Dear Mr. Gilmore
Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous
references to DWQ will remain in older stormwater permits issued prior to August I, 2013 until they are
modified. Please note that the updated permit or any updated pages to the permit will now reference
DEMLR as the Division responsible for issuance of the permit.
The Wilmington Regional Office received a complete, modified State Stormwater Management Permit
Application for the subject project on January 25, 2018. Staff review of the plans and specifications has
determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title
15A NCAC 2H.1000 effective January 1, 2017. We are forwarding modified Permit No. SW8 960605
dated January 31, 201 & for the construction, operation and maintenance of the Stormwater control
measures (SCMs), built -upon areas, as well as the stormwater collection system and/or vegetated
conveyance system associated with the subject project. Please replace the previously -permitted
subdivision map with the revised one.
This permit shall be effective from the date of issuance until November 3, 2020 and shall be subject to the
conditions and limitations as specified therein, and does not supersede any other agency permit that may
be required Please pay special attention to the permit conditions regarding the operation and
maintenance of the SCMs, stormwater collection system, and/or vegetated conveyances; the limitation of
built -upon area; modification of the project; the procedures for changing ownership of and/or transferring
the permit; and the need to renew the permit. Please also pay attention to the permit conditions that
requires the recordation of deed restrictions and protective covenants, easements, and the maintenance
agreement, which must all be provided along with certification upon completion of the project. Failure to
comply with these requirements will result in future compliance problems.
The following modifications are included and covered by this permit: The project has been re -
subdivided to create Lots 8R and 8A The impervious area summary, Attachment B, has been
updated to reflect the revised subdivision
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings
(OAR). The written petition must conform to Chapter 150B of the North Carolina General Statutes and
must be filed with the OAH within thirty (30) days of receipt of this permit. You should contact the OA}I
with all questions regarding the filing fee (if a filing fee is required) and/or the details of the filing process

North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

construction, operation and maintenance of 2 wet detention ponds in compliance with
the provisions of 15A NCAC 2H .1000, effective September 1, 1995 (hereafter referred
to as the "storm water rules') and the approved stormwater management plans and
specifications and other supporting data as attached and on file with and approved by
the Division of Energy, Mineral and Land Resources (DEMLR) and considered a part of
this permit.
This permit shall be effective from the date of issuance until November 3, 2020, and
shall be subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.6 on page 3 of this permit. The stormwater
controls labeled as Pond 1 and Pond 2 have been designed to handle the runoff
from 959,931 square and feet 988,703 square feet, respectively, of impervious
area.
3. The tract will be limited to the amount of built -upon area indicated in Attachment
B, and per approved plans. Each lot in the subdivision is limited to a maximum of
85% of its lot area as built -upon area
4. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
5. The runoff from all built -upon area within the permitted drainage area of this
project must be directed into the permitted stormwater control system.

The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface.
During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency. The approved Operation and Maintenance Plan must be followed in
its entirety and maintenance must occur at the scheduled intervals including, but
not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow
spreader, catch basins and piping.
a. Access to the outlet structure must be available at all times.
Records of maintenance activities must be kept and made available upon
request to authorized personnel of DEMLR. The records will indicate the date,
activity, name of person performing the work and what actions were taken.

Decorative spray fountains will be allowed in the stormwater treatment system,
subject to the following criteria.
a. The fountain must draw its water from less than 2' below the permanent
pool surface.
b. Separated units, where the nozzle, pump and intake are connected by
tubing, may be used only if they draw water from the surface in the
deepest part of the pond.
c. The falling water from the fountain must be centered in the pond, away
from the shoreline.
d. The maximum horsepower for a fountain in pond 1 is 1/4 horsepower and
pond 2 is 1/3 horsepower.
The facilities shall be constructed, operated and maintained in accordance with
the provisions of this permit, the approved plans and specifications, and the
supporting documents attached to this permit and on file with the Division.
Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation Any deviations from the
approved plans and specifications must be noted on the Certification. A
modification may be required for those deviations.
If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
9 Access to the stormwater facilities shall be maintained via appropriate
easements at all times.
10. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project
area. The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
11. The permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction.
12. A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction.

