Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR) All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified Please note that any updated pages or addendums to the permit will now reference DEMLR as
the Division responsible for issuance of the permit
On August 5, 2009, the Governor signed Session Law 2009-406 This law impacts any development
approval issued by the Division of Energy, Mineral and Land Resources under Article 21 of Chapter 143
of the General Statutes, which is current and valid at any point between January 1, 2008, and December
31, 2010 The law extends the effective period of any stormwater permit that was set to expire during this
time frame up to three (3) years from its current expiration date On August 2, 2010, the Governor signed
Session Law 2010-177, which granted an extra year for an extension of up to four (4) years
On July 15, 2016, the Division of Energy, Mineral and Land Resources (DEMLR) received a complete
request to transfer the ownership of and to change the project name of the state stormwater management
permit for the subject project Photographs of the site provided by Pelican Point CB, LLC date stamped
June 27, 2016 indicate that the project has not yet started construction As indicated on the
Name/Ownership Change form, you have acknowledged receipt of a copy of the permit, which includes
the application and supplement forms By acknowledging receipt of the permit, and by signing the
Name/Ownership Transfer form, you have accepted the responsibility for complying with the terms and
conditions outlined in this permit The Division is hereby notifying you that the subject project has been
transferred and the project name for the subject permit has been changed on July 15, 2016 and to remind
you that this permit shall be effective until October 12, 2021, which includes the extensions For your
records, please find enclosed a copy of the updated page 2 of the previously issued permit and a copy of
the Name/Ownership Change form accepted on July 6, 2016 Please attach this cover letter and updated
page 2 to your permit originally issued on October 12, 2007 and as modified thereafter
As the identified developer of the project, Pelican Point CB, LLC, shall be the designated permit holder
and responsible for meeting the conditions and limitations specified therein Please be aware that it is the
responsibility of the permit holders, Pelican Point CB, LLC and HDI Holdings, LLC, to notify the
Division of any changes in responsibility for complying with the permit and request an ownership/name
change for the stormwater permit However, please be reminded that if the development agreement
between Pelican Point CB, LLC and HDI Holdings, LLC is dissolved, cancelled or defaults, and the
Division is not notified by Pelican Point CB, LLC to transfer the permit, then the responsibility for permit
compliance reverts back to the property owner, HDI Holdings, LLC The Division must be notified
immediately of any permit ownership changes and submit a completed Name/Ownership form to the
Division within 30 days Otherwise HDI Holdings, LLC will be operating a stormwater treatment facility

without a valid permit This is a violation of NC General Statue 143-215 1 and may result in appropriate
enforcement action including the assessment of civil penalties of up to $25 000 per day
This permit is subject to the conditions and limitations as specified in the previously issued
permit Please pay special attention to the conditions listed in this permit regarding the Operation and
Maintenance of the BMP(s), recordation of deed restrictions, procedures for changes of ownership,
transferring the permit, and renewing the permit Failure to establish an adequate system for operation
and maintenance of the stormwater management system, to record deed restrictions, to transfer the permit,
or to renew the permit, will result in future compliance problems

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of
North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

construction, operation and maintenance of a sand filter in compliance with the
provisions of 15A NCAC 2H 1000 (hereafter referred to as the "stormwater rules') and
the approved stormwater management plans and specifications and other supporting
data as attached and on file with and approved by the Division of Energy, Mineral and
Land Resources (hereafter referred to as the Division or DEMLR) and considered a part
of this permit
This permit shall be effective from the date of issuance until October 12, 2021, and shall
be subject to the following specified conditions and limitations
I DESIGN STANDARDS
1 This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data
2 This stormwater system has been approved for the management of stormwater
runoff as described in Section 16 on page 3 of this permit The stormwater
control has been designed to handle the runoff from 36,520 square feet of
impervious area
3 The tract will be limited to the amount of built -upon area indicated on page 3 of
this permit, and per approved plans
4 All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans
5 The runoff from all built -upon area within the permitted drainage area of this
project must be directed into the permitted stormwater control system

The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface
It is the responsibility of the permit holders, Pelican Point CB, LLC and HDI
Holdings, LLC, to notify the Division of any changes in responsibility for
complying with the permit and request an ownership/name change for the
stormwater permit However, please be reminded that if the development
agreement between Pelican Point CB, LLC and HDI Holdings, LLC is dissolved,
cancelled or defaults, and the Division is not notified by Pelican Point CB, LLC to
transfer the permit, then the responsibility for permit compliance reverts back to
the property owner, HDI Holdings, LLC The Division must be notified
immediately of any permit ownership changes and submit a completed
Name/Ownership form to the Division within 30 days Otherwise HDI Holdings,
LLC will be operating a stormwater treatment facility without a valid permit This
is a violation of NC General Statue 143-215 1 and may result in appropriate
enforcement action including the assessment of civil penalties of up to $25,000
per day During construction, erosion shall be kept to a minimum and any eroded
areas of the system will be repaired immediately

