This law impacts any development approval issued by the Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which is current and valid at any point between January 1, 2008, and December 31, 2010. The law extends the effective period of any stormwater permit that was set to expire during this time frame up to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177, which granted an extra year for an extension of up to four (4) years. On May 29, 2012, the Division received a complete application to transfer the ownership of the permit. A file review and site inspection was performed on April 23, 2102 by DWQ and the site is currently in compliance with the terms and conditions of the current state stormwater permit. The Division is hereby notifying you that permit SW8 960605 has been transferred on June 11, 2012, and shall be effective until November 3, 2020, which includes the extensions. For your records, please find enclosed a copy of the updated page 2 of the previously issued permit, a copy of the inspection report, and a copy of the Name/Ownership Change form. Please attach this cover letter and updated page 2 to the permit originally issued on August 29, 1996 and as modified thereafter. This permit is subject to the conditions and limitations as specified in the previously issued permit. Please pay special attention to the conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), recordation of deed restrictions, procedures for changes of ownership, transferring the permit, and renewing the permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system, to record deed restrictions, to transfer the permit, or to renew the permit, will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of this permit. The stormwater controls labeled as Pond 1 and Pond 2 have been designed to handle the runoff from 959,931 square and feet 988,703 square feet, respectively, of impervious area. 3. The tract will be limited to the amount of built -upon area indicated in Section 1.6 on pa e 3 of this permit, and per approved plans. Each lot in the subdivision is limited to a maximum of 85% of its lot area as built -upon area. 4. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. 5. The runoff from all built -upon area within the permitted drainage area of this project must be directed into the permitted stormwater control system. Since that date, the enclosed request for information was mailed for that permit on May 11s,, and a response was received on May 14". During these discussions, it has been determined that Bojangles will buy 1.58ac of the 1.93ac land shown as Lot 16 on the most recent master plan approved December 13, 2010. The remaining 0.35ac portion (currently leased to the Salvation Army) will therefore become a stand-alone lot which I understand will be owned by Lakeside Estates, LLC (the master permittee, SW8 960605). A review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: Lakeside Park (SW8 960605): The current master plan shows Lot 16 in two pieces, a 1.58ac piece and a 0.35ac piece. A summary of the data on file is enclosed. a. Permit Modification: Please apply for a Permit Modification to document the necessary changes to the SW8 960605 permit. The application and instructions are available on our website, hHp://Podal.ncdenr.org/web/wo/ws/su/statesw/forms flocs. b. Master Table: Please verify the information in the enclosed master table, and submit any revisions with the modification application. This master table will be issued with your modification in order to more effectively track the impervious area permitted under this permit. Offsite Supplement: The maximum impervious area (85%) for the 1.58ac (68,825sf) is 58,501sf. I will revise the offsite supplement to show 58,501sf rather than the current value shown, 71,460sf unless you have objections. (71,460sf would have included the "Remainder" Lot's impervious.allocation.) ii. Application Summary Table (Section IV, 10 of the Application): The application lists data for the Salvation Army Parcel. I will cross through and initial that data since it will not be permitted under SW8 120413 since the "Remainder" lot will have a different owner unless you have objections. 3. Both: If any changes are made to either design, please make sure that each application reflects the change(s). Please note that this request for additional information is in response to a preliminary review. The requested information should be received in this Office prior to July 2, 2012, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. If you need additional time to submit the information, please mail, email or fax your request for a time extension to the Division at the address and fax number at the bottom of this letter. The request must indicate the date by which you expect to submit the required information. The Division is allowed 90 days from the receipt of a completed application to issue the permit. The construction of any impervious surfaces, other than a construction entrance under an approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement action pursuant to NCGS 143- 215.6A. A preliminary in-depth review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1) Project Area: County property records show that Lakeside Estates, LLC currently owns both of the pieces of Lot 16 (the undeveloped 1.58ac piece and the 0.35ac piece where the Salvation Army is located). The master plan for SW8 960605 shows both of these pieces as cumulatively being Lot 16. The plans for the new Bojangles permit (SW8120413) show a building on the 0.35ac portion that will remain intact: a) If Bojangles will buy all of Lot 16 (1.58ac + 0.35ac): If Bojangles' Restaurants is going to buy both pieces of land, please submit documentation of the pending sale such as the purchase agreement. If Bojangles buys all of Lot 16, but will lease the 0.35ac section to the Salvation Army (or another party), please identify who will be responsible for compliance with the stormwater permit per that lease agreement. i) If Bojangles will buy and then lease the 0.35ac portion and retain responsibility for controlling stormwater on the 0.35ac portion: Please submit a copy of the applicable portion of the lease agreement between Bojangles and the Salvation Army showing that Bojangles will hold this responsibility. ii) If Bojangles will buy and then lease the 0.35ac portion and transfer responsibility for controlling stormwater on the 0.35ac portion to the lessee: Please submit a copy of the applicable portion of the lease agreement showing that the lessee, the Salvation Army, will hold this responsibility. Since offsite permits must be issued to the responsible party, please obtain a separate permit for the 0.35ac section in the name of the lessee. b) If Bojangles will buy only 1.58ac: If Lakeside Estates, LLC will continue ownership of the 0.35ac piece or if it will sell the 0.35ac piece to a separate party, please revise the SW8120413 application to reflect that Bojangles will obtain a permit for the 1.58ac portion. Please also modify the master permit to split the 0.35ac portion to a separate lot because Bojangles will not have responsibility for compliance from that lot in this circumstance. 2) Plans: a) Pervious Concrete: Pervious concrete appears on the plans, but it does not appear that it is being used to comply with the State Stormwater permit because calculations for its design were not submitted. Please confirm that the impervious areas listed in the application package reflect the actual total impervious area as opposed the total impervious area that has been subject to a correction factor for receiving impervious credit for pervious concrete. b) Bearing & Distance Lines: If applicable, please update the bearing and distance lines per number one above. However within the P.O.A., Lakeside Owners Association Inc., Christian Lloyd serves as president and Brian Gilmore is the Vice President. My company, Creative Properties, is engaged by the P.O.A. to handle day- to-day finances and maintenances issues. So, I will remain the point person for any needed DENR contact about site issues.
