Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000 and Session Law 2008-21 1, as applicable. We are forwarding modified Permit No. SW8 970233, dated March 2, 2016, for the construction, operation and maintenance of the BMP's and built -upon area associated with the subject project. This permit shall be effective from the date of issuance until April 6, 2020, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the conditions listed in this permit regarding the Operation and Maintenance of the BMP(s); recordation of deed restrictions, certification of the BMP's, procedures for changing ownership, transferring the permit, and renewing the permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system, to record deed restrictions, to certify the BMP's, to transfer the permit, or to renew the permit, will result in future compliance problems. The following modifications are included and covered by this permit: 1. The construction of additional built -upon area beyond the originally approved plans. The increase in the built -upon area and drainage area is subject to Session Law 2008-211. 2. The previously approved wet detention pond will be converted to a constructed wetland and a new wet detention pond will be constructed to treat the runoff from remaining property. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of this permit. This permit shall be effective from the date of issuance until April 6, 2020 and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS 1. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.8 and 1.9 of this permit. The runoff from all built -upon area within the permitted drainage areas of this project must be directed into the permitted stormwater control measures. The stormwater control measures labeled A and B have been designed to handle the runoff from 162,187 and 29,771 square feet of built -upon area, respectively. 3. The maximum built -upon area allowed for the entire project is 191,958 square feet. 4. The drainage areas will be limited to the amounts of built -upon area indicated in Sections 1.2, 1.8, and 1.9 of this permit, and per approved plans. This permit does not provide any allocation of built -upon area for future development. 5. Within the project area subject to Session Law 2008-211, a 50' wide vegetative buffer must be provided and maintained adjacent surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the top of bank of both sides of streams and rivers and the mean high water line of tidal waters. A vegetated filter strip is not required for the wet detention pond as it has been designed for a 90% total suspended solids removal efficiency. All runoff being directed into (natural) wetlands shall flow into and through those wetlands at a non -erosive velocity. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 3. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. If the stormwater system is used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 4. The permittee shall at all times provide the operation and maintenance necessary to assure that all components of the permitted stormwater system function at design condition. The approved Operation and Maintenance Agreement is incorporated by reference into this permit and must be followed in its entirety and maintenance must occur at the scheduled intervals. 5. Records of maintenance activities must be kept and made available upon request to authorized personnel of the Division. The records will indicate the date, activity, name of person performing the work and what actions were taken. 6. If the permanent pool volume is greater than 30,000 cubic feet, a decorative spray fountain will be allowed in the stormwater treatment system, subject to the following criteria: a. The fountain must draw its water from less than 2' below the permanent pool surface. b. Separated units, where the nozzle, pump and intake are connected by tubing, may be used only if they draw water from the surface in the deepest part of the pond. C. The falling water from the fountain must be centered in the pond, away from the shoreline. d. The maximum horsepower for a fountain in this pond is 1/6 horsepower. 7. The facilities shall be constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, the permittee shall cause a certification from an appropriate designer for the system installed to be submitted, certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. All stormwater collection and treatment systems must be located, in either public rights - of -way, dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such rights -of -way, common areas and easements, in accordance with the approved plans. Access to the stormwater facilities for inspection and maintenance shall be maintained via appropriate recorded easements at all times: 10. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Redesign or addition to the approved amount of built -upon area or to the drainage area. G. Further development, subdivision, acquisition, lease or sale of any, all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. d. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. e. The construction of any future BUA listed on the application. 11. Prior to transfer of the permit, the stormwater facilities will be inspected by Division personnel. The project and the stormwater facility must be in substantial compliance with all permit conditions. Any items not in substantial compliance must be repaired, replaced or restored to design condition prior to the transfer. Records of maintenance activities performed to date will be required. 12. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time.schedule to the Director for modifying . the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS Any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or the Stormwater rules is subject to enforcement procedures as set forth in G.S. 143 Article 21. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. In the event that the facilities fail to perform satisfactorily the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. Additional or replacement stormwater management systems shall receive a permit from the Division prior to construction. Page 4 of 8 State Stormwater Management Systems Permit No. SW8 970233 4. This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed Name/Ownership Change Form, accompanied by the supporting documentation as listed on the form, to the Division at least 60 days prior to any one or more of the following events: a. An ownership change including the sale or conveyance of the project area in whole or in part; b. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association, subject to the requirements of Session Law 2011-256; c. Bankruptcy; d. Foreclosure; e. Dissolution of the partnership or corporate entity; f. A name change of .the current permittee; g. A name change of the project; h. A mailing address change of the permittee; . 5. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. Neither the sale of the project, in whole or in part, nor the conveyance of common area to a third party constitutes an approved transfer of the stormwater permit. 