The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency The approved Operation and Maintenance Plan must be followed in its
entirety and maintenance must occur at the scheduled intervals including, but not
limited to
Semiannual scheduled inspections (every 6 months)
Sediment removal
Mowing and revegetation of slopes and the vegetated filter
Immediate repair of eroded areas
Maintenance of all slopes in accordance with approved plans and
specifications
Debris removal and unclogging of outlet structure, orifice device, flow
spreader, catch basins and piping
A clear access path to the bypass structure must be available at all times
4 Records of maintenance activities must be kept and made available upon
request to authorized personnel of the Division The records will indicate the
date, activity, name of person performing the work and what actions were taken
5 The facilities shall be constructed as shown on the approved plans This permit
shall become voidable unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specifications, and other
supporting data
6 If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility
7 Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation Any deviations from the
approved plans and specifications must be noted on the Certification A
modification may be required for those deviations
8 Access to the stormwater facilities shall be maintained via appropriate
easements at all times
9 The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below
a Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc
b Protect name change
c Transfer of ownership
d Redesign or addition to the approved amount of built -upon area or to the
drainage area
e Further subdivision, acquisition, lease or sale of all or part of the protect
area The protect area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Major permit was sought
d Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan

10 The permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction
11 A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction
12 The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made
III GENERAL CONDITIONS
This permit is not transferable to any person or entity except after notice to and
approval by the Director In the event of a change of ownership, or a name
change, the permittee must submit a completed Name/Ownership Change form
to the Division, signed by the parties involved, and accompanied by the
appropriate documentation as listed on page 2 of the form The approval of this
request will be considered on its merits and may or may not be approved
The permittee is responsible for compliance with all permit conditions until such
time as the Division approves the transfer request
Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division, in accordance with
North Carolina General Statute 143-215 6A to 143-215 6C
The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction
In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems
The permittee grants DEMLR Staff permission to enter the property during
normal business hours for the purpose of inspecting all components of the
permitted stormwater management facility
The permit may be modified, revoked and reissued or terminated for cause The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition
Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual
Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit

be obtained from the appropriate Regional Office of the Division of Water Quality
This completed form, including all supporting documents and processing fee (if required), should be
sent to the appropriate Regional Office of the North Carolina Department of Environment and Natural
Resources, Division of Water Quality, as shown on the attached map

Effective immediately, NC DENR will consider approving an infiltration system with less than a
24-inch separation from the seasonal high water table if additional investigation and evaluation
show that the water quality design volume will infiltrate and any resulting mounding of the
water table will subside within five days The minimum separation that may be provided under
any circumstances is 6 inches
In order to support these findings, please provide a hydrogeologic evaluation prepared by a
Licensed Geologist, Licensed Soil Scientist, or Professional Engineer This evaluation shall be
based on borings for which the numbers, locations, and depths are sufficient to define the
components of the hydrogeologic evaluation in addition to borings, other techniques may be
used to investigate the subsurface conditions at the site These techniques may include
geophysical well logs, surface geophysical surveys, and tracer studies This evaluation shall be
presented in a report that includes the following components
1 A description of the regional and local geology and hydrogeology,
2 A description, based on field observations of the site, of the site topographic setting,
streams, springs and other groundwater discharge features, drainage features, existing
and abandoned wells, rocky outcrops, and other features that may affect the
movement of the contaminant plume and treated wastewater,
3 Changes in lithology (rock type) underlying the site,
4 Estimated depth to confining layers,
5 The hydraulic conductivity and transmissivity of the affected aquifer(s),
6 Depth to the seasonal high water table,
7 A discussion of the relationship between the affected aquifers of the site to local and
regional geologic and hydrogeologic features,

8 A discussion of the groundwater flow regime of the site prior to operation of the
proposed facility and post operation of the proposed facility focusing on the
relationship of the system to groundwater receptors, groundwater discharge features,
and groundwater flow media, and
9 A mounding analysis under the proposed infiltration basin to predict the level of the
SHWT five days after the occurrence of the water quality design storm Any mounding
that occurs after the design storm must subside In a period of five days or less
The reasons for this recommendation are
1 A capillary fringe above the SHWT can reduce the depth of unsaturated sod zone to
less than two feet
Typically, a licensed soil scientist will observe redoxomorphic features of the soil as a
surrogate for the location of the seasonal high water table Often, this information
dictates whether a BMP will be designed to Infiltrate stormwater in an infiltration basin
or to retain it In a wet detention pond According to NC State wetland soil scientist Mike
Vepraskas, the capillary fringe often extends six Inches above the redoxomorphic
features In the soil (Note The capillary fringe Iles lust above the water table, where
water can be drawn upward by capillary forces ) In other words, If the SHWT is found 2
feet below the bottom of a proposed infiltration basin, the capillary fringe may reduce
the available unsaturated soil depth to 15 feet
2 Local water table mounding effects can prevent infiltration from occurring in time for
the next storm
The time for water to move through the unsaturated zone is governed by two
parameters (1) the thickness, and (2) the vertical hydraulic conductivity of the
unsaturated zone In the soil beneath an infiltration basin, the water table will
eventually rise under the unsaturated zone, which is caused not only by vertical
percolation of Infiltrating water, but also the lateral movement from the temporary
ground water mound caused by the basin Coastal aquifers often do not have a strong
gradient to flow laterally through the aquifer, resulting in a limited ability for a
groundwater mound to dissipate If there is not an adequate a gradient for a local,
temporary mound to dissipate into the surrounding water table, then an infiltration
basin above the mound may not draw down In less than five days even If the soil under
the infiltration basin is pure sand with a very high unsaturated hydraulic conductivity

difficult to apply in all situations Currently, the two -foot separation dictates site design
options for engineers and developers Compared to other states, North Carolina's
separation requirement is rather small —other states and localities require two to five feet
of separation Given the lack of precedent for a smaller separation across the board, it was
suggested by experts and engineers that the two foot distance be maintained
In cases where infiltration may still be achieved in the required time period with a shallower
water table depth than two feet, it is recommended that designers submit a thorough
demonstration of proof that their site will meet the functional goals of an infiltration basin

