Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 970233 dated April 6, 1998, for the construction of 904 Storage. This permit shall be effective from the date of issuance until April 6, 2008, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the sormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding. DESIGN STANDARDS This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described on page 3 of this permit, the Project Data Sheet. The stormwater control has been designed to handle the runoff from 121,347 square feet of impervious area. 3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 4. The following items will require a modification to the permit: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area. e. Further subdivision of the project area. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. In addition, the Director may determine that other revisions to the project should require a modification to the permit. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. II. SCHEDULE OF COMPLIANCE The permittee will comply with the following schedule for construction and maintenance of the stormwater management system: a. The stormwater management system shall be constructed in it's entirety, vegetated and operational for it's intended use prior to the construction of any built -upon surface except roads. b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. g. Access to the outlet structure must be available at all times. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. State Stormwater Management Systems Permit No. SW8 970233 Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 6. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 7. Prior to the sale of any portion of the.property, an access/maintenance easement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale of any portion of the property. M. GENERAL CONDITIONS This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Pernuttee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143- 215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. The permittee grants DENR Staff permission to enter the property for the purpose of inspecting all components of the permitted stormwater management facility. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. Permit issued this the 6th day of April, 1998. Inspect the trash rack; remove accumulated debris, repair/replace if it is not functioning. B. Inspect and clear the orifice of auy obstructions. If a pump is used as the drawdown mechanism, pump operation will be�checked. A log of test nuns of the pump will be kept on site and made available to DWQipersonnel upon request. C. Inspect the pond side slopes and grassed inlet swales; remove trash, ' and repair eroded areas before the next rainfall event. D. If the pond is operated with a vegetated filter, the filter will be checked for sediment accumulation, trash accumulation, erosion and proper operation of the flow spreader mechanism. Accumulated trash will be cleared from basin grates, basin bottoms, and piping will be checked for obstructions and cleared as required- B. Pond inlet pipes will be checked for: undercutting. Riprap or other energy dissipation structtaes will be replaced, and broken pipes will be repaired. semi-annually (twice a year): A. Accumulated sediment from the bottom of the outlet structure will be removed. The forebay depth will be checked at various points. Sediment removal is required when the depth is reduced to 75 % of the original forehay design depth of 4.5' Grassed swales, including the vegetated filter if applicable, will be reseeded twice a year as necessary. Sediment removal is required when the depth is reduced to 75% of the original design depth or 3% whichever is greater. Design depth is 6 '.' ', measured vertically from the orifice down to the pond's bottom. Sediment must be removed to at least the original design depth. V. General:. A. Mowing of the side slopes will be accomplished according to the season. Maximum grass height will be 6". B. Cattails ate encouraged along the pond perimeter, however they will be removed whew they cover mote than 1/2 the surface area ofthe pond. The best time to cut them is at the end of the growing season, in November. Environmentally sensitive chemicals for use in killing cattails can also be used. Contact your nearest Agricultural Pxtension Agent- C. The orifice/pump is designed to draw down the pond in 2-5 days. If drawdown is not accomplished in that time, the orifice will be replaced with a larger or smaller orifice. Slow drawdown may be attributed to a clogged system. The source of the clogging will be found and eliminated. D. All components of the detention pond system will be kept in good working order- Repair or replacemcm components will meet the original design specifications as per the approved stormwater plan. The developer is responsible for the control of sediment on -site. If the approved erosion measures prove insufficient, the developer must take those additional steps necessary to stop erosion from leaving this site. 2. Any and all existing ditches on this project site are assumed to be left undisturbed by the proposed development unless otherwise noted. The removal of vegetation within any existing ditch or channel is prohibited unless the ditch or channel is to be regraded with side slopes of 2 horizontal to 1 vertical or less steep. Bank slopes may be mowed, but stripping of vegetation is considered new earth work and is subject to the same erosion control requirements as new ditches. 3. The developer is responsible for obtaining any and all permits and approvals necessary for the development of this project prior to the commencement of this land disturbing activity. This could include the Division of Coastal Management under CAMA requirements, the Division of Water Quality under stormwater regulations, the U.S. 