On November 13, 2006, the Wilmington Regional Office received a plan revision for Stormwater Management
Permit Number SW8 050316 Modification The revisions include the proposed construction of 44,710 square feet
of built -upon area on Outlot 3 The built -upon area allotted to Outlot 3 by Stormwater Management Permit No
SW8 050316 is 45,302 square feet This project proposes 44,710 square feet It has been determined that a
formal permit modification is not required for the proposed changes We are forwarding you an approved copy of
the revised plans for your files Please add the attached plans to the previously approved plan sheets
Please be aware that all terms and conditions of the permit issued on November 7, 2006, remain in full force
and effect Please also understand that the approval of this revision to the approved plans for the subject State
Stormwater Permit is done on a case -by -case basis Any other changes to this project must be approved
through this Office prior to construction The issuance of this plan revision does not preclude the permittee
from complying with all other applicable statutes, rules, regulations or ordinances which may have
jurisdiction over the proposed activity, and obtaining a permit or approval prior to construction
Please be aware that prior to the sale or transfer of ownership of any portion of the property deed restrictions and
covenants must be recorded (see Section II — Item 16 of State Stormwater Management Permit SW8 050316 dated
November 7, 2006) In addition, each outparcel or future development area whose ownership is not retained by
the permittee must obtain a separate Offsite State Stormwater Management Permit prior to any construction on
the lot /f

IV DEED RESTRICTIONS AND PROTECTIVE COVENANTS
The following italicized deed restrictions and protective covenants are required to be recorded for all
subdivisions outparcels and future development prior to the sale of any lot If lot sizes vary significantly a table
listing each lot number size and the allowable built -upon area for each lot must be provided as an attachment
1 The following covenants are Intended to ensure ongoing compliance with state stormwater management permit number
S W8 050316 as issued by the Division of Water Quality These covenants may not be
changed or deleted without the consent of the State
2 No more than 45,302 square feet of any lot shall be covered by structures or Impervious materials
Impervious materials Include asphalt gravel, concrete, brick stone slate or similar material but do not Include wood
decking or the water surface of swimming pools
3 Swales shall not be filed in piped or altered except as necessary to provide driveway crossings
4 Built upon area In excess of the permitted amount requires a state stormwater management permit modification prior to
construction
5 All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system These connections to the stormwater control system shall be performed In a manner that maintains the integrity
and performance of the system as permitted
By your signature below you certify that the recorded deed restrictions and protective covenants for this project
shall include all the applicable items required above that the covenants will be binding on all parties and persons
claiming under them that they will run with the land that the required covenants cannot be changed or deleted
without concurrence from the State, and that they will be recorded prior to the sale of any lot

VI SUBMITTAL REQUIREMENTS
Only complete application packages will be accepted and reviewed by the Division of Water Quality (DWQ)
A complete package includes all of the items listed below The complete application package should be
submitted to the appropriate DWQ Regional Office