ECS Carolinas, LLP (ECS) recently conducted a seasonal high water table (SHWT) estimation
and infiltration testing within the stormwater best management practice (BMP) area(s) at 402
North Lake Park Boulevard in Carolina Beach, New Hanover County, North Carolina This
letter, with attachments, is the report of our testing
Field Testing
On March 18, 2016, ECS conducted an exploration of the subsurface soil and groundwater
conditions at two requested locations shown on the attached Boring Location Plan (Figure 1)
ECS located the borings by using a site plan provided by Honeycutt Engineering The purpose
of this exploration was to obtain subsurface information of the in situ soils for the stormwater
BMP area(s) ECS explored the subsurface soil and groundwater conditions by advancing one
hand auger boring into the existing ground surface at each of the requested boring locations
ECS visually classified the subsurface soils and obtained representative samples of each soil
type encountered ECS also recorded the SHWT and groundwater elevation observed at the
time of the hand auger borings The attached Infiltration Testing Form provides a summary of
the subsurface conditions encountered at the hand auger boring locations
The SHWT and groundwater elevation was estimated at the boring locations below the existing
grade elevation A summary of the findings areas follows

ECS has conducted two infiltration tests utilizing a compact constant head permeameter near
the hand auger borings in order to estimate the infiltration rate for the subsurface soils
Infiltration tests are typically conducted at two feet above the SHWT or in the most restrictive
soil horizon Tests in clayey conditions are conducted and calculated up to 30 minute intervals
If an exact hydraulic conductivity is necessary for these locations, then ECS recommends
collecting samples by advancing Shelby tubes and performing laboratory permeability testing

A Unique Set of PpoJect•Speclnc Factors
Geotechmcal engineers consider a number of unique, project -specific factors
when establishing the scope of a study Typical factors include the clients
goals, objectives, and risk management preferences, the general nature of the
structure involved, its size, and configuration, the location of the structure
on the site, and other planned or existing site improvements, such as access
roads, parking lots and underground utilities Unless the geotechnical engi
neer who conducted the study specifically indicates otherwise, do not rely on
a geotechnical engineering report that was
• not prepared for you,
• not prepared for your project,
• not prepared for the specific site explored, or
• completed before important project changes were made
Typical changes that can erode the reliability of an existing geotechnicaI
engineering report include those that affect
• the function of the proposed structure, as when its changed from a
parking garage to an office budding, or from alight industrial plant
to a refrigerated warehouse,
• elevation, configuration location, orientation, or weight of the
proposed structure,
• composition of the design team, or
• protect ownership
As a general rule, always inform your geotechnical engineer of protect
changes - even minor ones - and request an assessment of their impact
Geotechmcal engineers cannot accept responsrbdrty or liability for problems
that occur because their reports do not consider developments of which they
were not Informed
Subsurface Comfitlons Can Change
A geotechnical engineering report is based on conditions that existed at the
time the study was pedormed Do not rely on a geotechnical engineering
report whose adequacy may have been affected by the passage of time, by
man-made events, such as construction on or adjacent to the site, or by natu-
ral events, such as floods earthquakes, or groundwater fluctuations Always
contact the geotechnical engineer before applying the report to determine if it
is still reliable Aminor amount of additional testing or analysis could prevent
major problems

Site exploration identifies subsurface conditions only at those points where

Do not overrely on the construction recommendations included in your re -
pod Those recommendations are not final, because geotechnical engineers
develop them principally from judgment and opinion Geotechnical engineers
can finalize their recommendations only by observing actual
subsurface conditions revealed during construction The geotechncal engi-
neer who developed your report cannot assume responsibility or liability for
the report's recommendations if that engineer does not perform construction
observation
A GeoWulthml EnghtleerNg Report Is Subject to
Misinterpretation
Other design team members' misinterpretation of geotechncal engineer-
ing reports has resulted in costly problems Lower that risk by having your
geotechncal engineer confer with appropriate members of the design team
after submitting the report Also retain your geotechncal engineer to review
pertinent elements of the design tams plans and specifications Contractors
can also misinterpret a geotechncal engineering report Reduce that risk by
having your geotechncal engineer participate in prebid and preconstruction
conferences, and by providing construction observation
Do Not Redraw the Enghmw% logs
Geotechnical engineers prepare final boring and testing logs based upon
their interpretation of field logs and laboratory data To prevent errors or
omissions the logs included in a geotechncal engineering report should
never be redrawn for inclusion in architectural or other design drawings
Only photographic or electronic reproduction is acceptable, but recognize
that separating logs from the report can elevate risk
Give Contmtors a Complete Report and
Some owners and design professionals mistakenly believe they can make
contractors liable for unanticipated subsurface conditions by limiting what
they provide for bid preparation To help prevent costly problems, give con-
tractors the complete geotechmcal engineering report, but preface it with a
clearly written letter of transmittal In that letter, advise contractors that the
report was not prepared for purposes of bid development and that the report's
accuracy is limited, encourage them to confer with the geotechmcal engineer
who prepared the report (a modest fee may be required) and/or to conduct ad-
ddinnal study to obtain the specific types of information they need or prefer
A prebid conference can also be valuable Be sure contractors have sufficient
time to perform additional study Only then might you be in a position to give
contractors the best information available to you, while requiring them to at
least share some of the financial responsibilities stemming from unantici-
pated conditions
Read Responsibility Provisions Closely
Some clients, design professionals, and contractors do not recognize that
geotechmcal engineering is far less exact than other engineering disciplines
This lack of understanding has created unrealistic expectations that have led
to disappointments, claims, and disputes To help reduce the risk of such
outcomes, geotechncal engineers commonly includes variety of explanatory
provisions in their reports Sometimes labeled "limitations many of these
provisions indicate where geotechmcal engineers' responsibilities begin
and end, to help others recognize their own responsibilities and risks Read
these provisions closely Ask questions Your geotechmcal engineer should
respond fully and frankly
GeoenvironmeMal Concerns Are Not Covered
The equipment, techniques and personnel used to perform a geoenviron-
mental study differ significantly from those used to perform a geotechnical
study For that reason, a geotechncal engineering report does not usually re-
late any geoenvironmental findings, conclusions or recommendations, e g ,
about the likelihood of encountering underground storage tanks or regulated
contaminants Unanticipated environmental problems have led to numerous
project (allures If you have not yet obtained your own geoenvironmental in-
formation, ask your geotechncal consultant for risk management guidance
Do not rely on an environmental report prepared for someone else
Obtain Professional Atnu tance To Deal with Mold
Diverse strategies can be applied during budding design, construction, op-
eration, and maintenance to prevent significant amounts of mold from grow-
ing on indoor surfaces To be effective all such strategies should be devised
for the express purpose of mold prevention, integrated into a comprehensive
plan, and executed with diligent oversight by a professional mold prevention
consultant Because lust a small amount of water or moisture an lead to
the development of severe mold infestations, a number of mold prevention
strategies focus on keeping building surfaces dry While groundwater, wa-
ter infiltration and similar issues may have been addressed as part of the