'Army Corps of Engineers under Article 404 jurisdiction, local County or Town Agencies under their local ordinances, or others that may be required. This approval cannot supersede any other permit or approval. However, in the case of a Cease and Desist Order from the Corps of Engineers, that Order would only apply to wetland areas. All highland would still have to be in compliance with the Sedimentation Pollution Control Act. 4. If any area on site falls under the jurisdiction of Section 404 of the Clean Water Act, the developer is responsible to the orders of the U.S. Army Corps of Engineers. Any erosion control measures that fall within jurisdictional wetland area must be relocated to the transition point between the wetlands and the highlands to assure that the migration of sediment will not occur. If that relocation presents a problem or contradicts any requirements of the Corps of Engineers, it is the responsibility of the developer to inform the Land Quality Section Regional Office so that an adequate contingency plan can be made to assure sufficient erosion control on site. Failure to do so will be considered a violation of this approval. 5. Any borrow material brought onto this site must be from a legally operated mine or other approved source. A single use borrow site or an area to waste material is only permissible if it is operated under total control of the Financially Responsible person or firm who is developing this site and a plan modification is submitted to this office that includes the area in question. 6. This permit allows for a land disturbance, as called for on the application plan, not to exceed 3.5 acres. Exceeding that acreage will be a violation of this permit and would require a revised plan. and additional application fee. The construction detail for the proposed silt fence requires reinforcing wire and posts a maximum of 8 feet apart. A graveled construction entrance must be located at east point of access and egress available to construction vehicles during the grading and construction phases of this project. It is understood that you are not counting the disturbed area on the adjacent unrelated project owned by J & B Associates (i.e. the septic system repair work). Enclosed is a copy of a site plan for the proposed improvements for this project that we have received from Mr. Johnson. As shown on this site plan, it is intended to leave an undisturbed area of 1,750 SF in the rear of the property. The disturbed area between the right-of-way of NC 904 and the existing edge of pavement is 750 SF. Therefore, the total disturbed area for this project will be 41,253 SF (0.947 Ac.). You are partially correct in your understanding of the N.C. Sedimentation Pollution Control Act in that a plan is required in those instances in which the land -disturbing activity comprises one acre or more in size. The size of the tract is not a relevant issue. If that were the case then any Brunswick County golf course could be platted up in hundreds of tracts of 0.97 acres each and developed without benefit of plan. In the case of Mr. Johnson's site, certain land disturbing activities are obviously taking place outside of the 0.97 acres that is shown on his site plan that was included in your. enclosures. For example, you show a highway entrance from N.C. Hwy 904 that is clearly part of this site's overall improvements. Likewise, there is a potential green area between the platted portion and the highway edge that has been graded and will be landscaped. In addition, that is an access gate to the adjacent areas that would imply that the adjoining property is part of an overall plan. Considering these areas outside of the 0.97 acres, it seems reasonably clear that the total active land disturbance has exceeded that one acre threshold. For that reason, we ask that Mr. Johnson take the required steps outlined in our February 24, 1997. Our records indicate that the letter was received at his Sunset Beach address on February 26, 1997; therefore, its twenty day response date will be March 18, 1997. We will expect plan application by that date or at the very least, indication that the plan will be finished in a reasonable number of days after that date. It is my understanding that an erosion and sedimentation control plan is required only in those instances in which the land -disturbing activity is on a tract comprising more than one acre. The tract in question is comprised of only 0.97 acres as evidenced by the enclosed copies of the warranty deed and site plan concerning the property. It did not, and does not, appear necessary to submit such plan for this project. Since Ms. Lewis visit, and on the same day, a silt fence was placed on the property. This property is owned by 904 Storage, Inc., a North Carolina corporation. It is easy to see why Ms. Lewis may have been under the impression that more than one acre was being disturbed. Simultaneous with the work being done by 904 Storage, Inc., J & B Associates a North Carolina General Partnership was preparing a new septic tank field for the property which it owns, immediately adjacent to the 904 Storage property. This activity is a culmination of almost 18 months of work in obtaining approval for the project, and had absolutely nothing to do with the project by 904 Storage, Inc. It was coincidental that these two projects were being constructed at the same time. Less than one acre was being disturbed by the project being completed by J & B Associates. Copies of a site plan showing the project and a copy of the deed showing ownership of the property in enclosed for your information. It would be greatly appreciated if, under the foregoing circumstances, you would lift your requirements that an erosion and sedimentation control plan be submitted to your office for approval, and that measures, structures and/or devices, other than those already in place, be devised to control erosion and retain sediment on site.
