If not, then we will have to spot check it with Google Earth 8 Two Permits I Am Already Working On a SW8 060901 Minor Mod issued 10/11 Transfer accepted 10/15/18 1 did not go through this package thoroughly before I accepted it because I did not realize that that had not already been done I see now that Mr Earp signed for the HOA for this one, and the recorded restrictions are also needed We also need the deeds) for the common areas where the stormwater system(s) are located Please also submit anything else in Items 1-7 above that have not been submitted SW8 070213 Minor Mod issued today (10/23) Transfer not yet accepted This modification was to modify the BUA/lot to match the recorded restrictions so we are good on that Mr Earp also signed this one so we will need to get that worked out, and we also need the common area deeds Please also submit anything else in Items 1-7 above that have not been submitted You are generally pretty good about separating out the items for each permit number when you submit things together But, please keep in mind that that is really important to how we file things here You are certainly welcome to submit items for five permits in one envelope, but please binder clip the data for each file independently and label each group of materials with the permit number That way I can easily file it and keep up with whether each permit has submitted various things Thanks, Kelly From Scott, Georgette Sent Tuesday, October 23, 2018 12 19 PM To Adam Grady <agrady@hdsilm cam> Cc Johnson, Kelly <kelly p lohnson@ncdenr gov> Subject RE [External] RE Brunswick Forest Transfer SW8 131102 , Minor Mod/Transfer of SW8 061007 and SW8 110319 There is no copy of the RECORDED covenants in the file for SW8 131102 For SW8 061007 and 110319 you may have to amend the covenants since you are doing a mod on the lots If the covenants recorded match what you are now modifying then fine I still need a copy of the recorded covenants for those two permits If the HOA is willing to take the permit than I think it is best to get them to sign to show they are working with you I just need the proper person signing for the HOA If it is Mr Earp, then provide documents that show he is in fact the VP for the HOA If they do not want to sign for some reason then you have the option of transferring without their signature as long as 50% or more of the lots are sold to other than the declarant (usually that is the developer) You have provided a list of residents already with the package If that shows that 50% or more are sold then you are fine On all transfers (no matter who signs) you will have to verify that the BUA is correct on the lots You may have done that by providing the lot owner info Kelly will review/verify that when she gets to it If the permittee is the only one signing the application to give the permit to the HOA then he must make sure they get a copy of the 0 & M for the ponds If the HOA signs the transfer application then they need to sign a new 0& M and it should be included in the transfer package Georgette Scott State Stormwater Program Supervisor Department of Environmental Quality Office (910) 796 7215 Fax (910) 350-2004 Georgette Scott(@ncdenr gov 127 Cardinal Drive Ext Wilmington, NC 28405 NIZ i' Nolhmg Compares Email correspondence to and from this address is subject to the North Carolina Public Records Law and may be disclosed to third parties From Adam Grady <agrady@hdsilm com> Sent Tuesday, October 23, 2018 12 05 PM To Scott, Georgette <georgette scott@ncdenr eov> Subject [External] RE Brunswick Forest Transfer SW8 131102, Minor Mod/Transfer of SW8 061007 and SW8 110319 Georgette, Hope your doing well I have a couple of questions 1 1 meant to mark X since it remains unchanged from the original Recorded Deed restrictions that were sent in I will include a copy 2 We were going to originally go the route of lust the permittees' signature but we were unclear of this after reading through the documents Would this be the best route to go from here on out? I have re -worked the data into two tables (attached in Excel) which will become permit attachments a Table 1 Impervious per Lot I have summarized the data that was permitted in 2007 At that time, we did not have the lots broken out per pond I have created two new columns to show the impervious area per lot and per pond One of the tables submitted shows Lots 10-51 will be given 6,800sf, but the pond number was left off of the title of that table The summary for Pond 12 submitted shows these same lot numbers (along with several others) getting significantly less impervious Please update the data in yellow in Table 1 Once that data is updated, the data shown in blue will automatically update and populate Table 2 Phase 6 Section 1 (Lots 10-22 and 49-51) dram to pond 11 which is the first table and summary submitted The other lots (Phase 6 Section 2) shown in the table dram to pond 12 We've updated the excel file you provided u Townhomes In 2007 there were 60 townhomes allocated 2,723sf per lot which totaled 163,380sf The data submitted recently shows a total of 173,910sf which would work out to 2,898 5sf per lot, which is an unusual allocation amount Please make any changes or clarifications to the data (Did the number of lots change?) These were originally due to be all townhome lots at the time of the original permitting, however, some lots were deleted or adjusted and now the area consist of townhome, single family, and duplex lots The allowable impervious 1123 Floral Parkway Wilmington, NC 28403 Phone (910) 343-8002 Fax 910) 343-9941 Business Firm License No C-0597 Han,over Design Services, P.A. Recorded Deed Restrictions Please record the required deed restrictions and include the book/page on Table 1 Book and page #'s added to table Table 2 The data in blue in Table 2 is automatically updated from Table 1 Please note that there appears to be an error in the 2007 data The table in the application showed a total of 381,750sf of impervious from lots The data found from summing the total of impervious for the deed restricted