Attn: Kyle Mertens 10411 Globe Road Morrisville, NC 27560 Dear Kyle Mertens: NORTH CAROLINA Environmental Quality July 14, 2022 Subject: N01 Application NCG130108 Raleigh Hauling and MRF Return #1334 Wake County We received your application for an NPDES discharge permit on June 2, 2022. On July 12, 2022, Thad Valentine with the Raleigh Regional Office conducted a site visit as a part of the review for permit coverage under Stormwater General Permit NCG130000. The site visit revealed that the facility conducts multiple industrial activities. These activities include a recycling center and disposal, vehicle washing station with an oil water separator, a maintenance shop, and fueling station. In addition, there is a poly tank for garbage leachate storage in need of a discharge valve lock There is also a maintenance shop and fueling station exposed to stormwater. There are multiple activities on this site, some of which are not covered subject the requested General Permit. As such, it was determined by the Division that General Permit NCG130000 is not adequate/appropriate for your facility and your application for coverage under NCG130000 is being returned to you. The conditions observed during the application review revealed the subject facility is in need/requires individual stormwater permit coverage. This office is requesting that you respond to this letter in writing within 30 days of receipt of this letter. Your response should address the each of the below listed items (1-2). 1) Individual en rmit. Please visit the DEMLR website "deq.nc.gov/SW-industrial" to find information and how to apply for coverage under an individual permit. Please clearly detail in your written response to this letter (include dates) when you expect to submit your individual permit application request. Your individual permit application should be submitted no later than 60 days of receipt of this correspondence. Conversely, if you do not plan to submit an individual permit application, please clearly detail in your written response to this letter what you have changed to the site conditions, facilities, and industrial processes such that your site may qualify for/secure coverage under an NPDES general stormwater permit. Or No exposure. Detail how you have changed the site conditions such that a no- exposure certification may be sought. See listed website: dea.nc.gov/SW-industrial Please note that your application for coverage under a Stormwater General Industrial Permit (NCG130000) by copy of this letter is returned. This return does not affect or change the requirements to obtain other permits that are required by Division of Energy Mineral and Land Resources or other state agencies. Again, site visit revealed that site is discharging stormwater without a NDPES stormwater permit coverage and an Individual stormwater permit coverage is required. Also, if wastewater discharge(s) is proposed to be discharged from the site, an NPDES wastewater permit is also required (contact the Division of Water Resources). Discharges without appropriate permit coverage are violations of North Carolina General Statures 143.215.1 a. and subject civil penalties of up $25,000.00 per day. Thank you for your attention to this matter. This office recognizes and has documented that you are attempting to comply with requires and secure proper permit coverage, as evident by your application for general permit coverage.
