Deed restrictions and protective covenants are necessary to ensure that the development maintains a "built -upon" area consistent with the applicable regulation governing the density level. The folluvving deed restrictions and covenants must be recorded prior to the sale of any lot: 1. The following covenants are intended to ensure ongoing compliance with State Stormwater Management Permit Number , as issued by the Division of Water Quality under NCAC 2H.1000. 2. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to maintain compliance with the stormwater management permit. 3. These covenants are to run with the land and be binding on all persons and parties claiming under them. 4. The covenants pertaining to stormwater may not be altered or rescinded without the express written consent of the State of North Carolina, Division of Water Quality. 5. Alteration of the drainage as shown on the approved plan may not take place without the concurrence of the Division of Water Quality. 6. Note: If the BUA per lot varies, please substitute the following statement for the paragraph above and provide a complete listing of the proposed BUA for each lot: The maximum allowable built -upon area per lot is as follows: rd Lot Impervious Allocation Lot Impervious Allocation 1 30,100 sq ft 8 38,200 sq ft 2 36,000 sq ft 9 38,200 sq ft 3 37,300 sq ft 10 38,200 sq ft 4 32,400 sq ft 11 31,100 sq ft 5 38,200 sq ft 12 30,900 sq ft 6 38,200 sq ft 13 30,500 sq ft 7 38,200 sq ft 14 30,200 sq It These allotted amounts include any built -upon area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas, but does not include raised, open wood decking, or the water surface of swimming pools. All runoff from the built -upon areas on the lot must drain into the permitted system. This may be accomplished through a variety of means including rood drain gutters which drain into the street, grading the lot to drain towards the street, or grading perimeter swa/es to collect the lot runoff and directing them into a component of the stormwater collection system. Lots that will naturally drain into the system are not required to provide these additional measures. Print Name and Title: Jeffrey M. Highway 421 in New Hanover County. This project is a high density stormwater project that uses roadside ditches to convey stormwater to an onsite conventional stormwater pond. This development is comprised of 15 lots, six (6) of which, have already been allocated to an existing stormwater permit (SW8 050217). Those previously allocated lots are lots 5-10 in this stormwater plan. All drainage from these lots will be directed towards the permitted stormwater pond and the impervious allocation will be as per the issued stormwater permit for that area. The stormwater from the remaining lots (1-4 and 11-15) will be directed towards one (1) conventional stormwater pond designed to meet both NCDENR's and New Hanover County's stormwater requirements. Site Description The topography of the Cape Fear Industrial Park is slightly rolling with mild slopes ranging from 0.5% to 1 % and is heavily vegetated with a thick pine forest. The site ultimately drains to the Cape Fear River 18-(63), a waterway classified as C:Sw. The elevations on this project ranges from 14 feet MSL to 18 feet. The majority of the soils, according to the Soil Survey of New Hanover County, are Lakeland sands and Wakulla sands. Both of these soils are well draining and have a soil hydrologic group of A. This property is zoned IND-2. Stormwater Treatment Roadside ditches will be constructed to direct stormwater to either the permitted stormwater pond, or the proposed stormwater pond. The permitted stormwater pond is already designed to treat the flow from lots 5- 10, so no modification will he required. Those lots will he graded such that the stormwater is directed towards the permitted stormwater pond. The proposed stormwater pond will be designed to treat the stormwater runoff from lots 1-4 and 11-15 according to NCDENR's and New Hanover County's stormwater requirements. Each roadside ditch is designed to handle the 100 year storm event without cresting over the road. Roadside ditches on the east side of the road cross underneath the roadway through 36" RCP culverts. These culverts are designed as well to handle the 100 year storm event during the unlike case when the bleeddown weir and principal spillway are blocked. Under these design criteria, the 100 year storm event can be fully bypassed without damage to the road or surrounding properties. The stormwater pond has been designed to meet NCDENR's capacity analysis as well as New Hanover County's pre -post requirements. The bleeddown orifice is designed to drain down the first 1" of rainfall within two (2) to five (5) days. The riser elevation was set at an elevation that would satisfy New Hanover County's pre -post requirement. The elevation of the emergency spillway was set at an elevation required to pass the 10 year storm event solely through the riser as per NCDENR regulations. The width of the emergency spillway for the proposed pond will be the back width of the pond. It will be stabilized with rip -rap along the flow path to prevent scour. The width of the emergency spillway is designed so that New Hanover County's top of dam requirement could be met. With the design conditions set as listed above, the conventional stormwater pond, culverts, and ditch system can safely route the 100-year storm event with or without the principal spillway in operation. New Hanover County requires that the post -development site discharge for the 25-, 10-, and 2-year storm events are to be lower than the pre -development discharge for the same storm events. The unpermitted portion of the site that drains to the proposed stormwater pond was used iu determine to calculate the pre - post for this site. The pre -development discharge for this site for the 25-, 10-, and 2-year storm events are 14cfs, 12cfs, and 10cfs, respectively. The post -development discharge for the same three storm events are 14cfs, 12cfs, and 7cfs, respectively. Since the post -development discharge is not greater than the pre - development discharge for the 25-, 10- and 2-year storm events, this site meets New Hanover County's pre - post discharge requirement. Existing Stormwater Riser Field Evlauation / Certification for Stormwater Project No. SW8 050217 New Hanover County, North Carolina 14-March-2007 Dear Mr. Baker: oasta Land design, PLLC Civil EnbMwningl Landscape ANb. itcoute ! C9ns' W09n M9nagcmeli1 A d$ K 1172 P'liona 910-254.4133 1W]flMMpn,NC28402 Fax 910-254-0502 As discussed in the submittal meeting for the Cape Fear Business Park on March 13, 2007, an evaluation of the existing stormwater pond riser structure at the 421 Industrial Park is required because stormwater drainage from the Cape Fear Business Park project is being directed towards the permitted stormwater pond at the 421 Industrial Park. On, Tuesday, March 131h, 2007, Coastal Land Design, PLLC, performed a visual inspection of the stormwater riser for the existing pond at the 421 Business Park as requested by your office. It was unclear from previous certifications and field changes on file in your office, not performed by Coastal Land Design, PLLC, which size orifice was actually installed in the existing stormwater riser. The purpose of the visual inspection was to determine the actual size of the bleeddown orifice installed in the riser. Upon inspection and measurement, the riser structure appears to have a 2-1/2" PVC bleeddown orifice. Since the installed bleeddown orifice (2-1/2") is larger than the permitted orifice (2-1/4"), the drawdown time of the existing pond needs to be verified to ensure a drawdown between 2 and 5 days. The permitted elevation of the temporary pool is 15.6fmsl, the permitted elevation of the permanent pool is 14.Ofmsl, and the permitted temporary pool volume is 47,456cf. Q2dW = 47,456cf / 172,800sec = 0.275cfs Qlft = 47,456cf / 432,000sec = 0.11 Ocfs Qpr(Mded (0.60)''-M,*(2.5"/24)2*[(2*32.2fpss)*(15.6fmsl-14.Ofmsl—(2.5"/24)]o.50 QprWd.d — 0.201 cfs Drawdown Time = 47,456cf / (0.201 cfs * 86,400sec/day) = 2.74days Since Q5day(0.110cfs) < Qp,o,id d(0.201cfs) < Q2day(0.275cfs), the 2-1/2" orifice will drain the temporary pool of the existing pond between 2 and 5 days. The actual drawdown of the temporary pool should be approximately 2.7 days. Please refer to the attached sketch for approximate dimensions and other detail notes concerning the existing stormwater riser at the 421 Business Park. Sincerely, cm, rvm]73 MAR 13 2007 Jeffrey B.