13. Prior to the sale of any lot, deed restrictions must be recorded which limit the
built -upon area per lot to the amount as shown on the Project Data Sheet, per
Section I, Part 2. The recorded statements must follow the form.
a. The maximum built -upon area per lot is 85% of the lot area. The allotted
BUA amount includes any built -upon area constructed within the lot
property boundaries, and that portion of the right-of-way between the front
lot line and the edge of the street pavement. Built upon area includes, but
is not limited to, structures, asphalt; concrete, gravel, brick, stone, slate,
coquina and parking areas, but does not include raised, open wood
decking, or the water surface of swimming pools
b. The covenants pertaining to stormwater may not be altered or rescinded
without the express written consent of the State of North Carolina,
DEMLR.
C. Alteration of the drainage as shown on the approved plans may not take
place without the concurrence of the DEMLR.
d. The State of North Carolina is made a beneficiary of these covenants to
the extent necessary to maintain compliance with the Stormwater
Management Permit.
e. These covenants are to run with the land and be binding on all persons
and parties claiming under them.
f. The connection into the pond must be made such that short-circuiting
does not occur.
g. All runoff on the lot must drain into one of the permitted systems
h. Each lot whose ownership is not retained by the permittee, is required to
submit a separate stormwater permit application to the DEMLR and
receive a permit prior to construction.
14 A copy of the recorded deed restrictions must be submitted to the Division within
30 days of the date of recording the plat, and prior to selling lots. The recorded
copy must bear the signature of the Permittee, the deed book number and page,
and stamp/signature of the Register of Deeds.
15. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
16. If the use of permeable pavement for BUA credit within the lot is desired, the
permittee shall direct the lot owner to submit an application with all supporting
documentation and the application fee to the Division and receive a permit prior
to construction of the permeable pavement.
III. GENERAL CONDITIONS
This permit is not transferable to any person or entity except after notice to and
approval by the Director The permittee shall submit a completed and signed
Name/Ownership Change Form, accompanied by the supporting documentation as
listed on the form, to the Division of Energy, Mineral and Land Resources at least
60 days prior to any one or more of the following events:
a. An ownership change including the sale or conveyance of the project area in
whole or in part, except in the case of an individual lot sale that is made
subject to the recorded deed restrictions;
b. The sale or conveyance of the common areas to a Homeowner's or Property
Owner's Association, subject to the requirements of Session Law 2011-256;
c. Bankruptcy;

d. Foreclosure, subject to the requirements of Session Law 2013-121;
e. Dissolution of the Partnership or corporate entity, subject to NCGS 57D-2-
01(e) and NCGS 57D-6-07;
f. A name change of the current permittee;
gg A name change of the project;
h. A mailing address change of the permittee;
2. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the DEMLR, in accordance with
North Carolina General Statute 143-215.6A to 143-215 6C.
3. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction
4. In the event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
5. The permittee grants DEQ Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
8 Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
9. The permittee shall notify the Division in writing of any name, ownership or
mailing address changes within 30 days.
10. Any individual or entity found to be in noncompliance with the provisions of this
stormwater management permit or the requirements of the Stormwater rules is
subject to enforcement procedures as set forth in NCGS 143 Article 21.
11 The permittee is responsible for compliance with all permit conditions until such
time as the Division approves the transfer request. Neither the sale of the
project, in whole or in part, nor the conveyance of common area to a third party
constitutes an approved transfer of the stormwater permit.
12. The permittee shall submit a permit renewal application request at least 180
days prior to the expiration date of this permit. The renewal request must include
the appropriate documentation and the processing fee.

Certification Requirements
1. The drainage area to the system contains approximately the permitted

In 2012, this Master Permit was modified. Somehow Lot 8 (Delaney) was accounted for as Lot 9
& the allocation of the Delaney lot was altered. This minor modification is correcting the Master Table.
Delaney is now again Lot 8. Lot SA is now owned by Holiday Inn Express & Suites. The Holiday Inn
Express & Suites lot is Lot 2A and drains to Pond #1. All lots remain (a)_ 85% impervious allotted as
originally approved.

