Skvarla, III Secretary The Wilmington Regional Office received a complete State Stormwater Management Permit Application for Hawkeswater at the River, Phase 4 on May 15, 2014. Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Session Law 2008-211 and Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 131207 dated May 16, 2014, for the construction, operation and maintenance of the BMP's and built -upon area associated with the subject project. This permit shall be effective from the date of issuance until May 16, 2022, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), recordation of deed restrictions, procedures for changing ownership, transferring the permit, and renewing the permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system, to record deed restrictions, to transfer the permit, or to renew the permit, will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The written petition must conform to Chapter 150E of the North Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of this permit. Hawkeswater at the River, Phase 4 River Road, Leland, Brunswick County FOR THE construction, operation and maintenance of one (1) wet detention pond in compliance with the provisions of 15A NCAC 2H .1000 and Session Law 2008-211 (hereafter separately and collectively referred to as the "stormwater rules') and the approved stormwater management plans and specifications and other supporting data as attached and on file with and approved by the Division and considered a part of this permit. This permit shall be effective from the date of issuance until May 16, 2022 and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.9 of this permit. The runoff from all built -upon area within the permitted drainage area of this project must be directed into the permitted stormwater control system. The wet pond has been designed to handle the runoff from 93,568 square feet of impervious area. 3. The subdivision is permitted for 8 lots, each allowed a maximum of 7,500 square feet of built -upon area. 4. The maximum built -upon area allowed for the entire subdivision is 93,568 square feet. 5. The project shall provide and maintain a 50' wide vegetative buffer adjacent surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the top of bank of each side of streams and rivers and . the mean high water line of tidal waters. 6. A vegetated filter strip is not required for this pond as it has been designed for a 90% total suspended solids removal efficiency. Based on this plan and design submitted to DEMLR, the elevation of the permanent pool is set at 6.0 fmsl, the elevation of the temporary pool is set at 7.0 fmsl, the outlet invert elevation is 5.5 fmsl, the elevation of the downstream discharge point is 5.0 fmsl, and the highest elevation of the adjacent wetland is 3.0 fmsl. a. The difference in the elevations between the permanent pool and the nearby wetlands indicates that the pond will not dewater the adjacent wetlands. Additionally, the downstream elevations and conveyances, as demonstrated on the plans, are at an elevation lower than the outlet pipe, allowing the pond to function adequately to release the required storage volume within the specified drawdown time. A site specific soil evaluation was not provided for this project. Without a site specific soils evaluation, the seasonal high water table and/or groundwater conditions are unclear in the location of the wet pond; therefore this wet pond may not be able to sustain its permanent pool level. Please note that this may cause the wet pond to become dry between storm events which may endanger the health of the vegetation on the vegetated shelf or incoming groundwater may maintain a pool level that prevents the required storage volume from being available and preventing the runoff from discharging within the specified drawdown time. Therefore, the designer is responsible for: 1. providing DEMLR with a certification and survey showing the pond meets all approved design criteria and elevations as noted in the plans and this permit. 2. ensuring that the owner is aware that: (a) the pond may dry out between storms and that, (b) a healthy stand of vegetation must be maintained on the vegetated shelf. C. If, in the future, this design is not found to sleet the intent of the stormwater rules or does not provide the required design elements, then modifications to the stormwater system, including the pond design, will be required. 8. The following design elements have been permitted for this wet detention pond stormwater facility, and must be provided in the system at all times. a. SCHEDULE OF COMPLIANCE No person or entity, including the permittee, shall alter any component of the approved stormwater drainage system shown on the approved plans, unless and until the Division has approved of the revised plan. The permittee is responsible for the routine monitoring of the project for compliance with the built -upon area limits, grading, and the storm drainage system established by this permit, the permit documents, the approved plans, and the recorded deed restrictions. The permittee shall notify any lot owner that is found to be in noncompliance with the conditions of this permit in writing, and shall require timely resolution. 3. The permittee shall review all individual proposed and modified lot plans for compliance with the conditions of this permit. The permittee shall not approve any lot plans where the maximum allowed built -upon area has been exceeded, or where revisions to the grading or to the storm drainage system are proposed unless and until a permit modification has been approved by the Division. 4. