Effective August I, 2013 the State Stormwater program has been transferred from the Division of Water
Quality (DWQ) to the Division of Energy Mineral and Land Resources (DEMLR) All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified Please note that the attached transferred permit has been updated to reference DEMLR as the
Division responsible for issuance of the permit
On August 5, 2009 the Governor signed Session Law 2009-406 This law impacts any development
approval issued by the Division of Energy, Mineral and Land Resources under Article 21 of Chapter 143
of the General Statutes which is current and valid at any point between January 1, 2008 and December
31, 2010 The law extends the effective period of any stormwater permit that was set to expire during this
time frame up to three (3) years from its current expiration date On August 2 2010, the Governor signed
Session Law 2010-177 which granted an extra year for an extension of up to four (4) years
On July 23, 2007, the Division received a request from Saturn Development to transfer the permit
associated with Brewster Place Phase 1 under SW8 960704 to the Brewster Place Homeowners
Association, Inc That permit was eventually transferred to the HOA and renewed on July 6, 2009 It
appears that Mr Turner's intent was to also transfer the permit for Phase 2 under SW8 990732 however
that did not happen The Division is correcting that oversight by transferring the SW8 990732 permit to
the Brewster Place Homeowners Association, Inc T he facility had been inspected as part of the SW8
960704 permit transfer process in 2009, and the stormwater facility was found to be in compliance, the
deed restrictions have been recorded and the 2 wet detention ponds have been certified as being in
compliance with the permit
The Division is hereby notifying you that permit SW8 990732 has been transferred on June 7 2017 and to
remind you that this permit shall be effective from the date of issuance until November 12, 2017 The
Division recommends that the HOA consolidate this permit with the SW8 960704 permit and havejust
one permit ineffect for the subdivision The HOA will then only need to renew one permit rather than
two permits fhe renewal application was due to be submitted to this office by May 12, 2017 so please
submit an application request to consolidate the 2 permits and then renew the consolidated permit as soon
as possible If the permit is compliant at the time of submittal, and you wish to submit both actions at the
same time, you only need to submit one $505 00 fee If you submit these actions separately, or if the
permit is out of compliance at submittal time, then there is a fee for the modification to consolidate the
permits, and there Is a fee for the renewal For your records, please find enclosed a copy of the updated
SW8 990732 permit, a copy of the June 6, 2017 letter from Terry Turner, a copy of the July 2007 transfer
request, and a copy of the supplement and O&M document for each pond Please keep this cover letter
and updated permit on file at all times

this permit is subject to the conditions and limitations as specified in the updated permit Please pay
special attention to the conditions listed in this permit regarding the Operation and Maintenance of the
BMP(s) recordation of deed restrictions procedures for changes of ownership, transferring the permit,
and renewing the permit Failure to establish an adequate system for operation and maintenance of the
stormwater management system to record deed restrictions, to transfer the permit, or to renew the permit,
will result in future compliance problems
If any parts requirements or limitations contained in this permit are unacceptable, you have the right to
request an ad3udicatory hearing by filing a written petition with the Office of Administrative Hearings
(OAH) The written petition must conform to Chapter 150B of the North Carolina General Statutes, and

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of
North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction, operation and maintenance of two (2) wet detention ponds in compliance
with the provisions of 15A NCAC 2H 1000 (hereafter referred to as the "stormwater
rules') and the approved stormwater management plans and specifications and other
supporting data as attached and on file with and approved by the Division of Water
Energy, Mineral and Land Resources (hereafter, DEMLR or Division) and considered a
part of this permit
This permit shall be effective from the date of issuance until November 12, 2017, and
shall be subject to the following specified conditions and limitations
I DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data
This stormwater system has been approved for the management of stormwater
runoff as described in Section 17 of this permit The ponds labeled as Pond 1
and Pond 2 have been designed to handle the runoff from 338,782 sf and
240,780 sf of BUA, respectively
The subdivision is permitted for 107 lots, each allowed a maximum of 4,000
square feet of built -upon area
The plans approved on November 12, 2003 and the specifications for this project
are incorporated by reference and are enforceable parts of this permit
Pond 1 will utilize the existing wetland as a forebay Runoff within the drainage
area of Pond 1 must first be directed into the wetland prior to entering the pond
Both of the permitted ponds have been sized for 90% TSS removal, therefore, a
vegetated filter is not required