ECS Carolinas, LLP (ECS) was requested to observe the seasonal high water table (SHWT)
and to perform infiltration testing at three locations within the stormwater best management
practice (BMP) area(s) at 402 North Lake Park Boulevard in Carolina Beach, New Hanover
County, North Carolina ECS was then requested to provide a Hydrogeologlc Evaluation of the
site in accordance to the North Carolina Department of Environmental Quality (NCDEQ)
standard for relaxing the 24-inch separation between infiltration systems and the SHWT This
letter, with attachments, is the report of our evaluation
Field Testing
On March 18, 2016, ECS conducted an exploration of the subsurface soil and groundwater
conditions at two requested locations, ECS returned to the site on June 30, 2016 to observe an
additional location These locations are shown on the attached Boring Location Plan (Figure 1)
ECS located the borings by using a site plan provided by Honeycutt Engineering The purpose
of this exploration was to obtain subsurface information of the in situ soils for the stormwater
BMP area(s) ECS explored the subsurface soil and groundwater conditions by advancing one
hand auger boring into the existing ground surface at each of the requested boring locations
ECS visually classified the subsurface soils and obtained representative samples of each soil
type encountered ECS also recorded the SHWT and groundwater elevation observed at the
time of the hand auger borings The attached Infiltration Testing Form provides a summary of
the subsurface conditions encountered at the hand auger boring locations
The SHWT and groundwater elevation was estimated at the boring locations below the existing
grade elevation A summary of the findings are as follows

ECS has conducted three infiltration tests utilizing a compact constant head permeameter near
the hand auger borings in order to estimate the infiltration rate for the subsurface soils
Infiltration tests are typically conducted at two feet above the SHWT or in the most restrictive
soil horizon Tests in clayey conditions are conducted and calculated up to 30 minute intervals
If an exact hydraulic conductivity is necessary for these locations, then ECS recommends
collecting samples by advancing Shelby tubes and performing laboratory permeability testing

Hydrogeologic Evaluation
There are required components listed in the NCDEQ standard for relaxing the 24-inch
separation between infiltration systems and the SHWT In order to evaluate the hydrogeologic
conditions of an area designated for a stormwater BMP, these components are evaluated

The site is located in the Coastal Plain Physiographic Province The Coastal Plain is
S�k^� composed of seven terraces, each representing a former level of the Atlantic Ocean
Soils in this area generally consist of sedimentary materials transported from the other
areas by the ocean and rivers These deposits vary in thickness from a thin veneer along
the western edge of the region to more than 2,000 feet near the coast The sedimentary
deposits of the Coastal Plain rest upon consolidated rocks similar to those underlying the
Piedmont and Mountain Physiographic Provinces
a • The site was observed to have a gradual elevation change decreasing to the east by
approximately three feet The site is bordered to the east by the Myrtle Grove Sound
No discharge or drainage features, abandoned wells, or rock outcrops were observed A
bulk head is constructed at the eastern portion of the site along the surface water
3�y • Based on regional geology and observations made in previous geotechnical borings
advanced by ECS, the site consists of surficial deposits of sandy sediment with clay
lenses up to 25 feet in depth The Pee Dee Formation consisting of greenish sandy to
clayey sand can be encountered beneath the surficial deposits The Castle Hayne
Limestone Formation then underlies the Pee Dee formation There can be up to 25 feet
before a confining layer is observed
S The hydraulic conductivity of the surficial sediment was tested and resulted in a range
from 12 5 to 16 6 inches per hour at the test locations
(o The SHWT was observed to range from 18 to 38 inches below the existing grade
elevation at the locations tested