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 5. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 6. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to the approved plans, regardless of size. b. Redesign or addition to the approved amount of built -upon area. C. Further development, subdivision, acquisition, or sale of any, all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. d. Alteration of any aspect of the approved stormwater drainage system and/or the approved stormwater BMPs. e. The construction of any permitted future development areas shown on the approved plans. 7. All stormwater collection and treatment systems must be located in public rights - of -way, dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required rights -of -way, common areas and easements, in accordance with the approved plans. 8. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. If the stormwater system is used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 9. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted Page 4 of 9 State Stormwater Management Systems Permit No. SW8 131207 facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 10. The facilities shall be constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 11. The permittee shall follow the approved Operation and Maintenance (O&M) Agreement in its entirety, and shall provide and perform the listed operation and maintenance at the scheduled intervals to assure that all components of the permitted stormwater system function at design condition. 12. Records of maintenance activities must be kept by the permittee. The records will indicate the date, activity, name of person performing the work and what actions were taken. 13. Prior to the sale of any lot, the following deed restrictions must be recorded: a. The following covenants are intended to ensure ongoing compliance with State Stormwater Management Permit Number SW8 131207, as issued by the Division of Energy, Mineral and Land Resources under NCAC 2H.1000. b. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to maintain compliance with the Stormwater Management Permit. C. These covenants are to run with the land and be binding on all persons and parties claiming under them. d. The covenants pertaining to stormwater may not be altered or rescinded without the express written consent of the State of North Carolina, Division of Energy, Mineral and Land Resources. e. Alteration of the drainage as shown on the approved plans may not take place without the concurrence of the Division of Energy, Mineral and Land Resources. f. The maximum built -upon area per lot is 7,500 square feet. This allotted amount includes any built -upon area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas, but does not include raised, open wood decking, or the water surface of swimming pools. g. For those lots within CAMA's Area of Environmental Concern, where DCM calculates a different maximum lot built -upon area, the governing lot BUA shall be the more restrictive of the two numbers. h. All runoff from the built -upon areas on the lot must drain into the permitted system. This may be accomplished through providing roof drain gutters, which drain to the pond or street, grading the lot to drain toward the street or directly into the pond, or grading perimeter swales and directing them into the pond or street. i. Built -upon area in excess of the permitted amount will require a permit modification. j. All affected lots shall maintain a 50' wide vegetative buffer adjacent to surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the top of bank of each side of streams and rivers and the mean high water line of tidal waters. k. Any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or the requirements of the Stormwater Rules is subject to enforcement procedures as set forth in G.S. 143, Article 21. A copy of the recorded deed restrictions must be submitted to the Division within 30 days of the date of recording the plat, and prior to selling lots. The recorded copy must contain all of the statements above, the signature of the Permittee, the deed book number and page, and the stamp/signature of the Register of Deeds. 15. Prior to transfer of the permit, the stormwater facilities will be inspected by DEMLR personnel. The project and the stormwater facility must be in compliance with all permit conditions. Any items not in compliance must be repaired, replaced or restored to design condition prior to the transfer. Records of maintenance activities performed to date will be required. 16. If the permanent pool volume is greater than 30,000 cubic feet, a decorative spray fountain will be allowed in the stormwater treatment system, subject to the following criteria: a. The fountain must draw its water from less than 2' below the permanent pool surface. b. Separated units, where the nozzle, pump and intake are connected by tubing, may be used only if they draw water from the surface in the deepest part of the pond. C. The falling water from the fountain must be centered in the pond, away from the shoreline. d. The maximum horsepower for the fountain's pump is based on the permanent pool volume. The maximum pump power for a fountain in this pond is 1/8 horsepower. 