The revisions include creating the attached impervious area summary table. It has been determined that a formal permit modification is not required for the proposed changes. The original plans have not been changed. The plans originally approved on June 26,1997 remain in effect. During the Plan Revision review, we noticed that the renewal permit dated May 21, 2009 contained an error. It did not require deed restrictions to be recorded as the original June 26,1997 permit required. Deed restrictions were recorded on June 19,1997 (beginning on BK1388 PG187) and were amended on March 26, 2001 (beginning on BK1692 PG0599). The recorded statements have been added back to the permit text. Please be aware that all terms and conditions of this corrected permit are in full force and effect. Please also understand that the approval of this Plan Revision to the approved plans for the subject State Stormwater Permit is done on a case -by -case basis. Any other changes to this project must be approved through this Office prior to construction. The issuance of this Plan Revision does not preclude the permittee from complying with all other applicable statutes, rules, regulations or ordinances which may have jurisdiction over the proposed activity, and obtaining a permit or approval prior to construction. Northwest Business Park Western Blvd (SR 1470), Jacksonville, Onslow County FOR THE operation and maintenance of two wet detention ponds in compliance with the provisions of 15A NCAC 2H .1000 effective September 1, 1995 (hereafter referred to as the "stormwater rules') and the approved stormwater management plans and specifications and other supporting data as attached and on file with and approved by the Division of Water Quality and considered a part of this permit. This permit shall be effective from the date of issuance until June 26, 2017, and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.7 on page 3 of this permit. Pond A has been designed to handle the runoff from 212,278 square feet (Lots 9,10,11, and 12 @85%) of impervious area, and Pond B has been designed to handle the runoff from 601,019 square feet (Lots 1-8, 13, and 14 @85%) of impervious area. 3. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per approved plans. 4. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. The runoff from all built -upon area within the permitted drainage area(s) of this project must be directed into the permitted stormwater control system. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all time provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and re -vegetation of slopes. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device, flow spreader, catch basins and piping. g. Access to the outlet structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. The facilities shall be constructed as shown on the approved plans. This permit shall become void unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 7. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 8. Access to the stormwater facilities for inspection and maintenance shall be maintained via appropriate recorded easements at all times. 9. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further development, subdivision, acquisition, lease or sale of any, all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 10. Prior to the construction of any permitted future areas shown on the approved plans, the permittee shall submit final site layout and grading plans to the Division for approval. 11. A copy of the approved plans and specifications shall be maintained on file by the Permittee at all times 12. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 13. Deed Restrictions must be recorded prior to the sale of any outparcel or future area shown on the approved plans to ensure that future owners are made aware of the built -upon area limitations. The following statements must be recorded: "No more than eighty-five percent (85%) of the total surface area of any lot shall be covered by structures and/or paved surfaces, including walkways or patios of brick, stone, slate or similar materials." (Recorded Book 1377, Page 194) "Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings. Built -upon area in excess of the permitted amount requires a state stormwater management permit modification prior to construction. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity and performance of the system as permitted." (Recorded Book 1692, Page 0600) Page 4 of 5 State Stormwater Management Systems Permit No. SW8 970517 Correction III. GENERAL CONDITIONS 1. This permit is not transferable to any person or entity except after notice to and approval by the Director. In the event of a change of ownership, or a name change, the permittee must submit a completed Name/Ownership Change Form signed by both parties, to the Division of Water Quality, accompanied by the supporting documentation as listed on page 2 of the form. The approval of this request will be considered on its merits and may or may not be approved. 2. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. Neither the sale of the project nor the transfer of common area to a third party constitutes an approved transfer of the stormwater permit. 3. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 4. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 6. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 7. The permit remains in force and effect until modified, revoked, terminated or renewed. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and re -issuance or termination does not stay any permit condition. 8. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 9. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 10. The permittee shall notify the Division of any name, ownership or mailing address changes at least 30 days prior to making such changes. 11. The permittee shall submit a permit renewal request at least 180 days prior to the expiration date of this permit. You can mail me the $505 check or put it up front for me to pick up. I suggest you make sure that you don't need it first, though. There is already a master plan for the development in your file. It is dated June 1997 by John L. Pierce. It shows all the lots in the business park development, with drainage flow areas. The permit states which lots flow to which ponds. I am thinking this is all the info you need — let me know otherwise. 2. The ones that I submitted were the deed restrictions I downloaded from the Onslow County Register of Deeds so they are recorded. So are they OK as is? Please say yes (fingers crossed).... 3. 