CAMA has visited the referenced site and I now have the Coastal Wetlands HWL
information. As I anticipated, there are Coastal Wetlands at the site, but there is less than i
thought and they are well beyond the proposed developed area. Therefore, the buffer to
the HWL will be much greater than 50 feet. This is good news because it will not take me
long to revised the submittal package.
I can have the submittal package ready any time after Wednesday of next week (after
3/25/15). Can you please look at your schedule and provide us with a new submittal
date. Based on the scoping meeting discussion, I believe you guys said that I could make
the revisions and drop the package off at the front desk. In other words, I do not believe we
need an actual submittal meeting, just a date. Let me know what I need to do.

Please find attached the Stormwater Permit Application along with the required
documents. As requested we are providing the additional information that was
requested for the referenced project based on our February 26, 2015 Submittal
Meeting. This includes removing overlap between Kingsbridge II Stormwater permits
at Lot RBO, confirming the NHW/MHW line, confirming Coastal Wetlands, providing a
50' buffer to NHW/MHW and adding conditions to the O&M Agreement that better
address the energy dissipater device. The Coastal Wetlands and NHW/MHW line(s)
were delineated by CAMA and provided to us by Pittman Soil Consulting. The CAMA
Determination is attached. Also, we have provided additional swale calculations and
added contours to the drawings. Finally, we have attached an Amended LLC Annual
Report that shows Neighborhood Homes & Realty, Inc. is a Member. Therefore, Mr. Bill
Treweek's signature on the applications are legitimate. Attached are the following

A soil study was conducted on the above referenced projects to determine the SHWT and
of the outlet swales.
Hand auger borings were performed in the proposed areas and revealed a SHWT between.
18 and 24 inches below the surface.

Kingsbridge II, Sections 5 & 6 is a proposed low density residential subdivision. An adjacent
subdivision, Kingsbridge II, Sections 1 through 4 and 4A is existing and is already permitted
separately. The two new sections consist of a total of 66 residential lots. Section 5 will have 42 lots
while Section 6 will have 24 lots. Section 4A, which consists of Lots 36A, 37A, 38A, 39A and 40A,
will be developed along with Sections 5 & 6; however, it is permitted separately under SW8 890414.
There will also be several off -site septic areas located within each section. Both of the new sections
will be subdivided out of a larger parcel(s), but they will not be contiguous. Another development,
The Highlands at Queens Creek, Section II (SW8 150301), will also be subdivided from the larger
parcel(s) and will be Iodated between Sections 5 & 6.
This project is located adjacent to East Ivybridge Drive, Chestwood Drive and Chestwood Court
which are approximately 1.5 miles north/northwest of the intersection of Queens Haven Road (SR
1576) and Queens Creek Road (SR 1509). The total property area within Sections 5&6 is
approximately 49.71 acres. However, the project area is 48.32 because some coastal wetlands
were deducted. The NHW/MHW Line and Coastal Wetlands were delineated by CAMA (see
attached). Since the project lies in close proximity to Queens Creek, the built -upon area will be
limited to 12%. The developable portion of lots is fairly small in the proposed subdivisions, thus
higher individual BUA allocations are not expected. However, there are a few lots that are closer to
Queens Creek. More BUA is allocated to these lots. A table shown the non -uniform lot BUA is
included in the application package.
As previously mentioned, this will be a low density project that utilizes grass swales to accommodate
stormwater runoff. Roadside swales will collect runoff from streets, drives and other impervious
areas. Runoff will flow to lot line swales, where it will be effectively infiltrated. A 50 foot vegetative
buffer is provided between the non -direct discharge areas and surface waters. There is a
substantial amount of wetlands at this site. No runoff will be directed to coastal wetlands and there
will be at least 50 foot buffer between any development and surface waters. The project drains to
Queens Creek (SA/HQW), which is part of the White Oak River Basin. It is anticipated that a total of
approximately 30 acres will be disturbed during construction. This includes land disturbance for all
streets, houses, yards, drive, septic areas and utilities. Erosion and sedimentation control measures
will consist of skimmer basins, silt fence and vegetative filters.
Water service will be provided for each lot by ONWASA. Wasteiwater disposal will be treated in
either an on -site septic system, off -site larger septic system or at a nearby private treatment plant.
The proposed subdivision will have all three of these options available.

