The Wilmington Regional Office received a complete State Stormwater Management Permit
Application for St James Fire Station on July 16, 2009 Staff review of the plans and
specifications has determined that the protect, as proposed, will comply with the Stormwater
Regulations set forth in Session Law 2006-246 and Title 15A NCAC 2H 1000 We are
forwarding Permit No SW8 080607 dated July 20, 2009, for the construction of the subject
protect
This permit shall be effective from the date of issuance until July 2, 2018, and shall be subject to
the conditions and limitations as specified therein Please pay special attention to the Operation
and Maintenance requirements in this permit Failure to establish an adequate system for
operation and maintenance of the stormwater management system will result in future
compliance problems
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adtudicatory hearing upon written request within sixty (60) days following
receipt of this permit This request must be in the form of a written petition, conforming to
Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative
Hearings, P O Drawer 27447, Raleigh, NC 27611-7447 Unless such demands are made this
permit shall be final and binding

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of
North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

construction, operation and maintenance of two infiltration basin(s) in compliance with
the provisions of Session Law 2006-246 and 15A NCAC 2H 1000 (hereafter referred to
as the "stormwater rules') and the approved stormwater management plans and
specifications and other supporting data as attached and on file with and approved by
the Division of Water Quality and considered a part of this permit
This permit shall be effective from the date of issuance until July 2, 2018, and shall be
subject to the following specified conditions and limitations
I DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data
2 This stormwater system has been approved for the management of stormwater
runoff as described in Section 18 on page 3 of this permit The stormwater
controls have been designed to handle the runoff from a total of 68,324 square
feet of impervious area Infiltration basins 1 and 2 have been designed to handle
14,208 and 54,116 square feet of impervious area, respectively
3 Infiltration basin 2 must be operated with a 30 foot vegetated filter
4 The tract will be limited to the amount of built -upon area indicated in Section 18
on page 3 of this permit, and as shown on the approved plans
5 All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans
The runoff from all built -upon area within the permitted drainage area of this
project must be directed into the permitted stormwater control system

7 The built -upon areas associated with this project shall be located at least 30 feet
landward of all perennial and intermittent surface waters
8 The following design criteria have been permitted for the infiltration basin and
must be provided and maintained at design condition

II SCHEDULE OF COMPLIANCE
The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface
During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately
The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency The approved Operation and Maintenance Plan must be followed in
its entirety and maintenance must occur at the scheduled intervals including, but
not limited to
a Semiannual scheduled inspections (every 6 months)
b Sediment removal
c Mowms and revegetation of slopes and the vegetated filter
d Immediate repair of eroded areas
e Maintenance of all slopes in accordance with approved plans and
specifications
f Debris removal and unclogging of bypass structure, infiltration media, flow
spreader, catch basins, piping and vegetated filter
g A clear access path to the bypass structure must be available at all times
4 Records of maintenance activities must be kept for each permitted BMP The
reports will indicate the date, activity, name of person performing the work and
what actions were taken

5 The permittee shall submit to the Division of Water Quality an annual summary
report of the maintenance and inspection records for each BMP The report
shall summarize the inspection dates, results of the inspections, and the
maintenance work performed at each inspection
6 The facilities shall be constructed as shown on the approved plans This permit
shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans and specifications, and other
supporting data
7 If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility
8 Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation Any deviations from the
approved plans and specifications must be noted on the Certification A
modification may be required for those deviations
9 Access to the stormwater facilities shall be maintained via appropriate
easements at all times
10 The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below
a Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc
b Project name change
c Transfer of ownership
d Redesign or addition to the approved amount of built -upon area or to the
drainage area
e Further subdivision, acquisition, lease or sale of all or part of the project
area The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Major permit was sought
f Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan
11 The permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction
12 A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction
13 The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made

III GENERAL CONDITIONS
This permit is not transferable to any person or entity except after notice to and
approval by the Director In the event of a change of ownership, or a name
change, the permittee must submit a completed Name/Ownership Change form
to the Division of Water Quality, signed by both parties, and accompanied by the
appropriate documentation as listed on page 2 of the form The approval of this
request will be considered on its merits and may or may not be approved
2 The permittee is responsible for compliance with all permit conditions until such
time as the Division approves the transfer request
3 Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215 6A to 143-215 6C
4 The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction
5 In the event that the facilities fad to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems
6 The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility
7 The permit issued shall continue in force and effect until revoked or terminated
The permit may be modified, revoked and reissued or terminated for cause The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition
8 Unless specified elsewhere, permanent seeding requirements for the stormwater
controls must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual
9 Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit
10 The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, or terminating the permit
as allowed by the laws, rules and regulations contained in Session Law 2006-
246, Title 15A NCAC 2H 1000, and NCGS 143-215 1 et al
11 The permittee shall notify the Division in writing of any name, ownership or
mailing address changes at least 30 days prior to making such changes
12 The permittee shall submit a permit renewal application at least 180 days prior to
the expiration date of this permit The renewal request must include the
appropriate documentation and the processing fee