7�g The surficial aquifer of the site consists of sandy conditions where groundwater flows
without confining conditions The site currently (pre -construction) consists of natural
pervious sediment which infiltrates rain events and migrates to the east toward the
Myrtle Grove Sound A proposed infiltration BMP system is to be constructed in order to
contain the runoff of the anticipated impervious areas
p A mounding analysis was generated utilizing the United States Geological Survey
/ (USGS) spread sheet solving the Hantush (1967) equation for groundwater mounding
beneath an infiltration basin The data used for calculating the mounding conditions was
collected from site specific field data, design data, and soil characteristics On the chart,
(R) represents a one inch storm event over a 12 hour period Specific yield (Sy) was
established by referencing the USGS Compilation of Specific Yield for Various Materials
by A I Johnson, 1963 Hydrauloic conductivity (K) was determined in the field and is
referenced in the text above Basin deminsions (X and Y) were provided by Honeycutt
Engineering (the site civil designer) Time (T) is the 5 day period set forth by NCDEQ for
an infiltration basin to function Thickness of saturadated zone HI(0) was derived by
subtracting the depth of the confining layer (approximately 25 feet) from the depth to
groundwater (4 feet) This calculation only uses the data represented at locations B-1
and B-2 The spreadsheet is included with the attachments

structure involved its size and configuration the location of the structure
on the site and other planned or existing site improvements such as access
loads parking lots and imrerground utilities Unless the geotechnical engi-

• not prepared .or your project
• not prepared or the specific site explored, or
• completer before important project changes were made
Typical changes that can erode the reliability of an existing geotechnical
engineering report include those that affect
• the function of the proposed structure as when its changed from a
parking garage to an office building or from alight industrial plant
to a refrigerated warehouse
• elevation configuration location orientation, or weight of the
proposed structure
• composition of the resign team or
• protect ownership
As a general rule always inform your geotechnical engineer of project
changes - even minor ones - and request an assessment of their impact

ECS Carolinas, LLP (ECS) recently conducted an additional seasonal high water table (SHWT)
estimation and infiltration testing within the stormwater best management practice (BMP)
area(s) at 402 North Lake Park Boulevard in Carolina Beach, New Hanover County, North
Carolina This letter, with attachments, is the report of our testing
Field Testing
On June 30, 2016, ECS conducted an exploration of the subsurface soil and groundwater
conditions at one requested location shown on the attached Boring Location Plan (Figure 1)
ECS was requested to conduct the testing at the survey stake labeled "44" on site The purpose
of this exploration was to obtain subsurface information of the in situ soils for the stormwater
BMP area(s) ECS explored the subsurface soil and groundwater conditions by advancing one
hand auger boring into the existing ground surface at the requested boring location ECS
visually classified the subsurface soils and obtained representative samples of each soil type
encountered ECS also recorded the SHWT and groundwater elevation observed at the time of
the hand auger boring The attached Infiltration Testing Form provides a summary of the
subsurface conditions encountered at the hand auger boring location
The SHWT and groundwater elevation was estimated at the bonng location below the existing
grade elevation A summary of the findings are as follows

ECS has conducted one infiltration test utilizing a compact constant head permeameter near the
hand auger boring in order to estimate the infiltration rate for the subsurface soils Infiltration
tests are typically conducted at two feet above the SHWT or in the most restrictive soil horizon
Tests in clayey conditions are conducted and calculated up to 30 minute intervals If an exact
hydraulic conductivity is necessary for these locations, then ECS recommends collecting
samples by advancing Shelby tubes and performing laboratory permeability testing

Hey Christine, as you know, I have been out of town with my Church Camp I received a rejection from
Secretary of State due to a name conflict I have resubmitted and should have the corrected documents
tomorrow? It will be Pelican Point CB, LLC instead of just Pelican Point, LLC
When I did the name search, it approved that name, but when the actual filling went in they discovered there
was a Pelican Point, INC and therefore, the law says that name is out of use until 9-2020 as it was
administratively dissolved in 2015 So, I have re -filed and will get you the Articles of Incorporation, etc over to
you the moment they come in Then all I should have to do is bring them to your office with the corrected
application page with that name on it Will that work for you?

Now I'm confused What program issued this "shell" permit by the Town? Are these pilings in the water or on
land? Assuming you are coming to the State for stormwater permitting, all stormwater approvals should be through the
State If you wish to have the Town approve the stormwater permit, my previous e-mails provided guidance on how to
go that route
Back to your question about permitting through the State
The transfer form was received by this office However, it was not logged in yet because that would have put it into the
regular program, which has a longer timeline for review We knew you were interested in going Express, so the transfer
request has been held aside for acceptance on the June 281h submittal date along with the modification (Permits can
only have one action at a time and logging the transfer into the regular program would have likely caused problems for
accepting the modification through Express )
Items necessary to process the transfer
• The ONLY reason we are allowing this transfer in Express is the fact that it has been stated that the site has not
yet been developed I didn't see attached with the transfer form a recent dated photo demonstrating that the
site remains undeveloped This is key for allowing the transfer to take place under the Express timeframes This
dated photo will need to be provided at the submittal meeting on June 28"
• Please ensure that all pertinent required items listed in Section III on page 2 of the transfer form have been
provided
Items necessary to process the modification
• The application form (SWU-101)
• Section VI of this application form lists the items that must be provided as part of the submittal package
• 15A NCAC 02H 1003 also covers items that are required as part of the submittal package (specifically,
subsections a and g)
• A $4,000 check for the Express high density fee
• The express stormwater program requires that BOTH the owner and engineer be present at the submittal
meeting This helps when discussing the project
All of these items will need to be provided at the submittal meeting on June 28t' At this meeting we will review the
package and ensure everything is complete If items are missing, the package will be returned and a new submittal date
will be needed If the package is complete, the project will be accepted and logged in At that point, I have 10 business
days for the first review After the first review, if additional information is needed, an e-mail will be sent requesting the
items and giving you 5 days to respond Once the information is received back in the office, I am to look at it within a
few business days The program allows for 2 rounds of requesting additional information with the goal is getting the
permit issued in 30 calendar days