17. If permeable pavement BUA credit is desired, the permittee must submit a request to modify this permit to incorporate such language as required by the Division of Energy, Mineral and Land Resources. The request to modify must include a proposed amendment to the deed restrictions and protective covenants for the subdivision, and a soils report identifying the type of soil, the Seasonal High Water Table elevation and the infiltration rate. Upon the successful completion of a permit modification, the individual lot owners that request to utilize permeable pavements shall submit the necessary forms and documentation to the permittee, or a designated agent, and receive approval prior to construction of the permeable pavement. III. GENERAL CONDITIONS This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed Name/Ownershi Change Form, accompanied by the supporting documentation as listed on the form, to the Division of Energy, Mineral and Land Resources at: least 60 days prior to any one or more of the following events: a. An ownership change including the sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions; b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association, subject to the requirements of Session Law 2011-256; c. Bankruptcy; d. Foreclosure; e. Dissolution of the partnership or corporate entity; f. A name change of the current permittee; g. A name change of the project; In. A mailing address change of the permittee; 2. The permittee is responsible for compliance with all permit conditions until such time as the Division approves a request to transfer the permit. Neither the sale of the project in whole or in part, nor the conveyance of common area to a third party constitutes an approved transfer of the permit. Any person or entity found to be in noncompliance with the terms and conditions of a stormwater management permit or the stormwater rules is subject to enforcement action as outlined in NCGS 143, Article 21. 4. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 5. In the event that the facilities fail to perform satisfactorily the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 6. The permittee grants DENR Staff permission to enter the property during normail business hours for the purpose of inspecting the permitted stormwater management facility. 7. The permit issued shall continue in force and effect until revoked or terminated. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and re -issuance or termination does not stay any permit condition. 8. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 9. Approved plans, specifications, supplement forms, O&M Agreements and calculations for this project are incorporated by reference and are enforceable parts of the permit. The permittee shall maintain a copy of these documents on file at all times. 10. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules and regulations contained in Session Law 2006- 246, Title 15A NCAC 2H.1000, and NCGS 143-215.1 et.al. 11. The permittee shall submit a permit renewal application at least 180 days prior to the expiration date of this permit. The renewal request must include the appropriate documentation and the processing fee. Permit issued this the 16th day of May 2014. PROJECT DESCRIPTION The project is located off NC Highway 133, adjacent to the Brunswick River, in or near Belville, Brunswick County. To find the project site from Wilmington, travel south on NC Hwy 133 towards Southport. Travel approximately 1.25 miles from US Hwy 74/76 and the property will be located on the left. Hawkeswater is a planned development that spans approximately 173 acres on the west side of NC Hwy 133 and consists of 455 planned residential units. The project site is a 7.25 acre parcel, called Phase 4 of Hawkeswater, located east of NC Hwy 133. The property slopes down from the road to the shoreline. The highground portion of the site is vegetated primarily with Oaks (Quercus spp), Pines (Pinus spp.) and Magnolias (Magnolia grandii fora). The shoreline has not been stabilized and transitions from high ground to mixed coastal and 404 wetland species: Common Reed (Phragmites australis), Cattails (Typha spp.), and Salt Marsh Cordgrass (Spartina alternii fora). A site visit by boat was conducted on November 25, 2013. Water depths taken at low tide were found to be consistently P deeper than what is depicted on the plans- which is likely due to both wind and a slightly higher than average tide. The waters of the Brunswick River are classified as SC by the North Carolina Division of Water Quality. The waters are designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvesting of shellfish. PROPOSED PROJECT: The applicant is proposing a new phase (Phase 4) of the Hawkeswater development consisting of an 8-lot subdivision of the parcel and a 46-slip marina. A 6' wide pier would extend 262' in length to a floating T-head, measuring 160' in length by 8' in width. A 16' in length by 16' in width roofed platform (gazebo) would be located approximately midway down the pier and over open water. The pier would lead down a ramp to a 8' in length by 8' in width ramp landing leading to the T-head. Two dock spines would then extend off the T-head. A -Dock would measure 170.5' in length by 8' in width and B-Dock would measure 155' in length by 8' in width. A -Dock would have ten finger piers, 5 on each side, each measuring 25' in length by 3.5' in width. B- Dock would have eight finger piers, four on each side, each measuring 25' in length by 8.5' in width. The two docks would create 42 permanent slips. A terminal T-head would be located at the end of the two dock spines. Each of the two terminal T-heads would measure 58' in length by 8' in width. The waterward side of the terminal T-heads would not accommodate permanent slips but is proposed to allow for the temporary tie-up of an additional 4 transient vessels for a total docking space of 46 vessels. No docking is proposed on the landward side of the docking facility. Water depths during my site visit appeared to be consistent with those shown on the