Effective August 1, 2013 the State Stogywater program has been transferred from the Division of Water Quality
(DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to DWQ will
remainin older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that this
permit will now reference DEMLR as the Division responsible for issuance of the permit.
On March 23, 2021, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources
received and accepted a caste minor modification application for changes to the approved plans for
Stormwater Management Permit Number SW8 950401. It has been determined that thi nature of the proposed
change meets the definition of a minor modification in that it does not result in an incense in the size of the
permitted stormwater control measure (SCM) and does not increase the amount of built -upon area. Tease refer to
Attachment C for a moiled won of the current proposed minor modification and a list of all the past
modifications approved during the effective period of the permit We are forwarding you an approved copy of the
modified plans for your files. Phase add the ached plans to the previously approved plan. set. Please replace
the previously issued permit with the revised permit, dated August 31, 2021, attached. This: revised permit does
not impose new or different terms; it merely restates some of the previous terms to provide you with a better
understanding of your obligations under the permit.
Please be aware that all terms and conditions of the permit issued on May 31, 1995 and modified asattached,
shall remain in frill force and effect. Please also understand that the approval of this minor modification to the
subject State Stormwater Permit is done on a case -by -case basis.. Any other changes to this project must be
approved through this Office prior to cow. The approval of this minor modification does not preclude the
permittee from complying with all other applicable statutes, rules, regulations or ordinances which may have
jurisdiction over the proposed activity, and obtaining a permit or approval prior to construction.

construction, operation, and maintenance of one (1) wet detention pond in compliance with
the provisions of 15A NCAC 2H .1003, hereafter referred to as the "stormwater rules". and
the approved stormwater management plans and specifications and other supporting data as
attached and on file with and approved by the Division of Energy, Mineral & Land Resources
(hereafter referred to the Division or DEMLR) and considered a part of this permit.
This Certification is pursuant to the application for Codington Elementary School (formerly
South Central Elementary School) received on April 3, 1995, including all additional reviews
thereafter. Staff review of the project plans and specifications has determined that the
stormwater control system as proposed for Codington Elementary School will comply with the
Stormwater Regulations set forth in Title 15A NCAC 2H.1003(i). The runoff from 167,000
square feet of impervious area will be treated in a detention pond sized to achieve 90%
reduction in Total Suspended Solids.
Any modification of the plans submitted to and approved by this Office or further development
of this site regardless of the fact that the modification may be less than 1 acre, will require an
additional Stormwater Submittal/Modification and approval prior to initiation of construction.
Modifications include but are not limited to; project name changes, transfer of ownership,
redesign of built -upon surfaces, addition of built -upon surfaces, redesign or further
subdivision of the project area.
This Certification shall be effective from the date of issuance until rescinded. The project
shall be constructed and maintained in accordance with the plans and specifications
approved by the Wilmington Regional Office. This Certification does not supersede any other
permit or approval. The developer is responsible for obtaining any and all permits and
approvals necessary for the development of this project.

A professional engineer must certify that the stormwater system has been installed in
accordance with the approved plans and specifications upon completion of construction.
The attached certification must be received by this Office within 30 days of completion of
construction.
The detention pond must be constructed in its entirety, operational for its intended use, and
permanently vegetated prior to the construction of any impervious surfaces proposed as a
part of the project, except roads.

Attached is some additional information that the manufacturer supplied to the school. I believe this was also provided to

Before we completed the design for the playground, Christine reviewed the surface design and agreed that is was
pervious (refer to email below). Based on her comments the school system ordered the playground equipment so that
the project could be completed in time for the students to use when school resumes in August. Now you are telling us
that the surface is not approved. This presents a problem!
I will discuss with the school system and see how they would like to proceed.

Thank you for the additional information. As long as the subsurface was not compacted,
it can be considered a pervious surface. we'll just need a minor mod to the permit to

demonstrate the change in material and new site layout. Please include your description
below or a similar construction sequence that confirms the subsurface was not or will not
be compacted.

Based on discussions with the playground company, this surface installation was developed
to maintain permeability so the soils are not compacted. The process is as follows:
1. The play area is staked for removal of the root mat.
2. Root mat is removed and the border is installed.
3. Geogrid with integral filter fabric is installed over the soil.
4. Stone is placed over the Geogrid from outside of the plastic border to prevent
equipment from compacting the soil. Stones with a diameter greater than 1-inch are
typically removed to insure a smooth surface.
5. Loose fill rubber chips are placed over the stone and reinforcing welded wire mesh is
imbedded for stability. This layer typically has a 1-inch installed thickness.
6. The troweled on rubber wearing surface is placed over the loose rubber chips by hand.
This surface is composed of rubber chips with a binder.
7. Color is applied to the wearing surface per the individual design.