In lieu of having Bill, the applicant, at the meeting today, we agreed that a summary of the meeting would be
provided in order to keep Bill in the loop. Please note for future Stormwater submittals through the express
program, applicants are required to attend the submittal meetings unless prior approval is given or arrangements
are made to summarize the meeting in a conference call with the application at the conclusion of the meeting.
Kin sbridge SW8 890414 — Plan Revision
My notes had indicated this would be submitted to the Express program. Kyle had it prepared to add to the
current application in house. This revision cannot be combined with the application in house due to the fact that
the current application in house has already been reviewed once and the requested additional information has
been submitted. A separate plan revision will need to be submitted.
In order to submit a plan revision to following items will be needed:
• A plan revision form with the original signature of the current permittee (the HOA)
• A cover letter describing the revisions
Two copies of the plans
The plan revision may be mailed in to the regular program for free or an express submittal may be scheduled
($500 fee).

The following items were noted during the Express submittal meeting and need to be addressed prior to
acceptance into the Express program:

« Remove the overlap in project areas between the two Kingsbridge permits. The road improvements on the
lot ROB within the SW8 890414 permit was also included in this project area.
• The NHW/MHW line needs to be confirmed by DCM
• The 50' buffer from the NHW/MHW needs to be delineated for those lots within this section of the
subdivision.
The coastal wetlands need to be confirmed by DCM
• Add items or conditions to the O&M agreement specific to the operation and maintenance of the proposed
energy dissipater device.
Once the representative with DCM is contacted and a better timeline is provided for the confirmation of the
NMH/MHW and the coastal wetlands, Kyle will need to contact us to schedule a new submittal date to mail in
or drop off the project.
Highlands Phase II — the new phase
The following items were noted during the Express submittal meeting and need to be addressed prior to
acceptance into the Express program:
• Remove the overlap in project areas between the two Highland permits. The road to be added on the lot
106 within the original Highland permit was also included in this project area.
• Add items or conditions to the O&M agreement specific to the operation and maintenance of the proposed
energy dissipater device.

Account of Richard D. Sparkman, who shall serve as the Disbursing Agent, to be
disbursed as provided in this Plan."
f. Disbursements shall be made to result in creditors receiving payment by
November 30, 2012 or as soon as practicable themafter, but no later than December 27,
2012.
g. in the event sales proceeds are insufficient to pay costs of administration,
the Debtor reserves whatever rights it may have to seek court authority to
surcharge lien claimants with costs of administration, including reasonable,
necessary costs and expenses of preserving, or disposing of such property to the
extent of any benefit to the holder of such claim pursuant to §506(c) of the
Bankruptcy Code. BB&T has objected to this treatment. The Court does not
presently determine whether the Debtor has such rights and all rights of the
Debtor and BB&T in this regard are preserved for later determination.
5. In conjunction with his appointment as Liquidating Agent per First Amended and Restated
Plan of Reorganization, the Debtor in Possession has filed an application with the court to approve
the employment of Mike Gurkins of Country Boys Auction & Realty Company, Inc. as auctioneer,
whose compensation, inclusive of all expense including labor and advertising, absent extraordinary
circumstances, shall be fixed at a rate not to exceed the following.

6. The Notice of proposed Public Auction of Real and Personal Property Free and Clear of Ali

objections other than BB&T's limited objection being filed,
NOW THEREFORE. IT IS ORDERED that, subject to the terns of the Debtor's confirmed
Chapter I 1 Bankruptcy Plan, and subject to the terms of this Order, the Debtor be and is hereby
authorized to sell the above described real and personal property at public auction free and clear of
all liens, including but not limited to the above liens, with the rights of lien creditors being
transferred to the proceeds of sale in their respective priority as determined and marshaled by the
Court pursuant to U.S.C. §§363(f), and to pay Country Boys Auction & Realty Company, Inc.
commissions as set forth hereinabove.