plans at 4' relative to Mean Low Water (MLW) in the approximate location of the landward side of the dock and approximately -8' at MLW toward the waterward side of the dock. A concrete path would be constructed outside the 30' buffer and would transition to a wooden boardwalk within the buffer. The sidewalk/boardwalk would lead to the marina facility. A stormwater pond is also proposed partially within the 75' Estuarine Shoreline AEC. A gate, road, marina parking, bathroom/storage building and residential infrastructure are also proposed landward of the 75'Estuarine Shoreline AEC (See Sheet 9 of 10). D. R. ANTICIPATED IMPACTS: The proposed development would incorporate approximately 20,543 square feet of shallow bottom in total (estuarine waters and public trust area). The pier would shade approximately 420 square feet of coastal wetlands. Approximately 300 square feet would be low marsh (Spartina alterniora) and the remaining 120 square feet would shade high marsh/§404 wetland species. The project would also disturb approximately 6.76 acres of high ground. The work would likely result in a temporary increase in turbidity. No dredging is proposed and water depths appear to be sufficient to avoid kicking or prop dredging. The proposed dock would extend approximately 347' into the waterbody from the waterward edge of marsh, which measures approximately 1474' across from marsh to marsh. As proposed, it does not appear the docking facility would encroach into the channel portion of the waterbody, nor would it exceed 1/4 the width of the waterbody as shown on plans. Brunswick River Applicant: U. R. Horton, Inc. The Hawkeswater development is located in Brunswick County on NC Highway 133 approximately '/4 of a mile south of US Highway 17/74/76. The development property contains a total of 172.88 acres. The majority of the property lies on the west side of NC 133, is zoned R-7500/PUD and planned for 455 residential units. The Phase 4 parcel., located on the east side of NC 133 features a shoreline along the Brunswick River, is zoned RR and is planned to have eight single-family residential lots and a wet slip boat storage facility with parking to serve I-lawkeswater residents. Under the RR zoning classification, a residential wet slip boat storage facility is a use allowed with a County Special Exception Permit. On October 10, 2013 the Brunswick County Board of Adjustments voted to approve the requested Special Exception Permit for such a facility. In order to obtain State and Federal authorizations for the community marina, a CAMA Major Permit application is being submitted for review. Following County approval, and through consultation with the Division of Coastal Management, the size of the facility has been reduced to accommodate 42 permanent slips rather than the original planned 64 slips. The Phase 4 parcel is currently undeveloped with a mixed pine -hardwood tree canopy and evergreen shrub layer on the upland with a mix of coastal wetland grasses along the: shoreline. The width of the Brunswick River in this location is approximately 1,500' (marsh to marsh). Water depths in the footprint of the proposed open -water facility are - 4' mllw to -8' mllw. The length of the property shoreline is 554' as measured at the Normal High Waterline. The riparian property located to the north of the parcel is Brunswick River Park and to the south is an undeveloped privately -owned tract. The proposed residential wet slip boat storage facility will be comprised of an elevated. 6'-wide fixed pier with a centrally located 16'xl6' gazebo. The end of the pier features a hinged ramp leading down to the floating dock system. The dock spine and two main dock extensions will be 8'-wide along with the T's at their ends. Shared slip fingers will be 3.5'-wide. There are to be 42 permanent 25' long slips. In addition, there will be 58 linear feet of side -to temporary tie up dockage located on the outsides of each of the two main dock extension T's. This temporary tie up dockage space is not to be sold or leased. Based on the current available water depths, no dredging will be required. The total area of Public Trust Waters not considered "access" to be occupied by the facility is 14,675.5 square feet. This total divided by 27 equals 543.5 linear footage of "dedicated" shoreline required to support the footprint. Therefore, a 10.5 foot length of shoreline will remain un-dedicated. The length of dedicated shoreline will either become common area or otherwise have enforceable restrictions placed upon it to prevent the construction of additional structures beyond the subject facility. Standard marine construction practices will apply to development of the access pier, dock structures, gazebo and piling installation. The access pier will be a fixed, elevated structure composed of treated wood. There will be ''/2" of spacing between individual deck boards to allow drip through of water and decking will be elevated a minimum of 36" above marsh substrate. The treated wood pilings of 12" or less in diameter will be installed by water jet or vibratory hammer. The contractor performing the work will follow guidelines established by the USFWS entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina." The facility will be private for use only by the Hawkeswater property owners and their guests. No commercial activities such as launching, fueling, servicing, painting or holding tank pump -out will be conducted on site. Boat owners will travel to commercial marinas for such services. Parking spaces and bathrooms will be provided for property owners accessing their boats. A pedestrian walkway from the