal meetings unless prior approval is given or arrangements are made to summarize
the meeting in a conference call with the application at the conclusion of the meeting.
Kingsbridge SW8 890414 — Plan Revision
My notes had indicated this would be submitted to the Express program. Kyle had it prepared to add to the current
application in house. This revision cannot be combined with the application in house due to the fact that the current
application in house has already been reviewed once and the requested additional information has been submitted. A
separate plan revision will need to be submitted.
In order to submit a plan revision to following items will be needed:
• A plan revision form with the original signature of the current permittee (the HOA)
• A cover letter describing the revisions
• Two copies of the plans
The plan revision may be mailed in to the regular program for free or an express submittal may be scheduled ($500 fee).
Kingsbridge — the 2 new phases
The following items were noted during the Express submittal meeting and need to be addressed prior to acceptance into
the Express program:
• Remove the overlap in project areas between the two Kingsbridge permits. The road improvements on the lot
ROB within the SW8 890414 permit was also included in this project area.
• The NHW/MHW line needs to be confirmed by DCM
• The 50' buffer from the NHW/MHW needs to be delineated for those lots within this section of the subdivision.
• The coastal wetlands need to be confirmed by DCM
• Add items or conditions to the O&M agreement specific to the operation and maintenance of the proposed
energy dissipater device.
Once the representative with DCM is contacted and a better timeline is provided for the confirmation of the NMH/MHW
and the coastal wetlands, Kyle will need to contact us to schedule a new submittal date to mail in or drop off the project.
Highlands Phase II —the new phase
The following items were noted during the Express submittal meeting and need to be addressed prior to acceptance into
the Express program:
Remove the overlap In project areas between the two Highland permits. The road to be added on the lot 106
within the original Highland permit was also included in this project area.
• Add items or conditions to the O&M agreement specific to the operation and maintenance of the proposed
energy dissipater device.
It was agreed that the revised Express submittal would be delivered to this office by noon on Weds, March 4cn

Please find attached Plan Sheet C-I. revised December 4, 2014. We added the
approx€mate locations of existing outlet syvales. This site was originai}y pear tted in
1989. Most of the drainage facilities have been in place for many years. During the
course of the last 25 years, North Carolina agent es Including NCDEKIR - Watew Cuariity
and NCDENR-j��Land Quality have had jurisdiction over the s€te. used on ,permit flies
on record at NYF CDENR. in RO, both agencies have ?nave multiple site vista and
Inspections since the original permit was issued. Several of these sate visits occurred
after roads were bull; -taut and the subject outlet swales were in place. To our
Knowledge there are not any current NCiENR violations at the site ror have any ever
been issued (or enforced). Therefore, we can on`y ascertain that the existing outlet
swales are performing adequately and meet the conditions under wh eh the permit was
originally issued. Furthermore, representatives of the Kingsbridge II Homeowners
Association have informed us that there are not any current homeowner complaints on
Me nor are there any other problems corcerning s ca►mwater runoff. AIJ swales are
operational and we do not know of any drainage, runoff conveyance or water quality
issues within the limits of this project.

The Wilmington Regional Office received and accepted a modified State Stormwater Management Permit
Application for Kingsbridge Properties on August 8, 2014. A preliminary in-depth review of that information
has determined that the application is not complete. The following information is needed to continue the
stormwater review:
1. Please clarify whether or not the recreation lot next to lot 1 within Section 2 and as shown on the
originally approved plans is included as part of the project area.
2. Please clarify what the purpose is for 20,000 square feet of other impervious area listed in Section

3. The originally approved development proposed six swales; however the low density supplement
indicates that there are no swales associated with this project. Please clarify whether or not swales
are a part of this project and if so, include the design information in Section III of the low density
supplement.

Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to
DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please
note that any updated pages or addendums to this permit will now reference DEMLR as the Division
responsible for issuance of the permit
On May 22, 2014, the Wilmington Regional Office received a request to transfer the ownership of the state
stormwater management permit for the subject project. Staff. of DEMLR have previously inspected the
project, determined that the documentation is in order, however, found that the project is not in compliance
with the terms and conditions of the state stormwater permit. Correspondence indicates that the HOA will
accept responsibility for resolving the few outstanding compliance issues. As indicated on the
Name/Ownership Change form, you have acknowledged that you have not received any of the application
permit documents. By signing the Name/Ownership Transfer form, you have accepted the responsibility for
complying with the terms and conditions outlined in this permit. The Division is hereby notifying you that the
subject permit has been transferred on August 8, 2014 and a copy of the original Certificate of Compliance
is attached for your records along with a copy of the Name/Ownership Change form submitted on May 22,
2014.
As discussed, the modification, which was also submitted at the same time, will now be processed and
logged in for review.
Please be aware that the project's built -upon area and stormwater controls must be built and maintained
in compliance with the permit documents and the approved plans. Maintenance of the approved system
shall be performed in accordance with the signed Operation and Maintenance agreement. Any
modifications to this project must be submitted to DEMLR and approved prior to construction. The
issuance of this approval does not preclude you from complying with all other applicable statutes, rules,
regulations or ordinances, which may have jurisdiction over the proposed activity, and obtaining a permit
or approval prior to construction.

A request to transfer a permit will not be approved by the Division of Water Quality (DWQ) unless all
of the applicable required items listed below are included with the submittal. Failure to provide the
listed items may result in processing delays or denial of the transfer.
1. This completed and signed form. This certification must be completed and signed by both the
current permit holder and the new applicant if this is a change of ownership.
2. Legal documentation of the property transfer to a new owner.
3. A copy of anv recorded deed restrictions, covenants; or easements, if .required by the permit.
4. The designer's certification (DWQ Engineer and Designer Certification Forms are available from
each DWQ Regional office), if required by the permit and if not already submitted to DWQ.
5. If the proposed permittee is a firm, partnership, association, institution, corporation, limited liability
company, or other corporate entity, provide documentation showing the authority of the named
representative to act on behalf of the proposed permittee.
6. The $40.00 processing fee. If this is an initial transfer from the original permittee the processing
fee is not required. Subsequent ownership transfers will require the $40.00 processing fee.

We are hereby submitting a Stormwater Management Permit Modification Application
for the above referenced project. The main purpose of this modification is for the
reallocation of BUA. A reallocation is needed to bring individual lots into compliance.
By our estimation, there are 60 to 70 different lot and/or property owners within the
boundary of this project. Since all individual lot BUA's are increasing and there are
many different owners, deeds have not been included (there are 88 or so separate
deeds). Please note that the modification includes a change in the Applicant from

Kingsbridge II is a residential subdivision that is partially developed. It consists of a total of five
(5) sections or phases which include Sections 1 through 4 and Future Section. There are a total
of 92 lots within this subdivision. Of these lots, 87 of them are in Sections 1 through 4. The
remaining five (5) lots are in Future Section. It is important to note that Lots 5 and 6 in Section II
have been recombined and are counted as one lot. Also, there is a lot within Section III that is
labeled as RBO instead of having a lot number. We have included it in our lot count because
there is a house on it. It appears it was once reserved for use as a street right-of-way. We
estimate that are currently about 65 individual owners for the 92 lots. This considers individuals
and/or entities that own multiple lots as a single owner. Of course, this can easily change at any
time.
This project is located along East Ivybridge Drive, Chestwood Drive and Chestwood Court
which are approximately 1.5 miles north of the intersection of Queens Haven Road (SR 1576)
and Queens Creek Road (SR 1509).
The purpose of this Stormwater Management Permit Modification is to reallocate BUA for the
development as well as assign Project Ownership to a new Applicant. We have also
researched Onslow County Land Records in an effort to accurately represent the development
as it is constructed. The current layout, sizes, dimensions of lots, streets and other facilities is
substantially different than what the original permit drawings show. Even the lot count is quite
different. We have made every effort to update this information and present it in such a way
that it actually represents what is on the ground or will be in the future. A Stormwater BUA
reallocation is required because the original permit allowed only 2,500 SF of BUA per lot. Due
to the lot sizes and high demand of this area 2,500 SF of BUA is an unreasonable allowance for