1 copied the engineer certification for Ponds A and B from your file (SW8970517). It is dated April 28, 2009 and was by David K. Newsome. It is one of your older certification forms — maybe that is why it is not readily apparent in your file. Let me know if you still can't find it. In general, your file on this master permit is in a lot better shape than Dutchman Village. Plus SECU is not subdividing their lot - Ha Ha! I have asked admin to pull it from the storage building, so I don't have the hard copy in front of me. I just have the electronic files. But, I do have some general questions before I get into it. 1.) Changes to Master Permit SW8 970517: It does not look like you are changing the BMP designs or reallocating impervious area among the lots. If you are not doing either of these, are you doing anything else that would change the permit text such as increasing the overall project area (that would be unlikely)? Unless you are changing the permit text, you do not need to mod this permit. This would be a Plan Revision rather than a mod ($0 rather than $505). When we issue an offsite to the master permit, you will get a table that summarizes the permits that offsite to the master permit and the allocation of BUA associated with each permit. And, the master permit will need to have a map showing the lot numbers, drainage areas, etc (just like we did for Dutchman Village) if it does not already have one. If you are changing the text and therefore DO need a mod, let me know because we will need the application package filled out to reflect the info for the entire master permit, not just the SECU that is getting an offsite to it. 2.) Deed Restrictions for SW8 970517: 1 see that you submitted the recorded restrictions, but I do not see the following statements recorded. Are these statements recorded? It looks like there was a typo when this permit was renewed because they were not carried over to the renewal permit. But, we can fix that. Here are the deed restriction statements from the original permit: a. "To ensure continued compliance with the INC Division of Water Quality Stormwater Management Permit Regulations, 15A NCAC 211.1000, each lot is limited to 85%of its lot area as built -upon area, inclusive of that portion of the right of way between the front lot line and the edge of the pavement, structures, pavement, walkways of brick, stone, slate, but not including wood decking or the water surface of swimming pools." b. "All built -upon area from the outparcel must be directed into the permitted stormwater control system." c. "Additional built -upon area will require a permit modification." d. EXISTING SITE Some of the other lots in the business park have been developed, while others remain undeveloped. The subject Lot 1 is bordered to the south by an undeveloped lot and a hotel beyond, to the east by a drainage ditch and undeveloped adjacent property (not part of the business park), to the west by developed lots in the business park, and to the north by Western Boulevard and a new residential development beyond. Subject Lot 1 drains to the existing Pond "B" in the business park. The Business Park has an existing NCDENR Master Stormwater permit. Pond B is the permitted pond in the development to accept drainage from the subject Lot 1. Storm drainage exists at the site boundaries to accept runoff from Lot 1. The subject Lot 1 is all on high ground and there are no wetlands on this Lot. PROPOSEDIMPROVEMENTS Impervious improvements on Lot 1 draining to Pond B will consist of the branch building, parking, sidewalks, and driveways. Portions of the landscaped areas will also drain to the storm drain system. Care has been taken to grade the driveways to capture as much on site runoff as possible from the property line inward. However, a very small portion of the driveways drain into North Plain Road. However, from NCDENR's perspective, this should not be of concern since runoff from North Plain Road is also directed to Pond B. A right turn lane addition has been required by the NCDOT and City of Jacksonville. Runoff will be directed to the roadside grass swale as it flows currently. The Engineer of this project looked at the possibility of treating the runoff from the right turn lane addition. Investigation was made to direct this stormwater also to one of the ponds in the commercial development. However, these ponds were only designed and permitted for the runoff inside the development and do not have the capacity to accept the additional runoff from this large multi -lane thoroughfare. Also, the stormwater piping and grass swale network in the business park is a very shallow design. Some pipes are within a couple inches of the pavement surface. The stormwater capacity of this system is at its maximum in its current state and does not have the capacity to accept the additional runoff from the road. i] v Based on the above, directing the runoff to one of the onsite ponds would require the storm drain system and ponds to be totally redesigned, repermitted, and rebuilt in this existing development. This is not possible as this development is already partially developed. As stated previously, the runoff from the right turn lane addition will flow to the roadside grass swale, which is large. Also, there is a long travel distance for the water in the swale before it enters a water body. In summary, it is the professional opinion of the engineer that this swale provides adequate treatment to the runoff from the right turn lane addition. The following site work permits are also required for this project: City Planning, City Utilities, City Erosion Control, and NCDOT Encroachment. Penalties Associated with Failure to Maintain Structural BMPs. Operation and Maintenance of the Structural BMPs must comply with all relevant provisions of the Ordinance, as may be amended from time to time, and the Operation and Maintenance Agreement. Failure to maintain the Structural BMPs is a violation of the Ordinance and may subject each Lot Owner to significant daily civil penalties and other enforcement actions by the City of Jacksonville. 7. Grant of Easement. Association hereby dedicates, bargains, sells, grants, and conveys unto the City of Jacksonville, its successors and assigns, a perpetual, non-exclusive and irrevocable right and easement over, under, through, and across the Stormwater Areas and access through the Property to and from the Stormwater Areas for the purpose of permitting City inspection and, if deemed necessary, as determined by the City, maintenance, replacement, reconstruction, and repair of the Structural BMPs. 8. Joint and Several Liabilitv. Action for Specific Performance. Recognizing the consequences to the City of Jacksonville of non-compliance with the obligations of this Maintenance Covenant, Association hereby grants the City of Jacksonville the right to seek, in any court of appropriate jurisdiction, judicial action for specific performance of any of the obligations established within this Maintenance Covenant.