parking area to the facility will be installed. No impervious materials will be used for facility access within the CAMA 30' buffer as measured from the Normal High Water line or the 50' stormwater buffer as measured from the Mean High Water line. The permanent boat slips will either be sold or leased to property owners and the facility will be managed and maintained by an entity of the developer or a property owner association founded for that purpose. The Phase 4 development will also include a gated entry, roadway, and standard subdivision infrastructure. According to the Brunswick County Planning Department, the required parking associated with the facility must equal a minimum of .25 parking spaces per boat slip. In addition a minimum of 3 spaces are required to support the planned bathroom/storage building. There are a total of 19 parking spaces planned. Any stormwater treatment features will be situated beyond the limits of the 30' AEC and the 50' stormwater buffer to be consistent with state regulations. A stormwater management plan has been submitted to the state for permitting and a sedimentation/erosion control plan will be submitted to the state for approval prior to construction. The 404 wetland boundaries have been delineated and approved by the Corps of Engineers. The Coastal Wetland line and the Normal High Water line have been inspected by DCM staff. No wetland impacts are proposed with the development of Phase 4 or the wet slip boat storage facility. A preliminary in-depth review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: In order to accurately evaluated the pond please provide either of the following two items: a. A signed and sealed soils report from a soil scientist or other qualified professional presenting the seasonal high water table results from a soil boring taken in the location of the BMP. b. Per the 2008 memo from Paramounte Engineering, if it is desired to not conduct a soils evaluation to determine the seasonal high water table (SHWT), then the following criteria will be required: i. A note will be added to the plans identifying the approximate elevation within the wetlands to demonstrate that the permanent pool elevation of the wet detention pond is not set lower than the elevation of the wetlands. ii. Additional surveying will be conducted along the periphery of the wetlands (± 20 ft), as deemed necessary, to illustrate the topography near the stormwater outfalls in relation to the elevation set for the permanent pool of the wet detention pond. iii. An analysis is completed by conducting additional field verification and the review of USGS topographic mapping, NRCS soils map data, and other permanent reference data. A copy of this analysis, review documents and data will be provided to the Division with the application submittal. iv. A summary of the analysis and soil evaluation will be placed in the narrative for clarification during the review. If it desired to go with option B, please consider and provide the following: a. A note on the plans to demonstrate that the permanent pool elevation is not set lower than the elevation of the wetlands. b. The third paragraph of the narrative states that draining the wetlands is not a concern because the outfall is not to standing water therefore the pond will function adequately to release the treatment volume within the required timeframe. This statement appears to be combining three separate concerns surrounding the SHWT as identified on pages 10-9 and 10-10 of the BMP manual. The first concern is when ponds are set below the SHWT level, the pond will dewater the surrounding areas, adversely affecting nearby wetlands that rely on that saturated condition. A separate concern is to confirm that the downstream conveyances will be able to function adequately and maintain a free flowing condition to allow the pond to discharge appropriately. A separate, third concern is that if groundwater does enter the pond, will the pond be able to handle it and not adversely effect the required storage volume. In the narrative, please summarize the analysis of the actions, resources, and references consulted to verify the design of the system as it relates to the specific concerns identified on pages 10-9 and 10-10 of the BMP manual. Please remove the sidewalk or change the proposed material to a pervious surface that supports the vegetation required within the buffer, such as open slatted boardwalk. ✓3. The drainage areas presented on sheet C-3.1 appear to only depict the drainage areas to the collection system inlets. Please delineate the 276,065 ft pond drainage area in the plan set. V 4. Please provide additional grading details, including spot elevations, to demonstrate that the runoff from the entrance of the road to the subdivision, the marina parking area, sidewalks and marina building will be directed to the stormwater collection system,. i/5. The plans and the first page of the pond calculations indicate that the next available outlet above the permanent pool is set at an elevation of 7.0 ft. However, the information presented in the supplement and stage storage tables indicate that the temporary pool elevation is 6.9 ft. The provided storage can exceed the minimum required storage, however the next available outlet is considered to be the temporary pool elevation. Please ensure the reported temporary pool elevation and the provided storage volume and surface area are consistent with the elevation of the next available outlet. 