It, along with SW8-970625 North Bulkhead Lots, replaced SW8-960102 Harbor Village Phase I. The permit area encompasses the Keelson Row area to the east of the Bald Head Island Marina Bulkhead and over to Bald Head Creek, and also Windward Court, Leeward Court and Tanbark Court, to the east/northeast of the Bald Head Marina. The development had its beginnings, pre- 1988 Stormwater Division Existence, as CAMA Major Permit 191-86 as a then Low -Density Development. This permit pre -dates my involvement with on island permits. While still not totally built out for impervious, according to the late Ed Brooks of CAMA, one of the houses along Keelson Row/Windward Court added a crofter that busted the then CAMA Lot Density Limit. That led presumably to the 1996 SW8-960102 Permit, which sparked homeowner lawsuits because of the proposed wet detention pond location in the Bald Head Creek Marsh triangle between Windward Court & Leeward Court. This, I was told, had to do with views of the creek. SW8-971223 corrected that by locating the wet pond at its present location on what has been called at various times "The Tent Site" / "QM" or "Quartermaster Row" / 'Marina Park". The SW8-971223 Mod Wet Pond is one of only two Bald Head Island Limited LLC wet detention ponds on Bald Head Island. The permit is hybrid Low Density in that the rear/Creekside portions of the lots along Keelson Row, Leeward Court, Windward Court and Tanbark Court are considered Low Density, with no designated treatment. See included reduced sized drawing of SWI, seal date 10-16-07; stamp approval date 1 1-6-07 for both the graphical and tabular listing of amounts of built upon area allowed on each "HV Lot" (Harbor Village), as total impervious and also to the pond through Stormwater piping in the roads, and also "To Low Density". I do not appear to have pdf's of the 24"x36" wet detention pond/project details. I have previously certified the pond "As-Builts". I have tried to check on the NC DEQ DEMLR Stormwater Permit Site for this permit's renewal date. DAVIS DVeMr This correspondence is with reference to the request you submitted to modify State Permit No.191-86, which was originally issued to Bald Head Island Limited on September 24, 1986, for the development of the Harbour Village Area adjacent to the marina on Bald Head Island. This permit has been continually renewed and modified. The permit was last modified on January 12, 2018 for a new 22 linear ft. section of bulkhead behind lot HV 86. The most recent renewal was issued on December 13, 2017. State Permit No. 191-86 is due to expire on December 31. 2019. The action proposed in your submittal consists of the construction of 102 linear ft. of 6 ft. wide wooden slatted walkway along Keelson Row, landward of the existing bulkhead and within 30 ft. of Normal High Water (NHW) as shown on the attached plan dated received on March 6, 2018. The new walkway will connect to the previously permitted raised deck extension waterward of the sail shop and extend to the east via egress stairs approximately 80 ft. before turning to the south extending another 22 ft. to connect to an existing concrete sidewalk. The proposal also consists of a request for seasonal table and chairs landward of the new walkway. Please note that only free- standing removable drip through tables are authorized within 30 ft. of NHW. Upon review of the information provided, the Division of Coastal Management has determined that the proposed action continues to be consistent with existing State rules and regulations and is in keeping with the original purpose and intent of the permit. I hereby submit this Letter of Refinement authorizing the modification of State Permit #191-86, as described in your request dated March 5, 2018. By copy of this letter we are notifying the US Army Corps of Engineers and the Division of Water Resources of our action. We have been previously approved (shown in green) by LOR dated 2-15-16 to continue/extend the existing waterside raised deck over the concrete marina bulkhead cap. The intent is to have the parallel to the marina portion of the wood marina walk to be appx 3' landward of the landward side of the bulkhead cap, and the north edge of the perpendicular wood marina walk a minimum of 10' south of the A -Dock Electrical panels/kiosk structure. The perpendicular portion to flush into the existing Keelson Row sidewalk. The perpendicular portion to be slightly sloped, at no greater than handicap 1:12. To complete the existing marina corner look carried from along the barge landing, across MOJO's, and continuing along the marina side of the Will O' the Wisp, we request the west rail edge to include rail seat, either full length or intermittent. A picture of Will O' the Wisp is shown on my drawing. Construction to be preservative treated soufhem yeffow pine lumber (PTSYPJ, ground contact or