Pusey BY' Environmental Engineer 127 Cardinal Drive Extension Wilmington, NC 28405 Dear Mr. Pusey: I am in receipt of a report sent by you in regard to the retention pond at The Cardinal Drive Trade Center COA, Inc. I have enclosed a letter that should be on file in your office sent to Rhoda Hall on December 13`s, 2007. As indicated in that letter the Board of Directors has no opposition to a transfer of the permit from Biltmark to Cardinal Drive Trade Center and intends to work in that direction once the Engineer's Certificate and any other necessary paperwork has been submitted by the builder/developer of the property. In the interim CDTC is having the pond maintained at its expense. Please inform me when you have acquired the required certificate from Biltmark so we can move this process along. It seems from your report that the pond is constructed as permitted so that is good news in itself. Also you require a copy of record deed restrictions? I'm afraid I'm not sure what you are referring to in this case. If you need a copy of the Declaration of Condominium of the Cardinal Drive Trace Center COA, Inc. provide me with your email and I'd be more than happy to forward you a copy of what we have on file here. Also, for your information, we have the monthly maintenance report as submitted to us by the pond maintenance vendor here at our office. You may review them at any time by appointed or upon request I'd also be happy to scan and email the recent reports to you if you provide your email address. Although the Association has for years at their expense mowed this pond it was never turned over properly from the Developer and Declarant, Cardinal Associates, LLC. No Board of Directors was ever asked by Mr. Mark Maynard, the signer of the permit, to take the ownership of this pond. The Association has never received a final engineers report or any other information from Mr. Maynard, Cardinal Associations, LLC, Eastwood Developers, LLC, Honeycutt Engineering, Biltmark Corporation or anyone else for that matter. The Cardinal Drive Trade Center COA, Inc. is not opposed to taking over full management of this facility as soon as the person responsible for the permit, Mr. Mark Maynard, has presented the proper engineering reports and paperwork, and certifies the pond was constructed according to his permit. Incidentally, in your letter you refer to me as the "property manager" of The Cardinal Drive Trade Center COA, Inc. Unfortunately this is incorrect. I am an association manager, which is quite different under the law of North Carolina. Sincerely, Stephen J. Sulkey, CMCA, AMS, PCAM Professional Association Management, Inc. Sincerely, T , Stephen J. Sulkey, CMCA, AMS, PCAM Professional Association Management, Inc.