6. All runoff that is directed to flow through any 401/404 wetlands shall flow into and through the wetlands at a non -erosive velocity, which is based on the peak flow from the 10 year storm. Please demonstrate that the discharge from the pond will enter the wetlands at a non -erosive velocity. �7. Please revise Section 111.1 b to indicate that Mr. Lee is a Vice President of DR Horton, Inc instead of the Authorized Agent. i r/8. Please provide the third section of the wet detention pond supplement which includes the required items checklist. On page 3 of the wet detention pond operation and maintenance (O&M) agreement, the two blanks above the basin diagram are intended to reflect the depth of water, not the depth of the accumulated sediment. The water surface often makes it difficult to determine the depth of sediment so the sediment depth is typically back calculated by the depth of the water. Please update page 3 of the O&M agreement to reflect the depth of water. Please remember that a change to one number may have a domino effect on other numbers. Please check all plans, calculations and forms to ensure that the numbers are consistent throughout. Please note that this request for additional information is in response to a preliminary review. A note will be added to the plans identifying the approximate elevation within the wetlands to demonstrate that the permanent pool elevation of the wet detention pond is not set lower than the elevation of the wetlands. b. Additional surveying will be conducted along the periphery of the wetlands (t 20 ft), as deemed necessary, to illustrate the topography near the stormwater outfalls in relation to the elevation set for the permanent pool of the wet detention pond. c. An analysis is completed by conducting additional field verification and the review of USGS topographic mapping, NRCS soils map data, and other permanent reference data. A copy of this analysis, review documents and data will be provided to the Division with the application submittal. d. A summary of the analysis and soil evaluation will be placed in the narrative for clarification during the review. Because the plans and narrative includes these notes, data and the summary of the soils evaluation under the seal, signature, and date of the engineer, DWQ is approving the soils analysis for this project. If, in the future, this design is found to not meet the intent of the stormwater rules or does not provide the required design elements, the permit holder may have to modify the stormwater system, including the pond design. This memorandum covers some of the major topics that were discussed during the meeting and the conclusions that were drawn. From the Application Return from The Reserve at St. James Phase V, comment #6 indicated that Seasonal I-ligh Water Table elevation calls had to be performed by a licensed soils scientist and that a sealed report would have to be done for each pond. o The discussion concluded with the fact that Paramounte Engineering (PEI) would provide a note indicating the approximate elevation within the wetlands; this note would help it to be determined that the permanent pool elevation of the wet detention pond would not be lower than the elevation of the wetlands and therefore not lower than the elevation of the Seasonal High Water Table. As a result, no soils evaluation will need to be performed since PEI is not setting the permanent pool of any wet detention pond below the elevation of the wetlands. Phase 4 will consist of 6.5 acres located within the Hawkeswater at the River development off of SE River Road (NC 133), approximately 1.15 miles south of US Highway 17 in Leland. Phase 4 consists of eight (8) single-family residential lots on the 7.25 acres, as well as parking for a proposed marina. The impervious area was calculated by taking into the account the roadways, single- family homes, driveways, and marina parking area. The pond is designed for 7500 square feet of built - upon —area per lot. All the runoff from the proposed impervious areas will be directed to a proposed on - site stormwater pond that is designed to treat the first inch and a half of runoff. The difference between the pre -development runoff and the post -development runoff for a 10-year, 24-hour storm is stored in this pond designed for the first inch and a half of runoff. The rate discharged through the 2" pond orifice is less than the pre -development runoff for a 1-year, 24-hour storm. The runoff will be directed to the on - site pond via a stormwater collection system. The seasonal high water table for the project was determined using the parameters described on pages 10- 9 and 10-10 of the BMP manual; therefore using good engineering judgment by field survey at and in the wetlands, inspection, and discussion with client on existing conditions of our outfall before setting outfall elevation of 5.5. The issue of draining the wetlands is not a concern because we are not oulfalling to standing water at our flared sections, therefore, the pond will function adequately to release the treatment volume in the 2-5 requirement as stated in the statue law. In addition, for the concern of the plantings staying alive, in times of drought, the developer has and will continue to provide the necessary irrigation to keep alive and maintain the water surface elevation for ascetic and marketing purposes. This information that the treatment volume will draw down between the 2-5 days as designed, wetland plantings maintained and inspection of other projects, give me as a licensed engineer in NC assurance that the seasonal high water table for this project is below the outfall elevation of 5.5 for the project. The project is within a drainage basin which drains to the Cape Fear River. The receiving stream is the Brunswick River (SC).