better, with corrosion resistant fasteners. Rail wire to be type 304 stainless steel or better.' Pile/posts to be 44, 46 or 6x6 (nominal) with 4.5' embedment. Structure design to be similar to that of my Deep Point B Dock handicap ramp, B-C observation deck & C-Dock.stairs. I read through the file and the permit in greater detail and discovered that the developer did not want to try to put a deed restriction on the existing property. In the absence of a deed restriction, we (DEQ) agreed to accept a BUA limitation based on the "building envelope" which was set by the lot setback lines that were in effect in 1998. However, the permit does require the permittee to convey that the building envelope (based on 1998 setbacks) is the maximum BUA limit for the lot, prior to the sale of the lot. Based on the CAMA Major application for Loy HV29, it would appear that this requirement is being met. As I suspected, based on CAMA Major Permit #191- 86, this was pre-stormwater, thus no DWQ deed restrictions regarding stormwater. "I did some research into Limited's old files and the ROD with respect to stormwater covenants for HV29. The first plat for this lot was recorded 06/26/1987 (Map Cabinet R, Page 365). Covenants governing the lots depicted on the plat were recorded that same day (Book 697, Page 267). A replat of HV 29 and other lots was recorded 11/11/1987 (MC S, PG 142). The covenants applicable to the replat was recorded 02/26/1988 (BK 722, PG 952). Neither set of covenants mentions anything about stormwater, BUA, etc. Although deed restrictions were recorded, there apparently were no stormwater restrictions imposed on these lots, including HV29. The covenants currently applicable to HV were recorded 06/06/1994 (BK 985, PG 384). These amended and restated covenants supersede all prior covenants and restrictions, and are the only covenants (as further amended) governing the HV lots depicted on the various plats and replats, including R/365 and S/142 where HV29 is found. Article VIII, Section 10 of the current covenants sets forth maximum BUA for HV lots 40, 42, 44, 46, 48, 50, 52, 54, 56, 80, 81, 82, 84, 86, 88, 90, 92, 93, 94,96, 98, 100, 102, 104, 106, 107, 108, and 110. (HV29 is not one of them.) An amendment to the current covenants was recorded 07/19/1994 (BK 991, PG 1022) to provide that Article VIII, Section 10 cannot be amended, modified or rescinded without the approval of the State of NC, Division of Environmental Management. Thereafter, covenant amendments establishing BUA limits were recorded for the following HV lots: 41, 43, 45, 47, 49, 51, 53 and 55 (BK 1185, PG 928; 11/25/1997; supersedes 1169/1129); 198 (BK 1286, PG 192; 03/11/1999); Row Boat 'i Row lots (BK 1291, PG 1007; 04/01/1999; amended in 2000 at BK 1352, PG 298 and BK 1372, PG 273). HV29 was not included in any of the amendments I found. Hey Bruce — I received a copy of a CAMA Major application for Lot #HV29 which is located at 29 Tanbark Court on BHI. It's one of the lots covered by SW8 971223 and it was assigned a maximum of 1815 sf of BUA under that permit. In order to make my comments to DCM on these individual lot applications, I usually take the opportunity to check that the deed restrictions are recorded and a copy is in the file, and that the lot is not exceeding its BUA limit. My problem is that I am unable to locate a copy of the recorded document where the BUA limit for this lot is set forth. The original recording is in DB 1353 at PG 404, but it only covered three larger tracts of land. An amendment was required to be recorded as part of the November 2007 modification for SW8 971223. Sharon and Steven McCoy Page Two 9. PROJECT DESCRIPTION The applicant's property is located at 29 Tanbark Court, adjacent to Bald Head Creek on Bald Head Island, Brunswick County. Directions from Bald Head Marina: travel south on Marina Wynd Road to Keelson Row. Turn left onto Keelson Row and travel less than 1 mile to Tanbark Court. Turn right on Tanbark Court and the vacant .project site, which is between a residence and a vacant lot, will be on the left. The project site is adjacent to Bald Head Creek and is a single lot measuring approximately 50 feet in width by approximately 70 feet in depth. The elevation of the high ground area of the lot averages approximately 5 feet above normal high water (NHW). High ground vegetation consists of grasses and woody shrubs. The high ground of the project site is a vacant lot with an existing retaining wall that extends towards the high ground in a v-shape in the middle of the lot. A large expanse of Coastal Wetlands, consisting of Glasswort (Salicornia sp.) and Salt Meadow Grass (Spartina Patens) are present waterward of the existing retaining wall. Normal High Water is approximately 100 ft. to the east of the face of the existing retaining wall. The project site is bordered by Section 404 and Coastal