Dear Gentlemen
On October 17, 2017 the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) received a State Stormwater permit application for Holiday Inn Express & Suites.
In support of that project's review, the DEMLR conducted a file review inspection of Lakeside Park
(SW8 969605) and Delaney Radiology (SW8 05041 1) on November 7, 2017, and requested minor
modifications to both projects to accommodate the Holiday Inn. The ponds for SW8 960605 were
inspected on November 20, 2017, and the SW8 960605 and SWS 050411 applications were received on
November 30, 2017. The following information is needed to complete the permitting process. Please
respond by December 21, 2017

i An inlet pipe that is not on the permitted plan has been added to Pond 1 behind
USCG.
The outlet structures do not appear to be functioning as designed and permitted
At the time of the inspection both ponds were full. Both ponds were designed
such that the 1.5ft of storage was provided between the permanent pool and the
bottom of the weir However, both ponds appear to not provide the required
storage. This problem was also noted during previous inspections If the orifices
are not clogged then the outlet structures are in other ways prohibiting the pond
from functioning properly to provide the required storage Please resolve this
issue

On October 17. 2017 the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) received a State Stonnwater permit application for Holiday Inn Express & Suites.
In support of that project's review, the DEMLR conducted a file review inspection of Lakeside Park
(SW8 969605) and Delaney Radiology (SW8 050411) which are located along Medical Center Drive in
New Hanover County Lakeside Park is the master permit covering the entire subdivision including two
stormwater ponds. Delaney Radiology is a tract inside the Lakeside Park subdivision. The land where
Holiday Inn & Suites will be constructed will be subdivided from the tract for Delaney Radiology.
Therefore, both the Delaney Radiology permit and the Lakeside Park permit must be modified to reflect
the configuration necessary to accommodate the Holiday Inn.
SW8 960605, Lakeside Park and SW8 050411, Delaney Radiology:
a. SW8 960605, Lakeside Park:
Permit Modification: Please apply for a minor modification.
Deed Restrictions' The original 1996 permit specified that the entire subdivision
would be allowed to be built to 85% impervious, and the associated deed
restriction was recorded on BK23091PG0548 in 1998. As the subdivision was
established, the exact impervious area per lot was established to clarify and
simplify the accounting. The impervious area per lot is quantified as Attachment
A of the permit, which was issued most recently on June 26, 2012. Please
update Attachment A and submit it with your application along with two sets of
plans reflecting the proposed lot configuration

b. SW8 050411: Delaney Radiology. There appears to be an error on the 2005 plan. It
shows that Lot 8 is split to drain partially to Pond 1 and partially to Pond 2 It establishes
Lot 8's impervious area based on 7.94ac (87,075sf+259,038sf=7 94ac) But the plan also
says that Lot 8 is 11.71 ac, which matches the project area on the 2005 application.
Please determine the appropriate project area (7 94ac or 11.71 ac), and submit a Minor
Modification permit application reflecting the revised lot configuration.

Here is a link to all of the stormwater application forms that we talked about, http://deg.nc.gov/about/divisions/energy-
mineral-land-resources/energy-mineral-land-permits/stormwater-permits/forms. You will need to apply for an offsite
permit for your development on Lot 2 to drain to Pond 2 of master permit SW8 960605 (Lakeside Park) which allocates
your lot 312,129sf of impervious (which is 85% of Lot 2's lot area). I have attached the master permit. Section 1(3)
shows the 85% requirement. Attachment A shows the exact data per lot. I also attached a photo of the vicinity of Pond
2 on the plans. If you want to come look through the file for the specifics for the design, just let me know. We try to
schedule those rather than having drop -ins because we only have one file review room for several agencies.
The application form, SWU-101, lists the paperwork submittal requirements permits in its Section VI. This is a list of
common things for all permits, but since you are an offsite permit you don't need all of those things. You can omit #2,
#6, and #9. The supplement that you will need (#3 on the application's list) is the offsite supplement which is on the
same website. That form will ask you to initial that some things have been completed for the master. It will ask you for
the PE Certification (attached), if the master permit has NOVs (it doesn't), if the master permit is in compliance (leave
that blank, we will have to do an inspection), and if the deed restrictions have been recorded (also leave that blank
because I need to go through the file to find them). The other thing to be aware of is that we will need original
signatures rather than copies for all applicable areas. Also, the person signing the forms has to have signature authority
to do so. That means that if it is an LLC, then the person signing has to be a manager of a manager -managed LLC, a
member of a member -managed LLC, or the VP or President of an Inc. The NC Secretary of State lists the appropriate
parties, https://www.sosnc.gov/corporations/. Look for "search by corporation".