The Wilmington Regional Office received a State Stormwater Management Permit Application for the
project located at 3628 St James Dr SE on June 4, 2009 The Division of Water Quality has conducted a
preliminary review of that information and determined that the application is not complete The
following information is needed to continue the stormwater review
1 Table of elevations The table of elevations for Basin #2 (which is shown on the page labeled
as the "infiltration Basin #2 Capacity" in the calculations contains a table of elevations for
24 75, 25 00, 26 00, and 27 00 fmsl Because the storage elevation is at 26 5 fmsl, please add
26 5 to the table and show the respective volume (7,185ft') and surface area (4,722ft2)
Please note that this request for additional information is in response to a preliminary review The
requested information should be received in this Office prior to August 13, 2009, or the application will
be returned as incomplete The return of a project will necessitate resubmittal of all required items,
including the application fee
If you need additional time to submit the information, please mail, email or fax your request for a time
extension to the Division at the address and fax number at the bottom of this letter The request must
indicate the date by which you expect to submit the required information The Division is allowed 90 days
from the receipt of a completed application to issue the permit
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation of NCGS 143-215 1 and is subject to enforcement
action pursuant to NCGS 143-215 6A

linfiltration area at the above site located off of Saint James Drive in Southport, North Carolina
This letter, with attachments, is the report of our evaluation
Field Testing I - I
On May 12, 2008 ECS met with Mr Jay Carmine with Coastal Land Design on site in order to
provide the requested additional test location ECS then conducted an exploration of the
subsurface soil and' ground water conditions at the requested location shown on the attached Site
Diagram The purpose of this exploration was to obtain subsurface information of the
suitability of the soils for the proposed infiltration area We explored the subsurface
soil conditions by advancing one hand auger bormg into the existing ground' surface at the
requested boring location. We visually classified the subsurface soils and obtained, r,
representative samples of each soil type encountered We also recorded the seasonal high
ground water level (SHWL) observed at the time of the hand auger bormg The attached
Infiltration Evaluation Form provides a summary of the subsurface conditions encountered at
each hand auger boring location i

