Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Session Law 2006-246 and Title 15A NCAC 21-1.1000. We are forwarding Permit No. SW8 080744 dated October 15, 2009, for the construction of the subject project. This permit shall be effective from the date of issuance until August 21, 2018, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. This permit shall be effective from the date of issuance until August 21, 2018, and shall be subject to the following specified conditions and limitations: 1. DESIGN STANDARDS This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.8 on page 3 of this permit. The stormwater control has been designed to handle the runoff from 30,928 square feet of impervious area. A vegetated filter has been waived for this system. 4. The tract will be limited to the amount of built -upon area indicated in Section 1.8 on page 3 of this permit, and per approved plans. This permit does not provide any allocation of built -upon area for future development. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. The runoff from all built -upon area within the permitted drainage area of this project must be directed into the permitted stormwater control system. The built -upon areas associated with this project shall be located at least 30 feet landward of all perennial and intermittent streams. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 4. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. Page 3 of 8 State Stormwater Management Systems Permit No. SW8 080744 MOD The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowin.9 and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of bypass structure, filter media, flow spreader, catch basins, piping and vegetated filter. g. A clear access path to the bypass structure must be available at all times. Records of maintenance activities must be kept for each permitted BMP. The records will indicate the date, activity, name of person performing the work and what actions were taken. The permittee shall submit to the Division of Water Quality an annual summary report of the maintenance and inspection records for each BMP. The report shall summarize the inspection dates, results of the inspections, and the maintenance work performed at each inspection. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. Access to the stormwater facilities shall be maintained via appropriate easements at all times. 10. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 11. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. 12. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS This permit is not transferable to any person or entity except after notice to and approval by the Director. At least 30 days prior to making a change of ownership, or a name change of the owner or project, or a mailing address change, the permittee must submit a completed and signed Name/Ownership Change form tc the Division of Water Quality, accompanied by the supporting documentation as listed on the form. The approval of this request will be considered on its merits and may or may not be approved. 2. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 3. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 4. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 6. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 7. The permit issued shall continue in force and effect until revoked or terminated. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 8. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 9. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 10. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules and regulations contained in Session Law 2006- 246, Title 15A NCAC 21-1.1000, and NCGS 143-215.1 et.al. We have attached the revised infiltration trench supplement, Stormtech Stage Storage Worksheet, revised Pond Pack Flow summaries and revised post -development exhibit for your review. You will find that when considering the additional storage provided by the perimeter stone, the result is there will be approximately 500 cubic feet of additional storage beyond the minimum requirement. The pond pack results clearly show the provided volume will allow the runoff from the 1 year storm to fully infiltrate. It is also important to note the 10"/hour infiltration rate used in the calculations is very conservative as the geotechnical boring taken directly under the proposed system was 27.8"/hour. The 10"/hour was used at the direction of the on -site DWQ inspector who observed the soil borings. We would request the installed system which was previously approved under the original permit be considered adequate based on the supporting calculations. We would also request that the outstanding comments with regard to the additional three (3) chambers be retracted since we have demonstrated the previously approved system is adequate on its own to meet parking plan modification. I understand that the original permit application had been approved using the 51 StormTech Chambers with appropriate manifold connections. The problem in permitting arose when the additional 3 chambers were added because those chambers were not attached to the manifold. John Kuzenski of Kimley-Horn had added those additional 3 chambers to add additional volume to the system because the impervious area had increased. I have just discussed with John that the addition of those 3 additional chambers is actually unnecessary because we have additional volume we can take credit for with the approved version of 51 chambers. The entire bed of the StormTech System uses a one foot perimeter stone for safety factor. If the additional stone