the type of market -driven residential construction expected here. For one reason or another
(there are many reasons that are beyond the scope of this narrative), the Developer and/or
Individual Owners have constructed BUA 'in excess of that allowed by the original permit.
Currently, there are over 30 lots where the BUA of 2,500 SF is exceeded. This Stormwater
Management Permit odification will rectify this issue and bring all lots into compliance with the
Law.
Mr. Robert F. Youngblood/Robert F. Youngblood Construction Company, Inc. is the original
developer who obtained Permit No. SW8 890414. To the best of our knowledge, this permit
was issued June 19, 1989 as a Low Density Option. Since that time, Mr. Youngblood and/or
others have constructed all of the streets except a small section that will be constructed on a lot
labeled as RBO (not the same Lot RBO described above) to access adjacent property and a
cul-de-sac in Future Section. Also. we estimate that about 40 houses have been built or are
currently under construction. Most of the remaining lots have been cleared and are prepped for
construction. Although Mr. Youngblood was the original developer, we understand that he
and/or his company filed for bankruptcy within the past few years. Therefore, it is in the interest
of individual owners to take the initiative to bring the subdivision into compliance. Kingsbridge II
Homeowners Association, Inc. wishes to become the Stormwater Management Permit
Applicant/Project Owner.
According to the laws that were in affect when the original permit was issued, this development
was allowed a BUA of 25%; therefore vested rights are being claimed. The reasoning used for
determining an original BUA of 2,500 SF per lot is beyond us. Regardless, it is the right of the
individual owners to claim the lawful amount of BUA. The Total Project Area listed in the
original permit is 60.84 acres. Many of the lot and right-of-way boundaries have changed over
the past several years. For instance, we understand that some of the lots along Queens Creek
were recombined to actually add property to individual lots and the overall project. After
studying deeds and plats for these lots, it appears that most if not all of the land that was added
to the project is below the normal high tide line. Coastal wetlands are not included in BUA
calculation so it is reasonable that the Total Project Area for calculation allowable BUA remains
in agreement with the original permit at 60.84 acres. This is in fact the value we used in our
calculations. Of the total project area, approximately 53.4 acres are substantially developed
meaning that streets are in and lots are cleared. There are houses on just under half of the 87
lots in Sections 1 through 4. The Future Section, which has not been developed, includes
approximately 7.4 acres.
As previously mentioned, the main purpose of the modification is to reallocate BUA for the Low
Density Subdivision. Design of Stormwater Management Controls is beyond the scope of this
modification. Stillwater Engineering did not locate, identify, quantify or otherwise
evaluate/investigate the existing Stormwater Management Controls. 4011404 Wetland lines
shown on our drawings were taken from other maps and have not been delineated. This is
beyond the scope of our work because lots are individually owned and are not Developer -
owned. The project drains to Queens Creek (SA/HQW), which is part of the White Oak River
Basin.

The Wilmington Regional Office of the Division of Water Quality (DWQ) recently became aware
that the permitted impervious area limits for Kingsbridge Properties may have been exceeded.
On February 14, 2013, the Division conducted a file review of Kingsbridge Properties in Onslow
County to determine compliance with Stormwater Management Permit Number SW8 890414
issued on June, 19, 1989. DWQ's file review revealed that the site may not be in compliance
with the terms and conditions of this permit. Please find a copy of the completed form entitled
"Compliance Inspection Report" attached to this letter, which summarizes the findings of the
recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. The Onslow County tax website was consulted to determine if the impervious areas
constructed on the lots and recreational areas were within the amounts allocated under
the Kingsbridge Properties permit, SW8 890414. It was found that:
a. The recreational area, which was not allocated any impervious area in the permit,
had impervious surfaces constructed on it.
b. Several of the lots appeared to have exceeded the impervious area allotment of
2,500 sq ft.
Please provide documentation demonstrating that every developed lot within the permitted area
of the subdivision has not exceeded the impervious area allotment of 2,500 square feet. This
can be accomplished by utilizing tax records and as built surveys of each lot. If it is found that
lots have exceeded the allotted impervious area, then the permit must be modified. Possible
options for modifying the permit and obtaining compliance could be:
1. Re -consider the density levels approved under the permit. This project was approved
with a percent of impervious coverage of 13.64%, which is less than the 25% that was
allowed under the rules in effect at that time.
2. Redistribute the impervious area allocated to each lot.
3. Request that DWQ to incorporate the pervious pavement language into the permit to
provide the homeowners the option of receiving the pervious pavement credit. This is
assuming that the requirements of the pervious pavement can be met.
4. Convert this site to a high density project
Please inform this Office in writing before March 15, 2013, of the specific actions that will be
undertaken and the time frame that will be required to correct the deficiencies. Failure to provide
the requested information, or to respond to this letter by the due date, may initiate enforcement
action including the assessment of civil penalties of up to $25,000 per day. If a written plan of
action is not submitted to this office by March 15, 2013 then DWQ staff will re -inspect the site
and issue a Notice of Violation if the listed deficiencies have not been addressed.