Wetlands adjacent to Bald Head Creek to the north, a vacant lot to the east, Tanbark Court to the south and a private residence to the west. No known archaeological sites are within the project vicinity. The Bald Head Island Land Use Plan classifies the adjacent waters as Conservation, and the adjacent high ground portion of the project area as Residential. The waters of the Bald Head Creek are classified SA/HQW by the Division of Water Resources and are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are OPEN to the harvest of shellfish. F BIB ] A r1 a.1011 Xy 11 The applicant is proposing to construct a single family residence with a detached garage and to install approximately 50 linear feet of retaining wall resulting in the filling of Coastal and Section 404 Wetlands. The applicant is proposing a new single family home and is requesting a new straightened linear retaining wall in order to enlarge the building footprint for a private residence which will result in wetland fill. According to the applicant, approximately 233 square feet of Coastal Wetlands and Section 404 Wetlands will be impacted, consisting of 129 sq. ft. of Coastal Wetland fill and 106 Sq. Ft. of joint Coastal/Section 404 Wetland fill. The retaining wall backfill would impact Coastal Wetland species consisting primarily of Glasswort (Salicornia sp.) and Salt Meadow Grass (Spartina patens) and would be located approximately 120 ft. from Normal High Water (NHW). As proposed, the retaining wall alignment would be positioned 5 ft. waterward of the proposed total 3500 sq. ft. single family residence with detached garage (See sheets 4 and 5). The house structure is proposed with an approximate house footprint of 1496 sq. ft. and a garage footprint of 240 sq. ft. with a total of 1,815 sq. ft. of impervious surface that is outside of the 75 ft. Estuarine Shoreline Area of Environmental Concern (AEC). According to the applicant, a variance request to the Bald Head Island Harbour Architectural Review Boards to reduce the front setback to avoid wetland impacts was denied (see Narrative and Attachment A). The applicant further states that providing a 5 ft. buffer between the retaining wall and the house structure is recommended per guidance from a structural engineer (see Narrative and Attachment B). The applicant proposes mitigation for wetland impacts by purchasing 0.1 acres of riparian wetland credits from the Lower Cape Fear Umbrella Mitigation Bank (see Narrative and Attachment C). A letter of objection regarding wetland impacts was received from Mr. John and Ms. Lena Eldridge on July 14, 2016 (Attached). 11. ANTICIPATED IMPACTS The proposed new retaining wall with associated backfill and tie back/anchor system would result in the filling of approximately 233 square feet of Coastal Wetlands which consists of 106 sq. ft. of Joint Section 404/Coastal Wetlands. Coastal Wetlands impacted would include Glasswort (Salicornia sp.) and Salt Meadow Grass (Spartina Patens), located above NHW. The proposed retaining wall construction would be located approximately 5 ft. from the proposed 3500 sq. ft. residence with a total of 1,815 sq. ft. if impervious surface outside of the 75 ft. Submitted by: Tara MacPherson Date: August 12, 2016 Office: Wilmington a, Project Narrative Revised July 2016 29 Tanbark Court Harbour Village Bald Head Island, North Carolina Introduction The lot located at 29 Tanbark Court is part of the Harbour Village Planned Development District (PD- 1) of Bald Head Island. Planned Development 1 District is established as a district in which the principal use of the land is for dwellings. It is the intent that this district encourages the construction and continued use of the land for single family residential dwellings. This district is intended to continue the use of and enjoyment of the lighthouse, golf course, tennis courts, property owner's clubhouse and other leisure activities and their attendant uses. Furthermore, this district benefits by having all lots adjacent to common areas which are to be enjoyed by all property owners or limited common areas which are necessary to serve a few adjoining lots. Uses of this district preclude any commercial or trade activity except that associated with a golf course or private clubhouse; and limited activities attendant to an inn facility. It is the intent of this district to preserve and protect as much as possible the natural environment by minimizing lot coverage and maximizing common areas and open spaces (VBHI Zoning Ordinance, rev. October 21, 1995). Given the small lot size and the required setbacks and architectural controls guiding single-family house construction within this planned development district, the viable building footprint of Lot 29 is significantly constrained. H. Existing Conditions Lot dimensions are approximately 70-ft deep by 50-ft wide (total lot area = 3,494.9 sf per Walter B. Cavedo (PLS) on survey plat dated 3/16/16). The lot lies within the 100 year floodplain (Zone VE based upon FIRM dated 10/16/08). Under the preliminary DFIRM, the lot is within the FEMA- designated AE Zone (AE-9). The site is located adjacent to Bald Head Creek, a tributary of the Lower Cape Fear River (HUC 03030005). Both the Section 404 and the coastal wetlands were delineated by staff of Land Management Group, Inc. (LMG) on December 30, 2015. Mr. John Policarpo, Project RE EIV D Manager for the U.S. Army Corps of Engineers (USACE), provided a verbal il%{on Qf the ,_„ flagged 404 wetlands on March 11, 2016. The coastal wetland line was originally1reviewed and �,uu a r_tit 9 f. approved in the field by Mr. Stephen Boyett, the LAMA Local Permit Officer (LPO). However, the location of the coastal wetland line was later revised by Ms. Tara MacPherson with the NC Division of Coastal Management. The site plan figures have been revised to reflect this change. The mean high water line appears to be located approximately 120 feet to the east of the lot, adjacent to Bald Head Creek. Both freshwater and coastal wetlands are located along the lot's northern property boundary. Wetlands support sea oxeye (Borrichia frutescens), cordgrass (Sportina patens), and glasswort (Solicornia depressa). Uplands within the site support eastern red cedar (Juniperus virginiano), live oak (Quercus virginiona), yucca (Yucca gloriosa), and cat briar (Smilax bona-nox). Ill. Proposed Project The applicant proposes to construct a two-story, single-family home, small garage, and a retaining wall with the lot. The home will be constructed on pilings to meet FEMA flood zone requirements and will utilize a minimum piling size of 8" in diameter. The retaining wall will be positioned 5' from the house structure. Total area of disturbance within the lot will be approximately 2,600 square feet, and the overall impervious area will be 1,815 square feet. Water service and sewer service will be provided by the Village of Bald Head Island. Standard construction methods will be used during construction of the pilings and house. IV. Environmental Impacts The applicant proposes to fill a total of 2 sf of freshwater wetlands and 104 sf of joint 404/coastal wetlands, and 129 sf of coastal wetlands for the construction of a retaining wall and residence. V. Avoidance and Minimization The applicant has attempted to avoid and minimize wetland impacts as much as possible. However, the lot is small in size and there are few options to minimize impacts. The applicant attempted to obtain a variance from the BHI — Harbour Architectural Review Board to reduce the front setback from 15' to 8' - 9" and to connect the house directly to the garage in order to avoid wetland impacts, but this request was denied (Attachment A). Also note that the proposed retaining wall cannot safely be situated any closer to the proposed house than depicted in the site plan. Per guidance from a structural engineer (Attachment B), this distance is needed to ensure that iiherriYh�eVnew,retaining Lsgi tRLYI:iLI wall nor the new structure interferes with each other and so that the house loads are not transferred to the retaining wall. Installing the building pilings too close to the retaining wall can cause liquefaction of the soil under the wall, compromising its structure and increasing the chances of sinkholes and water runoff into the wetlands in the future. If pilings are installed too close to deadmen or the edge of the retaining wall, the bearing capacity of the pilings and/or retaining wall structure is reduced. Providing a 5' buffer between the face of the retaining wall and the face of the building improves the integrity of both structures. Additionally, this open area will naturally absorb runoff and carry water away from the retaining wall to the street, allowing runoff to be filtered before being discharged into the groundwater. VI. Mitigation The applicant proposes to mitigate for these impacts by purchasing 0.1 acre of riparian wetland credits from the Lower Cape Fear Umbrella Mitigation Bank (Attachment C). The LCFUMB includes tidal marsh as one of its habitat types. Therefore, the mitigation is in -kind. The current decking does not extend to the outer edge of the bulkhead. The new proposal consists of extending the drip through decking and new railings to the outer waterward edge of the existing bulkhead. The new deck extension will be 62 ft. in length and the entire project will result in approximately 500 sq. ft. of new decking in this location (see sheet C1 dated February 12, 2016). Upon review of the information provided the Division of Coastal Management has determined that the proposed action continues to be consistent with existing State rules and regulations and is in keeping with the original purpose and intent of the permit.