Since the engineered rubber surface for the playground does not meet one of the 5 standard
exemptions to built -upon area (BUA) called out in N.C.G.S.143-214.7(b2), you have the option
of demonstrating to us that the proposed surface allows an adequate level of stormwater
infiltration to be considered either pervious or partially pervious. The information the applicant
provides shall be based on engineering calculations and the results of research studies showing
that the proposed surface provides equal or better infiltration rates as the surrounding pervious
surfaces and that it shall function in perpetuity.
Typically, for grassed A and B type soils, the infiltration rate is at least 1 inch per hour. Can you
provide some data on typical infiltration rates of this type of surface?

RESILIENT PLAYGROUND SURFACING SYSTEMS
Permeability - Drainage Capacitv
Sport and recreational surfacing can be constructed with either non -permeable or permeable
characteristics. The permeability is altered by choice of materials and installation techniques that
are adaptable in the field.
Most Pour -in -place playground surfaces are permeable, allowing rain water to pass through it;
this helps to control runoff, to be self cleansing to a certain degree, and to allow the area to be
used immediately after a rainfall. Non -permeable surfaces are frequently chosen for water -play
areas or food service play courts, where the need for sanitation control by regular cleaning is very
high.
The most recognized test for permeability is ASTM F1551-03. This test is directed toward
synthetic turf products but is sometimes used to describe the characteristics of bound rubber
particles used for play surfaces. While synthetic turf is produced in quality controlled factory
conditions, poured -in -place rubber surfaces are field installed and are usually variable in surface
texture and porosity. The variables are granule size and sieve distribution, thickness and density
of the wearing surface, quantity and type of polyurethane binder used, and the cleanliness of the
surface.
The following protocol was set to determine the range of results of a typical playground pour -in -
place surfacing system using OTS BTRTm Q-Series polyurethane binders and EPDM rubber
granules of 1-3.5mm as a wearing surface over a base of SBR buffings.
Test Method: ASTM F1551-03: Standard Test for the Comprehensive Characterization of
Synthetic Turf Playing Surfaces and Materials. Reference also Din18035, Part 6.

Test Procedure: The Tube was sealed to an 18" x 18" specimen with silicone cement to assure
that the water would drain only through the cap. The water was filled into the tube faster than the
specimen could drain until the water level reached the Index point. The elapsed time was

measured in seconds from the time the water level reached the index point until it drained to the
specimen surface. The procedure was repeated four times, with the first time being the
conditioning pass and three times being timed. The test data values represent the drainage rates
for the system and do not consider the type of sub -base on which the surface might be laid (i.e.,
crushed stone, asphalt, concrete or similar.)

Comment: The theoretical rainfall capacity of a PIP surface will vary, depending upon the nature
of the rubber / PU matrix that creates the open voids through which the water will pass. In field
tests of aged surfaces, it is noted that the rainfall capacity of the surface will naturally decline if
the voids become filled with silt, sand or debris.
It was concluded that except in extremely unusual conditions and circumstances, a standard
industry PIP surface remained very permeable over time, though certainly not to the original
tested flow rates. Further, the rainfall capacity of any PIP surface is more related to the capability
of the sub -base to carry the surface discharge at a rate equal to the flow of water through the PIP
system. These observations are not necessarily based on recorded data, but a combination of
field tests and practical observation.

installation detail for the play surface with the modification and include the description. John Barr with Barr's Recreation
said he would install according to the outline presented below.

III. REQUIRED ITEMS
A request to transfer a permit will not be approved by the Division of Water Quality (DWQ) unless all
of the applicable required items listed below are included with the submittal. Failure to provide the
listed items may result in processing delays or denial of the transfer.
1. This completed and signed form. This certification must be completed and signed by both the
current permit holder and the new applicant if this is a change of ownership.
2. Legal documentation of the property transfer to a new owner.
3. A copy of any recorded deed restrictions, covenants, or easements, if required by the permit.
4. The designer's certification (DWQ Engineer and Designer Certification Forms are available from
each DWQ Regional office), if required by the permit and if not already submitted to DWQ.
5. If the proposed permittee is a firm, partnership, association, institution, corporation, limited liability
company, or other corporate entity, provide documentation showing the authority of the named
representative to act on behalf of the proposed permittee.
6. The $40.00 processing fee. If this is an initial transfer from the original permittee the processing
fee is not required. Subsequent ownership transfers will require the $40.00 processing fee.
