THIS DEED, aEade and entered into this the �day of
19_ft, by and between EDGAR D. BAKER and
wife, M RIAH E. BAKER, parties of the first part, and the STATE OF NDRIR
CAROLINA, party of the second part;
W ITNESSETR:
That the said parties of the first part, in consideration of the
sun of Ten Dollars and other good and valuable consideration to them paid
by the party of the second part, receipt of which is hereby acknowledged,
have bargained and sold and by these presents do bargain, sell and convey,
unto the said party of the second part, its successors and assigns, subject
to the terms and conditions hereinafter set forth, all of that certain
tract or parcel of land situate, lying and being %a Cary Township, Wake
County, North Carolina, and being more particularly described as follows:
BEGINNING at a point in the centerline of the New
Ebenezer Church PA ad, said point being located 75
feet south of the southern end of the bridge across
Crabtree Creel:, running thence With the centerline
of New Ebenezer Church Poad S 5' 26' H 391.39 f eet
to a point; thence S 3' 36' W 154.43 feet to a point;
thence S 1' 5' £ 144.34 feet to a point; thence S 6'
28' E 140.85 feet to a point; thence S 13' 20' E
249.96 feet to a point; thence leaving the centerline
of the Neu Ebenezer Church Road and running with the
centerline of the Old Ebenezer Church Road and the
existing property lines of William B. Umstead State
Park N 37' 58' W 172.67 feet to a point; thence 13 13'
00' W 244.77 feet to a point; thence N 8' 23' W 298.76
feet to a point; thence N 7' 53' E 177.42 feet to a
point; thence N 33' 54' E 271.28 feet to the point of
beginning, containing 2.16 acres, more or less, accord-
ing to a survey by the Engineering Section, Division of
State Parks, North Carolina, Department of Natural Re-
sources and Community Development, dated January 22,
1971, entitled, "Land Exchange Between Wm. B. Umstead
State Park And Edgar D. Baker and wife, Miriam E. Baker,
House Creek Township, Wake County, N. C.".

To ghvE Am TO HOLD the aforesaid -tract or parcel of land and all
privileges and appurtenances thereunto belonging to the State of North
Caro;ina, its successors and assigns, forayer, but upon express condition
that the State of Borth Carolin shall use the above described land exclus-
ively for public park, recreational. and conservation purposes and the
title and right of possession of the above described land. with the improve-
sents thereon, shall become the property of the United States upon a find-
ing by the Secretary of the interior after notice to such grantee and after
an opportunity for a hearing, that the grantee has not complied with such
conditions during a period of *more than three years, which finding shall be
final and conclusive, and such lands and improvements thereon shall be under
the jurisdiction of the Department of Interior.
And the said parties of the first part do covenant that they are
seized of the said premises in fee simple and have the right to convey the
same in fee simple; that the s=e are free from any encumbrances except as
set forth herein, and that they will warrant and defend the said title to
the same against the claims of all persons whomsoever.
IN TESTIMONY WHEMF, the said parties of the first part have
hereunto set their rands and seals. all on the day and year first above
written.