void for the one foot perimeter is included with the volume of the originally approved system of 51 chambers, then this adjusted volume would put us over and above the required volume without having to take credit for the additional 3 chambers that were installed without being attached to the manifold. We could just disregard that those additional chambers are part of the system, because the required storage volume is already available in the original 51 chambers, and in the stone voids both above the chambers, below the chambers, in between the rows of chambers, and also in the one foot perimeter stone around the chamber bed. Please see the attached incremental storage sheet which illustrates that the required volume is contained in the original 51 chamber design, and it is not necessary to credit the additional 3 chamber with any storage volume. The volume available for storage in the 51 chamber layout including all available stone void is 4,525.30 Cubic Feet which exceeds the requirement for this project. It is my understanding after reviewing your letter dated June 29, 2009 that the three additional StormTech Chambers that were added to the system after the original design were installed without being connected to the inlet manifold. According to this letter it is required that a manifold connection be provided to this row of three chambers to provide maintenance and accessibility. I understand the concerns and requirements that the stomrwater system be accessible and maintained. StormTech strongly encourages project owners to provide access for maintenance for all sormwater systems. The StormTech Systems are equipped with a feature called the Isolator Row, which is designed to capture the overwhelming majority of the runoff (that which is most heavily laden with sediment), before the stornwater is allowed to enter any of the adjacent non -Isolator Rows. This is accomplished usually with a bypass structure / weir wall apparatus diverting these flows into the Isolator Row. Access to these Isolator Rows is required to perform a jet -vac procedure down the entire run to flush out any debris and sediment that comes to accumulate in these rows over the course of the year. These Isolator Rows are the only rows of chambers that are recommended to have this jet -vac procedure performed upon. The jet -vac equipment is not recommended to be placed in non -Isolator Rows due to potential scour damage this apparatus could cause to the stone backfill. It is therefore common practice to design these StormTech Systems to have rows of chambers that are not necessarily connected to inlet manifolds. The sormwater conveyance is provided to these non - connected rows through the perforations in the sides of the chambers, and through the voids in the stone backfill. Through monitoring of existing installed projects, and numerous water quality field test studies, it has been confirmed that these Isolator Rows do function as intended to capture the sediment coming into the system. A routine inspection schedule needs to be established for each individual location based upon site specific variables. The type of land use (i.e. industrial, commercial residential), anticipated pollutant load, per- cent imperviousness, climate, etc. all play a critical role in determining the actual frequency of inspection and maintenance practices. At a minimum, StormTech recommends annual inspec- tions. Initially, the Isolator Row should be inspected every 6 months for the first year of operation. For subsequent years, the inspection should be adjusted based upon previous observation of sediment deposition. The Isolator Row incorporates a combination of standard manhole(s) and strategically located inspection ports (as needed). The inspection ports allow for easy access to the system from the surface, eliminating the need to perform a confined space entry for inspection purposes. If upon visual inspection it is found that sediment has accumulated, a stadia rod should be Inserted to deter- mine the depth of sediment. When the average depth of sediment exceeds 3 inches throughout the length of the Isolator Row, clean -out should be performed. 2.2 MAINTENANCE The Isolator Row was designed to reduce the cost of periodic maintenance. By "isolating" sediments to just one row, costs are dramatically reduced by eliminating the need to clean out each row of the entire storage bed. If inspection indicates the potential need for main- tenance, access is provided via a manhole(s) located on the end(s) of the row for cleanout. If entry into the manhole is required, please follow local and OSHA rules for a confined space entries. The JetVac process utilizes a high pressure water noz- zle to propel itself down the Isolator Row while scouring and suspending sediments. As the nozzle is retrieved, the captured pollutants are flushed back into the man- hole for vacuuming. Most sewer and pipe maintenance companies have vacuum/JetVac combination vehicles. Selection of an appropriate JetVac nozzle will improve maintenance efficiency. Fixed nozzles designed for cul- verts or large diameter pipe cleaning are preferable. Rear facing jets with an effective spread of at least 45" are best. Most JetVac reels have 400 feet of hose allow- ing maintenance of an Isolator Row up to 50 chambers long. The open bottom chambers and perforated side - walls allow storm water to flow both vertically and horizon- tally out of the chambers. Sediments are captured In the Isolator Row protecting the storage areas of the adja- cent stone and chambers from sediment accumulation. Two different fabrics are used for the Isolator