On April 11 2006 Permit No SW8 051110 was issued to Calvary Assembly of God Church allowing 249 956 sq of new
impervious surface area (BUA) and requiring installation of two wet detention ponds

LIVING WATER CHRISTIAN SCHOOL, INC
8 I EXEMPT STATUS AND DISSOLUTION Said corporation is organized exclusively for
charitable, religious, and educational purposes including, for such purposes, the making of
distributions to organizations that qualify as exempt organizations under section 501(c)(3) of the
Interal Revenue Code or the corresponding section of any future federal tax code
No part of the net earning of the corporation shall inure to the benefit, or be distributable to
its members trustees, officers, or other private persons, except that the corporation shall be
authpprazed and empowered to pay reasonable compensation for services rendered and to make
payments and distributions in furtherance of its purposes
Notwithstanding any other provision of these articles, the corporation shall not carry on any
othe activities not permitted to be carried on (a) by a corporation exempt from federal income tax
under section 501(c)(3) of the Internal Revenue Code of 1986 or the corresponding provision of
any uture federal tax code or (b) by a corporation contributions to which are deductible under

qualify as exempt organizations under section 501(c)(3) of the Internal Revenue Code or the
corresponding section of any future federal tax code
The purposes for which the educational corporation is organized are as follows
(a) To establish and maintain an educational institution and not for pecuniary gam, for the
esta lishment, maintenance and support of a private Christian elementary and secondary schools
Chr (stian Academy) at which both chanty and pay students shall be received, for the
esta lishment maintenance, and support of a private Christian day care center and nursery school
(Mark 10 14, Luke 18 16-17) at which both chanty and pay students shall be received
(b) To establish and maintain a Christian bookstore for the benefit of the students and
members of the School and their guests (Psalm 68 11, Acts 13 39)
(c) To print, publish and distribute and sell books, magazines and other literature in connection
with the purposes of this corporation, to sell, record and reproduce tapes, radio, and television
programs in connection with the purposes of this corporation to produce and distribute radio and
tele ision programs (Deuteronomy 31 19, 1 Chronicles 16 23-24, Psalm 68 4, Revelation 14 2)
(d) To establish and maintain a day care or after school program for the young so working
parents, and others can have a service to assist them with their children during the day (Proverbs
22 6, Luke 18 16)

The several clauses contained in this Article shall be constructed both as purposes and
powers and powers and the statements contained in each clause, shall except where otherwise
expressed be in no wise limited or restricted by reference to or inference from the terms of any
other clauses, but shall be regarded as independent purposes and powers, so long as such are
permitted under section 501(c)(3) of the Internal Revenue Code
(f) To employ qualified counsel and other necessary personnel to carry out the purposes of this
school (Titus 3 13, James 5 4)
(g) To further all religious and charitable work and for such purposes to adopt and establish
Bylaws, rules, regulations in accordance with the law and not inconsistent with this Articles of
Incorporation (Joshua 1 7-8, Habakkuk 2 2-3, Romans 7 12 10 4)
(h) To do all those things allowed and permitted to be done under law and specifically those
set forth in the North Carolina NonProfit Corporation Code, so long as such is permitted under
section 501(c)(3) of the Internal Revenue Code
B DURATION The period of the duration of this corporation is perpetual, unless
dissolved according to the law
C CORPORATE AFFAIRS The affairs of the corporation shall be managed by officers
elected by the Board of Directors at its annual meeting The officers shall serve until the next
annual meeting of the Board of Directors unless removed earlier in accordance with the Bylaws
The general officers of the corporation shall be the President Vice -President, Secretary and
Treasurer
The principal duties of the President shall be to preside at all meetings of the members of
the Board of Directors and to the general supervision of the school He shall be the Chairman of the
Board of Directors
The principal duties of the Vice -President shall be to discharge the duties of the President in
the event of the absence or disability, for any cause whatsoever of the President
The principal duties of the Secretary shall be to countersign all deeds, leases, and
conveyances executed by the school, affix the seal thereto and to such other papers as shall be
required or directed to be sealed, and to keep a record of the proceedings of the Board of Directors
and to safely and systematically keep all books papers, records, and documents belonging to the
corporation and the school or in any way pertaining to the business thereof except the books and
records incidental to the duties of the Treasurer
The principal duties of the Treasurer shall be to keep an account of all monies, credits and
property of any and every nature of the school which shall come into his hands, and to keep an
accurate account of all monies received and disbursed and of proper vouchers for monies disbursed
and to render such accounts, statements, and inventories of monies received and disbursed and of
money and property on hand and generally of all matters pertaining to his office, as shall be
required by the Board of Directors
The Board of Directors may provide for the appointment of such additional officers as they
may deem for the best interest of the school
Whenever the Board of Directors may so order, any two officers the duties of which do not
conflict, may be held by one person
The officers shall perform such additional or different duties as shall from time

