Woodlawn Road, Charlotte, N.C. 28209 (project titled "Adler Montford Park"), Taft Development Group ("Taft') is required by the City of Charlotte and Mecklenburg County to be recorded as the financially responsible party for all Notices of Violation or related documents for any non-compliance of the City of Charlotte Soil Erosion and Sedimentation Ordinance as part of the site redevelopment. Construction plans currently under review by the City of Charlotte include required public infrastructure improvements and land -disturbing activity in the NCDOT right-of-way of Woodlawn Road. Construction areas and erosion/sedimentation control measures are illustrated on the enclosed Erosion Control Plan. Taft is required by Ordinance to submit the enclosed Financial Responsibility Form with the Erosion Control Plan acknowledging that Taft is solely financially responsible for all land -disturbing activity. Because right-of-way improvements extend beyond the project property line along Woodlawn Road, the form must also include the contact information and signature of any adjoining property owner indicating that Taft is the sole financially responsible party. Likewise, the Ordinance requires Taft submit a letter of consent from adjoining property owners for the project owner to seek and obtain approval of the referenced Erosion Control Plan. Please find a letter to that effect enclosed as well. We respectfully request that you or a responsible party for Horizon Development Properties, Inc. / INLIVIAN sign and return both the enclosed Financial Responsibility Form and the Consent Letter at your earliest convenience.