Row. A woven geotextile fabric is placed between the stone and the Isolator Row chambers. The tough geotextile provides a media for storm water filtration and provides a durable surface for maintenance operations. It is also designed to prevent scour of the underlying stone and remain intact during high pressure jetting. A non -woven fabric is placed over the chambers to provide a filter media for flows passing through the perforations in the sidewall of the chamber. The Isolator Row is typically designed to capture the 'first flush" and offers the versatility to be sized on a vol- ume basis or flow rate basis. An upstream manhole not only provides access to the Isolator Row but typically includes a high flow weir such that storm water flowrates or volumes that exceed the capacity of the Isolator Row overtop the over flow weir and discharge through a manifold to the other chambers. The Isolator Row may also be part of a treatment train. By treating storm water prior to entry into the chamber system, the service life can be extended and pollutants such as hydrocarbons can be captured. Pre-treatment best management practices can be as simple as deep sump catch basins, oil -water separators or can be inno- vative storm water treatment devices. The design of the treatment train and selection of pretreatment devices by the design engineer is often driven by regulatory requirements. Whether pretreatment is used or not, the Isolator Row is recommended by StormTech as an effective means to minimize maintenance requirements and maintenance costs. Plan sheets C5, and C10 illustrate that the three (3) additional Stormtech chambers required to treat the additional BUA are not connected to the inlet manifold. A site inspection on April 8, 2009 confirmed that these chambers have already been installed without the prior approval of DWQ. After reviewing the additional information received on April 28, 2009 and subsequent discussions within DWQ, it was decided that this additional row of Stormtech chambers is required to be connected to the manifold for maintenance and accessibility. Please extend the manifold to connect these additional Stormtech Chambers to the rest of the stormwater system. If the manifold is not extended to the additional row, a Notice of Violation will be issued for modifying the permitted stormwater system without prior approval. The following is not a requirement for approving the proposed modification, but is strongly recommended: 2. The site is draining to SA/HQW waters, an important resource to the coastal communities. The stormwater system, as permitted, appears to be designed to act more like an underground dry detention pond instead of an infiltration trench. This system appears to have been approved with an outlet device (including an orifice) that will assist in the draw down of the required storage volume. Infiltration systems should be designed to store the required volume for infiltration into the soil with the only outlet being an overflow weir to bypass the excess runoff. The Division is asking you to consider helping in our mission to preserve, protect, and enhance water quality by plugging the 3.5"x19" rectangular orifice in the outlet structure. They are modifying a previously permitted system to add 3 chambers. The problem is that this extra row of chambers does not include a manifold to allow the stormwater to directly enter that row. (see the attached file StormTech3) In my request for additional information, I asked them to extend the manifold to connect these additional chambers to the rest of the system. They claim that the chambers will fill up on their own and do not need to be connected to the manifold. They have submitted some paperwork to support this claim. This orifice will allow some runoff to leave the system during .larger rain events, but the system is designed to not exceed pre -development flow rates for the 1 year and 10 year 24 hour storm events. The Town of Oak Island requires pre/post detention of the 1 year and 10 year 24 hour storm events. The outlet structure configuration was designed to meet the detention requirements of the Town. This rationale is explained in tabular format in Appendix C and Appendix E of the Stormwater Analysis report. O The Stormtech system is designed for both water quality and quantity and the calculated size of the system is governed by the most restrictive requirement. In this case, the required water quality volume exceeded the volume required for detention; therefore the system was enlarged to accommodate the water quality requirements while still meeting the required pre/post detention criteria. The three items you requested are listed below: Revised Narrative: The owner requested that additional parking be added to the site plan adjacent to the proposed building for staff parking. This revision has been approved by the Town of Oak Island and is shown on the current civil construction plans. The net increase of impervious area added to the site was 0.04 acres. As a result, three additional Stormtech Chambers were added to the existing system to meet the appropriate water quality and quantity requirements for this project. These minor changes are addressed in this revision submittal to amend the previously approved Stormwater Permit issued by NCDWQ on 8/21/09. Status of Construction: The latest available site visit report that describes the improvements already constructed on site have been included in this report. It appears that as much as a 30 day delay has occurred due to rework and lack of possible productive work while design modifications are being considered 4.
