Mike Toler Chrysler Dodge Jeep Ram (formerly Fred's Beds) High Density Stormwater Project Carteret County Dear Mr. Murdoch: Dee Freeman Secretary The Wilmington Regional Office received a complete, modified Stormwater Management Permit Application for Mike Toler Chrysler Dodge Jeep Ram on August 10, 2012. Staff review of the submitted plans and specifications has determined that the modified project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000, The previously approved wet detention pond (from the February 13, 2004 permit) will remain on the property and be maintained by the new owners until such time as the new approved project is constructed, in approximately 2 years. We are forwarding modified Permit No. SW8 040205 dated February 13, 2004, for the construction, operation and maintenance of the permitted built -upon areas and BMP's associated with the subject project. The modifications included in this permit are: 1. A request to change the project name from Fred's Beds to Mike Toler Chrysler Dodge Jeep Ram due to the pending sale of the property. Upon the issuance of this permit modification, the sale of the property will be finalized and a formal permit transfer request must be submitted. 2. The old Fred's Beds 2.99 acre site has been incorporated into a larger 6.87 acre project, Mike Toler Chrysler Dodge Jeep Ram and a new wet detention pond is proposed which will treat the entire larger project area. The existing wet pond will continue to function and be maintained in compliance with the permit until such time as the larger construction project is started and the. new pond is constructed. 3. The plans previously approved on February 13, 2004 will remain in effect as the "Existing" condition until such time as the "Proposed" condition is constructed. On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any development approval issued by the Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which is current and valid at any point between January 1, 2008, and December 31, 2010. The law extends the effective period of any stormwater permit that is set to expire during this time frame to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law 2010- 177, which grants an extra year for a total of four (4) years extension. Please note that the expiration date of this permit has been adjusted to reflect this four year extension. This permit shall be effective from the date of issuance until February 13, 2018, and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS 1. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.6 of this permit. The existing stormwater wet detention pond has been designed to handle the runoff from 96,013 square feet of impervious area. The proposed wet detention pond has been designed to handle the runoff from 154,275 square feet of impervious area. 3. The tract will be limited to the amount of built -upon area indicated in Sections 1.2 and 1.6 of this permit, and per the approved plans. The built -upon area for the future development in the proposed pond is limited to 8,082 square feet. 4. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. 5. The runoff from all built -upon area within the permitted drainage area of this project must be directed into the permitted stormwater control system. A permit modification must be submitted and approved prior to the construction of additional built -upon area from outside of the approved drainage area. . The following design criteria have been permitted for the existing wet pond and for the proposed wet pond, and must be maintained at design condition. SCHEDULE OF COMPLIANCE The existing stormwater management system shall remain in place until such time as the proposed construction project begins. The proposed stormwater management system must be constructed in Its entirety, vegetated and operational for its intended use prior to closing off the existing wet Pond and prior to the construction of any additional built -upon area in excess of 96,013 square feet. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. At the point in the future when the permittee has met the requirements to permanently close the "Existing" stormwater system, the permittee shall notify the Division and request that the "Existing" condition be removed from the permit such that the only permitted stormwater BMP will be the "Proposed" condition. Page 4 of 9 State Stormwater Management Systems Permit No. SW8 040205 4. The permittee shall at all times provide the operation and maintenance necessary to assure that the permitted stormwater system functions at optimum efficiency. The permittee shall maintain the "Existing' wet detention pond until such time as it is replaced by the "Proposed" wet detention pond. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. c. Mowing and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Repair of all components of the drainage collection system, including debris removal and unclogging of outlet structure, orifice device, catch basins and piping. g. Access to the outlet structure must be available at all times. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 6. Decorative spray fountains will be allowed in the "Proposed" stormwater treatment system, subject to the following criteria. The "Existing" facility has less than 30,000 cubic feet of permanent pool volume therefore, a fountain may not be placed into the "Existing" facility. a. The fountain draws its water from less than 2' below the permanent pool surface. b. Separated units, where the nozzle, pump and intake are connected by tubing, may be used only if they draw water from the surface in the deepest part of the pond. c. The falling water from the fountain must be centered in the pond, away from the shoreline. d. The maximum horsepower for the fountain's pump is based on the permanent pool volume. The maximum pump power for a fountain in the "Proposed" pond is 1/4 horsepower. 