for its debts nor shall any members property be so liable
E BYLAWS The Bylaws of LIVING WATER CHRISTIAN SCHOOL, INC shall be

F DEDICATION OF ASSETS The property of this corporation is irrevocably dedicated
to educational and charitable purposes, and no part of the net income or assets of this corporation
shall ever inure to the benefit of any director, officer, or member thereof, or to the benefit of any

On June 13, 2006 personnel of this office inspected a project located on Gum Branch Road,
Jacksonville in Onslow County North Carolina This inspection was performed to determine
compliance with the North Carolina Sedimentation Pollution Control Act (Act) of 1973 The
inspection revealed a land -disturbing activity exceeding 5 acres being conducted
It is our understanding that you and/or your firm are responsible for this land -disturbing activity The
purpose of this letter is to inform you that this activity was found to be in violation of the Act, G S
i 13A-50 to 66, Title 15A, North Carolina Administrative Code (NCAC), Chapter 4 Ifyou feel that
you are not responsible for the following violations, please notify this office immediately
The violations that were found are
1 Failure to file an erosion and sedimentation control plan with this office 30 or more days pnor
to initiating any land -disturbing activity that will disturb more than one acre on a tract, failure to
secure this office's pnor approval of the plan for any land -disturbing activity prior to beginning
the land -disturbing activity, G S 1 13A-54(d)(4), G S 113A-57(4) and 15A NCAC 4B 0107(c)

hi March, 2006 you were notified of the need to file a sedimentation erosion control plan and
application with the State since a land disturbance exceeding one acre was underway on the property
A Plan was submitted but disappro� ed on May 24, 2006 No further information or correspondence
has been received
To correct these violations, you must
An acceptable erosion and sedimentation control plan and application must be filed with and
approved by this office and implemented on the site sufficient to prevent off -site
sedimentation Until the required plan has been approved, temporary measures must be
provided immediately to control erosion and prevent sedimentation damage Anyadditional
land disturbing activities conducted without an approved erosion and sedimentation control
plan will constitute additional violations of the Act We will notify you following our review
of the plan if additional measures are required
The penalty for an initial violation could be an assessment of up to $5,000 00 A time period for
compliance is not required for enforcement of this violation pursuant to NCGS 1 13A-61 l (c) and
NCGS I I3A-64(a)(1) Therefore, the initial violation maybe referred to the Director, Division of
Land Resources, for appropriate action
Please be advised that if these violations are not corrected within 30 days of receipt of this notice,
the Director of the Division of Land Resources will be requested to take appropriate legal action
against you pursuant to NCGS 113A-64 That action could be the assessment of a civil penalty, and
the amount maybe up to S5000 per day for each day of the violation The penalty maybe assessed
From the date of the violation, NCGS I I3A-61(a)(1) If the violations are corrected within the time
period specified for compliance, no further legal action will be pursued
Please be advised that any new land -disturbing activity associated with this project should not begin
until the area presently disturbed is brought into compliance with the Act When corrective actions
are complete, you should notify this office so that work can be inspected You should not assume
that the property complies with the Act until we have notified you After installation, all erosion
control measures must be maintained inproper working order until the site is completely stabilized
We solicit your cooperation, and would like to avoid taking further enforcement action At the same
time, it is your responsibility to understand and comply with the requirements of the Act Copies of
the relevant statute and administrative rules may be examined at this office or will be sent to you
upon request Should you have questions concerning this notice or the requirements of the Act
please contact either Janet Russell or me at your earliest convenience
