We have been asked by Sampson Bladen Oil Company to correct the deficiencies indentified in your Inspection Report
dated June 2, 2009 for the Bolivia Exxon Station, Stormwater Project No. SW8 990406. We have cut and removed the
cattails and brush. However, we need the plans to determine the design dimensions and vegetative requirements. The
property owners have searched and do not have the plans.
Can you please suggest how I can obtain a copy of the plan or permit so we can determine how to proceed with the
additional work needed? All I have is a copy of your letter and Inspection Report.
I sincerely appreciate your assistance with this matter. The property owner is anxious to get the deficiencies corrected.

Dear Mr. Clark,
I apologize for the delay in conversing with you in regards to the Bolivia Exxon Station stormwater system. Upon review
of my notes from the stormwater compliance inspection conducted on June 2, 2009,1 have the following to note.
The date mentioned in the inspection report cover letter was July 7, 2009. Please submit a plan of action to meet the
deficiencies to DWQ by July 27, 2009.
To bring the permit into compliance, the maintenance of the 2 dry detention basins should include removal of the
cattails; verification of the depths to the design depths; and re-seeding/re-vegetation is needed. In addition to the field
maintenance issues, prior to the official transfer, a permit renewal package must be submitted to DWQ. That includes a
renewal application, and processing fee of $505.00. The weblink for the renewal application is:

If you are willing to handle both of these, the transfer of ownership would be accepted by DWQ. Additionally, please
sign and notarize the maintenance agreement as the new stormwater permit owner to send in with the other materials.
A copy of that agreement was included in the initial compliance inspection mailing to the original Permittee, but I can
send out a copy to you if needed.

Please find attached a copy of the completed form entitled "Stormwater Compliance Inspection
Report". The report summarizes the findings of a recent inspection of the project's stormwater
controls conducted on June 2, 2009 to determine compliance with Stormwater Permit Number
SW8 990406 issued on June 24, 1999.
As indicated in the attached inspection report the following deficiencies must be resolved:
1. Update maintenance of both basins to meet its design dimensions and
vegetative requirements (Copy of Maintenance Requirements
enclosed).
2. Submit state stormwater renewal permit package to DWQ.
Please inform this Office in writing before July 7, 2009, of the specific actions that will be
undertaken and the time frame that will be required to correct the deficiencies. Failure to provide
the requested information, when required, may initiate enforcement action including the
assessment of civil penalties of up to $10,000 per day. If a written plan of action is not
submitted to this office by July 7, 2009 then DWQ staff will re -inspect the site and issue a Notice
of Violation if the listed deficiencies have not been addressed.
Please be reminded that if any ownership or name change has occurred it is the permittee's

b) Please repair the inlet to basin 42. Line with rip rap or construct a concrete flume to prevent future

Comment: Construction of the stormwater measures were certified by professional
engineer in 2000, however inlet and outlet structures were difficult to view due to
excessive vegetation. The type of vegetation and presence of water in the basins
observed may indicate function as an extended dry detention basin is not occuring.

Comment: Vegetation within basin 1 and 2 was overgrown. According to the
Maintenance Requirements, the basins should be mowed twice annually with maximum
height of 6 inches. The presence of water in the basins may indicate that the orifice is
clogged. The grassed swale at the corner closest to the intersection has eroded with no
evidence of reseeding.