7. The facilities shall be constructed as shown on the approved plans. This permit shall become void unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 8. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 9. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, changes in the grading, repositioning of the built -upon areas, etc. b. Redesign of or addition to the approved amount of built -upon area or to the permitted drainage area. C. Further subdivision or sale of all or part of the permitted project area. d. Additions to the permitted project area. e. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. f. Construction of any future BUA accounted for on the permit application. 11. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. If the proposed BUA exceeds the amount permitted under this permit, a modification to the permit must be submitted and approved prior to construction. 12. A copy of the approved plans and specifications shall be maintained on file by the Permittee at all times. 13. The permittee must maintain compliance with the proposed built -upon area limit and ensure that the site is graded such that runoff from all the built -upon is directed into the permitted system. 14. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS This permit is not transferable except after notice to and approval by the Director. At least 30 days prior to a change of ownership, or a name change of the owner or of the project, or a mailing address change, the permittee shall submit a completed and signed Name/Ownership Change form to the Division of Water Quality, accompanied by the required documentation as listed on the form. Ownership changes include dissolution of the corporate entity, foreclosure and bankruptcy proceedings. The approval of this request will be considered on its merits and may or may not be approved. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 2. Any individual or entity found to be in noncompliance with the terms and conditions of this permit or the requirements of the stormwater rules is subject to enforcement procedures by the Division of Water Quality, in accordance with G.S. 143, Article 21. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. In the event that the facilities fail to perform satisfactorily or fail to meet the permit requirements, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 8. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. Permit modified and reissued this the 14th day of August 2012. This maintenance record will be kept in a log in a known set location. Any deficient BMP elements noted in the inspection will be corrected, repaired or replaced immediately. These deficiencies can affect the integrity of structures, safety of the public, and the removal efficiency of the BMP. Repair eroded areas immediately, re -seed as necessary to maintain good vegetative cover, mow vegetative cover to maintain a maximum height of six inches, and remove trash as needed. 3. Inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.) quarterly to maintain proper functioning. 4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is reduced to 75% of the original design depth (see diagram below). Removed sediment shall be disposed of in an appropriate manner and shall be handled in a manner that will not adversely impact water quality (i.e. stockpiling near a wet detention basin or stream, etc.). The measuring device used to determine the sediment elevation shall be such that it will give an accurate depth reading and not readily penetrate into accumulated sediments. The calculations report that the provided storage volume is 30,281 cubic feet. This volume appears to be provided at elevation 19 feet, but the storage elevation is shown on the plans and supplement as 18.5 feet. The storage volume provided at elevation 18.5 appears to be 19,497 cubic feet, which is the temporary pool elevation and volume, respectively, reported on the supplement form. The storage volume provided to the first outlet elevation of 18.5 is 19,497cf and has been revised in the calculations and on Sheet 5 of the plans (both attached) to coincide with the Supplement. 2. The calculations use a temporary storage elevation of 18.46 for orifice sizing, but it is specified as 18.5 on the supplement and on the plan details. The calculations have been revised to reflect a storage elevation of 18.5 and a new drawdown time of 3.53 days. The new drawdown time is reflected in the Supplement attached. 3. Based on a shelf area of 4184 square feet, a minimum of 1046 wetlands plants must be provided. Per section 10.3.7 of the BMP Manual, woody shrubs cannot be planted on the shelf or on the embankment. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: The calculations report that the provided storage volume is 30,281 cubic feet. This volume appears to be provided at elevation 19 feet, but the storage elevation is shown on the plans and supplement as 18.5 feet. The storage volume provided at elevation 18.5 appears to be 19,497 cubic feet, which is the temporary pool elevation and volume, respectively, reported on the supplement form. 2. The calculations use a temporary storage elevation of 18.46 for orifice sizing, but it is specified as 18.5 on the supplement and on the plan details. Based on a shelf area of 4184 square feet, a minimum of 1046 wetlands plants must be provided. Per section 10.3.7 of the BMP Manual, woody shrubs cannot be planted on the shelf or on the embankment. The ability to switch out shallow water or shallow land plants for shrubs or trees is specific to a stormwater wetland only. Please note that a revision to one number may have a domino effect on other numbers, which may require revision of the applications, calculations, supplements, plans, details, and associated documentation. The site is permitted under SW8 040205 and this request is for a modification to this permit to reconstruct the lot into an automobile dealership. The wetlands have been delineated and approved by the U.S. Army