6: The permittee grants DEMLR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 7. The permit issued shall continue in force and effect until modified, revoked, terminated or renewed. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and re -issuance or termination does not stay any permit condition. 8. Approved plans, calculations, supplement forms, operation and maintenance agreements and specifications for this project are incorporated by reference and are enforceable parts of the permit. A copy of the approved plans and specifications shall be maintained on file by the Permittee at all times. 9. Unless specified elsewhere, permanent seeding requirements for the stormwater control measure must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 10. The issuance of this permit does not prohibit the Director from reopening and . modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules and regulations contained in Session Law 2006-246, Title 15A NCAC 2H.1000, and NCGS 143-215.1 et.al. The permittee shall submit a permit renewal application request at least 180 days prior to the expiration date of this permit. If the receiving stream is reported as class SA or the receiving stream drains to class SA waters within 1/2 mile of the site boundary, include the 1/2 mile radius on the map. 7. The pond in the permit was never constructed as permitted by the former owners. The project was acquired by the new owners Ample Storage Lake Worth, LLC and during the permit transfer process the site was issued a notice of violation due to the pond never being installed. The new owners will be expanding the site to the west to construct buildings and drive aisles for more rentable storage space. This submittal is for a revision to the existing permit to change the existing pond to a wetlands basin and install anew wet basin to handle the site expansion. Land disturbance associated with the improvements will be approximately 5.0 acres. The ACOE has made a determination that no wetlands are present onsite. Stormwater from the site drains through a tributary into Saw Pit Swamp C; SW located in the Lumber River Basin (Index # 15-25-2- 2). The project will be high density and utilize two BMPS for treatment and management of runoff. Since the project was originally approved when the storm event for treatment was the 1" rainfall event the existing impervious located on the eastern portion of the site will be directed to a new wetlands creation designed for the 1" storm event. New impervious located on the western portion of the site will be directed to catch basins in the drive aisles that will convey the water to a wet basin designed for the 1.5" storm event and 90% TSS removal. Since the project is located in Brunswick County the site will also need to manage the I and 10 year storms. The site will be served by the Brunswick County Utilities for water and the sanitary sewer. The site has direct access onto HWY 904. This letter, with attachments, is the report of our estimation. Field Testing On October 15, 2015, ECS conducted an exploration of the subsurface soil and SHWT conditions at three requested locations shown on the attached Boring Location Plan (Figure 1). The purpose of this exploration was to estimate the SHWT of the in place soils for the design of for the proposed stormwater BMP areas. The borings were located using a site plan provided by Coastal Site Design, PC. ECS explored the subsurface soil conditions by advancing one hand auger boring into the existing ground surface at the requested boring locations. ECS visually classified the subsurface soils and obtained representative samples of each soil type encountered. ECS recorded the SHWT elevation observed at the time of each hand auger boring. The attached SHWT sheet provides a summary of the subsurface conditions encountered at each hand auger boring location. A geotechnical engineering study conducted for a civil engineer may not fulfill the needs of a construction contractor or even another civil engineer. Because each geotechnical engineering study is unique, each geo- technical engineering report is unique, prepared solelyfor the client. No one except you should rely on your geotechnical engineering report without first conferring with the geotechnical engineer who prepared it. And no one - not even you -should apply the report for any purpose or project except the one originally contemplated. Read the Fug Report Serious problems have occurred because those relying on a geotechnical engineering report did not read it all. Do not rely on an executive summary. Do not read selected elements only. A Geotechnical Eloneering Report Is Based on A Unique get of Project -Specific Factors Geotechnical engineers consider a number of unique, project -specific factors when establishing the scope of a study. Typical factors include: the client's goals, objectives, and risk management preferences; the general nature of the structure involved, its size, and configuration; the location of the structure on the site; and other planned or existing site improvements, such as access roads, parking lots, and underground utilities. Unless the geotechnical engi- neer who conducted the study specifically indicates otherwise, do not rely on a geotechnical engineering report that was: • not prepared for you, • not prepared for your project, • not prepared for the specific site explored, or • completed before important project changes were made. Typical changes that can erode the reliability of an existing geotechnical engineering report include those that affect: • the function of the proposed structure, as when its changed from a parking garage to an office building, or from alight industrial plant to a refrigerated warehouse, • elevation, configuration, location, orientation, or weight of the proposed structure, • composition of the design team, or • project ownership. As a general rule, always inform your geotechnical engineer of project changes - even minor ones - and request an assessment of their impact. Geotechnical engineers cannot accept responsibility or liability for problems that occur because their reports do not consider developments of which they were not informed. Subsurface Cond-Wiens Can Change A geotechnical engineering report is based on conditions that existed at the time the study was performed. Do not rely on a geotechnical engineering report whose adequacy may have been affected by: the passage of time; by man-made events, such as construction on or adjacent to the site; or by natu- ral events, such as floods, earthquakes, or groundwater fluctuations. Always contact the geotechnical engineer before applying the report to determine if it is still reliable. A minoramount of additional testing or analysis could prevent major problems. Most Geotechnical Fimf>ngs Are Professional Ophdons Site exploration identifies subsurface conditions only at those points where subsurface