The following information is needed to continue the stormwater review: 1. Confirm that none of the existing site will drain to the new pond. 2. when was parking easement established and paved9 3 Provide details of the outlet ditch, the energy dissipator, and change the screening material for the orifice to hardware cloth. 4. The Operation and Maintenance agreement between Bob King and the City of Wilmington is sufficient to satisfy our requirements. Please send us a letter indicating that Bob King will abide by the requirements in the agreement, and have it signed and notarized. 5. INTRODUCTION: The project site is located along New Centre Drive, Wilmington, adjacent the existing Bob King Pontiac-GMC Auto Mall. The overall tract size is 2.00 acres of which 0 26 acres are contained within a parking lot easement for an adjoining tract The topography consists of relatively flat areas with the rear portion on a slightly higher plane than that of the front portion. Vegetation consists of grassed ground cover on the front portion with trees and thick underbrush throughout the rear portion of the site. 2. PROPOSED CONSTRUCTION: The proposed activity involves construction of the New and Used Car Recon Center toward the rear of the property as well as a future Sales Office located immediately adjacent New Centre Drive. Construction is to be completed in phases with Phase I construction consisting of installing the Recon Center improvements as well as the detention facility designed for the entire project area. At some undetermined future date, the front Sales Office is to be constructed. 3. DRAINAGE DESIGN The drainage features were designed to both City of Wilmington and the North Carolina Division of Environmental Management (DEM) drainage requirements. where both agencies had overlapping design criteria, the more stricter criteria was used for design Options for stormwater removal or retention included infiltration trenches, an infiltration pond and a detention pond. The first two options were deemed unlikely due to familiarity with existing organic soil material below the topsoil on tracts immediately across the street. Therefore, the detention pond option was pursued for final design. Drainage calculations were made using the Rational Method with a 10-year storm event. A time of concentration (Tc) of five (5) minutes was used due to the relatively short travel times over the paved areas. Using tables prepared by the City of Wilmington, the rainfall intensity for the Rational Method is 7.23 inches per hour Pipes draining into the pond as well as the pond overflow were sized according to this method. New and Used Car Pecon Center STATE OF NORTH CAROLINA COUNTY OF NEW HANOVER STORMWATER MANAGEMENT FACILITY INSPECTION AND MAINTENANCE AGREEMENT THIS AGREEMENT, made and entered into this IA-E, day of Se-ote nber 19g2, by and between Pob zan, Pontiac- GId:C, Inc. ("Permittee") and the City of Wilmington, a North Carolina municipal corporation ("City"). W I T N E S S E T H: WHEREAS, the City has adopted a Stormwater Management Ordinance applicable to the property of the permittee described in that deed recorded in Deed Book 29 at Page 76 of the New Hanover County Registry; and WHEREAS, such ordinance requires the permittee to obtain a stormwater discharge permit prior to the commencement of any development activities as described in the ordinance; and WHEREAS, the permittee has prepared plans for a private on -site stormwater management facility to satisfy the ieguirements of the ordinance; and WHEREAS, as a condition of the issuance of a stormwater discharge permit, the permittee is required to enter into a written inspection and maintenance agreement providing for the continued maintenance of the facility. NOW, THEREFORE, for and in consideration of the premises and the issuance by the City of a stormwater discharge permit for development activities on the above -described property, the permittee does hereby covenant and agree with the City that the above -described property shall be held, sold, and encumbered and conveyed subject to the covenants and conditions set forth herein. COVENANTS AND CONDITIONS 1. Inspection and Maintenance of Facilities. The permittee agrees to undertake and provide the following inspection and maintenance of the stormwater management facilities: a. Grassing around any detention/retention facility shall be maintained to prevent the erosion of these areas. The areas shall be periodically mowed to maintain the aesthetic quality of the site and to prevent a reduction in capacity of the stormwater system. Grass on slopes should not exceed a height of 15 inches. b. open ditches shall be kept free of undesirable growth and mowed or maintained to the design cross-section and area as shown on the Stormwater Management Plan approved by the City and on file in the office of the City Engineer Growth on the slopes and bottom should not exceed a height of 8 inches. C. Landscaping of the area around the detention/retention facility shall not reduce the capacity or hinder operation and maintenance of the stormwater system. d. The facility shall be routinely checked for and cleared of all accumulation of debris and the detentic../retention facility outlet structure cleared of any blockage that is present. e. Storm drainage pipes and culverts shall be periodically _nspectec for cenr_s a :c saac _he-, sna:: =e cleaned as necessary to provide for the free conveyance of stormwater as designed. f. The detention/retention facility shall be maintained at the design depth as shown on the Stormwater Management Plan approved by the City and on file in the office of the City Engineer. The pond shall be inspected on a regular basis but not less than every six months. Debris and sedimentation shall be removed if: 1. The primary outlet capacity is impaired and/or; 2. The depth of the facility is more than one foot above the original facility depth or facility volume is reduced by 25% of the design impoundment volume. g. Landscaping shall be maintained to ensure that landscape materials live and prosper. 2. Payment of Maintenance Expense. The permittee covenants and agrees to pay all costs of maintenance of the stormwater management facility as set forth in this agreement. 3. Right of Inspection by City. The permittee hereby grants to the City the right, privilege and easement over the property of the permittee as described above for the purpose of inspecting the stormwater management facility and for the purpose of correcting, repairing, replacing or maintaining the facility as provided in paragraph 4 herein. This right, privilege and easement is appurtenant to and runs with the land now owned by the permittee. 4. Remedies for Vic'ations of Covenants. (a) If the permittee shall fail to maintain or repair the stormwater management :3Ci__ 3s set f_rt_. :er=_i:, the =_c_ ma_- order the permittee to undertake the necessary repair or maintenance. If the permittee shall fail to comply with such order within thirty (30) days from the date thereof, the City may enter the property and perform all necessary work to place the facility in proper working condition. The full cost of performing the work shall be a lien on the property as provided by G.S. 160A-193. The owners of all property served by the facility shall be jointly and severally responsible to the City for the maintenance of the facility and liable for any costs incurred by the City pursuant to this paragraph. (b) The City shall have the right to bring an action and recover sums due, damages, injunctive relief, and/or such other and further relief as may be just and appropriate. (c) The remedies provided by this paragraph are cumulative, and are in addition to any other remedies provided by law. 5. No waiver of Breacn. In the event of a breach of any term of this agreement, any delay or failure on the part of the City to exercise any rights, powers or remedies herein provided, shall not be construed as a waiver thereof or acquiescence therein. 6. Amendments. This agreement may ne amended, revised or modified by the permittee only with the prior written approval of the City. 7. Binding Effect. The conditions and restrictions set forth herein shall run with the land and shall bind the permittee and its successors and assigns, and all parties claiming by, through, or under them shall ne taken to hold, agree, anc covenant with the City, with its successors and assigns, and with each of them to conform to and observe said conditions and restrictions. The City shall be deemed a beneficiary of the conditions and restrictions set forth herein and such conditions and restrictions shall run in favor of the City. S. Warranties of Title. The permittee covenants and warrants that it is lawfully seized and possessed of the property described above; and that it has good right and lawful authority to enter into this agreement for the purposes herein expressed. 9. Interpretation. Use of the masculine gender herein includes the feminine and neuter, and the singular number used herein shall equally include the plural. The captions preceding the various provisions of this agreement are for the convenience of reference only, and shall not be used as an aid in interpretation of construction of this agreement. 10. Severability. Invalidation of any one of these covenants or conditions by judgment or order of any court snall in no way affect any of the other provisions which shall remain in full force and effect.
