The deficiency noted in the inspection report was the need to remove accumulated sediment from the forebay, as recommended on the Designer's Certification provided as part of the permit renewal application. In our permit renewal application, submitted on August 19, 2008, we noted in the cover letter (last paragraph on page 1) that the reconmiended maintenance was complete and we included the scope of work from the contractor performing the task. This scope included removal of sediment from the forebay and reseeding the slopes with permanent vegetation. Attached is a photograph of the forebay taken on August 19, 2008, immediately following completion of the maintenance activity. We were not present for the agency inspection performed in September 2008 (either on September 11, 2008 or September 25, 2008, as both dates are referenced in the inspection report). As the facility is gated and controlled -access, it is likely that the inspector was unable to adequately observe the stormwater control system from outside the gate. Based on the additional documentation of completion of this maintenance activity provided by this letter, we respectfully request that the non-compliance notification be rescinded in writing. We are strongly committed to being good stewards of the environment and non-compliance events are taken very seriously by Progress Energy staff and management. Progress Energy also offers the following comments on the permit itself, which we believe will require reissuance. First, on page 2 of 7, the permit expiration date is listed as September 25, 2008. We believe the correct expiration date is September 25, 2018. Second, there are two instances where the runoff from impervious area is listed as 159,459 ft2 instead of the correct area of 159,232 RZ. These are on pages 2 and 3 of the permit. Additionally, we are planning to schedule a meeting with Mr. Cox of your office to obtain clarification on the required inspection frequency.
