Skvarla, III Secretary Effective August 1, 2013 the State Stormwater program was transferred from the Division of Water Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that DEMLR is the Division responsible for any issues regarding the stormwater management permit. On November 1, 2005, the Wilmington Regional Office of the former Division of Water Quality issued a modified State Stormwater Management Permit to Edwin Bumett for Barnes Bluff Subdivision. A mailing address change has taken place without prior notification to the Division. Please note that General Condition 111.9 of the permit requires the permittee to notify the Division of any name, ownership or mailing address changes within 30 days. This letter is being sent to the corporate mailing. address on file with the NC Secretary of State. If the project is nearing completion, it may be time to transfer the permit to the Association. Please do not allow too much time to pass before the permit is transferred. You should consider transferring the permit at the point in time when >50% of the lots are sold and the common areas of the subdivision have been conveyed to the Association. As part of the transfer process, you will need to submit the completed and signed Name/Ownership Change form, a copy of the deed(s) conveying the common areas to the Association, and documentation that no lot has exceeded its maximum allowed built -upon area. Upon receipt of these items, the Division will conduct a detailed compliance inspection of the project and issue a report. Any non -compliances listed in the inspection report must be addressed prior to transfer. Once the Division determines that the project is in compliance, the permit can be transferred. A copy of the recorded deed restrictions was previously submitted on October 26, 2005, and need not be resubmitted.