Narrative
Brief Update
This project is being submitted for a modification at the duectton of Linda Lewis (NCDENR) There were
some modifications to the shape of the infiltration basins that had to be made in older to satisfy some
spatial and hydraulic concerns that were not present at the time of design due to an unknown survey error
that did not come to light until this project was under construction These modifications were shown in the
Designer's Certification for this project (SW8 080607) These noted changes, however, were determined to
be too signficant to allow the ceinfication to suffice without a submittal of the modified plans
applications, and calculations Please iefer to the Designer s Certification for this project on file with the
State when referencing this project At this point, all impervious has been constructed and the project is
complete — minus the necessary modifications to the shape of the infiltration basins that will result from
this submittal
A brief synopsis of the changes to the infiltration basins ai e shown below
1) Infiltration Basin #1 (ROW was actually 6 wider in the field)
a Length was truncated by approximately 6' (to 60' from 66')
b The depth of the basin was increased by P (to 26 0' from 27 0 )
c The foi ebay-main basin sepal ation will be changed to i ip-i ap from earthen matet ial
2) Infiltration Basin #2 (Hydraulic outlet was about 6" higher in the field)
a The bypass weir (temporary pool) elevation was raised by 6' (to 26 50' from 26 0')
b The level spreader lip elevation was raised by 6" (to 26 25' from 25 75')
c the vegetated filter outlet elevation was raised by 6" (to 25 75' from 25 25')
d A 6"xl8" flat channel was consn ucted at the `front' of the level spreader
e An 8" roof dram leader was outlets to the Swale (piped instead of sheet flow)
f The bottom of the basin will be i aised by 9 (to 24 75 fi oin 24 0 )
rhese aforementioned modifications, in conjunction with the previously approved permitting variances by
the State for this project, allow the infiltration basins to remain complaint with the State's design criteria
The original narrative has been included with this project to offer supplemental information for the design
approach that was originally taken and to give background information on the pre -sub rattal agreements
that were between the State and St James Fire Department, Inc for this project Only the infiltration basin
shapes have been modified None of the drainage basins, site design, or basin hydrology has been altered
and remains as previously permitted The only calculation procedural change was the use of the NOAA
Atlas-14 to determine the pre development and post influent discharges rather than the values listed in the
Brunswick County stormwater manual
Protect Overview
The St James Fire Station is located in St James Plantation in Southport, NC Please refer to the vicinity
map on plan set The St James Fire Station was built in the late 90's and because the ouginal tract of
development was less than one acre, it did not have to apply for NCDENR stormwater or erosion control
permits The fire station was not originally designed with any expectations of future expansion, however,
with the growth of the St James Plantation development, an expansion is now required to keep tip with the
potential demand from the development This stormwatei management plan is designed to treat the
proposed expansion as well as the existing impervious on site y
The emsnng file station is 7,108sf, the existing pai king lot is 12 294sf, and the portion of the private drive
on the property is 421sf The existing private drive and the parking lot underneath the proposed building -
will be iemoved with the expansion Tine expansion is for the addition of 4 080sf of budding and 31 723sf
of pm king lot The total amount of impel vious for this stot mwater project is 71,163sf and will be neated by
two (2) infiltration basins
Due to the maximum driveway slope and rate of vertical curvature limits for fire engines, a small portion of
each driveway is not feasible to be captured by the infiltration basins The portion of the untreated existing
driveway is 450sf and the untreated portion of the proposed driveway is 1,093sf Both will be collected by
the existing curb and gutter along St James Drive SE This was discussed at the pre -submittal meeting for
this project and was it was agreed that the small amount of impervious that cannot be caught, due to these
constraints, was acceptable There is also an existing sidewalk loop on the property that is not feasible to be
treated by conventional stormwater measures The untreated existing sidewalk impervious surface is
1,296sf and will be filtered by the existing 30' buffer along St James Drive SE Thus, the total amount of
untreated impervious from this site is 2,839sf (450sf of existing parking, 1,093sf of proposed parking, and
1,296sf of existing sidewalk) The rest of the impervious on the property will be treated by the infiltration
basins that are designed to not only meet NCDENR's stormwater requirements but to also allow the site to
meet Brunswick County's post -development discharge requirements
Site Descuption
The topography of the St James Fire Station expansion pioject is wooded and has an overall slope of
approximately 1 5% The property has a grade Meal, at approximately the north side of the existing
building and directs runoff to either flow north over the emsting driveway or south through the proposed
parking lot addition The entire property ultimately chains into the Beaverdanl Creek, a waterway classified
as SC, Sw, HQW The elevations on this project range from 25 feet MSL to 32 feet MSL and according to
the Soil Survey of Brunswick County, North Carolina, the underlying sods are Wanda fine sands This soil
is rapidly draining and has a sod hydrologic group of A The seasonal high water table and the infiltration
rate of the soils underneath the proposed infiltration basins were analyzed by ECS, Carolinas and
confirmed by Vincent Lewis of NCDENR Please refer to the soils reports shown included with this
stormwater management plan application As per the direction of NCDENR, an infiltration rate of 10 Om/hr
was used in the design of both infiltration basins rather than the higher rates as determined from the site
specific soil testing There are no wetlands on this property
Stormwater Treatment System
Infiltration basm-I is designed to treat the northern portion of the site and will treat 14,208sf of the existing
parking lot The exfiltration rate for this area is 24 31n/lir according to sod boring 95 as performed by the
soil investigation, however, an exfiltration rate of 10 Oin/hr was used in this design Stormwater will be
collected by a trench drain at the lowest feasible part of the existing driveway/parking lot The rim
elevation for the trench dram is 30 00fmsl which is also the elevation of the temporary pool Thus, excess
stormwater above the design storm event will flow across the trench dram rim, and will be bypassed from
the infiltration basin As per the pre -submittal meeting for this project, this infiltration basin is designed to
treat the first 3 0" of runoff, rather than the first 1 5', in lieu of a vegetated filter on the bypass because of
its spatial constraints and the fact that it is only treating stormwater from existing impervious Stormwater
will be pretreated by a small forebay connected to the infiltration basin Bypassed stormwater will be
discharged by sheet flow into the existing curb and gutter for St James Drive SE
Infiltration basin-2 is designed to treat the remainder of the existing impervious area and the proposed
impervious for the fii a station expansion (54,116st) The exfiltration rate for this area is 29 51n/hr according
to soil boring #4 as performed by the soil investigation, however, an exfiltration rate of 10 Om/hr was used
in this design Stormwater will be collected by a pretreatment swale that discharges stormwater into the
infiltration basin A weir is designed in the channel and set at an elevation of 26 50finsl to dnect
stormwater into the infiltration basin That elevation is also the elevation of the temporary pool Thus
excess stormwater above the design storm event will flow over the weir in the channel and will be
bypassed from the infiltration basin The bypassed stormwater will then be directed to an 82' long level
spreader which is designed to treat runoff from the 10 year storm event After then level spreader, runoff
ivll then be directed through a 30 vegetated filter Stormwater will then be ultimately discharged b) sheet
float into the existing curb and guttei for St James Drive SE

The Division received the Designer's Certification for the subject project on May 13,
2009 The certification notes a few deviations from the permitted condition
For Basin #1, the noted changes will require a permit modification Deepening
the basin by 1 foot to make up for a 6 foot reduction in the length of the basin
is the kind of change that requires a permit modification to be approved
BEFORE construction The permitted bottom elevation may already be as low
as it can go based on the SHWT elevation Luckily, there is enough room to
lower the bottom of Basin #1 by one foot, however, a permit modification,
revised calculations, revised plans and permit application fee are still required
to demonstrate that the required storage volume has been provided in the
modified basin
The items listed for Basin #2 do appear to provide more storage, however, if
there had been no changes to Basin #1, a plan revision would have been the
correct course of action to document these changes Since the changes to
Basin #1 require a modification, the changes to Basin #2 should just be
included with that mod
In the future, when there are deviations to the permitted elevations that result in
changes to the areas or volumes, an as -built survey should be included with the
Certification or Modification