Corps of Engineers and a portion of the wetlands have received approval to be filled per Action ID SAW-2012-00204. The previously approved high density plan allowed for the construction of a commercial building and associated parking and drives, including an impervious allotment for future development on the parcel to the east. The plan being submitted is proposing to remove all existing impervious on the site and fill in the existing pond to allow for the new high density development. The new development will not commence construction for two to three years and until then the site is to remain as permitted and constructed. Once construction is to begin, impervious areas must be removed in their entirety prior to the existing pond being filled in. II. Stormwater Information n S'.la � J n'Jl• I fis'I The project is located within the White Oak River basin and currently drains northerly to Hull Swamp, Class C, 21-15, a tributary of the Newport River. This project is being submitted as a high density commercial project under the current Coastal Stormwater Rules modifying the permit from 2004. Stormwater will be treated by a wet detention pond to 90% TSS. III. Erosion and Sedimentation Control Measures The following measures are proposed for the site. If it becomes evident that additional erosion and sedimentation control measures are needed, they shall be installed immediately. It is intended that all grading and excavation activities within a certain area will be protected as soon as that activity is complete. 1. Sediment Fence — Sediment fence will be utilized as necessary in locations as shown on plans or as deemed necessary by the engineer to insure that off -site sedimentation is controlled. 2. Seeding — All disturbed areas will be seeded within 14 days following construction in accordance with the seeding schedule shown on the plans. 3. Stone Construction Entrance — Stone construction entrance will be used to reduce transport of sediment off site. 4. Sediment Basins- The detention pond to be constructed will serve as a sediment basin during construction. This project requires a storage sediment rate at 3600 cf/acre of disturbance and required surface area is based on the 10-year storm. Sediment volume from the earth disturbing activities draining to the pond is estimated to be 17,100 cubic feet based on 4.75 acres of disturbance. The forebay will have 12,009 cf and the main basin 53,087 cf of sediment storage capability totaling 65,095 cf exceeding the required volume. The surface area required of 3,992 sf is also exceeded providing a total surface area of 16,659 sf. Upon completion and stabilization of project the pond shall be cleaned to the original design depth. IV. Maintenance Plan 1. All erosion and sediment control measures shall be checked for stability and effective operations following every runoff producing rainfall event or at least once per week. Repairs required shall be completed immediately to the dimension and functions indicated on the plans. 2. Sediment shall be removed form behind the sediment fencing when it becomes 0.5 feet deep at the fence. The fence shall be replaced or repaired as necessary to maintain a barrier. 3. All seeded areas shall be fertilized, seeded and mulched within 14 calendar days of disturbance. Disturbed areas shall be fertilized, reseeded and mulched as necessary according to the Contract documents to establish and maintain a dense vegetative cover. V. Construction Sequence 1. Remove and/or relocate existing obstructions. 2. Install gravel construction entrance and silt fencing at specified locations. 3. Muck and fill existing pond to surrounding grade elevation once all existing impervious has been removed from the site. 4. Complete clearing and grubbing operations. 5. Excavate, rough grade and temporarily seed stormwater detention basin at new location. 6. Rough grade parking areas and begin preparation of building sites. 7. NCDENR-DWQ "Stormwater Management" rules and regulations (NCAC 15-2H-.1000) were used as guidelines in making this evaluation. New and revised NCDENR-DWQ coastal stormwater rules became effective October 1, 2008 and are more rigorous than previous rules. This is a general evaluation that consisted of transects across the tract, free -style soils mapping and shallow borings within accessible areas, qualitative estimates of the land and soil properties, and review of existing maps or information on these areas. The SW portions of the tract have historically existing impervious surfaces or disturbances, thus evaluations were not completed within this area. No quantitative on -site or specific testing was completed as part of this evaluation that can be required for NCDWQ stormwater permitting. According to NCDENR-DWQ rules, coastal stormwater may be treated by infiltrative devices, detention treatment basins, or an equivalent alternative method when the proposed project is greater than 1 acre in size, has >12% residential impervious surfaces, >10,000 sqft non-residential impervious surfaces, and are within '% mile of Class S.A. Waters or their unclassified tributaries. Coastal lands that are >%: mile from Class S.A. Waters or their unclassified tributaries allow up to 24% residential impervious surface for low -density development, or 10,000 sqft non-residential impervious surfaces, before requiring engineered stormwater treatment systems. This tract is >1/2 mile from S.A. Waters, and appears to drain towards the NW to an unnamed tributary of Hull Swamp which is classified as Class-C Waters (see topo and DWQ map). It appears a high density project within these tracts would require prescriptive engineered stormwater treatment methods and design if the lands exceed 24% impervious surface. Infiltration methods or infiltrative "best management practices" (BMP) are utilized for stormwater treatment on coastal high density projects to preserve space or due to inadequate drainage outlets. Detention stormwater treatment