II SCHEDULE OF COMPLIANCE
1 The permlttee shall ensure that the stormwater management system Is
constructed (including vegetation) operated and maintained for its permitted use
2 The permlttee shall monitor the project on a routine basis to ensure that each lot
maintains compliance with the permitted BUA limits and grading
3 The permlttee shall review all proposed new and modified lot plans for
compliance with the BUA limits and the grading requirements The permlttee
shall not approve any new or modified lot plans that propose to exceed the
maximum BUA limit or to change the way runoff Is transported
4 The permlttee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, Including, but not limited to, those listed
below
a Any revision to the approved plans, regardless of size
b Changes to the maximum allowed BUA per lot
c Redesign of or addition to the approved amount of built -upon area
d Further subdivision, acquisition, or sale of the project area as reported onthe
application documents
e Filling In, altering, resizing, relocating, redirecting or removing any of the
runoff conveyances (vegetated or piped) shown on the approved plan
f The construction of any #57 stone area or permeable pavement areas for
BUA credit
g Other revisions as determined by the Director

5 The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made
6 Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation Any deviations from the
approved plans and specifications must be noted on the Certification The
required certification for Pond #1 was submitted to the Division on October 16,
2002 The required certification for Pond #2 was submitted to the Division on
April 24, 2006
7 Decorative spray fountains shall be allowed in the ponds shall be subject to the
following criteria
a The permanent pool volume is greater than 30 000 cubic feetia
b The fountain must draw its water from less than 2' below the permanent pool
surface
c Separated units, where the nozzle, pump and intake are connected by tubing,
may be used only if they draw water from the surface in the deepest part of
the pond
d The falling water from the fountain must be centered in the pond, away from
the shoreline
e The maximum horsepower for a fountain in these ponds is stipulated in
Section 17 of this permit
8 Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual
9 Prior to transfer of the permit, the pond must be inspected by Division staff, and
determined to be in compliance with all permit conditions and the requirements of
the stormwater rules Any items not in compliance must be repaired or replaced
to design condition prior to the transfer Records of maintenance activities
performed to date will be required
10 The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency The approved Operation and Maintenance Plan must be followed in its
entirety and maintenance must occur at the scheduled intervals including, but not
limited to
a Semiannual scheduled inspections (every 6 months)
b Sediment removal
c Mowing and revegetation of side slopes
d Immediate repair of eroded areas
e Maintenance of side slopes in accordance with approved plans and
specifications
f Debris removal and unclogging of outlet structure, orifice device and catch
basins and piping
q Access to the outlet structure must be available at all times

11 Records of maintenance activities must be kept and made available upon
request to authorized personnel of DEMLR The records will indicate the date,
activity, name of person performing the work and what actions were taken
12 A copy of the recorded deed restrictions has been submitted to the Division The
following required deed restriction statements below were recorded on February
11, 2003 in DB 3640 at PG 5623
a The maximum built -upon area per lot is 4,000 square feet This allotted
amount includes any built -upon area constructed within the lot property
boundaries, and that portion of the right-of-way between the front lot line and
the edge of the pavement Built upon area includes, but is not limited to
structures, asphalt, concrete gravel, brick, stone, slate coquina, driveways
and parking areas, but does not include raised, open wood decking, or the
water surface of swimming pools
b The covenants pertaining to stormwater regulations may not be changed or
deleted without concurrence of the State
c Alteration of the drainage as shown on the approved plan may not take place
without the concurrence of the State
d All runoff on the lot must drain into the permitted system This may be
accomplished through providing roof drain gutters which drain to the street,
grading the lot to drain toward the street, or grading perimeter swales and
directing them into the pond or street Lots that naturally drain into the system
are not required to provide these measures
13 The facilities shall be constructed, operated and maintained in accordance with
the conditions of this permit, the approved plans and specifications, and other
supporting data
14 A copy of the November 12, 2003 approved plans and specifications shall be
maintained on file by the Permittee
15 Built upon area includes, but is not limited to, structures, asphalt, concrete,
gravel, brick, stone, slate, coquina, driveways, and parking areas, but does not
include raised, open wood decking, the water surface of swimming pools, a
surface of #57 stone laid at least 4" thick over a geotextile fabric, or appropriately
designed permeable pavement areas
III GENERAL CONDITIONS
Any individual or entity found to be in noncompliance with the provisions of a
stormwater management permit or the requirements of the stormwater rules, is
subject to enforcement action as set forth in NCGS 143, Article 21
The issuance of this permit does not preclude the Permittee from complying with
all statutes, rules, regulations, or ordinances which may be imposed by other
government agencies (local, state, and federal) which have jurisdiction
3 If the facilities fail to perform satisfactorily the Permittee shall take immediate
corrective action, including those as may be required by this Division, such as the
construction of additional or replacement stormwater management systems Any
additional or replacement stormwater management measures shall receive a
permit from the Division prior to construction