tests are conducted or samples are taken. Geotechnical engineers review field and laboratory data and then apply their professional judgment to render an opinion about subsurface conditions throughout the site. Actual subsurface conditions may differ -sometimes significantly from those indi- cated in your report. Retaining the geotechnical engineer who developed your report to provide construction observation is the most effective method of managing the risks associated with unanticipated conditions. Those recommendations are not final, because geotechnical engineers develop them principally from judgment and opinion. Geotechnical engineers can finalize their recommendations only by observing actual onsf?! The geotechnical engi- neer who developed your report cannot assume responsibility or liability for the report's recommendations if that engineer does not perform construction observation. A Geotechnhal Engineering Report Is SUMIA to Misinterpretation Other design team members' misinterpretation of geotechnical engineer- ing reports has resulted in costly problems. Lower that risk by having your geotechnical engineer confer with appropriate members of the design team after submitting the report. Also retain your geotechnical engineer to review pertinent elements of the design leant plans and specifications. Contractors can also misinterpret a geotechnical engineering report. Reduce that risk by having your geotechnical engineer participate in prehid and preconstruction conferences, and by providing construction observation. Do Not Redraw the Engineer's Logs Geotechnial engineers prepare final boring and testing logs based upon their interpretation of field logs and laboratory data. To prevent errors or omissions, the logs included in a geotechnical engineering report should never be redrawn for inclusion in architectural or other design drawings. Only photographic or electronic reproduction is acceptable, but recognize that separating logs from the report can elevate risk. Give Contractors a Complete Report and Guidance Some owners and design professionals mistakenly believe they can make contractors liable for unanticipated subsurface conditions by limiting what they provide for bid preparation. To help prevent costly problems, give con- tractors the complete geotechnical engineering report, but preface it with a clearly written letter of transmittal. In that letter, advise contractors that the report was not prepared for purposes of bid development and that the report's accuracy is limited; encourage them to confer with the geotechnical engineer who prepared the report (a modest fee may be required) and/or to conduct ad- ditional study to obtain the specific types of information they need or prefer. A prebid conference can also be valuable. Be sure contractors have sufficient time to perform additional study. Only then might you be in a position to give contractors the best information available to you, while requiring them to at least share some of the financial responsibilities stemming from unantici- pated conditions. Read Responsiffift Provisions Clos* Some clients, design professionals, and contractors do not recognize that geotechnical engineering is far less exact than other engineering disciplines. This lack of understanding has created unrealistic expectations that have led to disappointments, claims, and disputes. To help reduce the risk of such outcomes, geotechnical engineers commonly include a variety of explanatory provisions in their reports. Sometimes labeled "limitations" many of these provisions indicate where geotechnical engineers' responsibilities begin and end, to help others recognize their own responsibilities and risks. Read these provisions closely Ask questions. Your geotechnical engineer should respond fully and frankly. Geoenvironmelft Concerns Are Not Covered The equipment, techniques, and personnel used to perform a geoenviron- mental study differ significantly from those used to perform a geotechniral study. For that reason, a geotechnical engineering report does not usually re- late any geoenvironmenlal findings, conclusions, or recommendations; e.g., about the likelihood of encountering underground storage lanks or regulated contaminants. Unanticipated environmental problems have led to numerous project failures. If you have not yet obtained your own geoenvironmenlal in- formation, ask your geotechnical consultant for risk management guidance. Do not rely on an environmental report prepared for someone else. Obtaln Professional Assistance To Deal with Motel Diverse strategies can be applied during building design, construction, op- eration, and maintenance to prevent significant amounts of mold from grow- ing on indoor surfaces. To be effective, all such strategies should be devised for the express purpose of mold prevention, integrated into a comprehensive plan, and executed with diligent oversight by professional mold prevention consultant. Because just a small amount of water or moisture can lead to the development of severe mold inlestalions, a number of mold prevention strategies focus on keeping building surfaces dry. A preliminary in-depth review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 15A NCAC 02H.1003(g)(7): Provide technical information showing final numbers, calculations, assumptions, drawings and procedures associated with the stormwater management measures including: The supplement lists the calculated average depth as being 3.75 ft and is rounded up to 4 ft. However, the calculations list the average depth as being 3.73 ft, which would round down to 3.5 ft. Please confirm the average depth of the pond, the associated SA/DA ratio, and the resulting minimum required permanent pool surface area. ✓b. Please confirm the permanent pool volume provided in the wet detention basin. There appears to be an error in the calculations for the incremental volume to be provided at an elevation of 40 ft. C. Please confirm the depths and elevations listed on page 3 of the Operation and Maintenance Agreement for the wet detention pond. 2. 15A NCAC 02H.1008(h) and .1008(e)(2): The drawdown calculations for the constructed wetland appear to be based on the provided volume. Please provide additional documentation to 5 support that the minimum required storage volume will drawdown in 2 to 5 days using a 1" N, orifice. This site has an existing NCDENR SW permit (SW8 970233) which will be modified to add an additional wet pond and convert the permitted wetbasin into a bio-retention basin. The expansion will connect to the existing paved driveway and expanded the site to the West to add additional storage buildings and drive aisles. None of the proposed new buildings will require water or sewer service. The existing office building is served by Brunswick County for water and sewer service. Stormwater from the site will be treated in two stormwater BMPS. The rear of the site will utilize a wet basin designed for 90% TSS removal and the front of the site will utilize a bio-retention basin.