The two options for permitting this site are
1 Permit through state stormwater Transfer the permit to the current responsible party then modify the
permit with the Division Since this site has not developed yet, both of these actions can happen at the
same time in Express Please note that the transfer is only being allowed in Express because the site was not
developed yet
2 Permit through Carolina Beach You can work with the permittee to have them request this original state
stormwater permit be rescinded This opens the door for allowing you to apply for a new permit with the
Town of Carolina Beach
You need to decide which path works best for you - permitting through the Carolina Beach or through the State
Stormwater permitting program under the original permit for this site This is a decision you need to coordinate with
your consultant to make now
The meeting scheduled on June 28"' is a submittal meeting where it is expected that everything necessary to submit a
modification to the state stormwater permit is brought to the meeting for review (including the transfer paperwork —
otherwise it will wait in line for review through the Regular program) This is the starting point for Option 1 above
The choice is yours Please let us know what you decide so we can adjust our schedule accordingly

wasn't sure where it should go9
What I really need your help with is next steps
I am on the list for June 28 at 10 00am, but I don t want to wait until then to choose my course of action - that
meeting is to approve my action, correct?
So the question is, how do I modify the existing permit and by doing so, does that mean that I will already have
an "approved" permit?
Last, since this is a State Stormwater Permit, albeit under the older rules, there is no longer any chance that we
would have a Carolina Beach permit instead, correct?

A few more tidbits of information The parcel appears to be empty, at least per NHC tax records
The property was owned by Tri-Coast Properties from 2005 - 2011 1 believe the reason we issued a
permit in 2007 may have been in anticipation of a sale to Marina East LLC, which must have fallen
through, because Tri-Coast sold the property to Park Sterling Bank in July 2011 It was purchased
from the Bank by HDI in 2013, who remains the current owner (Robert Huth, Manager) We've
already contacted Mr Huth to either take over the permit, or apply for a new permit through the Town
of Carolina Beach

NARRATIVE ON PELICAN POINT
402 N LAKE PARK BLVD
CAROLINA BEACH, NORTH CAROLINA
STORMWATER MANAGEMENT PLAN
The site located at 402 Lake Park Blvd is approximately 985 acres
(42,893 square feet) with 3942 square feet below the mean high water line
8429 square feet of the site are in the AEC The project will consist of a
four story building with 36 units on piles with associated parking The
project has a small swimming pool adjacent to the AEC
The site has one drainage basin Runoff from the roof will be routed
directly into infiltration trenches on each side of the building Runoff from
the remainder of the site will be routed via surface grading to catch basins
and then into a series of smart boxes The smart boxes then direct the
water into a network of infiltration trenches All trenches are interconnected
and are separated from the seasonal high water table by 24 inches
Infiltration rates vary on the site from 16 6 to 18 5 inches per hour
Overflow from one smart box drains to the next smart box and then into the
infiltration system
The stormwater system has been designed to infiltrate the first 1-1/2" of
runoff from impervious surfaces The system has also been designed to
pass the 10 year and 50 year storms with a non -erosive velocity
The site contains coastal wetlands of which about 100 square feet will be
affected by the pipe discharging from the site A major CAMA permit for
the site has been approved with conditions

Thanks for the phone call and e-mail I confirmed that the Town of Carolina Beach has been delegated the authority to
issue stormwater permits That being said, I dug into this a bit further and found a state stormwater permit that may
have already been issued for this site The address listed on your CAMA application is 402 N Lake Park Blvd I found
that the permit for Marina East, SW8 070817, lists the addresses covered under that permit as 400, 400-A, and 402 N
Lake Park Blvd In trying to compare the plans between these two sites, the site areas do look very similar but I can't be
sure if the entire project area approved under SW8 070817 is the property you are interested in or not
Since this site may or may not already have an existing state stormwater permit, you might need to do a bit more
digging to figure out what the next step is Our files are considered public record and available for review, I would
suggest you or your designer conduct a file review to take a look at this one to see how it impacts your site If this site
truly is already permitted under SW8 070817, the options include
Transfer the permit to the current responsible party then modify the permit with the Division This may
or may not vest the site to an older set of rules (please refer to 15A NCAC 02H 1005(h)) Also, permits
that need to be transferred cannot be processed in Express unless it is demonstrate through recent,
dated photos that the site remains undeveloped
If the site and impervious area has not yet been constructed, you can also work with the permittee to
have them request this original permit be rescinded This opens the door for allowing you to apply for a
new permit This new permit would likely be issued by the Town of Carolina Beach
There are likely other scenarios that could be available and will ultimately depend on if this site is truly already
permitted by the State If you do end up coming to the state for permitting, the Name/Ownership Change form to
transfer the permit and the application form to modify the permit are available on the following website

Also, I don't believe I actually answered your question about starting site work As long as there is no impervious area
constructed, other improvements can be made to the site

I) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application No other structure,
whether floating or stationary, shall become a permanent part of this docking facility without permit
modification No non -water dependent uses of structures shall be conducted on, in or over Public
Crust wateis without permit modification
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility Any sewage discharge at the docking tacihty shall be considered a violation of this
permit for which the permittee is responsible This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date

3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit The permittee is not relieved of this requirement if he abandons the
permittedlactrvity without having it transferred to a third party
4) The permittee shall installiand maintain at his expense any signal lights or signals prescribed by the U S
Coast Guard, through regulation or otherwise, on the authorized facilities At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather
5) This permit authorizes only transient boat slips
6) Any portion of the permitted access pier and docking facilities built over coastal wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as
measured from the bottom of the decking
7) The authorized structures and associated activity shall not exceed the established Carolina Beach pier head
line and federal channel setback
8) Should either adjacent property be sold prior to the initiation of construction of the docking facility, the
permittee shall be required to obtain a signed riparian corridor waiver from the new property owner prior
to the placement of any structures within the 15 foot riparian corridor
9) The authorized covered platform/gazebo shall not be enclosed Any material used on the sides shall not
obstruct view and shall be permeable to air and water Screen or wire on the sides along with benches and
knee walls are permitted Lattice is specifically excluded from being used under this authorization
10) The roof of the covered platform/gazebo shall not be designed for second story use
11) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work
12) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation
U S Army Corps of Engineers Conditions
25) The permittee understands and agrees that, if future operations by the United States requires the removal,
relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the
Secretary of the Army or his authorized representative, said stiucture or work shall cause unreasonable
obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice
from the Corps of Engineers, to remove relocate or alter the structural work or obstructions caused thereby,
without expense to the United States or the state of North Carolina No claim shall be made against the
United States or the state of North Carolina on account of any such removal or alteration

26) In order to further protect the endangered West Indian Manatee, Tnchechus manatus, the applicant must
implement the U S Fish & Wildlife Service's Manatee Guidelines, and strictly adhere to all
requirements within The guidelines can be found at

Bulkhead
13) The alignment of the authorized bulkhead/riprap shall be staked by a representative of the Division of
Coastal Management within a maximum of 30 days prior to the start of construction Failure to initiate
construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the
alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of
construction
14) The bulkhead shall be constructed prior to any backfillmg activities
15) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure
16) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel No excavation is permitted except for that which
may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc
17) The fill material shall be clean and free of any pollutants except in trace quantities
18) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead
19) No backfill material is to be placed within 30 feet of the normal high water line, except that which will be
used to backfill the area behind the permitted bulkhead
20) All fill material to be placed below normal water high level shall be confined behind the permitted
bulkhead
Excavation
21) In order to protect juvenile shrimp and finfish populations, no excavation or filling shall be permitted
between April 1 and September 30 of any year without the prior approval of the Division of Coastal
Management, in consultation with the appropriate resource agencies
22) Excavation shall not exceed -5' feet below the mean low water In no case shall the depth of excavation
exceed the depth of connecting waters

triggered a review for the applicability of the stormwater rules under one of the following

3 The project requires approval of a Sediment and Erosion Control Plan, or,
4 The project requires a CAMA Major Permit.
The North Carolina Administrative Code requires any project that proposes more than 10,000 square feet of new
built -upon area, or is part of a larger common plan of development, or that must receive Sedimentation and Erosion
Control Plan approval for the disturbance of more than 1 acre, or that must receive a CAMA Major permit, to apply for
and receive a Stormwater Management Permit from the Division of Energy, Mineral and Land Resources Please
understand that the NPDES 010000 Federal Construction Stormwater Permit that is issued with the Erosion Control
Plan approval letter is NOT the same as a Coastal Stormwater Management Permit Any construction on the subject