This permit is not transferable to any person or entity except after notice to and
approval by the Director The permittee shall submit a completed and signed
Name/Ownership Change Form, accompanied by the supporting documentation
as listed on the form, to the Division of Energy Mineral and Land Resources at
least 60 days prior to any one or more of the following events
a An ownership change including the sale or conveyance of the project area in
whole or in part, except in the case of an individual lot sale that is made
subject to the recorded deed restrictions,
b The sale or conveyance of the common areas to a Homeowner's or Property
Owner's Association, subject to the requirements of Session Law 2011-256,
c Bankruptcy,
d Foreclosure, subject to the requirements of Session Law 2013-121,
e Dissolution of the partnership or corporate entity, subject to NCGS 57D-2-
01(e) and NCGS 57D-6-07,
f A name change of the current permittee
g A name change of the protect,
h A mailing address change of the permittee,
The permit may be modified, revoked and reissued or terminated for cause The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition
Permittee grants permission to staff of the DEMLR to access the property for the
purposes of inspecting the stormwater facilities during normal business hours
The permittee shall submit a renewal application and fee to the Division at least
180 days prior to the expiration date of this permit

As we discussed on the phone, Brewster Place Phase II is still in your name However my research of both the
Phase I and Phase II files revealed that a transfer application was sent in to this office with Just SW8 960704
listed on the application but all of the information and requirements to transfer both permits (960704 & 990732)
was included with the transfer application That information included PE Certifications for ponds under both
permits, Recorded Deeds showing the HOA owned the common areas, Recorded Covenants and amendments
for both phases that matched permit requirements, HOA signed O & M agreements and letters from you
showing maintenance had been completed per past inspections An inspector from this office, David Cox, also
had performed an inspection and found the entire site in compliance
So my question to you is, "Was it your intent to transfer both permits with this transfer application?" If this was
your intent then we can make a correction and send a letter to you and the HOA that both permits were
transferred in 2009 with your July 2007 transfer application request
If this was NOT your intent, then I will need anew transfer application submitted by you for SW8 990732 The

Per our phone conversation today
SW8 960704 was last renewed July 6, 2009 The last expiration date in our correspondence was
September 12, 2016 Since this permit was renewed and active when the governor gave 4 extra
years to all permittees this permit now expires September 12, 2020 This permit was the first
phase of construction for Brewster Place and has 2 ponds associated with this permit that must be
maintained
SW 990732 was modified on November 12, 2003 The expiration date in the modification
correspondence was November 12, 2013 Because this permit was active when the governor gave 4
extra years in 2010 Et 2011 this permit received 4 extra years and now expires November 12, 2017
This permit also has 2 ponds associated with it that must be maintained
Renewal Applications must be forwarded to our office 180 days prior to expiration
The website for the renewal application is http //deg nc gov/about/divisions/energy-mineral-
land-resources/energy-mineral-land-rules/stormwater-program/post-construction Scroll down to
the Renewal application SWU-102 This can be filled out by your company, but must be signed by
the permittee (HOA), unless the HOA (permittee of record) gives us a legal document saying that
you can sign for them A check for $505 00 must be sent with the permit renewal
application When filling out the renewal you will notice other questions that pertain to the
renewal The PE certifications for these permits have already been received and are in our files so
you do not have to send those
If you need information or copies of the pond drawings you can request a file review of the permit
file and schedule an appointment to make copies of our documents For a File Review appointment
call Cameron Weaver at 910-796-7303 Large Plan Drawings must be taken to Always graphics or
any print shop to make copies The permittee will have to pay for those copies
If the president of the HOA changes, or if you are their representative and are to receive future
correspondence for the HOA then the HOA must notify us I have attached an address change
document for the HOA and your convenience Please fill this out with reps and addresses where you
want future correspondence to be sent