lots was 443,380sf I have documented this error in Table 2, and it will be shown as a correction when this modification is issued As you insert the data in yellow on Table 1, please ensure that that data forces the total impervious in Table 2 to show that Pond 11 can hold 163,350sf and Pond 12 can hold 435,600sf since those values were the respective maximum impervious for the two ponds (If the impervious area does not 'fit" in the pond as it is currently designed please contact me If there is room in the pond, you maybe able to re -calculate the volume that the pond can hold without making changes to the pond which may be able to give your more available impervious area There are some caveats such as you have to add the new impervious area at 1 5" rather than 1 0" And, there are some logistical considerations because that would be a major modification rather than a minor modification) We also noticed the error while filling out the permit revisions and the correct amount was shown in the summary table submitted for Pond 12 (435,600 sf) A portion of the future was reallocated to accommodate some of the extra impervious to the lots Originally there was 15,666 sf of future impervious, that number now is 2,606 sf The total BUA is still below the permitted total for the pond 2 Recorded Deed Restrictions Please submit a copy of the No SW8 070213 Brunswick Forest Phase 6 - Sections 1 & 2 Brunswick County Dear Mr Earp I he Wilmington Regional Office received and accepted a modified State Stormwater Management Permit Application for the subject project on September 5, 2018 The transfer application that was mailed with the minor modification will be accepted once the minor modification is completed A preliminary in-depth review of that information has determined that the application is not complete and that additional information is needed ro continue the review, please provide the following additional information Accounting Thank you for the tables summarizing the impervious area for the two ponds I would like to get some clarification on them, however I suspect that there are different sections with similar numbers7 I have re -worked the data into two tables (attached in Excel) which will become permit attachments a I able 1 I Impervious per Lot I have summarized the data that was permitted in 2007 At that time, we did not have the lots broken out per pond I have created two new columns to show the impervious area per lot and per pond One of the tables submitted shows Lots 10-51 will be given 6,800sf, but the pond number was left off of the title of that table The summary for Pond 12 submitted shows these same lot numbers (along with several others) getting significantly less impervious Please update the data of yellow in Table 1 Once that data is updated, the data shown in blue will automatically update and populate Table 2 Townhomes In 2007 there were 60 townhomes allocated 2,723sf per lot which totaled 163,380sf 1 he data submitted recently shows a total of 173,910sf which would workout to 2,898 Ssf per lot, which is an unusual allocation amount Please make any changes or clarifications to the data (Did the number of lots change7) wmcvnw ov.a..,nenimrm North Carolina Department of Environmental Quality I Division of Energy Mineral and Land Resources Wilmington Regional Office 1 127 Cardinal Drive Extension I Wilmington, North Carolina 28405 910796 7215 State Stormwater fermi No Sw8 070213 Page 2 of 3 in Recorded Deed Restrictions Please record the required deed restrictions and include the book/page on Table 1 7 able 2 1 he data in blue in Table 2 is automatically updated from Table 1 Please note that there appears to be an error in the 2007 data I he table in the application showed a total of 381,750sf of impervious from lots I he data found from summing the total of impervious for the deed restricted lots was 443,380sf I have documented this error in 7 able 2, and it will be shown as a correction when this modification is issued As you insert the data in yellow on Table 1, please ensure that that data forces the total impervious in fable 2 to show that Pond it can hold I63,350sf and Pond 12 can hold 435,600sf since those values were the respective maximum impervious for the two ponds (If the impervious area does not 'Tit" in the pond as it is currently designed please contact me If there is room in the pond, you maybe able to re -calculate the volume that the pond can hold without making changes to the pond which may be able to give your more available impervious area There are some caveats such as you have to add the new impervious area at 1 S" rather than 1 0" And, there are some logistical considerations because that would he a major modification rather than a minor modification) 2 Recorded Deed Restrictions Please submit a copy of the recorded deed restrictions for all of the lots Please remember to confirm that any revised information is presented consistently throughout the application documents including calculations, supplements, narrative, and plans Please also remember to provide two hard copies of any updated documents per 15A NCAC 0211 1042(2) The requested information should be received in this Office prior to October 29, 2018, or the application will be returned as incomplete If the project is returned and you wash to re -submit later, you will need to resubmit all required items at that time, including the application fee If additional time is needed to submit the requested information please e-mail, mail, or fax your extension request, prior to the original due date, to the Division using the contact information available in this letter The extension request must include a justification and a date of when the requested information will be submitted to the Division Please remember that extension requests delay the issuance of the final permit The Division is allowed 90 days from the receipt of a complete application to issue the permit The construction of any impervious surfaces, other than a construction entrance under an approved Sedimentation f'rosion Control