The project is located at 402 N Lake Park Blvd , adjacent to the Carolina Beach Yacht Basin/Myrtle Grove Sound, in the Town
of Carolina Beach, New Hanover Co To locate the project site from the Wilmington Regional Office (WiRO), travel from
Wilmington to Carolina Beach south on College Road (NC Hwy 421) for approximately 12 miles south Continue over Snows
Cut Bridge on N Lake Park Blvd for approximately 12 miles south until you reach the comer of Saint Joseph's Street and N
Lake Park Blvd Turn left onto Saint Joseph's Street and the project site will be immediately on the nght, just before Lees Lane
The applicant currently maintains the approximately 0 98 acre tract, which is currently undeveloped with elevations ranging from
3' to 10' above normal high water (NHW) The project site is bordered by unimproved Lees Lane and Inland Harbour
condominiums to the north The project site is also bordered by a residential property to the south A failed timber bulkhead
and small concrete rubble exists along the approximately 145' of angled shoreline along the Carolina Beach Yacht Basin It
appears that failure to maintain the bulkhead has allowed upland vegetation and coastal wetlands to volunteer on the landward
side of the most northern end of the timber bulkhead, consisting primarily of Smooth Cordgrass (Spartrna altemrflora) The
shoreline along Lees Lane is stabilized by vegetation consisting of Salt Meadow Grass (Spartina patens) and Smooth Cordgrass
(Spahna alternrflora) in an area approximately 20' in width Vegetation associated with the high ground portion of project consists
primarily of wild grasses, Wax Myrtle, Live Oak and Magnolia trees
The Town of Carolina Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion
of the project area as Developed The waters of the Carolina Beach Yacht Basin are classified SB# by the Division of Water
Resources They are NOT designated as a Primary Nursery Area by the N C Division of Marne Fisheries and they are CLOSED
to the harvest of shellfish
PROPOSED PROJECT
The applicant proposes to develop a new 36 unit condominium complex with associated amenities, new shoreline stabilization,
new boat basin and transient docks within Myrtle Grove Sound The application states that the existing failing timber bulkhead
would be removed and a new approximately 91 linear foot (LF) bulkhead would be constructed, which would straighten the
alignment along the shoreline This would result in locating a portion of the new bulkhead (32 LF) ranging from approximately
2' to 12' waterward of mean high water (MHW) and the remaining 48 LF would be constructed above MHW Once constructed,
the applicant also proposes to excavate the area waterward of the new bulkhead in an area of approximately 75' in length by
20' in width to a final project depth of -5 @ mean low water (MLW) for a boat basin, which would result in the removal of
approximately 211 cubic yards (CY) of shallow bottom and upland matenal The application states the material would be
mechanically removed and placed onto the highground of the project area outside of the 30' Coastal Shoreline buffer and
stabilized by silt fencing The application also states that once de -watered, the material would be utilized on -site
A new access pier, measuring approximately 20' m length by 6' in width would extend from the most northern end of the property
off the new bulkhead into Myrtle Grove Sound The pier would then terminate onto a partially covered fixed platform, measuring
approximately 32' in length and would range from approximately 5' to 10' in width An access ramp would lead from the southern
side most landward end of the access pier onto a floating dock, measuring approximately 65' in length by 6' in width, which
would run parallel to the new bulkhead The application states that the structures would be designated as transient slips use
only The applicant also proposes a 6' in width elevated walkway along the landward side of the new bulkhead, which would tie
into the access pier to the docking facility and the uncovered decking associated with the following proposed upland
development
The applicant proposes to develop a new 36 unit condominium complex with associated amenities A new four story building
approximately 150' in length by 65' in width by approximately 55' in height would be constructed with associated parking area
on the western end of the property The applicant also proposes improvement of Lees Lane Right -of -Way by paving an area of
approximately 270' in length by 25' in width to accommodate the new condominium and also the existing Inland Harbor
Condominium located to the north of Lees Lane and the new development The applicant also proposes to provide amenities
on the eastern end of the new building, which includes a pool area and uncovered wooden decking (See Sheet C2 and Project
Narrative)

10 ANTICIPATED IMPACTS
The proposed excavation for the proposed boat basin would impact approximately 1,500 sq ft of shallow bottom and highground
area on the landward side of the failed timber bulkhead The proposed excavation would incorporate 100 sq ft of Coastal
Wetlands that primarily consist of Smooth Cordgrass (Spartrna altemiflora) and Salt Meadow Hay (Spartina patens), which
appears to have colonized on the landward side of the existing failed timber bulkhead due to the lack of maintenance This
would also result in the removal of approximately 211 CY of material, which would be placed on the highground area on the
project site, in an area of approximately 1,500 sq ft
The proposed new bulkhead would incorporate approximately 384 sq ft of Estuarine Waters and Public Trust Area in the area
landward of the dilapidated wooden bulkhead The remaining proposed bulkhead would be located landward of MHW The
bulkhead would disturb approximately 1,800 sq ft of highground for the associated backfll and tie -back anchor system
The proposed structures would incorporate approximately 772 sq ft , partially of newly created Estuarine Waters and Public
Trust Area As proposed in the application, the proposed docking structures would accommodate three (3) transient vessels
The proposed pier and dock would not exceed the Town of Carolina Beach historical pier head line nor the setback from the
USACE AIWW The proposed structures would encroach into the adjacent ripanan corridor setback requirement to the north
and south, however, the applicant has received waivers from the adjacent property owners for the encroachment of these
proposed structures
The proposed upland development for the 36-unit condominium, associated parking areas and Lees Lane improvements would
disturb approximately 38,900 sq ft (0 893 acres) of highground, of which approximately 20 3% would be covered by built upon
area within the 75' Coastal Shoreline AEC It appears the only structures that would encroach into the 30' Coastal Shoreline
buffer would be the uncovered decking associated with the pool area, which does not exceed 200 sq ft and the 6' in width
wooden access walkways
There would be increased turbidity levels during project activity, however, if timed to avoid periods of peak biological activity,
no long term adverse impacts are anticipated

Narrative for CAMA Application
Pelican Point is a small -space living project proposed for the vacant property located at
402 N Lake Park Blvd in Carolina Beach, North Carolina 28428 The project will consist of 36
condo units located in one building The building will be four levels on pilings (nine units on
each level)
Pelican Point offers two condo unit sizes There are 28 units that are approx 500 square
feet with an 8' x 28' outdoor deck and water views There are 8 waterfront units that are approx
650 square feet with an 8' x 24' deck Each level will consist of seven smaller units and two
larger units All condo units will be one bedroom and one bathroom
The building will be equipped with a commercial elevator and fire sprinkler system
throughout Residents will also be able to enjoy a water front pool area and 65' day dock with a
pier leading to a gazebo over the water
The construction consists of removing the dilapidated bulk head and replacing with a new
bulkhead that straightens the shoreline Once the new bulkhead is constructed, excavation will
be done to accommodate a transient floating day dock that will be used by Pelican Point
residents only The gazebo will also be for Pelican Point residents only
The existing wetlands on the lot appear to be from lack of maintenance of the bulkhead
It also appears the coastal wetlands have volunteered in the area near the old bulkhead are not
significant This project will have approximately 20 3% of development in the AEC