ponds may also be used if they do not directly discharge to S.A. waters through "effective infiltration" methods. Low density projects (<12% to <24% residential impervious surface or <10,000 sqft non-residential impervious surface) should not require engineered stormwater treatment systems. Historically existing impervious surfaces should be exempted from stormwater density calculations, and then new development should comply with current NCDWQ stormwater requirements as much as practicable. The estimated seasonal high water static water table is +18 - <24 inches from the present surface, pending location and based upon soil wetness indicators and general elevations. Estimated permeability is 30 — 90 min/in or 0.6 — 2 in/hr to +50 inch depths from present surface, based upon soil texture and structure. Soil types found are similar to Mandarin and Leon -dry phase soil series. These soil areas should be usable for stormwater infiltration with basin bottoms +0.5 - 1 ft above the present surface (pending location) to maintain a 2 ft separation from seasonal high water table. We recommend a long -tens loading rate for stormwater infiltration that is Y: or less the average estimated soil hydraulic conductivity, or —0.6 — 1.0 in/hr for these moderate to moderately slow hydraulic conductivity rates and gradients. Detention ponds would have to maintain the permanent pool elevation between 12 - 30 inches from the present ground surface. The "Pink" Areas (see map) are poorly drained, with deep uniform fine to medium sand textures, thicker surface horizons higher in organic content, and hardpan (spodic) soil horizons. The estimated seasonal high water static water table is <12 inches from the present surface, based upon soil wetness indicators and general elevations. Estimated permeability is 90 —+300 min/in or <0.2 — 0.6 in/hr to +50 inch depths from present surface, based upon soil texture and structure. Soil types found are similar to Lynn -haven, Torhunta, and Leon soil series. These soil areas are not recommended for stormwater infiltration due to slow permeability and shallow seasonal water table indicators. Detention may be possible with major fill and sidewall berm site improvements, but this is not recommended. The "Gray" Areas (see map) are potential 404 wetlands that have been previously evaluated, located, and approved by others. Careful planning and design should be exercised to insure adequate and usable soil areas are reserved in the conceptual design for any future development in order to allow for on -site stormwater treatment usage. The soil areas evaluated have slight to moderate limitations for usage with on -site stormwater infiltration systems, pending final design locations. We recommend using 1/2 or less of the average natural permeability rate for the infiltrative stormwater system's design rate. Any historically existing impervious surfaces should be measured and given full credit for any new development stormwater calculations. NCDENR-DWQ or local Universal stormwater rules are the regulatory agency over stormwater systems and have final review, approval, and permitting authority. These and other regulatory agencies must be contacted for their reviews, general concurrences, and required permits before initiating any development activities. We recommend NCDWQ and appropriate agencies to review pre - application plans for their general concurrence as to site locations for final design considerations. NCDENR EXPRESS July 2012 The project is located within the White Oak River basin and currently drains northerly to Hull Swamp, Class C, 21-15, a tributary of the Newport River. This project is being submitted as a high density commercial project under the current Coastal Stormwater Rules modifying the permit from 2004. Stormwater will be treated by a wet detention pond to 90% TSS. III. Erosion and Sedimentation Control Measures The following measures are proposed for the site. If it becomes evident that additional erosion and sedimentation control measures are needed, they shall be installed immediately. It is intended that all grading and excavation activities within a certain area will be protected as soon as that activity is complete. 1. Sediment Fence — Sediment fence will be utilized as necessary in locations as shown on plans or as deemed necessary by the engineer to insure that off -site sedimentation is controlled. 2. Seeding — All disturbed areas will be seeded within 14 days following construction in accordance with the seeding schedule shown on the plans. 3. Stone Construction Entrance — Stone construction entrance will be used to reduce transport of sediment off site. 4. Sediment Basins- The detention pond to be constructed will serve as a sediment basin during construction. This project requires a storage sediment rate at 3600 cf/acre of disturbance and required surface area is based on the 10-year storm. Sediment volume from the earth disturbing activities draining to the pond is estimated to be 17,100 cubic feet based on 4.75 acres of disturbance. The forebay will have 12,009 cf and the main basin 53,087 cf of sediment storage capability totaling 65,095 cf exceeding the required volume. The surface area required of 3,992 sf is also exceeded providing a total surface area of 16,659 sf. Upon completion and stabilization of project the pond shall be cleaned to the original design depth. IV. Maintenance Plan 1. All erosion and sediment control measures shall be checked for stability and effective operations following every runoff producing rainfall event or at least once per week. Repairs required shall be completed immediately to the dimension and functions indicated on the plans. 2. Sediment shall be removed form behind the sediment fencing when it becomes 0.5 feet deep at the fence. The fence shall be replaced or repaired as necessary to maintain a barrier. 3. All seeded areas shall be fertilized, seeded and mulched within 14 calendar days of disturbance.
